O.Gill Mr. H.T.Goyne Mr. Sranley R.Hague, Jr, This day the Executive Secretary presented easement for the improvement of Hagood Avenue in Natoaca District, which road was included in the Rural road program beginning July 1, 1954, which rights -of -way were ordered received and filed, This day the Executive Secretary read a list of road additions to the Secondary System. These additions are listed below: (Copy in Minute book).. This day the Executive Secretary read a letter from Mr, p.Il. Snead saying that the Highway Department contemplated widening Rt. 10 at Cosby's Lake in the coming fiscal year, which letter was ordered received and filed. This dc;y the Executive Socretary road a letter from the Hines Engineering Company relative to construction of roads in the (,uail Oak Farms Subdivision, which letter was received and filed. This day tho Executive Secretary read a latter from Mrs. Bentley, who lives in the vicintiy of the southern and of Rt• 707, requesting some improvement to Rt. 707. It was agreed that an inspection of this road would be made. This day the matter of widening the road from the Petersburg Pike to Bellwood Manor, Rt. 613, came before the Board and on motion of Mr.Goyne, seconded by Mr.Guntor, it is resolved that the Highway Dopartmcnt be roquestod to investigate the feasibility of widening said road and constructing sidewalks for the pedestrian traffic, This day again the improvemont of Rt:?56 came before the Board, and it was generally agreed that the Exooutive Secretary will answer said petition presented on enteribor 14th. M 0 -2- This day NIre Kellam presented an estimator of the cost of the improvement of a portion of Boroughbridge Road, northwest of Jahnko Road in the amount of $765,00. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that the highway Department be roquested,td- improve said road at a cost not to exceed $765,00 to be paid from the 30 road Fund of the County And be it further resolved that the above resolution be carried out provided one-half of thy: cost be paid by citizens of the area. This day 1Ir. hellam presented the cost of construction Of Elm load to moot the Highways spcifications in the amount of $890,00, Un motion of Mr. Gunter, seconded by Mr, Britton, it is resolved that the Highway Department be and it hereby is requested to improve Elm Road at a cost not to exceed $890,00. Upon consideration whereof and on motion of Xr,Britton, seconded by Ilr.Guntor, it is rasolvod thalr this Board request tho Virginia Department of I:ighways to reduce the 35-milo per hour limit to 25-miles per hour until the presently proposed widening of Rt, 10 be Completed. On motion of Mr, Britton, seconded by Mr, Gunter, it is resolved that this Board request the Virginia Department of Hlighways to expedite as quickly as possible the improvement of Rt. 10, from its interseotion of Rt. 161 to the City line, ''hereass several unsuccessful attempts have bean made to secure rights -of -way on the ?reams Road extension to the LNitehoad Road, and "heroas, the County has guaranteed to the Highway Department a 30-foot unrestricted right-of-way for the improvement of sc.id road Now, Therefore, Be it 'Rosolved, on motion of 1Ir.Britton, seconded by Mr.Gunter, that this Board request the Nighway Dopartment to abandon the right-of-way from the western end of Rt. 1683 westwardly to Rt.645,' I-nd o it furtlior .resolved thc.t_ the ri.ght--nf-wa,r for ti e sw� -3- road leading fron Bells Road to tho oberhead bridge across the Atlantic Coast Lino tracks be substituted for the above abandoned road, 'Whereas, numerous complaints have been received by officials of the County concerning the number of prisoners osoupt6l, fr. %p t' o State Road Camp Yo. 24, and 7hereas, the fear of the populous in the surrounding area of road camp ATo. 24 has substantially increased, Now, Therefore, Be it Resolved on :potion of Mr. Hague, seconded by Mr.Goynu, that this Board request the Department Of Stato ?lelfare.and Institutions to install more effective protective measures to prevent further 4seapes from State Road Camp ITo. 241; On motion of Mr.Goyne* seconded by Mr. Gunter, the following resolution was approved and adopted: Whereas, the Commonwealth of Virginia, through the Department of Highways has prepared and submitted plans to the Board for the construction or improvement of a section of Route 618 of the State Secindary System, Project 1320-24, in Chesterfield County, fro, Int, Rt. 827 and 618 to 0,701 Mi. E. of Int. Rt. 827 and 618 (Bermuda hundred), approved September 299 I954; and 'Jheroas, it is the desire of this Board that said roan be improted