Summary of Information:
Mr. Adam Kennedy with the Greater Richmond Aquatics Partnership will present
an update on upcoming sports tourism activity. He will also recognize the
efforts of the Richmond Kickers, Chesterfield United, Richmond Strikers,
Sports Backers, Greater Richmond Aquatic Partnerships and Meadowbrook High
School for their outstanding contribution to sports tourism in Chesterfield
County.
During the months of February and March, multiple sporting events including
VA High School League State Championships in swimming, will bring thousands
of participants and spectators to Chesterfield County, providing economic
impact opportunities and highlighting the county's tourism initiatives.

The Board of Supervisors is requested to adopt the attached resolution.
Summary of Information:
Since 1990, Chesterfield County has been celebrating Black History Month, to
recognize the contributions of African-Americans to the world and to the
county. February 2014 marks the 25th anniversary of the county's Black
History Month Celebrations, and HRM is requesting that the Board of
Supervisors express appreciation to our business partners, corporate
sponsors, employees and residents for their continued support and to formally
recognize the county's 25th anniversary of Black History Month Celebrations.

RECOGNIZING 25" ANNIVERSARY OF CHESTERFIELD COUNTY'S
BLACK HISTORY MONTH CELEBRATIONS
WHEREAS, February is recognized as Black History Month and is a time to
formally acknowledge the many tremendous contributions of African-Americans
to the world and Chesterfield County; and
WHEREAS, this month, Chesterfield County is celebrating the 25th
anniversary of its nationally acclaimed Black History Month Celebrations,
which have received state and national awards for presentation creativity and
content quality; and
WHEREAS, during the past 24 years, more than 105,000 members of the
community have attended events, including 50,000 attendees at concerts; and
WHEREAS, more than 100 scholarships have been awarded to high school
students attending a college or university in Virginia, and more than 7,000
business partners have attended the annual diversity business breakfasts,
which featured notable keynote speakers; and
WHEREAS, numerous corporate and individual sponsors have renewed
financial commitments, and dedicated volunteers and employees have devoted
countless hours annually to produce incredible community events; and
WHEREAS, Chesterfield County has a strong desire to continue this
special tradition by joining together with the residents of the county and
the Richmond region in celebrating Black History month.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 12th day of February 2014, hereby expresses its
appreciation to the county's business partners, corporate sponsors, employees
and residents for their continued support of the County's Black History Month
Celebrations.
AND, BE IT FURTHER RESOLVED that the Chesterfield County Board of

RECOGNIZING SHERIFF DENNIS S. PROFFITT
UPON HIS RETIREMENT
WHEREAS, Mr. Dennis S. Proffitt began his public safety career by
serving as a dispatcher for Chesterfield and Henrico Counties prior to
becoming a patrolman in 1975, after completing the Chesterfield County Police
Academy; and
WHEREAS, in 1976, Sheriff Proffitt was promoted to Detective in the vice
and Narcotics Unit, where he served as the first undercover police officer in
the history of the Chesterfield County Police Department; and
WHEREAS, Sheriff Proffitt served in the Vice and Narcotics Unit until
1989, during which time he was promoted to Sergeant and Lieutenant and
demonstrated innovative strategies for conducting narcotics investigations by
obtaining the first wiretap for a marijuana investigation in the Commonwealth
of Virginia; and
WHEREAS, Sheriff Proffitt was selected as Police officer of the Year in
1979; and
WHEREAS, Sheriff Proffitt served on the first Police Department SWAT
Team; and
WHEREAS, in 1996, Sheriff Proffitt was promoted to Inspector in charge
of Special Investigations, where he was responsible for 40 investigators
conducting narcotic and covert investigations; and
WHEREAS, in 1997, Sheriff Proffitt was promoted to Captain in charge of
criminal investigations, where he supervised more than 75 detectives and was
responsible for all criminal investigative matters; and
WHEREAS, Sheriff Proffitt expanded his criminal justice knowledge by
attending the DEA Commander School, FBI National Academy, and FBI Special
Tactical School; and
WHEREAS, in 1997, Sheriff Proffitt transferred to the Sheriff's Office
as a Captain, later being promoted to Major and then to Undersheriff in 1999;
and
WHEREAS, Sheriff Proffitt was appointed Sheriff on February 1, 2007, and
was elected Sheriff by the citizens of Chesterfield in November 2007 and
again in November 2011; and
WHEREAS, Sheriff Proffitt was instrumental in implementing a
comprehensive executive protection program to enhance the security provided
for the elected and appointed Boards and Commissions of Chesterfield County;
and
WHEREAS, Sheriff Proffitt was a passionate advocate for his employees,
demonstrated by his commitment to training, career development programs and
employee engagement; and
WHEREAS, Sheriff Proffitt supported inmate workforce programs that
provided grounds maintenance and litter control services on county grounds,
resulting in tremendous cost savings; and "'C", 0 .0 C) 09
WHEREAS, Sheriff Proffitt supported the development and implementation
of technological improvements such as the Jail Management and Civil Papers
systems, mobile data terminals, and video pre-trial, resulting in significant
efficiencies; and
WHEREAS, Sheriff Proffitt led efforts to restructure child -support
enforcement programs, resulting in the collection of millions of dollars of
unpaid child support; and
WHEREAS, Sheriff Proffitt has demonstrated a commitment to community
causes such as hunters' safety training, Special Olympics, Seniors -In -Touch,
TRIAD and Project Lifesaver; and
WHEREAS, during Sheriff Proffitt's tenure, the Sheriff's Office
maintained full compliance with Virginia Board of Corrections standards and
maintained full accreditation through the Virginia Law Enforcement
Professional Standards Commission; and
WHEREAS, Sheriff Proffitt's leadership resulted in significant security
enhancements to jail and courts facilities, such as bullet resistant security
stations, electronic control systems, and digital video recording; and
WHEREAS, Sheriff Proffitt expanded the capabilities of the Sheriff's
Office to be an invaluable resource to the county during times of crisis and
natural disaster; and
WHEREAS, Sheriff Proffitt's legacy is his unwavering commitment to
public safety and ensuring that the citizens of Chesterfield County are safe
and secure; and
WHEREAS, Sheriff Proffitt exemplifies servant leadership through his
commitment to service, empathy, foresight and stewardship.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 12th day of February 2014, publicly recognizes the
outstanding contributions of Sheriff Dennis S. Proffitt, expresses the
appreciation of all residents for his service to Chesterfield County and
extends appreciation for his dedicated service to the county and
congratulations upon his retirement, as well as best wishes for a long and
happy retirement.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented
to Sheriff Proffitt, and that this resolution be permanently recorded among
the papers of this Board of Supervisors of Chesterfield County, Virginia.

