Nomination/Reappointment to the Economic Development Authority for the County
of Chesterfield

Board Action Requested:
Request that the Board suspend the rules and simultaneously nominate and
reappoint Ms. Terri Cofer Beirne, Mr. Art Heinz, and Mr. Lloyd Lenhart to the
Economic Development Authority for the County of Chesterfield. Their
appointments will be for a four-year term, which would become effective July
1, 2015, and will expire on June 30, 2019.
Summary of Information:
Ms. Beirne, Mr. Heinz, and Mr. Lenhart are available to serve the Economic
Development Authority, with terms expiring June 30, 2019. The members of the
Board of Supervisors concur with their reappointments.
Under the existing rules of procedure, appointments to boards and committees
are nominated at one meeting and appointed at the subsequent meeting unless
the rules of procedure are suspended by a unanimous vote of the Board members
present. Nominees are voted on in the order in which they are nominated.

Board Action Request :
Nominate/appoint/reappoint two members to serve on the John Tyler Community
College Local Board.
Summary of Information:
The John Tyler Community College Local Board acts in an advisory capacity
to the State Board for community colleges and performs such duties with
respect to the operations of the College as may be delegated to it by the
State Board.
The Board of Supervisors makes three at -large appointments to the local
board. The terms of Mr. Art Heinz and Dr. Joyce Rowe expire June 30,
2015. Mr. Heinz has served two four-year terms and is not eligible for
reappointment. Dr. Joyce Rowe has served one four-year term and has
expressed an interest in serving for a second term, and John Tyler
Community College has requested for Dr. Rowe to serve a second term. Mr.
Aubrey Lindsey has expressed an interest in serving on the board and has
submitted an application. A total of 3 applications were received for
appointment to the John Tyler Community College Local Board. The terms of
the two appointees would be effective July 1, 2015 through June 30, 2019.
Board members concur with the reappointment of Dr. Rowe and the
appointment of Mr. Lindsey.

Board Action Requested:
Nominate/ reappoint Mr. William M. Collie, Mr. William Poole, Mr. Michael
Simms and Mr. William "Ed" Nicely to serve on the Camp Baker Management
Board.
The term of appointment is effective May 1, 2015 through April 30, 2018.
Summary of Information:
The Camp Baker Management Board has the responsibility of overseeing and
monitoring the operation of Camp Baker. The positions representing the
Greater Richmond ARC and the Chester Civitan Club expire April 30, 2015. Two
applications were received for these positions.
Additionally, the term of the Matoaca District representative, Mr. Michael
Simms, expires April 30, 2015.
Mr. William Collie has served as the Chester Civitan Club representative for
many years. The Chester Civitan Club has nominated, and Mr. Collie has
accepted to serve as the Chester Civitan Club representative for another term
of three years, should the Board of Supervisors so choose.

Mr. William Poole has served on the Camp Baker Management Board for many
years. Mr. Poole serves on the Greater Richmond ARC Board who has nominated,
and Mr. Poole has accepted to serve as the Greater Richmond ARC
representative for a term of three years, should the Board of Supervisors so
choose.
Mr. Michael "Mick" Simms has served on the Camp Baker Management Board for a
term of three years. Mr. Simms is interested in continuing to serve on the
Camp Baker Management Board as the Matoaca District representative for
another term of three years, should the Board of Supervisors so choose. Mr.
Elswick concurs with this appointment.
Mr. William "Ed" Nicely is employed by Chesterfield County Department of
Mental Health Support Services as the Intellectual Disability Services
Manager, and is a strong advocate for services and opportunities available to
those with intellectual disabilities. Mr. Nicely's knowledge and expertise
has been an asset to the Camp Baker Management Board. Mr. Nicely has agreed
to continue serving as the administrative liaison for the County of
Chesterfield for another term of three years, should the Board of Supervisors
so choose.
The Camp Baker Management Board concurs with the appointments of Mr. Collie,
Mr. Poole, Mr. Simms and Mr. Nicely. The terms would be effective May 1,
2015, through April 30, 2018.

RESOLUTION HONORING THE SERVICE AND SACRIFICE OF
SPECIALIST KYLE PASCAL STOECKLI, UNITED STATES ARMY
WHEREAS, Mr. Kyle Pascal Stoeckli of Moseley, Virginia was
born on March 18, 1992, and grew up in the Woodlake Community of
Highberry Woods; and
WHEREAS, Mr. Stoeckli attended Woolridge Elementary School
and graduated from Cosby High School; and
WHEREAS, Mr. Stoeckli participated in many activities of the
Woodlake Swim and Racquet Club, Club Lacrosse and Cosby High
Football, and was employed at Panera Bread, Hull Street; and
WHEREAS, Mr. Stoeckli loved designing and creating art and a
sense of peace and happiness for all; and
WHEREAS, Mr. Stoeckli loved life, riding his motorcycle,
being with family and friends in his community and always offering
help with his attitude and smile; and
WHEREAS, Mr. Stoeckli enlisted in the United States Army in
July 2010; and
WHEREAS, in June 2013, Specialist Stoeckli was serving as an
assistant gunner and vehicle commander with the 3rd Platoon
"Centurion" Company, 1st Battalion, 36th Infantry Regiment, 1st
Armored Division in Maiwand, Afghanistan; and
WHEREAS, Specialist Stoeckli was killed in action on June 1,
2013; and
WHEREAS, Specialist Stoeckli gave his life in defense of a
grateful nation; and
WHEREAS, the Chesterfield County Board of Supervisors wishes
to memorialize the life and the sacrifice of Specialist Stoeckli.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County
Board of Supervisors, on behalf of the citizens of Chesterfield
County, Virginia, does hereby honor the service and sacrifice of
Specialist Kyle Pascal Stoeckli by naming the Woodridge Road
Bridge over Swift Creek Reservoir the "Specialist Kyle Pascal
Stoeckli Memorial Bridge."
AND, BE IT FURTHER RESOLVED that a copy of this resolution be
presented to the family of Mr. Stoeckli and that this resolution
be permanently recorded among the papers of this Board of