to accordance with said plans, Nowt Therefore, Be it Resolved: That this Board hereby approves the plans and requests the Department of Highways to proceed with construction in accordance with these plans, and this Board hereay agrees toand does guarantee an 80-foct unrestricted right of way as indicated or noted on said plgps together with the right and easement to use such ac;,itiDnal areas as may be required for the groper execution and maintenance of the work as indicated on plans, it being understood tW.t incidental costs such as moving and resetting existing fences, houses, structures, utilities, or other obstructions of such nature, are tobo paid from S3condary Funds allocated or to be allocated to Chesterfield County. TJ. of Int. Rt. 619 to Int. Rt,.827, approved September 29, 1954; and flaoreas, it is the desire of this BoarJ thr:t said road be improved in accordance with said plans. Now, Therefore, Be it Resolved; That this Board hereby approvos the plans and requests the Department of Highways to proceed with construction in accordance with these plans, and this Hoard hereby agrees to and does guarantee an 80-foot unrestricted right of way, including the land shown as being required for connoctio ns, together with the right and easement toextend the slopes for cuts and fills where necessary for the Proper execution and maintenance of the work as indicated on plans, it being understood that incidental costs such'as moving and resetting existing fences, houses, structures, utilities, or other obstructiods of such nature, are to be paid from Secondary Funds allocated or to be allocated to Chesterfield County. It is further understood and agreed that in the event one or more property owners refuse to execute a deed covering land required from their properties for right of ay purposes, this Board hereby authorizes the Commonwealth of Virginia, Department of Highways, to institute condemnation proceedings and agrees t^ pay from funds allocated or to be allocated to Chesterfield County all costs in connection therewith, including awards of commissioners, tlheroas, an unrestricted right-of-way of 80-feet in width has been presented to this Board by Mr. Dallas Coons, Nir. T.A.Keek, and the Allied Chemical Company, and .1hereas, much negotiation and considerable cooperation is necessary to effect such a compromise, Now, Therefore, Be it Resolved on motion of Mr.Goyne, seconded by Mr.Britton, that this Boar] publicly commend all parties for a part in this negotiation and particularly Mr, Dallas Coons, Mr„ T.A.Kock, Mr,W.R.McCann, anJ the Virginia Department of Highways, for a job exceptionally well done* This day Mr. C.F.Kollam, and 1Ir.p.*,1.Snead, of the Virginia Department of Highways, presented the final budget of the Secondary roads in the County of Chesterfield, which budget was for a total of $5239123.56. Upop consideration whereof and on motion of Mr.Goyne, seconded by bIr.Hague, it is resolve:] that this Boarcl approve the 1954-155 budget as presented; n This day Mr. McCormick and Mr. Woosley camebefore the Board seeking the rezoning from residential-2 to General Business of the following; described parcel of land: In Manchester Magisterial District, a parcel of land fronting on the GraniteRoad, 80 feet and extending southwardly 200 feeto being beater known as Lot 4 in the Gravel -ill Subdivision, to be'rezoned from Residential-2 to General Business. And 'thoro apppt:ring no opposition to this request, it is on notion of 11rj Brjttonj seconded by Mr. Gunter, resolved that the aforedeseribed parcel of land be and the same is hereby zoned to General Business. On notion of Mr.Brittonq seconded by Mr.Gunter, it is resolved that this Board request the Commonwealth's Attorney to prepare a new agreement covering the right-of-way 6n tho Mitchell :oad, seeking to get all parties concerned thereto to sign this agreement, This day an ordinance providing for a license tax on motor vehicles for the County of Chesterfield was presented for the Board's consideration. There came, speaking against the passage of this ordinance Mr, Leo Myers, Mr, McCullen, Mr,A.O,Uoodfin, Mr, Blick, Mr. E,C,Bookman, and Mr. Jerry Jewett. Came also Mr. J.V.Bowen to speak in favor of such a tact. There was also presented a Potition signed by approximatol$ 300 persons deem Bvemuda District opposing the proposed tax and a letter from the American Lo,ion Pott 354 in Opposition to the proposed tax. `?horeupon Mr. Goyne stated the fact that under the law no levy could be placed on anticipated needs, made the following motion: That this Board dismiss the proposed auto tax. which motion died for the want of a second. Upon further consideration and 3n motion of Mr.Gunter, who stated that the County does need the taxes, that the auto tax will correct certain inequalities in our tax structure. 