Board of Supervisors Chesterfield County Chesterfield, Virginia Gentlemen: June 13, 1955 I am enclosing herewith copy of a letter sent to the Attorney General. Upon an examination of the Opinions of the Attorney General, I found an Opinion in OAG 52-533 page 27, rendered February 2, 1953, which stated that a Board of Supervisors cannot make a loan to a Sanitary Dist- rict from the General County Fund. Lindsay Almond, Jr. Attorney General of Virginia State Law Library Building Richmond, Virginia Dear Judge Almonds The Ettriak Sanitary District of Chesterfield County was created under the authority granted by the Acts of the Assembly 1926, Chapter 161. This District provides sewage facilities to the residents, which sewage is dumped untreated into the Appomattox River. There is a $2§,000.00 bonded in- debtedness in this District which bonds become due October 1, 1958. These bonds are not callable and the Board of Supervisors of Chesterfield County has set aside from net revenue derived, in a sinking fund, pursuant to the provisions of the enabling Act, sufficient funds to retire this indebtedness. The money in the sinking fund has been invested in U. S. Government obligations under authority of the Circuit Court of this County. The State Water Control Board has under advisement the issuance of a special order requiring the Ettriak Sanitary Dist. riot to abate the pollution of the Appomattox River. The Board of Supervisors has determised that it is necessary to correct this matter by connecting the Httrick sew'fige #gstem with the sewfie system of the City of Petersburg. The connecting cost will amount to approximately $33,000.00. This District has on hand approximately $1S,000.00 which can be used for making this J Cn Honorable J. Lindsay Almond, Jr. - 2 connection.