LAW ENFORCEMENT WEEK" IN CHESTERFIELD COUNTY
WHEREAS, one of Chesterfield County's five strategic goals is "to
partner with residents to provide a safe and secure community through
prevention, readiness, and professional response"; and
WHEREAS, no community goal is more precious and vital than
maintaining the safety of family, self and others we hold dear; and
WHEREAS, the dedication, steadfastness and bravery of our law
enforcement teams that operate in Chesterfield County are well known
as they provide essential services to all citizens; and
WHEREAS, this service, provided 24 hours a day and 365 days a
year, is the keystone upon which our quality of life rests; and
WHEREAS, since the first known line -of -duty death in 1791, over
20,000 law enforcement officers have made the ultimate sacrifice; on
average one officer dies in the line of duty every 58 hours and as
such, there are 20,267 names engraved on the walls of the National
Law Enforcement Officers Memorial; and
WHEREAS, the week of May 10-16, 2015, is recognized across the
country as "National Law Enforcement Week" and will honor the 126
national law enforcement officers who gave their lives in 2014 in the
line of duty; and
WHEREAS, Chesterfield County is grateful and honored to have such
outstanding and professional individuals serving as law enforcement
officers to protect the health, safety and welfare of its citizenry.

UPON HIS RETIREMENT
WHEREAS, Captain Harry C. Ashby, Jr., retired from the Chesterfield
Fire and Emergency Medical Services Department, Chesterfield County, on
April 1, 2015; and
WHEREAS, Captain Ashby attended Recruit School #15 in 1984, and has
faithfully served the county and its residents for over 30 years in
various assignments; and
WHEREAS, Captain Ashby served as a firefighter at the Wagstaff and
Manchester Fire and EMS Stations; and
WHEREAS, Captain Ashby was promoted to sergeant in September 1989,
and later reclassified as a lieutenant, and served as a company officer
at the Buford and Manchester Fire and EMS Stations; and
WHEREAS, Captain Ashby was promoted to captain in March 1996, and
served at the Wagstaff, Ettrick, Rivers Bend and Matoaca Fire and EMS
Stations; and
WHEREAS, Captain Ashby began serving as an Advanced Life Support
Provider in June 1993; and
WHEREAS, Captain Ashby served as a member of the Hazardous Incident
Team for three years, the Scuba Rescue Team for six years, as well as
the Tactical Medic Team for six years; and
WHEREAS, Captain Ashby was recognized with two Emergency Medical
Services Awards for his life-saving actions in March 1990, and December
1992, for the successful resuscitation of cardiac arrest victims; and
WHEREAS, Captain Ashby was recognized with a Unit Citation for his
team's dedicated performance and professionalism in December 1994, for
the search and rescue of a trapped occupant, as they assisted other
units fighting a house fire; and
WHEREAS, Captain Ashby was recognized with a Unit Citation for his
teamwork and extensive firefighting efforts displayed in May 1995, when
a fire swept through a 58 -unit multifamily apartment building in the Old
Buckingham Station Complex; and
WHEREAS, Captain Ashby was recognized with a Unit Citation and a
Lifesave Award for the aggressive teamwork approach that resulted in
saving a child's life after being rescued from a house on fire in March
2007; and
WHEREAS, Captain Ashby was recognized with a Police Chief's
Commendation for serving as a Tactical Medic to the Chesterfield Police
Department's SWAT Team; and
WHEREAS, Captain Ashby was involved in conducting various training
programs, including in-service training and recruit school training,
where he sought to provide younger members of the organization with the
benefit of his knowledge and experience.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors recognizes the contributions of Captain Harry C. Ashby,
Jr., expresses the appreciation of all residents for his service to the