77horeupon Mr.Britton} seconding Zir. Gunter's motion, stated that at least ten times more people in Manchester District wanted the automobile tad than those who do not want it, it is resolved that this 3oar,l introduce and publish the following ordinance as prescribed by law. It is here noted that Mr. Goyne voted in the negative.. (Copy Ordinance into minutes) This clay k1r. C.S.Cobaught represented by Mr. Mizelle, came before the Board seeking an extension of the water line on Long View Drive, of approximately 175 feet. Upon consideration Whereof and on motion of Dr.Gill, seconded by Mr. Goyne, it is resolved that this matter be referred to the Committee for further consideration. This day Mrs, Snyder representing the Lester Brothers Corp. selling the Lesco honest came before the Board, requesting that Lesco truss be approved spaced 2411 on center, and it was Pointed out that the County of Henrico and the City of Richmond had approved this truss, and it was ;pointed out further that substantial evidence from qualified engineers proviod that such construct4on would be sufficient to carry maxim= loads of the elements. Upon consideration whereof, and on motion of Mr.Guntor, seconded by hr.Goyne, it is resolved that the Loseo truss be and the same is hereby approved spaced 24 inches on center. This day Mr. George TLr.Dean, cache before the 3oard citing the fact that he was paid 100 per name for transferring names to the rolls of the now I3ollwood precinct, and that much work had been done in order to purge the list of namosfurnished him by the registrars of Drewry's Bluff and Chester, and requested that the Board pay further compensation for the work completed to set up the now Precinct. It was pointed out by the Board that this compensation was the same as paid to other registrars and it would be unwise at this time to change this rate of compensation. This day Mr. Burgess presented a petition signed by some 170 persons, recommending to the Board that an Assistant Agricultural Agont be requested by the County of Chesterfield,, It was generally agreed that this matter would be deferred until a future meeting. This day the salaries of the Commissioner of Revenue, Treasurer, Commonwealth's Attorney, and the Sheriff, ax presented to the Compensation T'oard for the year 1955 iferc; presented to the hoard of Supervisors; Upon consideration whereof and on motion of ivir.Goyne, seconded by Mr. Ha ue, it is resolved that the amount of the salaries and office expenses be approved as submitted. On motion of Dr.Gill, seconded by Mr, Goyne, it is resolved that the County Building Inspection Department refund all building permit fees charged for churches since January 1, 1954, and to make no charge in the future for any building belonging to or a part of churches. On motion of Mr. Gunter, seconded by Mr.Britton, it is resolved that the minutes of the meeting held September 14, 1954, be and they wore hereby approved. Approved by the Board of Supervisors AN ORDINANCE to provide for a license tax on Motor Vehicles and punishment for failure to comply with same. { 3 BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY as follows: MOTOR VEHICLES - Every Motor Vehicle and trailer operated on the streets, highways or roads within Chesterfield County in bus- iness or for the private use or benefit of the owner, shall be sub j sot to a license tax as provided herein. Nothing in triis Ordinance shall be construed to require the payment of a license tax on vehicles exclusively employed in transporting fuel, provisions, manure or other things to be used only at the owner's farm or dwelling. 1. automobiles - On each and every automobile there shall be a tax of .00 and on each and every motorcycle, a tax of 2.00. This shall not be required of any person who does not actual y reside in Chesterfield County and who does not use their automobile in Chesterfield County in the conduct of their business, occupation or profession. The word "reside" as used in this section shall be construed to mean "to have a place of abode in Chesterfield County" if'respeetive of the intention of any person to return to some resi- dence outside of Chesterfield County at some future time. 2. Trucks, trailers, etc. - (a) Every truck, trailer, semi -trailer and auto -wagon not designed and used for the transport- ation of passengers, operated on the streets, highways and roads within Chesterfield