Subject: Resolution Recognizing Mrs. Kay Coles James for Her Outstanding Public Service Contributions County Administrator's Comments: County Administrator: Board Action Requested: Mr. Warren requests that the Board of Supervisors adopt this resolution recognizing Mrs. Kay Coles James for her outstanding public service contributions. Summary of Information: Mrs. Kay Coles James is a Chesterfield County resident serving in Governor Bob McDonnell's administration. She has held many senior administrative positions in state and national government and has served with distinction on many boards of directors. KAY COLES JAMES FOR HER OUTSTANDING PUBLIC SERVICE CONTRIBUTIONS WHEREAS, Mrs. Kay Coles James is a resident of the Clover Hill Magisterial District in Chesterfield County, Virginia; and WHEREAS, Mrs. James was born in Richmond, Virginia; and and WHEREAS, Mrs. James also is co-chair of the governor's transition team; WHEREAS, previously, Mrs. James served as director of the U.S. Office of Personnel Management from 2001-2005, having been appointed by President George W. Bush; and WHEREAS, in the aftermath of the September 11, 2001 terrorist attacks on America, Mrs. James led the civil service and provided oversight for the merging of 22 different agencies into the U.S. Department of Homeland Security; and WHEREAS, Mrs. James is a strong advocate for all civil servants and the important role they play in our everyday lives; and WHEREAS, her distinguished public service career also includes serving as Virginia's secretary of health and human services in Governor George Allen's administration; and and WHEREAS, Mrs. James founded the Crisis Pregnancy Center in Richmond; and WHEREAS, she also was dean of Regent University's School of Government; WHEREAS, Mrs. James has lent her talents to the boards of the Salvation Army and the Family Research Council; and WHEREAS, she has served on the National Aeronautics and Space Administration Advisory Council; and and WHEREAS, Mrs. James has served on the Heritage Foundation, and others; WHEREAS, she is founder and president of the Gloucester Institute, a leadership training center for young African-Americans. Summary of Information: The attached resolution is to recognize the vital contributions of county administrative professionals and to proclaim the week of April 18-24, 2010, as "Administrative Professionals Week" and April 21, 2010, as "Administrative Professionals Day" throughout Chesterfield County. Summary of Information: As a result of ongoing collaborative community efforts among SAFE, Youth Planning and Development, the Police Department and the Virginia Department of Alcoholic Beverage Control, sales of alcohol to underage buyers in Chesterfield County have been reduced by 60 percent in the past three years. April is "National Alcohol Awareness Month." The Board of Supervisors is requested to help bring visibility to this issue by recognizing "Alcohol Awareness Month" in Chesterfield County. Carter Title: Director, Juvenile Services Attachments: ~ Yes ~ No # OD00~?9 RECOGNIZING APRIL 2010, AS "ALCOHOL AWARENESS MONTH" WHEREAS, ethyl alcohol, the intoxicating ingredient in wine, beer and spirits, is produced, marketed, merchandised and controlled by adults; and WHEREAS, the cost of underage drinking in Virginia was $1.3 billion dollars in 2007; and WHEREAS, the Center for Disease Control reports that 28 percent of American children under the age of 13 have drunk alcohol, more than just a few sips, and those persons are seven times more likely to engage in binge drinking by age 17; and WHEREAS, youths who begin to drink alcohol prior to age 15 are four times more likely to become alcohol dependent as those who wait until age 21 to begin drinking; and WHEREAS, according to a 2007 Chesterfield County community youth survey, 44 percent of youths ages 17 and 18 reported having consumed alcohol within the 30-day period prior to the survey; and WHEREAS, one in four Chesterfield County youths ages 17 and 18 reported having engaged in binge drinking (having five or more alcoholic beverages in one setting); and WHEREAS, alcohol consumption has been shown to have damaging effects on developing human brains, which are not fully developed until age 25; and WHEREAS, Substance Abuse Free Environment Inc. (SAFE), Chesterfield County's substance-abuse-prevention coalition, has launched multiple initiatives to educate parents, merchants, community leaders and children of all ages about the dangers and legal issues surrounding underage drinking; and WHEREAS, SAFE has worked with Chesterfield County Police and the Virginia Department of Alcoholic Beverage Control to conduct nearly 400 underage compliance checks at off-premises alcohol outlets in Chesterfield County over the past three years; and WHEREAS, the combined efforts of community partners has resulted in a 60 percent decrease in the rate at which Chesterfield County merchants sell alcohol to underage buyers; and WHEREAS, underage drinking is the most prevalent substance abuse problem among Chesterfield teenagers and prevention efforts need to be aggressive and ongoing to lower the frequency; and WHEREAS, April is "National Alcohol Awareness" month. Summary of Information: This time has been scheduled for a final work session on the