APPROVAL OF MINUTES FOR SEPTEMBER 27, 2006 On motion of Mrs. Humphrey, seconded by Mr. King, the Board approved the minutes of September 27, 2006, as submitted. Ayes: King, Miller, Beirne, Humphrey and Warren. Nays: None. 2. COUNTY ADMINISTRATOR I S COMMENTS o Mr. Ramsey introduced Dr. Marcus appointed Superintendent of Schools. Newsome, newly Dr. Newsome stated he looks forward to building upon the accomplishments and continuing the good work of the Chesterfield County School System. Mr. King welcomed Dr. Newsome to the county. o FAMILY VIOLENCE FATALITY REVIEW TEAM UPDATE Ms. Sharon Lindsay, Domestic Violence Coordinator for the Police Department, updated the Board on the implementation of recommendations from the county's Intimate Partner and Family Violence Fatality Review Team and provided details of the team's efforts to prevent future homicides. Mr. King thanked Ms. Lindsay for the present:ation and the work of the team. 3. BOARD MEMBER REPORTS There were no Board member reports at this time. 4. REQUESTS TO POSTPONE AGENDA ITEMS AND ADDITIONS, OR CHANGES IN THE ORDER OF PRESENTATION There were no requests to postpone agenda items, additions or changes in the order of presentation at this time. 5. RESOLUTIONS AND RECOGNITIONS 5.A. RECOGNIZING THE MONTH OF OCTOBER 2006, AS "DISABILITY AWARENESS MONTH" FOR THE COUNTY OF CHESTERFIELD Ms. Dickson introduced Ms. Ngozi Ukeje, who was present to receive the resolution. On motion of the Board, the following resolution was adopted: WHEREAS, the first recognition of Disability Awareness Month was made on August 11, 1945 by a joi.nt resolution of 06-914 10/11/06 the United States Congress as the "National Employment of the Physically Handicapped Week"j and - WHEREAS, Disability Awareness Month was further supported through the signing of the "Americans with Disabili ties Act of 1990" (ADA) by President George H. W. Bush for the purpose of prohibiting discrimination against persons with disabilities in education, employment, and government services, and at places of public accommodation, commercial facilities, and in many other areas of society; and WHEREAS, Disability Awareness Month highlights that people with disabilities residing in Chesterfield County are valued and vital members of the community; and WHEREAS, Disability Awareness Month acknowledges and salutes the skills, talents, creativity, and abilities that people with disabili ties contribute to Chesterfield County; and WHEREAS, Disability Awareness Month increases public knowledge of the barriers, social or physical, that still exist and prevent full participation in community living of Americans with disabilities and that the foundations established by the ADA are continued wi th commitment and passion. NOW, THEREFORE, BE IT RESOLVED, that the Chesterfield County Board of Supervisors, this 11th day of October 2006, publicly recognizes October 2006, as "Disability Awareness Month" in Chesterfield County and urges all citizens to support the activities of the Chesterfield County Disability Services Board through advocacy for people with physical and sensory disabilities. Mrs. Humphrey presented the executed resolution to Ms. Ukeje and expressed appreciation for the services provided by members of the Disability Services Board. Ms. Ukeje thanked the Board for recognizing "Disability Awareness Month" and provided details of activities to promote awareness of disabilities during the month. 5.B. RECOGNIZING MR. R. E. "DICK" PAGE FOR HIS CONTRIBUTIONS TO THE BEAUTIFICATION OF CHESTERFIELD COUNTY ,- Ms. Ruth introduced Mr. Dick Page who was present to receive the resolution. On motion of the Board, the following resolution was adopted: WHEREAS, Mr. R. E. "Dick" Page is an outstanding citizen of Chesterfield County, Virginia; and WHEREAS, Mr. Page has been an advocate for the county and residents in the removal of illegal signs placed in medians and alongside roads; and 06-915 10/11./06 WHEREAS, signs in the medians and immediately adjacent to county roads are located in the rights of way maintained by the Virginia Department of Transportation; and WHEREAS, state law makes it illegal to erect most temporary signs on VDOT-controlled property and VDOT is the only entity given the right to enforce that requirement; and WHEREAS, the virginia Department of Transportation gave Chesterfield County the authority to remove those signs in 2000; and WHEREAS, the county's Code Compliance Office, which is responsible for the enforcement of county zoning ordinances, without additional staff or resources, has been able to remove 12,328 illegal signs in VDOT rights-af-way since January 2004; and WHEREAS, the removal of these signs has been a challenge for Code Compliance Officers, due to