County, shall be licensed.Meh truck and auto - wagon not designed and used for the transportation of passengers up to one and one-half tons (1j) factory rated capacity shall pay a tax of $5.00 and each truck and auto -wagon not designed and used for the transportation of passengers of one and one-half (1j) tons rated! -2- trailer or semi -trailer, each vehicle constituting a part of such combination shall be licensed as a separate vehicle, and separate license plates shall be issued therefor. (a) The County license tax for the license plates to be paid by the owner of any motor vehicles, trailer or semi -trailer, upon which well drilling machinery is attached and which is perman- ently used solely for transporting such machinery shall be $10.00. 3. License Tax Year - The license tax year shall com- mence on the first day of April and shall expire on the thirty-first day of March of each year. 4. Prorations - Only one-half of the license tax pre- scribed by this Ordinance shall be assessed and collected whenever i any such license tax first becomes assessable during the period be- ginning on the first day of October in any year, and ending on the fifteenth day of January in the same license tax year; and only one -I third of such license tax shall be assessed and collected whenever any such license taz first becomes assessable after the -fifteenth day of January in the same license tax year. Each license issued upon the payment of the license tax thereon shall expire at the end of the license tax year in which the same is issued. 5. Refunds of Unused Motor Vehicle License Taxes - Eve�y { person holding a current motor vehicle license tin or tag and dispo- ing of the vehicle for which it was issued, and not purchasing another vehicle of the same class for tax purposes, shall be entitled to a refund of the unused portion of the license tax paid by him upon a surrender, on or before the thirtieth day of September of the then current license tax year, of the county license tin or tag and the production of a certificate from the state motor vehicle eommissiongr or other proper State Officer, that the State license plates and re4- *4r -3- Ime of the license tax paid. Such a refund shall be made by the Treasur er of the County from the treasury of Chesterfield County. b. Issuing License Tags - Any person coming under the provisions of this Ordinance shall make application for license upon forms prescribed by the Treasurer of Chesterfield County and at such places as he may designate and upon payment of required tax shall be issued as evidence, tins or tags which shall be attached to the rear' of the vehicle so licensed so as to be readable in a manner similar j i to the State license tags. Failure to display tins or tags shall bej considered as violation even though the license tax has been paid. 1 It shall be unlawful for any person to whom a tin or tag is issued upon the payment of any license tax prescribed in this Ordinance, tot give, loan, rent, sell, assign or transfer such tin or tag to anothe or to otherwise permit another to use in any manner such tin or tag,, during the license tax year which the same is issued. 7. Lost Tags - A duplicate plate shall be issued upon affidavit of the applicant that the original tag has been lost, at a cost of fifty cents. 8: `Exemption - Nothing in this Ordinance shall be cons- trued to require a license tax of a person, firm or corporation exempted under provisions of the State Statute. 9. Penalty - Every person who violates any provision of this Ordinance shall be guilty of a misdemeanor and, upon conviction! i thereof, shall be punished by a fine of not less than Five Dollars i j 45.00), nor more than Five Hundred Dollars ($500.00), recoverable before the Trial Justice of the County, upon a stimons issued by they Chesterfield County Police Department. 10. After the inspection of the site on August 11, 1954, with the interested parties, it is the opinion of this office that the condition of the dump at the time of inspection did not consitute a health menace. However, the practices being followed do not conform U the recommendations of the Health Department for the satisfactory disposal of trash and garbage. It is believed that the existing conditions will become pro— gressively worse unless a standard landfill operation is followed. As for the disposal of trash and garbage, whether it be collected by a private concern or by the county, the Health Department recommends that disposal be by use of a standard sanitary landfill in order to eliminate the ('eating *f nuisances and potential insanitary conditions in the future.