proposed budget as well as other ordinance changes. Staff will review proposed revisions to the plans at the work session. All Board approved revisions will be incorporated into the appropriations resolution and approved as part of adoption of the budget. Summary of Information: The Board of Supervisors held a public hearing on March 24, 2010 concerning the proposed changes to Utilities fees. The Utilities Department's analysis of the FY2011 budget, capital replacement projects, and projections over the next ten years indicate that current revenues, without fee increases, will not be sufficient to cover operating expenses. As an enterprise fund fully supported by payments from users, fee increases are necessary to offset costs of capital projects to comply with the nutrient regulations for the Chesapeake Bay, pump station rehabilitation, new and replacement water tanks, new and replacement water lines, the county's contractual share of Richmond water plant projects, as well as maintaining the integrity of the county's water and wastewater facilities. While the FY2011 budget is proposed to be 14 percent below the FY2010 adopted budget, additional revenues are required to meet the projected longer term costs. A comparison of the FY2010 and proposed FY2011 budgets indicates that personnel costs would be reduced 3.4 percent, operating costs reduced 8 percent, capital would be reduced 1.6 percent and debt would be reduced 38.9 percent due to the retirement of bonds in FY2010. A slight revenue decrease is also anticipated for FY2011. Preparers Allan M. The increase is comprised of changes in both the commodity and base charges. The wastewater commodity charge is proposed to increase by $0.05 per one hundred cubic feet (CCF) and is anticipated to generate an additional $595,000 in revenues. The water and wastewater bi-monthly base charges for a typical 5/8" residential size meter is proposed to increase by $1.68 and is anticipated to generate an additional $1,168,000. These increases are needed to cover the projected cost of rendering water and wastewater utility services and funding capital replacement projects and will increase a typical bi-monthly bill to $90.60. The base charges for larger meters increases proportionately based on meter size. In addition, the department's analysis of costs for expansion projects and projections over the next ten years reflect the need for a connection fee adjustment to cover capital costs. The connection fees for a 5/8" residential size meter are proposed to increase in water from $4,025 to $4,400 (generating an additional $680,000) and in wastewater from $3,140 to $3,455 (generating an additional $439,600). The connection fees for larger meters will increase proportionately based on meter size. Even after the proposed rate increases (assuming a typical bill for combined services), the County's rates will still be significantly less than surrounding jurisdictions. In addition, the industrial strong waste surcharge for Total Suspended Solids TSS) is proposed to increase to cover the department's cost of treating this waste. This charge is increasing from $0.13 per pound to $0.21 per pound (generating additional estimated revenue of $8,680). The ordinance is attached. Summary of Information: The Board of Supervisors held a public hearing on the proposed changes to the ordinance relating to stipulation for issuance of a business license on March 24, 2010. The proposed code revision for issuance of a business license would allow the county to collect all delinquent taxes prior to issuance of a business license. Additionally, the ordinance proposes a technical change to allow for the assessment of the interest penalties on delinquent taxes to be automatically calculated at the beginning of the next month after they were due. The requested change will allow the county to convert from a manual to an automated process for the assessment of penalties. The ordinance also proposes a new category for business licenses, adding a "Limited Mixed Beverage Retailer" category for businesses meeting this Virginia Department of Alcoholic Beverage Control classification. (b) A penalty of one percent of the unpaid tax and fee for each day the tax and/or fee is unpaid up to ten percent of the unpaid tax and fee, or $2.00, whichever is greater, shall be imposed upon the failure to pay the tax and/or fee on or before March 1 if the person was in business prior to January 1 of the license year; or began business before February 1 of the license yeah or within ~A-~s one month of beginning business if the person wu~-iivc-iix began business prier~e after January ~ 31 of the license year. In the case of an assessment of additional tax made by the commissioner of the revenue, if the application and, if applicable, the payment were made in good faith and the understatement of the tax was not due to any fraud, reckless or intentional disregard of the law by the taxpayer, there shall be no late payment penalty assessed with the additional tax. If any assessment of tax by the commissioner of the revenue is not paid within 30 days, the treasurer may impose a ten percent late payment penalty. If the failure to file or pay was not the fault of the taxpayer, the penalty shall not be imposed, or if imposed, shall be abated by the commissioner of the revenue. In order to demonstrate lack of fault, the taxpayer must show that he acted responsibly and that the failure was due to events beyond his control. 