UPON HIS RETIREMENT
WHEREAS, Lieutenant Michael L. Jones retired from the Chesterfield
Fire and Emergency Medical Services Department, Chesterfield County, on
April 1, 2015; and
WHEREAS, Lieutenant Jones attended Recruit School #20 in 1989, and
has faithfully served the county and its residents for over 25 years in
various assignments; and
WHEREAS, Lieutenant Jones served as a firefighter at the
Manchester, Clover Hill and Bensley Fire and EMS Stations; and
WHEREAS, Lieutenant Jones was promoted to lieutenant in June 2003,
and served as a company officer at the Ettrick, Manchester, Buford, Dale
and Midlothian Fire and EMS Stations, mentoring a number of probationary
firefighters, as well as experienced firefighters; and
WHEREAS, while serving at the Manchester Fire and EMS Station,
Lieutenant Jones became a certified mask -repair technician, saving
Chesterfield County budgeted funds by repairing self-contained breathing
apparatus while on duty; and
WHEREAS, Lieutenant Jones' expert knowledge and his technical
competence was an asset to the department, as he served on multiple
committees and workgroups, including the Self -Contained Breathing
Apparatus selection committee and the Truck 7 replacement committee; and
WHEREAS, Lieutenant Jones was recognized with an EMS Unit Citation
for his teamwork efforts in September 2002, resulting in a positive
outcome for a victim who had fallen; and
WHEREAS, Lieutenant Jones was recognized with a Unit Citation for
exemplary service and commendable performance in March 2007, for his
teamwork efforts alongside fellow firefighters who responded to a
structure fire on Trickling Creek Road involving trapped citizens; and
WHEREAS, Lieutenant Jones was recognized with an EMS Unit Citation
for teamwork efforts in March 2011, after providing advanced care to a
patient who was suffering from cardiac arrest.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors recognizes the contributions of Lieutenant Michael L.
Jones, expresses the appreciation of all residents for his service to
the county, and extends their appreciation for his dedicated service and

RECOGNIZING MRS. LOU O'BOYLE UPON HER RETIREMENT
WHEREAS, Mrs. Lou O'Boyle began working for the Chesterfield County Fire and
Emergency Medical Services Department on October 3, 1988, as an administrative
assistant before transferring to the Sheriff's Office as Administrative Officer to
Sheriff Williams; and
WHEREAS, Mrs. O'Boyle was promoted to Human Resource Management in 1993 to
provide administrative support to the Employee Relations and Development unit where
she began her successful and impactful career in organizational development; and
WHEREAS, Mrs. O'Boyle was co -team leader of the county's first Training and
Development self-directed work team where new forms of teamwork and innovation were
tested and applied in real-world application; and
WHEREAS, Mrs. O'Boyle was a key initiator in exploring the possibilities and
developing Chesterfield University, a nationally -recognized corporate university
which has been recognized by the National Association of Counties, CUBIC Awards and
many other awards and recognition; and
WHEREAS, Mrs. O'Boyle has played an instrumental part in educating employees
and developing the county's Total Quality Improvement culture that remains in place
today by designing and developing curriculum, delivering classroom instruction, and
facilitating numerous retreats and strategic planning sessions for county leaders and
employees; and
WHEREAS, following several years of training and development service, Mrs.
O'Boyle left the county in 2001 to successfully start her own company, Zelos, which
provides customer -service training, strategic planning, and organizational
development services to government sector organizations; and
WHEREAS, Mrs. O'Boyle returned to Chesterfield County in March 2012 as Strategy
and Performance Coordinator where she led the development of the county's strategic
plan - Blueprint Chesterfield, established its measurement strategy and promoted it
to employees; and
WHEREAS, Mrs. O'Boyle continues to positively "make a difference" in the work
environment and county strategy through her positive and optimistic views, friendly
demeanor and ability to identify talent and harness engagement that produces results;
and
WHEREAS, Mrs. O'Boyle has consistently shown exceptional dedication to her work
and has contributed positively in serving the citizens of Chesterfield County during
16 years of service.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the outstanding contributions of Mrs. Lou O'Boyle, expresses

The Board is requested to set a public hearing for May 27, 2015 to consider
amending § 15-196 of the County Code to allow taxicab companies to increase
the fee for trips originating at Richmond International Airport by $0.30.
Summary of Information:
The Capital Region Airport Commission ("Commission") recently approved an
increase in the access fee for public ground transportation vehicles using
the Richmond International Airport facilities to service Airport patrons. A
copy of the resolution is attached. The new rate for taxicabs originating
fares at the Airport will be $2.30. The old rate was $2.00. Accordingly,
the Commission has requested that all member jurisdictions adopt amendments
to their respective taxicab ordinance to allow the new charge. Henrico,
Hanover, and Richmond are all in the process of amending their ordinances.
The rate will go into effect after all member jurisdictions adopt ordinance
amendments.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTION 15-196 RELATING TO TAXICAB FEES
FOR TRIPS ORIGINATING AT RICHMOND INTERNATIONAL AIRPORT
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section I5-196 of the Code of the County of Chester geld, 1997, as amended, is
amended and re-enacted to read as follows:
Sec. 15-196. Same—Enumerated; special discount for elderly passengers and disabled
passengers.
(a) Taxicab drivers shall charge passengers:
For the first one-fifth mile ... $2.50
For each succeeding one-fifth mile ... 0.50
For each 80 seconds of waiting time ... 0.50
For each additional passenger over one (children six years of age or younger, when
accompanying a fare -paying passenger, shall not be deemed additional passengers) ...

