reviewed legislative requests, including potential
legislation from the Board's Transportation Summit; and
amending the Code of Virginia to remove the cri teria of
hardship "approaching confiscation" that Board of Zoning
Appeals must currently consider when contemplating variance
requests. She stated the proposed legislative program
includes supporting/opposing potential legislation

(JLARC) recommendations from study of the Comprehensive
Services Act. She further stated additional potential issues
for the 2007 General Assembly include eminent domain
legislation; real estate tax caps; transportation
legislation; Chesapeake Bay Clean-Up funding; and state
budget funding. She reviewed the calendar of important dates
related to the 2007 session.
Discussion ensued relative to the JLARC

Mr. Ramsey stated staff has been negotiating for some time
wi th a family that owns three parcels in the middle of the
property Mrs. Humphrey referred to. He further stated staff
recently negotiated a contract to purchase the property, and
the owners have requested that the county move forward with
the purchase. He stated the county had anticipated
purchasing the property in 2008 in the Capital Improvement
Program. He further stated staff had originally thought that
funding for the 360 West Area Park planned for 2007 could be
swi tched to this proj ect . He s ta ted Mrs. Humphrey has
expressed concerns relative to the speed in which the Matoaca
Park project is moving and the proposed exchange of funding
for the projects. He further stated staff is now requesting
that funding be advanced from the Reserve for Capital
Projects to purchase this land until the Matoaca Park project
has been awarded, and the funds would be switched at that
time.
Mr. Miller stated he would like to acquire the land for the
park and appreciates Mrs. Humphrey working with him to get
this done.
-
Mrs. Humphrey stated this request should have been discussed
with both she and Mr. Miller well in advance. She expressed
concerns relative to the delayed expansion of Matoaca Park
and stated she has requested assurance that pending Matoaca
District projects are being completed before transferring
funds for the purchase of the Falling Creek Park property.
She requested that Ms. Dickson provide her with the remaining
balance for the Route 360 West Area Park proj ect once the
transfer of funds is completed, indicating that she may want
to address funding of the project in next year's budget.
On motion of Mrs. Humphrey, seconded by Mr. Miller, the Board
approved a contract for the purchase of three parcels of land
on Jessup Road, containing a total of 15 acres, more or less,
with improvements, for $425,000 from Donald R. and Madonna R.
Creech, subject to the necessary approvals to use the
property for a park, and authorized the County Administrator
to execute the real estate contract and deed.

And, further, the Board approved the transfer of $346,000

Creek Park - North Recreational proj ect Account. (It is
noted $305,000 will be repaid to the Reserve for Future