000 (c) Interest shall be charged on the late payment of the tax and fee from the due date until the date paid without regard to fault or other reason for the late payment. For persons who were not in business in the county on January 1 of the license year, interest shall be assessed on the unpaid balance ewe on the first day of the month after the month in which such taxpayer became delinquent, and thereafter on the first day of each following month on the unpaid balance. Whenever an assessment of additional or omitted tax or fee by the commissioner of the revenue is found to be erroneous, all interest and penalty charged and collected on the amount of the assessment found to be erroneous shall be refunded together with interest on the refund from the date of payment or the due date, whichever is later. Interest shall be paid on the refund of any license tax or fee from the date of payment or due date, whichever is later, whether attributable to an amended return or other reason. Interest on any refund shall be paid at the same rate charged under Code of Virginia, § 58.1-3916. The fees generated from the revenue recovery program only partially offset the cost of providing emergency medical transport/rescue services in Chesterfield County. Over time, the allowable Medicare and commercial insurance company reimbursement rates for emergency medical care and transportation have been adjusted and are now higher than Chesterfield's current charges. The requested changes in the emergency ambulance transport fee schedule would allow the county to recover costs in accordance with allowable insurance and Medicare rates. The revenue recovery fee schedule was last adjusted in April of 2008, the only time since inception of the program in July of 2002. This increase has been recommended by the Internal Audit Department and is supported by the Fire and EMS Department. Real Property and Mobile Homes. (a) Except as provided in Sec. 1 (b), on tracts of land, lots or improvements thereon and on mobile homes the tax shall be $0.95 on every $100 of assessed value thereof. Sec. 2. Personal Property. Public Service Corporation Property. (a) On that portion of real estate and tangible personal property of public service corporations which has been equalized as provided in Section 58.1-2604 of the Code of Virginia, 1950, as amended, the tax shall be $0.95 on every $100 of the assessed value thereof determined by the State Corporation Commission. The FY2011 recommendation for this program totals $1,945,700 which is comprised of $1,255,800 in new CDBG allotments, $525,900 in new HOME Investment Partnerships allotments, and $164,000 in Reprogrammed funding. These allocations are contingent upon notification from HUD of an approved grant amount for FY2011. Since the public hearing, preliminary grant award amounts reflect an increase of $105,220 in the CDBG program and a $5,055 decrease in the HOME Plan (that can be covered by the unallocated HOME funding in the proposed version). Upon final confirmation of the grant award from HUD, staff will prepare recommendations for the Board to consider in a later meeting. The County's Community Development Block Grant and HOME Investment Partnerships Annual Plan for FY2011 is required to be submitted to the U.S. Department of Housing and Urban Development forty five (45) days prior to the commencement of the county's fiscal year. Staff is requesting a change in funding sources, not in the total project budget, for the Circuit/General District Court Building Expansion Project. Staff requests the approval to increase the use of reserve for capital projects by $832,500 and decrease the currently appropriated debt financing by the same amount. This project was originally funded with a combination of debt financing and capital project reserves. Upon receipt of a favorable bid, the county opted not to sell all of the appropriated debt based on the anticipated project savings. It is now estimated that funding in the amount budgeted will be necessary for the project. The change in funding sources is requested since it is not cost effective to issue debt in such a small amount and there are no lease purchase financings planned within the time funding is necessary. This amount is allocated to the schools at intervals during the year contingent upon the availability of funds. These disbursement intervals, as defined in the Resolutions, are to occur on December 15th, February 15th and May 5th. This practice allows for flexibility to adjust the School appropriation should the need arise due to a downturn in revenues or some other unplanned event. The Appropriations Resolution also defines the percentage of personal property tax relief approved for qualifying vehicles. Each year staff calculates the amount of tax relief for personal property taxes as a direct result of the State's decision to cap the personal property tax relief reimbursement revenue available to Chesterfield. The appropriations resolution stipulates the reimbursement percentage rate for the different levels of value as follows: Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief, consistent