Waiting time is (i) the time the taxicab is stopped or moving at a speed less than 15 miles
per hour, (ii) the time the taxicab is waiting for a passenger beginning five minutes after
the time of arrival and (iii) the time consumed while a taxicab stands at the direction of
the passenger. Waiting time shall not include, and no charge shall be made, for the time a
taxicab loses on account of inefficiency, breakdowns, or premature response to a call. No
taxicab shall charge for mileage while charging waiting time.
(b) A surcharge of $1.00 per trip shall be added to compute the fare for a trip originating
between the hours of 9:00 p.m. and 6:00 a.m. the next day.
(c) The owner of any taxicab, upon receipt of satisfactory proof that a passenger is 65 years
of age or older or disabled, may offer a discount not to exceed 20 percent of the total
charge.
(d) The owner of any taxicab may enter into written contracts with organizations and
companies to provide taxicab services on a negotiated basis. The owner of any taxicab
may enter into written contracts with individuals to provide regular service on a
negotiated basis. All such contracts must be kept in the main office of the taxicab
company during the terms of the contract and for 12 months after termination of the
contract. The rates to be charged for such services shall be determined by contract, not
established by the board of supervisors, but taximeters shall be in operation at all times
during the transportation of contract passengers.
(e) For a trip originating at Richmond International Airport, the rate shall be the charge
registered on the meter plus "$2.30.
(2) That this ordinance shall become effective immediately upon adoption.

CAPITAL REGION AIRPORT COMMISSION
EXECUTIVE SUMMARY
RESOLUTION UPDATING COMMERCIAL GROUND TRANSPORTATION FEES
ITEM III.E.l.e.
WHEREAS, the Capital Region Airport Commission (the "Commission") was created
by and pursuant to Chapter 537 of the Acts of Assembly of 1975, as amended, and continued by
Chapter 380 of the Acts of Assembly of 1980, as amended (the "Enabling Act"), and is
authorized to fix, revise, charge and collect fees, rents, rates and charges for the use and services
of its facilities and to make and enter into all contracts, leases and arrangements necessary or
incidental to the exercise of its powers;
WHEREAS, the Commission finds that in order to pay Commission obligations incurred
in connection with the operation and maintenance of the Airport; to protect the public and
preserve order; to provide for the public safety, health and welfare; and to maximize and
maintain revenues necessary for the maintenance, administration and operation of the Airport, it
is necessary and proper to fix charges and fees for the use of Airport property and facilities and
to regulate those persons, firms and corporations who desire to use Airport property and facilities
for the purpose of conducting business operations, either directly or indirectly, for the purpose of
serving customers (picking up or discharging) on Airport property or for the purpose of
otherwise using the Airport for business or commercial purposes;
WHEREAS, the Commission receives no tax revenue and relies on fees, rates and
charges to meet the Airport's operating expenses, and under federal law, including applicable
FAA Grant Assurances, the Airport is required to be self-sustaining;
WHEREAS, the Commission's President and CEO has recommended that the
Commission consider and adopt a per trip vehicle access fee schedule that categorizes public
ground transportation vehicles on the basis of the Gross Vehicle Weight Rating ("GVRW"),
Vehicle Class, and GVRW Category of each vehicle as recognized by the Federal Highway
Administration ("FHWA");

WHEREAS, the Commission's President and CEO has recommended that the Commission
adopt three public ground transportation vehicle categories, specifically, Light Duty, Medium
Duty and Heavy Duty, and authorize contract and non -contract per trip vehicle access fees
ranging from $2.30 to $20.00, all as set forth and explained in Table A attached hereto.
WHEREAS, the Commission's President and CEO has recommended that the proposed
vehicle classifications and public ground transportation vehicle access fees become effective July
1, 2015, for the Fiscal Year 2016, and apply immediately for all non -contract public ground
transportation providers;
WHEREAS, the Commission's President and CEO has recommended that the proposed
vehicle classifications and public ground transportation access fees apply to contract public
ground transportation providers (taxis, limousines, hotel and off -airport parking courtesy
vehicles, irregular route vehicles, executive sedan vehicles and charter buses) upon the renewal
of any existing contracts, permits or agreements by such providers on or after July 1, 2015.
WHEREAS, the Commission's President and CEO has recommended that these
proposed vehicle classifications and revised public ground transportation access fees be available
to off -airport parking providers as an alternative to, but not in lieu of, the current gross revenue
fee of 8% established by the Commission by Resolution adopted on August 30, 2005; and
WHEREAS, the Commission's President and CEO has explained to this Committee that
this fee structure will assist in offsetting the approximate $1.6 million of annual costs incurred by
the Commission associated with its roads and transportation infrastructure.
The Finance Committee recommends the Commission adopt the following resolution:
NOW, THEREFORE, BE IT RESOLVED BY THE CAPITAL REGION
AIRPORT COMMISSION AS FOLLOWS:
1. The Commission hereby authorizes the President and Chief Executive Officer to
establish in structure and amounts the access fees for public ground transportation vehicles in
substantially the form presented to this meeting, with such revisions, changes, omissions or
insertions as the President and CEO, upon advice of counsel, may deem appropriate.
2. The President and CEO is hereby authorized and directed to take all actions
necessary and execute all other documents necessary and appropriate to carry out the
transactions contemplated by this resolution.