The Board is requested to hold a work session to review projected revenues
for the Proposed FY2015 Budget.
Summary of Information:
Staff will review revenues for the Proposed FY2015 Budget, presenting
information on the economic conditions and the impact on revenues. The
presentation will also provide insight on years beyond FY2015 and will be
followed with an outlook on expenditure forecasts in a subsequent work
session on the proposed budget.
The County Administrator's overall proposed budget will be presented on March
10th along with presentations on the FY2015 School budget and by the public
safety departments. Work sessions on the proposed budget will take place
over the next several weeks.

The real estate tax rate to offset the changes in assessed value as
prescribed by the Code of Virginia (excluding new construction) is $0.94
per $100 in assessed value.
Staff is currently developing the FY2015 budget, and believes that the
operating budget can be balanced without additional revenue, though to do
so would entail reductions in programs/ services. In order to accomplish
the projects in the proposed CTP, however, additional revenue would be
required as previously discussed. Accordingly, it is recommended that the
Board direct that the tax rate be advertised at $0.98 for the purposes of
allowing the public the opportunity to provide their views on the FY2015
plans that have been under discussion.
The Board must advertise a rate for each tax classification for the 2014
tax year. Advertisement of a specific rate leaves the Board the
flexibility to adopt any rate up to, but not higher than the advertised
rate. The existing tax rates are shown below.

Regional Jail in Prince George County. The Authority consists of fourteen

Dr. Sheryl Bailey serves as the county's appointed member and Ms. Mary Ann
Curtin currently serves as the alternate member. Sheriff Proffitt also
served as a member of the Board by virtue of his office.
Staff is requesting that the Board appoint Sheriff Karl Leonard as the
county's member on the RRJA Board, with a term effective February 1, 2014,
and continuing through his service as Sheriff.

WHEREAS, Chapter 726 of the 1990 Acts of Assembly created the
Riverside Regional Jail Authority (the "Authority"), which
legislation was amended by Chapter 228 of the 1993 Acts of Assembly
and Chapter 642 of the 1999 Acts of Assembly; and
WHEREAS, the Board of the Authority consists of the sheriff
from each member jurisdiction and one additional member (plus an
alternate, if desired) from the jurisdiction appointed by the
governing body for a four-year term; and
WHEREAS, Sheriff Dennis Proffitt has notified the county of
his intent to retire effective February 1, 2014, and Mr. Karl
Leonard was sworn in as Sheriff on February 1, 2014.

RECOGNIZING MRS. CATHARINE L. NUTTALL UPON HER RETIREMENT
WHEREAS, Mrs. Catharine L. Nuttall will retire on March 1, 2014,
after providing 19 years of dedicated and faithful service to
Chesterfield County; and
WHEREAS, Mrs. Nuttall began her service with Chesterfield County in
the Parks and Recreation Department on February 13, 1995, providing
secretarial support to the department director and his chiefs; and
WHEREAS, during her tenure with the Parks and Recreation Department,
Mrs. Nuttall was an enthusiastic member of the Health Fair team and a
willing volunteer of events such as the annual Independence Day fireworks
display and the Chesterfield County Fair; and
WHEREAS, Mrs. Nuttall was promoted to legal secretary on September
20, 1999, for the Commonwealth's Attorney, preparing weekly dockets for
the Juvenile and Domestic Relations District Court; and
WHEREAS, Mrs. Nuttall transferred to the Department of Environmental
Engineering on July 16, 2005, as administrative secretary to the director
and engineering supervisor; and
WHEREAS, Mrs. Nuttall has served as the Environmental Engineering
representative on the Chesterfield Employees Association for nine years
and for four years as the Parks and Recreation Department's
representative; and
WHEREAS, Mrs. Nuttall was instrumental in the implementation of the
2010 and 2011 Canine Carnival, working tirelessly to ensure these events
were huge successes for the county and the CEA; and
WHEREAS, Mrs. Nuttall will be missed by the president and other
members of the CEA for her voluntarism, enthusiasm and participation on
numerous CEA committees and events; and
WHEREAS, as the Environmental Engineering representative, Mrs.
Nuttall was a generous supporter of the American Heart Association and
United Way through participation on many charitable fundraising teams;
and
WHEREAS, as a result of her diligence in preparing records for
scanning and quality control of document imaging, Mrs. Nuttall was
selected as the Environmental Engineering Employee of the Quarter for the
fourth quarter 2013; and
WHEREAS, Mrs. Nuttall sought to improve herself and provide service
to hearing-impaired citizens by attending weekly American Sign Language
classes at Commonwealth Catholic Charities and participating in silent
dinner events for the hearing impaired; and
WHEREAS, Mrs. Nuttall served as one of the department's Disaster
Recovery Liaisons, tracking staff resources for cost recovery throughout
the duration of any disaster; and
WHEREAS, Mrs. Nuttall has always performed her duties and
responsibilities in a professional manner, rendering valuable service to
the department director, engineering supervisor and staff of the
Environmental Engineering Department.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the outstanding contributions of Mrs. Catharine L.