with prior years. Personal use vehicles valued at $1,001 to $20,000 will be eligible for 65 0 of tax relief. Personal use vehicles valued at $20,001 or more shall receive 65% of tax relief on the first $20,000 of value. All other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use, motor homes, etc.) will not be eligible for any form of tax relief under this program. The percentage relief amount is recalculated annually and is recommended to remain at the current rate of 65%. Should the actual contract price for a project be less than the appropriation, the County Administrator may approve the transfer of excess funds back to the original funding source upon completion of the project. Sec. 8 Upon completion of a grant program, the County Administrator is authorized to close the grant and transfer balances back to the funding source. Sec. 11 The Treasurer may advance monies to and from the various funds of the county to allow maximum cash flow efficiency. T'he advances must not violate county bond covenants or other legal restrictions that would prohibit such an advance. The Treasurer may also advance cash in support of employee benefit accounts. Sec. 12 The County Administrator is authorized to make expenditures from Trust & Agency Funds for the specified reasons for which the funds were established. In no case shall the expenditure exceed the available balance in the fund. Sec. 13 The County Administrator is authorized to transfer among appropriation categories and/or appropriate funds in excess of $50,000 for supplemental retirement, Workers' Compensation, healthcare for retirees and other compensation-related costs, as well as for transfers to cover energy/fuel costs. Sec. 15 The County Administrator may increase the general fund appropriation in the School Operating Fund contingent upon availability of funds and other circumstances, based on the following schedule: a) Increase general fund transfer/appropriation on December 15 by $3,000,000. b) Increase general fund transfer/appropriation on February 15 by $3,000,000. c) Increase general fund transfer/appropriation on May 5 by $3,000,000. Sec. 16 T'he County Administrator is authorized to reallocate funding sources for capital projects, azbitrage rebates/penalties, and debt service payments and to appropriate bond interest earnings to minimize arbitrage rebates/penalties, including the appropriation of transfers among funds to accomplish such reallocations. Budgets for specific capital projects will not be increased beyond the level authorized by Sections 3 and 4. Sec. 17 Salaries for Planning Commissioners will be increased equivalent to the merit increase county employees are eligible for. The effective date for pay increases, including the Planning Commission and the Board of Supervisors, may cross fiscal yeazs. Sec. 18 The County Administrator is authorized to approve transfers among funds and capital projects as long as total net appropriation is not increased. ~~~~~~ FY2011 APPROPRIATIONS RESOLUTION Sec. 19 The Utilities Department rate stabilization reserve shall be maintained as per guidelines outlined below: a) The minimum annual contribution to the reserve will be 50% of the previous year's depreciation on fixed assets. b) The annual contribution to the reserve will continue until 100% of accumulated depreciation on the fixed assets is funded. If at the beginning of a fiscal year a reserve balance exceeds 100% of accumulated depreciation, a reduction in the annual contribution may be considered. c) Funds cannot be used from the rate stabilization reserve if the balance falls below 25% of that utility's fixed asset accumulated depreciation, other than for Utility internal borrowing purposes. d) The declaration of a fmancial emergency by the Director of Utilities and a corresponding four-fifths vote by the Board of Supervisors at a publicly advertised meeting declaring the existence of such an emergency is required to suspend Sec. 19a, Sec. 19b, and Sec. 19c. Sec. 20 Upon adoption of this resolution, the School Board and/or the School Superintendent may make expenditure and revenue changes within the school fund as follows: a) Transfers of $50,000 or less are subject to the approval of the Superintendent. b) Transfers of $50,001 to $499,999 require the approval of the Superintendent and the School Board c) Transfers of $500,000 or more require the approval of the Superintendent, the School Board, and the Board of Supervisors. The School Board and/or the School Superintendent shall prepare a budget status report reflecting changes to the approved school budget between appropriation categories, as amended, and the report shall be presented to the County Administrator quarterly. Sec. 21 In accordance with the requirements set forth in Section 58.1-3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly, any qualifying vehicle situated within the County commencing January 1, 2006, shall receive personal property tax relief in the following manner: a) Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; b) Personal use vehicles valued at $1,001 to $20,000 will be eligible for 65% tax relief; c) Personal use vehicles valued at $20,001 or more shall receive 65% tax relief on the first $20,000 of value; d) All