the number of complaints and the increasing number of illegal signs; and WHEREAS, Mr. Page has personally removed hundreds of these illegal signs; and WHEREAS, in July 2006, Mr. Page proposed the creation of a code-compliance task force made up of resident volunteers to help keep these signs off of public roadways; and WHEREAS, Mr. Page's efforts led to county staff investigating the issue and, in September 2006, the Board of Supervisors approving an agreement wi th the Virginia State Department of Transportation that designates Chesterfield County as an agent of VDOT to remove illegal signs in the rights of way wi thin the locality and to take enforcement actions against those who place them there; and WHEREAS, this agreement also enables the county to organize a volunteer program to assist in clean up efforts; to communicate with residents and businesses about this ini tiati ve; and to establish enforcement mechanisms against those who place illegal signs in the public rights of way in the county; and WHEREAS, Mr. Page's support of this initiative will lead to the beautification of the county and a recovery of county landscape from commercial graffiti; and WHEREAS, Mr. Page has served hi s local communi ty and Chesterfield County with great energy, leadership, dedication and wisdom in this situation and in other capacities; and WHEREAS, Mr. Page has been a positive force for change in his community and for Chesterfield County, and his efforts will continue to have a beneficial effect for years to come. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield Board of Supervisors, on behalf of all Chesterfield County residents, this 11th day of October 2006, publicly recognizes Mr. R. E. "Dick" Page; extends sincere appreciation for his civic-minded spirit, leadership and pursuit of excellence, which have made Chesterfield County a better place in which 06-916 10/11/06 to live, work and enjoy life; and offers best wishes to Mr. Page for continued success in all his endeavors. Mr. Warren presented the executed resolution expressed appreciation for his efforts in illegal signs in the county. to Mr. Page and the removal of - Mr. Page commended Ms. Tara McGee, Assistant County Attorney, on her outstanding efforts regarding this issue. He thanked the Board for taking the first step in recouping the landscape along the county's highways. 6. WORK SESSION o PROPOSED 2007 LEGISLATIVE PROGRAM AND UPDATE ON 2006 SPECIAL SESSION ON TRANSPORTATION Ms. Curtin stated several minor bills were passed during the special session on transportation, none of which substantively deal with issues of concern to the Board of Supervisors. She reviewed Board priorities for the county's proposed 2007 legislative program, including securing adequate funding for transportation needs in the county; protection of cash proffer authority; protection of local government land use and zoning authority; protection of local revenues; prevention of state cost-shifting to localities; and opposition to additional state mandates. She then reviewed legislative requests, including potential legislation from the Board's Transportation Summit; and amending the Code of Virginia to remove the cri teria of hardship "approaching confiscation" that Board of Zoning Appeals must currently consider when contemplating variance requests. She stated the proposed legislative program includes supporting/opposing potential legislation implementing the Joint Legislative Audit Review Commission (JLARC) recommendations from study of the Comprehensive Services Act. She further stated additional potential issues for the 2007 General Assembly include eminent domain legislation; real estate tax caps; transportation legislation; Chesapeake Bay Clean-Up funding; and state budget funding. She reviewed the calendar of important dates related to the 2007 session. Discussion ensued relative to the JLARC Cornprehensi ve Services, which will be released 2006 and the procedure for communicating localities through the Virginia Association regarding legislative issues. study on in December wi th 0 ther of Counties - Mr. King thanked Ms. Curtin for the informative presentation. 