lease with Newell Properties LLC and authorize the Police Chief to execute
the contract.
Summary of Information:
The renovation of the two- and three-story portion of the police headquarters
building caused police personnel to be temporarily moved to an offsite
location. As the project unfolded, it was determined that space allocations
within the two- and three-story building would not be sufficient to allow
some units to return to the building.
Police department staff identified and evaluated four locations that would
incorporate office space for more than 40 people with a combination of
private offices and bullpen areas, garage facilities for storage of specialty
vehicles, storage areas for specialized equipment, and be within close
proximity to County offices. The chosen location meets all of the
department's criteria and was the least expensive location identified.

It provides adequate parking and convenient access to police headquarters and
the government complex. It fits the location outlined in the County
Comprehensive Plan, and it is close enough for quick access to county
services.
Moving forward with the anticipated relocation will meet the Police
Department's immediate and long-term programmatic needs and provide the
department better supervision and communication between work groups.
Staff Recommendation:
Staff recommends the Board take the following actions:
1. Authorize the Police Department to enter into a lease for the facility;
and
2. Authorize the Police Chief to execute the lease contract.
Budget and Management Comments:
There are three expenses associated with this potential move: 1) upfront
moving and technology costs of approximately $40,000; 2) lease expenses to
cover the remainder of FY2014 of approximately .$49,100; and 3) the annual
operating/lease costs associated with the facility of $147,400 (which do not
come into play until FY2015).
The estimated upfront costs of $40,000 to cover moving expenses, card readers
and IT setup will be covered by asset forfeiture funds. The annual operating
costs, including the lease, could be largely absorbed ($104,200 of the
$147,000) via reallocations in the Police budget, with the remainder needing
to be funded in the FY2015 budget. In addition, some funds may be received
from partner agencies that might also use the facility, which could offset
the annual costs if an agreement to share space is reached. The gap funding
for the remaining months in FY2014 could be accommodated within the current
Police appropriation.

construction contract to the lowest responsive and responsible bidder in an

Summary of Information:
This curve has poor horizontal alignment, low shoulders, and substandard
cross slope. Five accidents occurred in the vicinity of this curve in 2013,
and staff received a citizen request to improve the curve due to the number
of recent accidents.

The proposed improvements will involve minor pavement widening on both sides
of Branders Bridge Road and an increase of the pavement thickness to correct
the substandard cross slope at the curve. The road work is anticipated to
take place within the existing right-of-way; however, some additional right-
of-way and/or easements may be necessary. Staff will meet with the adjacent
property owners to discuss the proposed improvements. If there are
significant concerns expressed by the property owners, staff will bring a
detailed design to the Board for formal approval.
It is requested that the County Administrator be authorized to proceed with
the customary project activities including the award of a construction
contract up to $100,000 to the lowest responsive and responsible bidder.
Recommendation:
Staff recommends the Board take the following actions for the Branders Bridge
Road (North of Old Happy Hill Road) Curve Improvement Project:
1. Transfer $150,000 in Shed 18 road cash proffers from the completed
Branders Bridge Road (old Happy Hill Road to Happy Hill Road) project;
2. Authorize the County Administrator to proceed with the design and
right-of-way acquisition, including advertisement of an eminent domain
public hearing if necessary, and to accept the conveyance of right-of-
way and easements that are acquired;
3. Authorize the County Administrator to enter into the customary
VDOT/County agreements/contracts, permits/mitigation agreements and
surety agreements, acceptable to the County Attorney;
4. Authorize the Chairman of the Board of Supervisors and County
Administrator to execute easement agreements for relocation of
utilities;
5. Authorize the advertisement and award of a construction contract, up
to $100,000, to the lowest responsive and responsible bidder; and
6. Authorize the County Administrator to approve change orders up to 25
percent of the contract amount for the project.

Shows, Inc., for an entertainment festival permit to conduct a carnival at
Chesterfield Towne Center on April 10 through April 27, 2014. If the Board
grants the request, staff recommends that it be granted subject to the
attached conditions.
Summary of Information:
Reithoffer Shows, Inc. proposes to conduct an outdoor carnival on Thursday,
April 10 through Sunday, April 27, 2014, at Chesterfield Towne Center at
11500 Midlothian Turnpike. Reithoffer is an experienced carnival operator
that has conducted numerous shows on the east coast. Reithoffer Shows
successfully conducted a similar carnival at the Towne Center last spring.
The event, which will include rides, food, outdoor games, and entertainment,
is proposed to be staged in the center's rear parking lot located at Koger
Center Boulevard and Mall Drive. Hours of operation will be from 4 p.m. to
11 p.m. Mondays through Fridays; 11 a.m. to 11 p.m. Saturdays; and 12 p.m. to
10 p.m. Sundays.