other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. Pursuant to authority conferred in Item 503.D of the 2005 State Appropriations Act, the County Treasurer shall issue a supplemental personal property tax bill in the amount of 100 percent of tax due without regard to any former entitlement to state PPTRA relief, plus applicable penalties and interest, to any taxpayer whose taxes with respect to a qualifying vehicle for tax year 2005 or any prior tax year remain unpaid on September 1, 2006, or such date as state funds for reimbursement of the state share of such bill have become unavailable, whichever occurs first. e) Penalty and interest with respect to bills issued pursuant to this section shall be computed on the entire amount of tax owed. Interest shall be computed at the rate provided in Section 9-51 of the county code from the original due date of the tax. Sec. 15 The County Administrator may increase the general fund appropriation in the School Operating Fund contingent upon availability of funds and other circumstances, based on the following schedule: a) Increase general fund transfer/appropriation on December 15 by $3,000,000. b) Increase general fund transfer/appropriation on February 15 by $3,000,000. c) Increase general fund transfer/appropriation on May 5 by $3,000,000. Sec. 16 The County Administrator is authorized to reallocate funding sources for capital projects, arbitrage rebates/penalties, and debt service payments and to appropriate bond interest earnings to minimize arbitrage rebates/penalties, including the appropriation of transfers among funds to accomplish such reallocations. Budgets for specific capital projects will not be increased beyond the level authorized by Sections 3 and 4. Sec. 17 Salaries for Planning Commissioners will be increased equivalent to the merit increase county employees are eligible for. The effective date for pay increases, including the Planning Commission and the Board of Supervisors, may cross fiscal years. Sec. 18 The County Administrator is authorized to approve transfers among funds and capital projects as long as total net appropriation is not increased. Sec. 19 The Utilities Department rate stabilization reserve shall be maintained as per guidelines outlined below: a) The minimum annual contribution to the reserve will be 50% of the previous year's depreciation on fixed assets. ®a~~~~~ TENATIVE FY2012 APPROPRIATIONS RESOL UTION b) The annual contribution to the reserve will continue until 100% of accumulated depreciation on the fixed assets is funded. If at the beginning of a fiscal year a reserve balance exceeds 100% of accumulated depreciation, a reduction in the annual contribution may be considered. c) Funds cannot be used from the rate stabilization reserve if the balance falls below 25% of that utility's fixed asset accumulated depreciation, other than for Utility internal borrowing purposes. d) The declaration of a fmancial emergency by the Director of Utilities and a corresponding four-fifths vote by the Board of Supervisors at a publicly advertised meeting declaring the existence of such an emergency is required to suspend Sec. 19a, Sec. 19b, and Sec. 19c. Sec. 20 Upon adoption of this resolution, the School Board and/or the School Superintendent may make expenditure and revenue changes within the school fund as follows: a) Transfers of $50,000 or less are subject to the approval of the Superintendent. b) Transfers of $50,001 to $499,999 require the approval of the Superintendent and the School Board c) Transfers of $500,000 or more require the approval of the Superintendent, the School Board, and the Board of Supervisors. The School Board and/or the School Superintendent shall prepare a budget status report reflecting changes to the approved school budget between appropriation categories, as amended, and the report shall be presented to the County Administrator quarterly. Sec. 21 In accordance with the requirements set forth in Section 58.1-3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly, any qualifying vehicle situated within the County commencing January 1, 2006, shall receive personal property tax relief in the following manner: a) Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; b) Personal use vehicles valued at $1,001 to $20,000 will be eligible for 65% tax relief; c) Personal use vehicles valued at $20,001 or more shall receive 65% tax relief on the first $20,000 of value; d) All other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. Pursuant to authority conferred in Item 503.D of the 2005 State Appropriations Act, the County Treasurer shall issue a supplemental personal property tax bill in the amount of 100 percent of tax due without regard to any former entitlement to state PPTRA relief, plus applicable penalties and interest, to any taxpayer whose taxes with respect to a qualifying vehicle for tax year 2005 or any prior tax year remain unpaid on September 1, 2006, or such date as state funds for reimbursement of the state share of such bill have become unavailable, whichever occurs first. e) Penalty and interest with respect to bills issued pursuant to this section shall be computed on the entire amount of tax owed. Interest shall be computed at the rate provided in Section 9-51 of the county code from the original due date of the