1. This chart illustrates the vehicle weight classes and categories used by the Federal
Highway Administration (FHWA). Classes 1 -8 are based on gross vehicle weight rating
(GVWR), the maximum weight of the vehicle, as specified by the manufacturer. GVWR
includes total vehicle weight plus fluids, passengers, and cargo.
2. FHWA categorizes vehicles as tight Duty (Class 1-2), Medium Duty (Class 3-6), and Heavy
Duty (Class 7-8).
3. The Vehicle Access Fee is calculated by using a base per trip fee of $2.30, dividing the
base fee by the midrange weight of the Light Duty Category (5,000 lbs.), resulting in a
rate per pound of $0.00046.
4. If applied in the same manner to the midrange weight of the Medium Duty (18,000 lbs.)
and Heavy Duty (40,000 lbs,) categories, the resulting per trip vehicle access fee for
contract providers would be $8.28 and $18.40, respectively.
5. The recommended Fiscal Year 2016 contract per trip Vehicle Access Fees for Medium
($4.50) and Heavy Duty ($9.00) categories are approximately 50% of these calculated
fees. It is recommended that the Commission adopt this initial access fee base for FY
2016, and consider annually thereafter an increase of the Medium and Heavy Duty
vehicle access fees by no less than 5% per annum to achieve full implementation.

FY2016-FY2021 Secondary Road Six -Year Improvement Plan
State statute requires the Board of Supervisors to update every two years,
jointly with the Virginia Department of Transportation (VDOT), a six-year
plan identifying improvements that are anticipated to be made to the
secondary road system in the county. The recommended FY2016-FY2021 Plan
has been developed by VDOT and staff based on projected revenues of
approximately $1 million per year, plus $30,000 which must be used for
hard surfacing unpaved roads. A summary of the proposed Six -Year Plan is
shown on Attachment A.
Of the projects in the current Plan, two projects are under construction,
(Reams Road at Rosegill Turn Lanes and East River Road Widening) and three

Also included in the current Plan are Newbys Bridge Road (Sussex Drive to
Falling Creek) and Newbys Bridge Road (Cogbill Road to Celestial Lane)
projects. Right-of-way acquisition for both projects is anticipated to
begin this summer.
Staff recommends adding one rural addition project and 22 revenue sharing
projects to the Plan.
Rural Addition
For localities that meet certain criteria, VDOT allows 5 percent of
secondary road construction funds to be used towards upgrading qualifying
non -state standard roads so that they can be accepted into the state road
system as a rural addition. Under the rural addition program, VDOT will
pay the road construction costs. The county, or others, must pay right-of-
way acquisition and utility adjustment costs. In the past, rural addition
projects have been selected by the Board on a case-by-case basis as
requests are received from citizens.
Staff is recommending that Wild Turkey Run be added to the Plan as a rural
addition project. Wild Turkey Run serves five residences. This project
was added to the Plan in 1997, but was removed in 2002 when secondary road
construction funding levels dropped. Changes to VDOT's rural addition
program would not allow the county to participate in the program until
recently. The resident on Wild Turkey Run who originally requested the
road be upgraded has continued to request improvements to the road. To
proceed with this project, a transfer of $35,000 from the General Road
Improvement Account to the project will be required to fund anticipated
right-of-way acquisition and utility adjustment costs.
Revenue Sharing
The Revenue Sharing program is a program offered by VDOT, wherein the
county may provide local funds towards road improvements in anticipation
of an equal match by VDOT. Annually, the Board approves the revenue
sharing projects to be submitted to VDOT for funding consideration.
Staff is recommending that all revenue sharing projects on secondary roads
be included in the Plan. This will provide funding flexibility for these
projects. The following existing and anticipated revenue sharing projects
are recommended to be added to the Plan:

Unpaved Secondary Roads
The Code of Virginia requires that approximately 5% of statewide secondary
construction funds are set aside for the paving of unpaved roads. These
funds are then distributed among localities proportionately based on the
number of miles of unpaved roads carrying over 50 vehicles per day (vpd)
in each locality.
Approximately $30,000/year has been allocated to the Plan specifically for
hard surfacing unpaved roads. The unpaved secondary road funds have been
programmed to projects through FY2018. Staff does not recommend the
addition of an unpaved road to this year's update of the Plan. The
remaining funds in FY2019 - FY2021 can be programmed with future updates
to the Plan.

The Board is requested to appropriate $482,900 in Federal and State
revenue and authorize the creation of ten (10) eligibility worker and one
(1) eligibility supervisor positions effective July 1, 2015 contingent on
the receipt of outside funding.
Summary of Information:
The state budget recently signed by the Governor includes $5.6 million in
federal and state funds to allow for the addition of ninety-three (93) new
eligibility worker positions for local social services departments across
the Commonwealth.
The Chesterfield -Colonial Heights Department of Social Services has
received an allocation of $482,900 in federal and state funds.
Chesterfield received the highest allocation of any locality in the state
as the allocation was based in part on Chesterfield's share of the state's
current eligibility workload.

Inclusion of these funds in the FY2016 Budget will allow the agency to
create ten (10) new eligibility worker positions and one (1) eligibility
supervisor position. These positions will help to address a local
caseload that has increased 112 percent since FY2007. Social Services
staffing levels have actually been reduced by five positions since FY2007.
These additional funds and positions will provide much needed relief to an
agency that has experienced overwhelming increases in caseloads. More
importantly, the additional resources will have a positive impact on
responsiveness to our citizens.
The additional funding does have a 15.5 percent local match requirement of
approximately $88,500 in FY2016 (of which the City of Colonial Heights
shares in about 6 percent). That said local funds are not needed at this
time as it will take some time to fill the 11 positions. Moreover,
expected turnover savings in the department could be used to fund any
required local match during the course of FY2016. It is anticipated that
this state and federal funding will be made available on a recurring basis
and the actions requested in this item are contingent upon ongoing
funding. If outside resources are eliminated, the 11 positions and the
required funding will be reevaluated during a future budget process.