There will be a minimal gate fee to the carnival, and entrants will be
required to purchase sheet tickets at $20 per sheet in order to ride the
amusement rides. It is estimated that over the 18 days of operation
approximately 8,500 people will attend the carnival. Food and beverages will
be provided by Reithoffer Shows, Inc.
The entertainment arrangements have been reviewed by the County Attorney's
Office and are adequate to meet the requirements for obtaining a permit
provided that the sponsor complies with the attached conditions, which
address proper crowd control, medical care, sanitation, and other needs.
These are the same conditions that have been imposed on other carnivals in
the county.

2. Permit holder shall maintain a First Aid station, with at least one certified
Emergency Medical Technician on duty during all times of Carnival operation.
3. Prior to the Carnival, the permit holder shall provide the Fire Marshal with a
site plan showing the means of emergency access to the premises where the Carnival is being
conducted.
4. No food vendor shall sell or give away any food unless a permit for food
vending has been issued by the Chesterfield Health Department. All permit applications
have been completed.
5. Permit holder shall provide the Risk Manager with a Certificate of Insurance,
in a form approved by the Risk Manager and County Attorney, as follows:
a. Permit holder must provide a certificate of insurance with a minimum
Commercial General Limit of $5,000,000 per occurrence for General
Liability and $5,000,000 per occurrence for Automobile Liability.
b. Permit holder must provide the Risk Manager with a complete list of all
vendors who will work at the Carnival. Each vendor must provide a
certificate of insurance with a minimum Commercial General Limit of
$ 1,000,000 per occurrence and $2,000,000 general aggregate.
C. The insurance required by this provision must be provided before the
permit holder or any vendor will be allowed to begin set-up for the event.
6. No carnival ride shall be operated unless a permit for its operation has been
issued by the Building Official. All permit applications have been completed.

WATER AND SEWERS
Sec. 18-1. Definitions.
For the purposes of this chapter, the following words and phrases shall have the following
meanings:

from the ground.

a commercial consumer who installs plumbing fixtures that require a lower total volume but a
higher instantaneous flow than standard fixtures; or, (ii) the meter size that provides water
service to a residential consumer, excluding water service for fire protection.
(aa b Wastewater: Normal domestic and industrial waste which enters the wastewater system
carried by water from residential, commercial and industrial establishments or other places and
infiltration.
(lib) cc Wastewater system: All of the facilities that are owned by the county which transport or
treat wastewater.
(ee)(ddd) Water: Water that does not contain enough impurities to cause human disease or
harmful physiological effects and that has bacteriological and chemical qualities which conform
to the standards for potable water that have been established by the director and by the state
department of health's Virginia Waterworks Regulations.
(dd)Leel Water system: All of the facilities that are owned by the county which impound,
transport or treat water.
Sec. 18-53. Utility extensions.

Ua For residential development, off-site extension of any public water or
public gravity wastewater trunk line shall not exceed a distance of 3,000
feet from the nearest existing line as measured along the most reasonable
extension route, as determined by the director of utilities. This limitation
shall not preclude extension to accommodate a mixed use development
having as its primary component non-residential uses as determined b
the directors of planning and utilities.

(.a)Ub No person shall extend the utility system without the approval of the
director. The director shall impose reasonable terms and conditions on all
utility extensions. The developer or owner of the land that will be served
by an extension shall pay the cost of the extension. However, the
developer or owner may be eligible for refunds for a portion of the cost of
the extension in accordance with this article.
(bUc The director shall not approve any utility extension unless he determines
that the extension is in the best interest of the utility system and the
health, safety and welfare of county residents.
(e)k!L No person shall extend utility lines until he has entered into a contract
with the county to construct the extension. The form of the contract shall
be approved by the director and by the county attorney. The extension
contract shall require the developer to provide the county with a copy of a
construction contract in a form that is approved by the director with an
approved, licensed utility contractor and to convey all utility easements to
the county that are necessary for the county to provide utility service to the
property. The county shall approve the size, type, location and material of
all utility mains; service lines, including corporation stops, meter yokes,
fittings and service pipes; and other facilities. The extension shall be
installed in accordance with the Chesterfield County Water and Sewer
Specifications and Procedures Manual and other county policies and
administrative procedures.
Sec. 18-60. Required Use of Utility System.
The distance extensions described in this section shall be measured from the nearest existing line
as measured along the most reasonable extension route, as determined by the director of utilities.
A. Residential. For the purposes of this section, the term "dwelling unit" shall be as defined
in Chapter 19 and shall not include a dwelling unit that is being rebuilt due to damage b

Sec. 18-61. Exceptions to Use of Utility Systems.