tax. Chesterfield Berry Farm is both the applicant and event promoter. The Berry Farm is currently seeking sponsors to help defray the costs of the event . All net proceeds from the music series will go to the Berry Farm. The Berry Farm will assume full financial responsibility for the Festival and music series. The Berry Farm will have food, water, and soft drinks available for purchase during festival hours. Portolets remain on the location throughout the May season and are serviced twice a week by Nes services. The Berry Farm maintains appropriate clean-up and trash disposal. There is ample parking, and off-duty police officers will assist with parking, crowd control and other security needs. Emergency medical and fire department officials are aware of the event and will be available to render service. The music/entertainment arrangements have been reviewed by the County Attorney's Office and meet the substantive requirements of the ordinance. These arrangements provide adequate measures to insure public safety, fire prevention, medical protection, sanitation, traffic control, insurance coverage, relevant permits and security. Although the Board of Supervisors may require a bond to insure compliance with the permit, the Board traditionally has not required a bond except when the event occurs on County property. ANN DUFFER FOR HER CONTRIBUTIONS TO CHESTERFIELD COUNTY WHEREAS, Ms. Ann Duffer is a highly respected Chesterfield County resident; and WHEREAS, she has distinguished herself as an advocate for the county's senior residents; and WHEREAS, Ms. Duffer was the driving force behind the establishment of a new senior center after the closure of the Featherstone senior center; and WHEREAS, Ms. Duffer helped guide the development of the new senior center, and opened the door to her own home as a meeting place for nearly two years as a task force met to plan the new senior center; and WHEREAS, on April 1, 2006, Ms. Duffer used the occasion of her 75tH birthday party as a fundraiser, with all the money raised going toward the costs of establishing a new senior center; and WHEREAS, as the task force meetings progressed, Ms. Duffer suggested that the group should become a nonprofit organization; and WHEREAS, Ms. Duffer, as she had done in the past with numerous other expenses, selflessly offered to pay for the cost of forming a nonprofit organization; and WHEREAS, in large part due to the generosity, inspiration and leadership of Ms. Duffer, the Chesterfield Senior Center became a registered nonprofit organization on September 27, 2007; and WHEREAS, on February 14, 2008, the Chesterfield Senior Center was notified that its tax-exempt status was formally approved; and WHEREAS, Ms. Duffer then paid for the purchase of a computer and Internet service for the Chesterfield Senior Center; and WHEREAS, with the establishment of a Board of Directors for the Chesterfield Senior Center, Ms. Duffer was elected board secretary, and held that position until her declining health made it necessary for her to resign; and WHEREAS, Ms. Duffer continues to assist the Chesterfield Senior Center, which owes its existence to her vision, energy and altruistic spirit. Subject: Public Hearing to Consider Siting Approval for the Dominion Virginia Power Industrial Landfill County Administrator's Comments: County Administrator: Staff requests the Board to approve the siting, and management and disposal of waste material, for the proposed industrial landfill at the Dominion Virginia Power Dutch Gap Power Generation Facility under § 11-92 of the County Code. Summary of Information: In order to operate the proposed landfill for fossil fuel combustion products, the applicant must have: 1) approved zoning; and 2) siting, management, and operations approval from the Board of Supervisors in accordance with § 11-92 of the County Code. The zoning case was approved by the Board on February 24, 2010. In order to obtain approval for siting and management and disposal operations, Dominion Virginia Power (Owner and Applicant) submitted the documentation to meet the requirements of § 11-94 of the County Code. The criteria for approval are that the proposed facility poses no substantial present or potential danger either to the health, safety or welfare of any person or the environment. Preparers Robert C. This analysis enabled county staff to perform a review of the proposed operations and the location and general design of the facility in order to make determinations on the potential impacts of such a facility on the county. All of the potential concerns of General Services' staff have been adequately addressed in the application documents or in the proffered conditions outlined in the zoning case. Approval will allow the applicant to apply for a Waste Management Operations permit from the Virginia Department of Environmental Quality (VADEQ). This application process includes a comprehensive technical review of the science and engineering of the facility as provided by the regulatory authority granted VADEQ through both state and federal regulations. VADEQ is also responsible for approving the design, construction, and oversight of the facility. Thus, the review and approval by the Board is the initial step in a multi-step process designed to protect the safety