Summary of Information:
In 2012, the county executed a Programmatic Project Administration
Agreement for revenue sharing projects (Attachment A). This agreement
allowed the county to administer the preliminary engineering, right-of-way

LOCALITY and the Commonwealth of Virginia, Department of Transportation, hereinafter
referred to as the DEPARTMENT.
WHEREAS, the LOCALITY may, in accordance with §33.1-23.05 of the Code of
1,'irginia (1950),, as amended (the Code), and Commonwealth Transportation Board (CTB)
policy, submit application(s) for Revenue Sharing funding and may also administer projects
approved for Revenue Sharing funding by the CTB; and
WHEREAS, Appendix A documents the funding allocated to each Project and shall be
developed and included as an attachment to this agreement. Such attachment may be amended,
revised or removed or an additional Appendix A may be added as additional projects or funding
is approved by the CTB and allocated to the LOCALITY to finance the Projcct(s) within the
term of this Agreement without the need to execute an additional project administration
agreement: and
WHEREAS, current and future projects approved for Revenue Sharing funding by the
CTB Nvithin the term of this agreement and subject to the terms and conditions specified herein
shall be identified on a list which will be included as an attachment to this Agreement as
Appendix B. Such attachment may be amended as additional projects are approved by the CTB
and shall be signed by an authorized LOCALITY and VDOT official, without the need to
execute an additional project administration agreement. If any active project with an existing
agreement is incorporated herein, the original project agreement shall automatically terminate
upon inclusion in this, programmatic agreement of an updated Appendix A and an amended
Appendix B to reflect that project, and
WHERE AS, both parties have concurred in the LOCALITY's administration of the
phase(s) of work, for the respective Project(s) listed in the attachments in accordance with
applicable federal, state and local laws and regulations and that the locality will certify
compliance with those laws and regulations as prescribed by the Department.
NOW THEREFORE, in consideration of the mutual premises contained herein, the
parties hereto agree as follows:
I . This agreement shall be effective for an initial period of THREE fiscal years and may be
extended by an addendum signed by each party for one additional term of THREE fiscal
years unless a change in policy or the Code, necessitates a change in terms and conditions
before the term of this agreement shall have passed. This Agreement shall NOT extend
beyond SIX fiscal years. In the event that a new agreement becomes necessary during
the life of this Agreement, Appendix A and Appendix B may be incorporated within the
new approved agreement upon mutual agreement by both parties.

LOCALITY will consult the DEPARTMENT to obtain an attorney from the list of
outside counsel approved by the Office of the Attorney General- Costs associated
with outside counsel services shall be reimbursable expenses of the project.
k. For projects on facilities not maintained by the DEPARTMENT, provide, or have
others provide, maintenance of the Project upon completion, unless otherwise agreed
to by the DEPARTMENT,
3. The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals witich are the
responsibility of the DEPARTMENT. as required by federal or state laws and
regulations or as otherwise agreed to, in writing, between the parties.
b. Upon receipt of the LOCALITY's invoices pursuant to paragraph 21, reimburse the
LOCALITY the cost of eligible Project expenses, as described in Appendix A. Such
reimbursements shall be payable by the DEPARTMENT within 30 days of an
acceptable submission by the LOCALITY.
c. If appropriate, submit invoices to the LOCALITY for the LOCALITY's share of
eligible Project expenses incurred by the DEPARTMENT in the performance of
activities pursuant to paragraph 2.a.
d. Audit the LOCALITY's Project records and documentation as may be required to
verify LOCALITY compliance with applicable laws and regulations.
e. Make available to the LOCALITY guidelines to assist the parties in carrying out
responsibilities under this Agreement.
4. Appendix A identifies the specific funding sources for each Project under this
Agreement, phases of work to be administered by the LOCALITY, and additional
project -specific requirements agreed to by the parties. There may be additional elements
that, once identified, shall be addressed by the parties hereto in writing, which may
require an amendment to this Agreement.
5. If designated by the DEPARTMENT, the LOCALITY is authorized to act as the
DEPARTMENT*s agent for the purpose of conducting survey work pursuant to Section
33. 1 -94 of the Code.
6. Nothing in this Agreement shall obligate the parties hereto to expend or provide any
funds in excess of funds agreed upon in this Agreement or as shall have been included in
an annual or other lawful appropriation. in the, event the cost of a Project under this
agreement is anticipated to exceed the allocation shown for such Project on the respective
Appendix A, both parties agree to cooperate in providing additional funding for the
Project or to terminate the Project before its cost exceeds the allocated amount, however
the DEPARTMENT and the LOCALITY shall not be obligated to provide additional
funds beyond those appropriated pursuant to an annual or other lawful appropriation.