1. Submission of an application with a $1000.00 fee to the Planning Department.

the application and make a recommendation to the Planning Commission. A
recommendation for the exception approval may include a recommendation for
the imposition of conditions. The recommendation shall consider whether:
a) the use of a private system will encourage future area development
inconsistent with the Comprehensive Plan-, and

4. The Planning Commission, following a public hearing, shall make a

B. An exception to the requirements of section 18-60 A.1. a), A.2. a) and B. Lb). may be granted

request and make a finding that connecting to the utility system is physically impractical
due to: (i) topography, 60 conflicts with other underground utilities, (iii) capacity

AMENDMENT OVERVIEW
The power and duties of the Board of Zoning Appeals (BZA) are provided in
Section 19-21 of the Zoning ordinance. Among these powers is the ability to
grant variances to the Zoning Ordinance and to make certain determinations or
decisions based upon specific findings and criteria.
In order to be in conformance with state code changes in regards to the
criteria by which the BZA may grant and decide upon variances and other
considerations, staff proposes the attached ordinance amendment.

1) in granting a variance the BZA shall, among other things, make a finding
that the granting of the variance would alleviate a demonstrable
hardship as distinguished from a special privilege or convenience sought
by the applicant. The existing ordinance has the additional provision
that the demonstrable hardship "approach confiscation", a threshold much
more difficult to achieve in many circumstances and no longer required
in state code; as such the proposed amendment would remove that phrase.

APPEALS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 19-21 of the Code of the County of Chesterfield, 1997, is amended and
re-enacted, to read as follows:
CHAPTER 19
ZONING

Sec. 19-21. Same --Powers and duties.
The board of zoning appeals shall have the following powers and duties:
(a) To hear appeals as provided for in section 19-19.1.
(b) The board of zoning appeals may authorize upon appeal or original application in
specific cases such variance as defined in section 19-301 from the terms of this
chapter as will not be contrary to the public interest, when, owning to special
conditions, a literal enforcement of the provisions will result in unnecessary
hardship; provided that the spirit of this chapter shall be observed and substantial
justice done, as follows: When a property owner can show that his property was
acquired in good faith and where by reason of the exceptional narrowness,
shallowness, size or shape of a specific piece of property on March 31, 1997, or
reason of exceptional topographic conditions or other extraordinary situation or
condition of such piece of property, or of the conditions, situation, use or
development of property immediately adjacent thereto, the strict application of the
terms of this chapter would effectively prohibit or unreasonably restrict the use of
the property or where the board is satisfied, upon the evidence heard by it, that the
granting of such variance will alleviate a clearly demonstrable hardship
appr-ea,ehing eenfiseAien as distinguished from a special privilege or
convenience sought by the applicant, provided that all variances shall be in
harmony with the intended spirit and purpose of the chapter.
No such variance shall be authorized by the board unless it finds:
(1) That the strict application of this chapter would produce undue hardship;
(2) That such hardship is not shared generally by other properties in the same
zoning district and the same vicinity; and

(3) That the authorization of such variance will not be of substantial detriment
to adjacent property and that the character of the district will not be
changed by granting the variance.
No variance shall be authorized unless the board finds that the condition or
situation of the property concerned or the intended use of the property is not of so
general or recurring a nature as to make reasonably practicable the formulation of
a general regulation to be adopted as an amendment to this chapter.
In authorizing a variance the board may impose such condition regarding the
location, character and other features of the proposed structure or use as it may
deem necessary in the public interest, and may require a guarantee or bond to
insure that the conditions imposed are being and will continue to be complied
with.

(e) No provision of this section shall be construed as granting the board of zoning
appeals the power to rezone property or to base decisions on the merits of the
purpose and intent of the zoning ordinance adopted by the Board of Supervisors.

the Addison -Evans Water Treatment Plant Flocculation and Sedimentation Basin
Improvements in the amount of $124,910 and authorize the County Administrator
to execute the necessary documents.
Summary of Information:
This project includes the rehabilitation of four settling basins at the
Addison -Evans Water Treatment Plant, two of which were part of the original
plant construction in 1967 and two constructed in 1971. As the
rehabilitation project progressed, additional rehabilitation work was
identified beyond the original scope of this project. Change Order Number
Two represents additional work to complete concrete repairs.
The current contract amount is $755,085.87; with approval of this change
order the new contract amount will be $879,995.87.
Funds are available within this project. The county administrative policy
addressing change orders requires all change orders exceeding $50,000 to be
approved by the Board of Supervisors.

LAND USE
Comprehensive Plan:
The Comprehensive Plan designates the request property for Industrial use where
moderate to intense manufacturing uses that are generally dependent upon the processing
of raw materials. These uses may have associated outside storage areas.
The Public Facilities Plan, an element of the Comprehensive Plan, suggests that a special
operations facility should continue to be located in the vicinity of Iron Bridge Road and
Route 288 to house special operations units with a recommended timeframe of between
2013 and 2017.
Area Development Trends:
Properties to the north, south, cast and west are zoned Light Industrial (1-1) and are
occupied by industrial, warehouse and office uses (Chesterfield Industrial Park). It is
anticipated that industrial uses will continue in the area, as suggested by the Plan.
Site Location and Selection:
The applicant proposes to lease an existing 12,000 square foot office/warehouse building
within the Chesterfield Industrial Park. The Chesterfield County Police Department would
lease the building to house its Police personnel. Renovations to the existing Police
Headquarters Building inside the Government Center resulted in insufficient space being left
for the Police personnel to return to the building. Therefore, the Police Department
examined several off-site locations that were in close proximity to the Police Headquarters
near the intersection of Iron Bridge Road and Route 288. The Police Department selected
four (4) sites to consider lease agreements. The request property presented the least
expensive lease agreement while providing the necessary office and parking space
requirements. The request property will permit the entire division to be located in a single
building, which will promote efficient communication and supervision of work groups
within the division.
CONCLUSION
The relocation of the Police office space satisfies the criteria of location, character and extent as
specified in the Code of Virginia. Specifically, the proposal complies with the recommendations
of the 'Public Facilities Plan, an element of the Comprehensive Plan, which suggests that a
special operations facility for police services should be located close to Police Headquarters,
within the vicinity of Iron Bridge Road and Route 288.
Therefore, staff recommends that the Commission determine that the government office (public
safety) is in substantial accord with the Comprehensive Plan.