of citizens and the environment. The County Code requires the Board of Supervisors to hold a public hearing concerning the siting of the proposed industrial landfill. Staff recommends approval of the siting, management and disposal operations of the facility with all the conditions and requirements set out in the zoning, the permit application and the attached report. General Services Staff Report Dominion VA Power Coal Ash Landfill April 6, 2010 Dominion Virginia Power has submitted and received approval for zoning changes and conditional use of portions of the property known as Dutch Gap Power Station for a Fossil Fuel Combustion Products Management Facility. The zoning approval by the Chesterfield County Board of Supervisors occurred on February 24, 2010. This facility is classified by the Virginia Department of Environmental Quality as an industrial landfill and therefore, in addition to zoning approvals, requires both siting approval and operational approval by the Chesterfield County Board of Supervisors as codified in the Code of Chesterfield County Virginia. Siting and Operation of the Facility Any individual or company wishing to establish and operate a waste disposal or management facility in Chesterfield County must comply with an application and approval process set forth in the Code of Chesterfield County Virginia. Siting requirements for such a facility are set forth in Article VII and the approval of waste material and management are set forth in Article VIII. The specific application requirements for Article VII and Article VIII are set forth in Section 11-74 Form of Application for Siting Approval, and Section 11-94 Form of Application for Approval, respectively. In August 2009 Dominion Virginia Power (Owner and Applicant) submitted two separate sets of documents to meet the requirements of the code in their process to gain approval for a Fossil Fuel Combustion Products (FFCP's) Management Facility. The Chesterfield County General Services Department (General Services) is the process owner of this siting approval process. An environmental engineering consultant (Faulkner and Flynn) was retained by General Services to assist in the analysis of the submission to verify that all necessary components to the application were submitted and that the application requirements were met by the submission. This analysis is designed to provide the county with much of the information that will be required by the Virginia Department of Environmental Quality (VADEQ) in the part A and Part B application process administered by VADEQ that leads to an approved Waste Management Operations Permit that the Owner must have to construct and operate such a waste facility within the Commonwealth of Virginia. This information enables county staff to perform a review of the proposed operations, as well as an analysis of the location and general design of the facility in order to make determinations on the potential impacts of such a facility on the county and its' citizens and businesses. This review process conducted by the county and its consultant is neither intended nor represented as a comprehensive technical review of the science and engineering of the design and operation of the waste management facility, but rather it provides the county with a ~~0~ ~s preview of the facility and assistance in measuring the impacts the facility may have on the county. The technical review of the science and engineering of the facility is conducted by VADEQ in the Part A and Part B application process required for permitting and licensing of the facility as provided by the regulatory authority granted VADEQ through both state and federal regulations. All of the potential concerns of General Services' staff have been adequately addressed in the two parallel submissions or in the proffered conditions. In the summary below, we have individually addressed those proffered conditions that relate to General Services. General Services Review of Proffered Conditions 1. Uses Staff was initially concerned that materials other than generally inert materials generated by the Fossil Fuel Combustion process could also eventually be disposed of within this facility. Dominion submitted a proffer which clearly defines the materials that will be allowed by VADEQ to be disposed in the facility. Staff is satisfied that the proffer restricts the materials to those which are relatively inert and would be unlikely to create contamination issues with ground water or surface water. 2. Construction and Phasing of FFCP Facility The phasing of the operation has been divided into four separate phases which will progress generally in an east to west direction. This delays the visibility of this facility by the adjacent industrial parcels. Each phasing plan will be submitted for approval to the Director of General Services or his/her designee to confirm compliance with the dimensional requirements submitted within the proffers of this case. The soil stockpile has been limited in height at 50 feet above existing grade and the location has been defined as the Phase Four area of the facility during each of the first three phases of the project. During Phase Four, the stockpile location will need to be approved by the Director of General Services or his/her designee as part of the Phase Four phasing plan approval. Finally, the height of each phase at completion has been defined within this proffer. These proffered conditions satisfy the concerns of staff in relation to the construction and phasing of this facility. 