THIS ADDENDUM is made and executed in triplicate this day of , 20_, by and
between the County of Chesterfield, Virginia, hereinafter referred to as the LOCALITY and the Commonwealth
of Virginia, Department of Transportation, hereinafter referred to as the DEPARTMENT.
WHEREAS, the LOCALITY and the DEPARTMENT, entered into a Programmatic Project
Administration Agreement for Revenue Sharing Projects on August 16, 2012; and
WHEREAS, said agreement has an initial term of three fiscal years (each year beginning July 1St -
June 30th), and will expire on June 30, 2015, and may be extended for one additional term of three fiscal years;
and
WHEREAS, the parties to the agreement hereby declare their intent to extend said agreement as provided
in Paragraph 1 of said agreement and further declare that such terms and provisions provided therein shall remain

Authorize the County Administrator to execute a development agreement and an
operating agreement, substantially in the form of the attached documents and
in a form approved by the county attorney, for the Chesterfield Center for
the Arts.
Summary of Information:
The Chesterfield Center for the Arts was approved as a project as part of the
2004 bond referendum, funded by a mix of public and private revenues. Since
that time, the budget for the project has been reduced and the private sector
financial role has shifted. More specifically, the private sector is now
proposed to play a smaller role in the capital funding while at the same time
take on responsibilities for operating the facility.
The Board has approved actions to advance this project in recent meetings. In
November 2014, the Board approved a memorandum of understanding that
established the basis for these agreements, and on April 15, 2015 the
County's portion of the funding for the facility was appropriated with the
Board's adoption of the FY2016 CIP.

The development agreement calls for a collaborative public-private approach
where the project will be financed and constructed through the County's
Economic Development Authority (EDA). This alternative method of finance has
been selected as the time frame to sell bonds from the 2004 referendum
expired last November. Under terms of the agreement, the Chesterfield Center
for the Arts Foundation is responsible for providing not less than $1.1
million in capital funding prior to the start of construction. The EDA will
hold the contracts for designing and constructing the facility while the
County will act as the project manager for the project. The agreement also
includes references regarding leasing real property to the foundation and
transfers of real property, both of which will be governed by specific terms
of a lease agreement.
The operating agreement between the County and the Foundation governs the
operation of the facility after construction is completed. The Foundation is
generally responsible for day to day operations while the County is generally
responsible for major building systems repair/ replacement and grounds
maintenance. Similar to terms in the development agreement, the Foundation is
required to demonstrate their ability to fund their share of the operating
costs by establishing an operating reserve prior to the start of
construction; the operating agreement defines that minimum balances are
required thereafter for the first three years of operation. Under the current
project schedule assumptions, the county would begin to incur a portion of
the operating costs likely at the beginning of FY2018.
Both the development and operating agreements will be made available prior to
the Board meeting.

To the honorable Chairman of the Board Mr. Steve Elswick, Vice Chair, board members, and County
Administrator Mr. James J. L. Stegmaier, my name is L. J. McCoy, Jr., president of the Chesterfield NAACP.
I'd first like to thank your administrators that have supported the branch's programs, especially our recent ACT -
SO Youth Program earlier this month.
But now I'd like to focus on three issues that are very dear to the Chesterfield NAACP. Our branch has had
dialogue with police chief Thierry Dupius on outfitting officers with body cams. We also believe that sensitivity
training, during these times, is an issue that should not be avoided.
Also, as a Mega Mentor at two high schools, we believe that the presence of the African American male makes
a difference in the behavior of younger African American males. But at least 24 African American applicants had
their applications processed for the school system here at a 2014 job fair, yet none were hired.
Finally, Virginia State University has offered Ballard Construction over a $54 million construction contract. Yet to
our knowledge, not one African American contractor has been awarded a contract.
The Chesterfield NAACP recognizes the disparities here in the county. Therefore the branch has partnered with
other branches and community leaders to have conversation with the community in order to have discussion on
these and other issues. At 6:30 PM Thursday May 7th at Union Branch Baptist Church 11519 River Rd. we will
again have another community discussion.
Finally, we know looking the other way, is not an option. For if we continue to ignore these situations, and fail to
address them, then this county would be no better than those disenfranchised individuals we see on the evening
news. Thank you.

RECOGNIZING MAY 16-22, 2015, AS "SAFE BOATING WEEK"
IN CHESTERFIELD COUNTY
WHEREAS, many Chesterfield County residents choose recreational
boating as a way to relax with their families and friends; and
WHEREAS, opportunities for on -the -water activities grow each year;
and
WHEREAS, with this growth comes additional risk and responsibility;
and
WHEREAS, a substantial proportion of the boats currently registered
in the Commonwealth of Virginia are owned by residents of the County of
Chesterfield; and
WHEREAS, use of kayaks and other self-propelled watercraft not
required to be registered is increasing rapidly; and
WHEREAS, additional boaters from outside the county visit our waters
each boating season; and
WHEREAS, it is important that both novice and experienced boaters
practice safe boating habits, maintain essential safety equipment, and
wear a life jacket; and
WHEREAS, the law requires that a wearable life jacket be carried for
each person on board all boats; and
WHEREAS, the life jackets of today are more comfortable, attractive,
and wearable than the styles of past; and
WHEREAS, the theme for the North American Safe Boating Campaign,
"Wear It!", acknowledges that many lives are saved by the use of life
jackets; and
WHEREAS, boating safety education classes and complimentary vessel
safety checks are readily available throughout the year from the United
States Coast Guard Auxiliary.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 29th day of April 2015, publicly recognizes May 16-22,
2015, as "Safe Boating Week" in Chesterfield County and urges all
Chesterfield boaters to take a boating safety course, wear their life
jackets, have their boats checked for other safety equipment, and
practice safe boating.