My name is Nancy Wood. I teacher Senior English at Manchester High School. I urge you to
a tax rate increase in order to fund our schools.

People say "I know things have gotten tough," but they really don't. When I started teaching in
Chesterfield 11 years ago, my average class size was about 22 students. Now, my classes average
29-30. That is 7 extra students per class, or 35 extra papers to grade every time I give an
assignment. That's more than an extra class to teach everyday—and I have had my salary
reduced to teach this extra class.
If seven extra students does not sound like a huge burden, let me illustrate. For one assignment, a
research paper, I spend about 10 minutes grading each draft, 20-30 minutes per revision, and at
least 30 minutes for the final product. That is 41 extra hours of work to grade just one
assignment, just for the extra 7 students per class, that must be carried out at night and on
weekends on my own time, while I continue to instruct and plan lessons every school day. So
much for a week "off' at Spring Break.
Unfortunately, while our workload increases, our salary decreases. The past six years of salary
cuts have had devastating effects on my family. The four of us share my daughters' cars to get to
our jobs. My daughters have stopped classes at community college. One used her hard-earned
tuition money to buy the car I now use to get to work every day. I have a Master's degree and 19
years of experience. I am the new face of poverty.
Our schools used to be a priority in Chesterfield. Not anymore. Something has had to give, and it
is the quality of instruction we are able to provide. Cutting funding may seem an easy solution to
the current financial problems the county is experiencing. But easy is seldom good. Easy is
seldom beneficial, or long term, or morally defendable. Easy condemns our students to a long
term detriment they will never be able to make up. They have senior year only once. This year.
Now. Now is when they need the solution. They cannot wait three more years for the economy to
improve. If anyone needs to take in their belts and wait it out, it cannot be our kids. They can't
afford one more year of not learning to read, of no personal interaction with teachers. To put up
with bullying. One more year to fail.
My Matoaca district is here. We are watching and hoping for support from our district
supervisor, Steve Elswick. My seniors are here, learning in a real world environment. They will
be able to exercise the right to vote this year. They know what the budget cuts are doing to our
schools, and they don't like it. They don't want to use books that are missing pages. They don't
want to sit on cracked plastic seats that pinch and rip their clothes. They don't want to have to
miss out on field trips or tournaments because they have become too expensive or their teachers
are too over -burdened to organize and chaperone them. They don't want another worksheet in
lieu of a good class discussion.
On the other hand, the return on investment for the average $75 increase per household is
significant. $75 per household can improve our chances of holding on to the community awards
we are so proud of. We get more businesses moving in due to an educated work force and good
community resources for employees. We get a lower drop- out rate, and a lower crime rate. Our
house values increase, saving the equity we have left. We educate the youth of the community.
What a bargain, for $75.
Cutting the school budget contributes to a downward spiral. Please stop the spiral and get us
back on the right track: if not exactly moving forward, at least catching up.
Hello, My names Makary Zaki, I attend Manchester high school and this is my senior year. I've
attended Manchester high school since freshmen year. I've heard so many stories on the news of cutting
the school budget down. I know many teachers have spooking about this situation of cutting the school
budget down. But let me speak from a student prospective and how I feel about it. A couple of weeks
ago I was in My English class, my teacher happens to be here watching me right now her name is Mrs.
Wood. She is my Favorite teacher she goes over and beyond her job to try to get the material to us as
easy as possible. But a couple of weeks ago I've experienced something that shocked me in one of my
classes. I was in English class and Mrs. Wood my English teacher told us to get a text book so we can
start our independent class work. As everyone went up to get a text book and sat down. There were 2
people without a text book because we had no more and as I was looking to turn to page 129 to start my
work the page was missing. There were a total of 10 pages missing in the book. And I looked at her and
said I'm missing the page Mrs. Wood and she had this sad look on her face. Then as everyone started to
start their work me and the other 2 people couldn't start so we had to wait till she printed us copies out.
This took 15 minutes to do so as everyone was finishing up me and my other 2 class mates sat waiting
till we got a printed copy. This made me realize why aren't we getting new books that are up to date?
Why is our class size over 28 people and over? The class size takes away from the student ability to pay
attention. Also in my government class it's so many students that one of the students have to sit on the
teacher's desk and work! This shows that it is way too many students and its overcrowding and one
more question I asked myself was why isn't the county supplying more money to Manchester high
school and other high schools? Also school is my job to attend every single day? Why can't the county
supply us with funds for our school and raises for the teachers? In my eyes the teachers
are doing everything they can for the students and aren't getting a reward for it. And the students are
doing their job so why can't we have funds to get new text books and money to support class sizes and
sports.