3. Off-Site FFCP's Staff felt that increases in off-site materials would be detrimental to the county due to the increased truck traffic such a scenario would generate. The owner has proffered a limit of 122,500 tons per year of FFCP's generated off-site that may be delivered to this facility. This is close to the volume that the facility is currently accepting. The owner has also proffered that off-site FFCP's brought to this facility will be limited to FFCP's generated at facilities owned by Dominion Virginia Power. The owner will maintain records of the precise tonnage of off-site waste brought ~~®~2~ into the facility and will annually pay the county $1.00 per ton for each of these tons in order to assist in mitigating transportation impacts caused by the vehicular traffic associated with this operation. These proffers adequately address the concerns that staff had with off-site FFCP's. 4. Public Facility Proffer Staff had general concerns regarding staff involvement in assuring compliance to proffers and regulations, not yet determined general impacts from the facility, and other costs which may be incurred by the county because of this facility. The owner has proffered to pay the county $100,000 annually to be used within the Capital Improvement Program to address any impacts that the facility may cause the county. 5. Spill Response Plan The owner has proffered to provide access to spill response plans, that meet all applicable state and federal regulations, to the Director of General Services or his/her designee. All updates to such plans will also be made available. 6. Fugitive Dust Management As dust has been an issue occasionally from the existing disposal site at Dutch Gap, staff was concerned that Dominion Virginia Power needed to apply all reasonable efforts to contain or eliminate air born dust from their proposed operation. A proffer has addressed the concerns of staff by identifying specific issues that will be addressed in a Fugitive Dust Management Plan as required by the regulatory agencies with jurisdiction over this facility. If such a plan is at any time not required by the regulatory agencies, the owner will create such a plan to be approved by the Director of General Services or his/her designee. Further the owner has proffered that no more than 10 acres of working area where FFCP's are placed will be open at any time. 7. Committee Dominion has proffered to provide for a committee including a representative of the owner, the Director of General Services or his/her designee, and at least one representative of the James River Industrial Park. The committee will meet annually to provide open channels of communications regarding the operation of the facility and the associated impacts. 8. Summary of Information: In October 2009, the Board approved the design and authorized staff to proceed with right-of-way acquisition for the Happy Hill Road Improvement project. The Board also authorized the advertisement of an eminent domain public hearing, if needed. Settlements have been reached with twelve of the thirteen landowners impacted by the project. The county needs to acquire 0.062 acre in temporary construction easement, 0.093 acre in permanent drainage easement and 0.142 acre in Dominion Virginia Power/Verizon easement from this owner. The county's consultant appraised the acquisition at $13,490. On July 22, 2009, at the request of the property owner, staff requested authorization from the Board for early acquisition of right-of-way for this property. The consultant made the first attempt to contact the property owner on September 29, 2009. The property owner cancelled or rescheduled three meetings before meeting with the consultant on December 9, 2009 at which time the offer was discussed. On March 9, 2010, the property owner provided a verbal counter offer of $30,000. Staff feels this amount cannot be justified. Staff has notified the owner of the eminent domain request before the Board. If the county proceeds with the eminent domain, a certificate of deposit will be filed with the court which will immediately entitle the county to enter and use the easements prior to the commencement and conclusion of eminent domain proceedings in court. The county will then be obligated to purchase the easements from the landowners. Sufficient funds are available in the budget to pay the anticipated condemnation costs. Staff will continue to attempt to negotiate a settlement with the owner after the certificate is filed, and pursuant to the certificate, the owner, upon request, will be paid the amount which the county's appraisal reflects is owed. The project is scheduled to be under construction this summer, but the schedule is contingent on utility relocations. Recommendation: Staff recommends the Board authorize the exercise of eminent domain on Melissa Kay Vaughan, parcel identified as 13835 Happy Hill Road, GPIN 792644293700000 for the acquisition of a temporary construction, permanent drainage, and utility easements for the Happy Hill Road Improvement Project.