IN CHESTERFIELD COUNTY
WHEREAS, Chesterfield County includes a thriving community of older
Americans who deserve recognition for their contributions and sacrifices
to ensure a better life for future generations; and
WHEREAS, Chesterfield County and the Office of the Senior Advocate
are committed to helping all individuals live longer, healthier lives in
the communities of their choice for as long as possible; and
WHEREAS, since 1965, the Older Americans Act has provided services
that help older adults remain healthy and independent by complementing
existing medical and health care systems, helping prevent hospital
readmissions, and supporting some of life's most basic functions, such as
bathing or preparing meals; and
WHEREAS, these programs also support family caregivers, address
issues of exploitation, neglect and abuse of older adults, and adapt
services to the needs of American elders; and
WHEREAS, our older adults are active community members involved in
volunteering, mentorship, arts and culture, and civic engagement; and
WHEREAS, we recognize the value of community engagement and service
in helping older adults remain healthy and active while giving back to
others; and
WHEREAS, many organizations and Chesterfield County departments
provide services and programs to help older residents in Chesterfield
County lead active, fulfilling and independent lives and to remain in
their homes.
WHEREAS, our community can provide opportunities to enrich the lives
of individuals of all ages by promoting and engaging in activity, wellness
and social inclusion; emphasizing home and community-based services that
support independent living; ensuring community members of all ages benefit
from the contributions and experience of older adults; and
WHEREAS, Chesterfield TRIAD declares May 6, as Senior Day in
Chesterfield County; and
WHEREAS, the Richmond region and Chesterfield County were recognized
as one of three regions in the country as a 2015 Best Intergeneration
Community by Generations United and MetLife Foundation, acknowledging that
children, youth and older adults are an integral and valued part of the
community; and

WHEREAS, the Senior Advocate's office sponsored an essay contest for
fourth and fifth grade Chesterfield County students to acknowledge
positive older adult role models, celebrate intergenerational
relationships and demonstrate good writing skills, and Christopher Akers
of Crenshaw Elementary School is being recognized as the grand prize
winner of the contest in which he acknowledged his grandmother; and
WHEREAS, the following students are being recognized as the school

BOARD OF SUPERVISORS' MEETING: PUBLIC COMMENT PERIOD
Tonight I am here to report there are issues arising with youth baseball and
softball groups with respect to the co-sponsorship program similar to those
reported more than a year ago to the appropriate Deputy County
Administrator. These issues have not been properly addressed.
While the Sports Manual states that Parks and Recreation "may request
financial reports," if you are not going to do that when citizens report that
their attempts to obtain financial records to which they are entitled have
been unsuccessful, then when will you request those reports? Contrary to
staff's assertions that there is nothing they can do, I suggest that there is
something they can do.
The Manual's general criteria for co-sponsorship stipulate that groups must
be "organized for not-for-profit purposes." In addition; the Manual
provides information pertaining to annual filing requirements for nonprofit
organizations, including IRS filing requirements and Virginia's requirement
that "all organizations that receive charitable contributions and/or conduct
fundraising activities" must register with the Office of Consumer Affairs.
When co-sponsored groups do not file tax returns and are no longer valid
501(c) (3) groups, then I do not believe the county should be affiliated with
them. To avoid such problems in the future, I am suggesting that the co-
sponsorship agreement and procedures be amended to require that a copy
of the group's approved application for 501(c) 3 status be required for
initial approval of the agreement and a copy of their most recent tax return
be required for renewal of co-sponsored status.
In addition, the group seeking co-sponsorship should be required to submit
a copy of their registration with the Department of Consumer Affairs and a
copy of any other required registrations with their renewal applications
prior to approval. These actions should prevent the county from partnering
with groups who are not filing tax returns and not completing required
registrations with state agencies.
This would help raise awareness among these groups that there are serious
consequences associated with failing to file required tax returns and
registrations. Those who sponsor and contribute to groups that do not file
tax returns to maintain their tax-exempt status cannot legally deduct their
contributions.
Parks and Recreation should also verify that officers and directors of each
group hold background check cards by checking the submitted names
against the list they maintain. I reported two individuals of one group that
had no background checks despite the president of that group attesting
that they did on the renewal application. Those two individuals never
applied for background checks, but were disqualified to hold office only
after I identified them. The fact that there is no consequence for such
lapses should concern parents.
If there are no consequences to breaking the rules, then there will continue
to be issues. Please see that these issues are addressed for the good of our
community and especially our children.

Approve the leasing of county property at James River High School to Cellco
Partnership d/b/a Verizon Wireless.
Summary of Information:
On January 9, 2008, conditional use was granted for construction of
communications towers at James River High School. An existing light pole at
the football field will be replaced with a structure capable of supporting
the lights and communications antennas. The lease will be for five years at
$12,000 per year, with a 30-. annual escalation and three five-year renewal
terms. There will also be a one-time payment in the amount of $20,000 to
James River High School. This request has been reviewed by county staff,
schools administration and school staff.