IN CHESTERFIELD COUNTY
WHEREAS, the eleventh annual "Give Kids a Smile! Access to Dental
Care Day" was conducted in a number of Chesterfield County dental
offices and schools on February 7, 2014; and
WHEREAS, numerous children's dental health outreach activities and
education will take place in Chesterfield County Schools throughout
February 2014; and
WHEREAS, through the joint efforts of the Southside Dental
Society, the Virginia Dental Association, the Virginia Department of
Health, Division of Dentistry, the Chesterfield County Technical Center
Dental Assisting Program, local dentists and dental healthcare
providers who volunteer their time, and the school district of
Chesterfield County, this program was established to foster the
improvement of children's dental health; and
WHEREAS, since inception of the "Give Kids a Smile! Access to
Dental Care" program in 2003, the Southside Dental Society, along with
many dental partners, have delivered more than $875,000 in free dental
care to more than 7,200 patients utilizing more than 8000 volunteers, a
tremendous example of community partners and stakeholders working
together to decrease barriers to accessing dental care for at -risk
children in the community; and
WHEREAS, these dental volunteers have provided educational
materials and programs and stress the importance of regular dental
examinations, daily brushing and flossing, proper nutrition, sealants
and the use of mouth guards during athletic activities; and
WHEREAS, several local dental offices volunteered their services
on "Give Kids a Smile! Access to Dental Care Day," to provide treatment
and education to local underprivileged children.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 12th day of February 2014, publicly recognizes
February 7, 2014, as "Give Kids a Smile! Access to Dental Care Day" and

RECOGNIZING MR. DON J. KAPPEL UPON HIS RETIREMENT
WHEREAS, Mr. Don J. Kappel is a native of New York City and has
made Chesterfield County his home for the past 20 years; and
WHEREAS, Mr. Kappel served honorably in the U.S. Marine Corps for
22 years, from 1972 to 1994, including service in Japan, Cuba, Iraq, the
Philippines, on sea duty and elsewhere, and served as "Official U.S.
Marine Corps Spokesman" in Washington, D.C., before retiring as a major,
having earned the Meritorious Service Medal, several Navy Achievement,
Marine Corps Achievement, Humanitarian Service and National Defense
Service medals, a Southwest Asia Service Medal and other joint,
personal and unit awards; and
WHEREAS, upon retiring from the Marines, he joined Chesterfield
County in 1994 as a media officer in the newly formed Public Affairs
Department, and was promoted to director in 1996; and
WHEREAS, under his leadership, the department produced and
distributed nearly 9,000 press releases about county programs and
services, along with hundreds of brochures, fliers, posters, videos and
other informational materials, earned nearly 200 state and national
awards for a variety of communications products, and a first -place award
for County Comments, the employee e -newsletter, from Ragan's PR Daily in
an international competition for nonprofits in 2013; and
WHEREAS, he co-authored six consecutive successful America's
Promise award submissions, resulting in the county being named "One of
the 100 Best Communities in America for Young People;" and
WHEREAS, Mr. Kappel served on Chesterfield County's Leadership Team
for 18 years, and was the county's focal point for media queries and
Freedom of Information Act requests; and
WHEREAS, he suggested and served as project officer for the
development of regional county and city public -information radio
networks, including Chesterfield County's 1630 AM, which provides
information to the public 24 hours a day, and
WHEREAS, he hosted approximately 1,300 television programs for
Chesterfield County on Comcast Cable, and authored the FIRST CHOICE
column for the county in each edition of Chesterfield Living magazine
for 11 years; and
WHEREAS, Mr. Kappel was a charter member of the Board of Directors,
Central Virginia Film Institute, served as Region 2 Director for the
National Association of County Information Officers Board of Directors,
and served as the county's representative on the Central Virginia Public
Safety Media Council; and
WHEREAS, Mr. Kappel taught Associated Press Style writing and Media
Relations for the county's Center for Organizational Excellence; and
WHEREAS, he served as the master of ceremonies for the annual
Chesterfield County Veterans Day ceremony since 2010, coordinating with
the Chesterfield Historical Society; and
WHEREAS, he staffed the county's Emergency Operations Center during
numerous activations for hurricanes, flooding and other events, once
working a 29 -hour shift during Hurricane Isabel, and continuously
provided "on call" service to support Police, Fire and EMS and other
departments during weather incidents and other natural and man-made
disaster situations; and
WHEREAS, Mr. Kappel has announced his retirement from Chesterfield
County effective March 1, 2014, after a distinguished 20 -year career
with this organization.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 12th day of February 2014, publicly recognizes the
dedication, exemplary military achievements and noteworthy local
government contributions of Mr. Don J. Kappel over a combined 42 years

AMENDMENT OVERVIEW
State law was amended in 2013 regarding mandatory zoning provisions
relating to use of temporary family health care structures. In order to be
in conformance with these changes, staff proposes the attached ordinance
amendment.
The use of Temporary Family Health Care Units is permitted with certain
restrictions within single-family Residential Districts (R-7 through R-88
and R -C) . The proposed amendment to Section 19-65 would change the
required restrictions within each of the listed zoning districts.

OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTION 19-65 RELATING TO
TEMPORARY FAMILY HEALTH CARE UNITS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 19-65 of the Code of the County of Chester geld, 1997, as amended,
is
amended and re-enacted to read as follows:
See. 19-65. Uses permitted with certain restrictions.
(i) Temporary family health care unit, provided that:
(1) Unit shall be accessory to a single family dwelling located on a lot;
(2) A planning permit shall be obtained, and maintained, from the Planning
Department for the unit. In conjunction with the request for a permit and
annually thereafter, the following shall be submitted: (i) documentation, as
deemed necessary by the Planning Department, to insure compliance with
this sectionandstate law, (ii) documentation of the need for care for the
mentally or physically impaired person and if applicable, the spouse
residing in the unit who requires assistance with one or more daily
activities under state law, (iii) documentation of the relationship of the
mentally or physically impaired person and the caregiver, and (iv)
permission for a Planning Department representative to inspect, at
reasonably convenient times, the unit and the single family dwelling on
the lot to determine compliance with this section. The Planning
Department may revoke the permit for any violation of this section;
(3) Only one unit shall be permitted per lot;
(4) Unit shall not exceed 300 gross square feet in area;
(5) Unit shall comply with setback requirements for primary structures in the
district;
(6) Unit shall comply with height limitations for accessory structures in the
district;
(7) Unit shall primarily be assembled at a location other than the lot on which
it is to be located;
(8) Unit shall not be placed on a permanent foundation;
(9) Occupancy of the unit shall be limited to one mentally or physically

Hold a Public Hearing to consider the restriction of through truck traffic on
North Enon Church Road from Leslie Lane to Meadowville Road.
Summary of Information:
The county has received a request from residents to restrict any through
truck, truck and trailer, or semi -trailer combination, except pickup or panel
trucks, from using North Enon Church Road (Route 746) from Leslie Lane (Route
2496) to Meadowville Road (Route 618). The recommended alternate route is
North Enon Church Road (Route 746), Meadowville Technology Parkway (Route
618), and Meadowville Road (Route 618).
The Virginia Department of Transportation (VDOT) has four criteria it
considers when a restriction is requested. A requested restriction must meet
the first two criteria, in that: 1) a reasonable alternate route is provided;
and 2) the character or frequency of truck traffic on the route proposed for
restriction is not compatible with the affected area.
Evaluation of the second criterion will include safety issues, accident
history, engineering of the roadway, vehicle composition, and other traffic
engineering related issues.

In addition, a requested restriction must meet either of the last two
criteria, in that: 1) the roadway is residential in nature, with at least 12
dwellings on both sides within 150 feet of the roadway centerline per 1,000
feet of roadway; or 2) the roadway must be functionally classified as either
a local or collector road.
Staff recommends approval of the restriction.
Recommendation:
If the Board wishes to pursue this request, the attached resolution
requesting the Virginia Department of Transportation to restrict through
truck traffic on North Enon Church Road from Leslie Lane to Meadowville Road
should be adopted.

Hold a public hearing and authorize the exercise of eminent domain for the
acquisition of right-of-way and easements for the East River Road Widening
Project, including the filing of certificates of deposit, so that
construction may begin prior to the commencement of eminent domain
proceedings.
Summary of Information:
On October 24, 2012, the Board authorized staff to proceed with the East
River Road Widening Project, including acquisition of right-of-way and
easements. The Board also authorized the advertisement of an eminent domain
public hearing, if needed.
The county's right-of-way acquisition consultant has been successful in
acquiring right-of-way and easements from a majority of property owners who
were impacted by the project; however, the county's consultant has been
unable to reach agreement with two owners. Plan sheets showing the impacted
areas and plats showing the proposed acquisitions are attached.
The property located at 3508 East River Road, GPIN 7956134823, is owned by
James Reese. The county needs to acquire 525 square feet (0.0121 acres) in
temporary construction easement to tie in the driveway entrance for the
property. The county's consultant appraised the acquisition at $550. The

county's consultant attempted to contact the property owner by regular mail
on 11/01/13, 12/02/13, and 12/19/13, by certified mail on 11/01/13, 12/02/13,
and 12/19/13, and in person on 10/28/13, 10/31/13, 11/21/13, 1/8/14, and
1/9/14. The property owner did not respond to any of the consultant's
requests to meet and the certified letters were returned undeliverable.
Diligent efforts to obtain voluntary conveyance from the owner of 3508 East
River Road have failed. Staff has sent notification to the owners of the
eminent domain request before the Board.
The property located at 3112 East River Road, GPIN 7966149013, is owned by
Johnny Bell, Valeria Bell, and Sylvia Bell. The county needs to acquire 791
square feet (0.0182 acres) in fee right-of-way for construction of the road
widening, 1401 square feet (0.0322 acres) in utility -(Dominion Virginia
Power/Verizon/ Comcast) easement, and 624 square feet (0.0143 acres) in
temporary construction easement to tie in the driveway entrance for the
property. The county's consultant appraised the acquisition at $1,354. Johnny
Bell agreed to this amount on January 9, 2014; however, Valeria Bell and
Sylvia Bell cannot be located. County records list the contact information
for 3112 East River Road as Johnny Bell's address, and Mr. Bell does not know
the whereabouts of Valeria Bell or Sylvia Bell. Diligent efforts to obtain
voluntary conveyance from the owners of 3112 East River Road have failed.
Staff has notified the owners of the eminent domain request before the Board.
If the county proceeds with eminent domain, a certificate of deposit will be
filed with the court, which will allow the county to immediately enter and
use the right-of-way and easements so the project can proceed without delay.
Sufficient funds are available in the budget to pay the anticipated
condemnation costs.
Staff will continue to negotiate with the owners in an attempt to reach a
settlement after the certificate is filed, and, if requested, the owner will
be paid the county's estimated value prior to the condemnation hearing.
Recommendation:
Staff recommends the Board authorize the exercise of eminent domain for the
acquisition of right-of-way and easements from the following property owners
for the East River Road Widening Project:
