05-26-1943 MinutesVIRGINIA: at an adjourned meeting of the Board of SuPervisors of Cheste field County, held at the Cour house on May 26, 1943, at 10:0 o'clock A.M. Present: H. L.Chalkley,Chair~n J. G. Honing H. T. Goyne W. A. Horner T. D. Watkins Absent: P. W. Covington This day further arguments were heard for and against the enactment of the propose Zoning Ordinance for Chesterfield County. There appearing against the Ordinance-Mr. E. A. Kyhn, Mr. Wm. 01d, Mr. A. T. Curtis, and M~s. Cline; those appearing in favor of the Ordinance, Mr. R. Stuart Royer and Mr. ~rvin Sutherland ~fter lengthy discussions, Mr. H. T. Goyne offered a motion that the Ordinance be tabled for the duration of the War. This motion died for the want of a secon Those present were notified that the next meeting scheduled for hearing on the proposed Zoning Ordinance would be June 23, 1943, at 10:00 o'clock A.M. This day the Executive Secretary again called the attention of the Board tc~ a suggestion from the State Department of Taxation and the State Planning Board that they assist Chesterfield County in producing a land tax map for the County; planning to make it a beginning of a simflar service to other counties in the State by the DePartment of Taxation and the State Planning Board. Mr. Marvin Sutherla~d, of the State Planning Board, appeared to express the view of the State Planning Board in this matter and stated that at its last meeting all members of the State Planning Board were in favor of beginning such a project,and while no defLuite figures were available yet, from experiences of counties similar to Chesterfield who had created a land tax map he felt that the cost to Chesterfie County would not be over $5,000.00, and that it was the opinion of the State Planning Board that any cost above this amount might be borne by the Department of Taxation and the Planning Board. Upon consideration whereof, and on motion of H. T. Goyne, it is resolved that this matter be carried over to the next meeting of the Board of Supervisors. ~nd be it further reso~ved~that the Executive Secretary be and he hereby is instructed to obtain such data on the actual cost of this project as possible before that date. This day the Executive Secretary brought to the Board's atte~tion the fact that the Office of Civilian Defense had offered certain fire fighting equipment to the County of Chesterfield, provided Property Agents be appointed by the Board of Supervisors and properly bonded to care for the safety of such equipment. On motion of H.T. Goyne, it is resolved that a Committee be appointed to investigate the advisability of accepting such equipment and to report at a later meeting. Whereupon, the Chairman appointed H. T. Goyne and T. D. '~atkins as this Committee. This day the Executive Secretary reported to the Board that ~he water in the syste at Bellewood Manor from analysis showed a high content of carbon dioxide, acting on the tank and pipes causing discoloration, and after a survey by the State Health Department it was recommended that the water be treated with Micromar to relieve this situation. On motion of W. A. l~rner, it is resolved that the Executive Secretary be and he hereby is instructed to take such steps as ~ecessar to correct the condition now existing. This day, Mr. J. Wm. Dance, Treasurer, of Chesterfield County, appeared before t Board and requested that he be permitted to increase the salaries of his three (3) office assistants in the amount of $10.00 per month, effective May l, 19~3, provided such an increasm w~Iibe allowed by the Compensation Board; and an addi- tional $60.00 for extra helpduring his field collection trips. UDon consideration whereof, and on motion of' W. A. Hornet. it is resolved that the request of Mr. Dance be granted and that the sum of SA0.00 be transferred from the unexpended surplus of the General Fund to budgetary code ~a-10~, Compensation of Office Assistants, of the current budget, $ogether with the sum of SE00.00 previously sst up in the budget for 1943-'44, this being the County's part of such an increase, complying with the request of Mr. Dance. Notice of the adoption of a "Pig" Ordinance as amended having been duly advertise~ it is resolved on motion of T. D.Watkins, that the Ordinance be and it hereby is ~dopted as amended as follows: ld An ordinance prohibiting o~nership, and/or possession, and/or control of a pig or pigs confined in any enclosure in Chesterfield County, within 500 feet of any church, scho~ol, public meeting place, private residence of another, and~or within 100 feet of any public road, street or avenue, and setting out certain definitions and providing for a penalty for the violation thereof, and repealing a similar ordinance. Under and by virtue of the authority conferred upon theBoard of Supervisors of Chesterfield County, Virginia, by an ~ct of the General ~ssembly of Virginia, approved April 2, 1942, and known as Chapter 389 of the said Acts of Assembly, this Board having carefully considered the matter, doth ordain ~s follows: Section 1. That the ownership, and/or possession and/or control of a pig or pigs confined in any enclosure in Chesterfield County, within 500 feet of any church, school, public meeting place, private residence of another, and/or within 100 feet of any public road, street or avenue, is prohibited. Section 2. It shall be unlawful for any person, firm or corporation to own and/or ossess and/or control a pig or pigs confined in any enclosure in Chesterfield cunt¥, within 500 feet of any church, school, public meeting place, private residence of another and/or within 100 feet of any public road, street or avenue. Section 3. ~nY person, firm or corporation who or which shall violate the provisions of this ordinance shall upon conviction thereof be punished by a fine not exceeding $50.00and by confinement in Jail not exceeding 30 days, eit~r or bo~ ~ection 4. The term "pig or pigs" as used in this ordinance shall mean swine of all ages. Section 5. Trials of all violations of this ordinance shall be enforced by proceedings before the Trial Justice Court in like manner and with like right of appeal as is provided in misdemeanor cases. Section 6. The term" enclosures" am used in this ordinance means any enclosed a~ well defined area used.for the housing and/or feeding of swine, and/or that part of a swine pasture which is used for the feeding of swine. Section 7. Thais ordinance shall not be construed as in any sense limiting and/or replacing and/er affecting any state law appertaining to common and/or public nuisance s. ~ he ~d/or Section 8. If any section or part of a section of this ordinance is hereafter held by any Court of competent Jurisdiction to be unconstitutional and invalid, such decision shall in no wise affect or render void the remainder of this ordinance. Section 9. An ordinance adopted by this Board on the 8th day of September, 19~3, probhiting the ownership and/or possession and/or control of a pig or pigs confined in any enclosure in any sanitary district of Chesterfield County is hereb repealed. This day Supervisor H. T. Goyne. called the Board'a Stention to a condition existing on the highway in the Village of Chester, stating t'hat the bridge over the Atlantic Coast Line Ry. near the Chester High School was inadequate for the traffic now being passed over it, and that recently a least one school child had been struck by a vehicle and while no injury was sustained it was a forceful example of what could happen on this bridge. He suggested that the bridge formerly used by the Virginia Electric & Power Company now owned by the Virginia Department of Highways, together with approaching roads be conditioned for travel and be used as a one-way bridge for west bound traffic on Route $1 at this point; that the existing bridge be used for one-way travel for east bound traffic at this point, and that by so doing it would relieve the necessity of passing on the present narrow bridge and would give an opportunity to develop a protected walk along these bridges. Upon consideration whereof, and on motion of H. T. Goyne, it is resolved that the Virginia Department of Highways be and it hereby is requested to make a survey of this situation and to take such steps as possibl~ during this t&me of emergency to relieve this congestion. ~nd be it further resolved that a copy of this resolution be sent to the Virginia Department of Highways. This day the Executive oecretary calle¢~ the atteiition of the Board to a request from Lit. P. ~ixey Jones, County ~ent, for additional office space to house the newly established Federal Employment ~ency for Che~terfield County. Whereupon the Executive Secretary was instructed to request ldr. Jones to appear before the Board at the next meeting of this Board.