7 . APPOINTMENTS On motion of Mr. King, seconded by Mrs. Humphrey, the Board suspended its rules at this time to allow for simultaneous nomination/appointment of members to serve on the Towing Advisory Board. Nays: None. o TOWING ADVISORY BOARD On motion of Mrs. Humphrey, seconded by Mr. Miller, the Board simultaneously nominated/appointed Mr. Ray Cullop, Mr. Tony Purcell and Mr. Roger Kendrick to serve on the Towing Advisory Board, whose terms will be at the pleasure of the Board. ACCEPTANCE OF A GRANT AWARDED BY THE UNITED STATES DEPARTMENT OF JUSTICE, OFFICE OF COMMUNITY ORIENTED POLICING SERVICES FOR THE 2006 COPS TECHNOLOGY GRANT On motion of Mr. Miller, seconded by Mr. King, the Board authorized the Police Department to accept and appropriate an award from the United States Department of Justice COPS Office, 2006 COPS Technology Grant, in the amount of $98,723, and authorized the County Administrator to execute all documents. TRANSFER OF FUNDS FROM THE RESERVE FOR FUTURE CAPITAL PROJECTS TO THE PARKS AND RECREATION DEPARTMENT FOR SITE IMPROVEMENTS AT HENRICUS HISTORICAL PARK On motion of Mr. Miller, seconded by Mr. King, the Board approved the transfer of $70,000 from the Reserve for Future Capital Projects to a Parks and Recreation capital project for site improvements at Henricus Historical Park. ADOPTION OF RESOLUTION RECOGNIZING OCTOBER 8-14, 2006, AS "FIRE PREVENTION WEEK" IN CHESTERFIELD COUNTY On motion of Mr. Miller, seconded by Mr. King, the Board adopted the following resolution: 06-918 10/11/06 WHEREAS, the County of Chesterfield is committed to ensuring the safety and security of all those living in and visiting our county; and WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are the locations where people are at greatest risk from fire; and WHEREAS, the National Fire Protection Association (NFPA) has documented through its research a significant increase in cooking fires, even as most other causes of home fires have steadily declined; and WHEREAS, Chesterfield Fire and Services first responders are dedicated occurrence of cooking fires and cooking fire prevention and protection education; and Emergency Medical to reducing the injuries through WHEREAS, Chesterfield County residents are responsive to public education measures and are able to take personal steps to increase their safety from fire; and WHEREAS, using proper care while cooking will have a positive effect on the home fire problem; and WHEREAS, each cooking fire that Chesterfield County is an opportunity injury and costly property damage; and is prevented in to prevent painful WHEREAS, the 2006 Fire Prevention Week theme, "Prevent Cooking Fires; Watch What You Heat " effectively serves to remind us all of the simple actions we can take to stay safer from fire during Fire Prevention Week and year-round. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors recognizes October 8-14, 2006, as "Fire Prevention Week" throughout the county, and urges all people of Chesterfield County to heed the important safety messages of Fire Prevention Week 2006, and to support the many public safety activities and efforts of Chesterfield County's Fire and Emergency Medical Services. APPROVAL OF FY2008 PRIORITY LIST OF PRIMARY AND INTERSTATE NEEDS .,..~ On motion of Mr. Miller, seconded by Mr. King, the Board approved the recommended FY2008 priority list of highway projects and letter regarding Chesterfield's primary and interstate road needs and directed staff to forward this information to the Commonwealth Transportation Board and the county's Congressional and State Legislative Delegations. He further stated staff is now requesting that funding be advanced from the Reserve for Capital Projects to purchase this land until the Matoaca Park project has been awarded, and the funds would be switched at that time. Mr. Miller stated he would like to acquire the land for the park and appreciates Mrs. Humphrey working with him to get this done. - Mrs. Humphrey stated this request should have been discussed with both she and Mr. Miller well in advance. He reviewed Virginia Department of Transportation information relative to transportation costs and revenues from FYOO-FY06 and expressed concerns that state construction funding will be insufficient to provide the required match for federal funds starting in 2013. He provided details of increased road construction costs from 1992 to 2006 and expressed concerns relative to what inflation has done to the cost of building roads. He reviewed Chesterfield's secondary road allocations from 1983 until 2006 and interstate and primary allocations for Chesterfield and the Richmond District. He stated the county is contributing significantly to road construction and provided details of the county's participation in the Route 360 project, including acquiring right of way dedication through the zoning process; construction of pavement by developers; construction of drainage basins through the site plan process; an interest free county loan to VDOT in the amount of $10 million; and a county contribution of $2 million. He provided details of transportation needs that have been identified in the county to maintain current levels of service. He stated staff has scheduled a Transportation Summit for November 20, 2006 for the Board to address the county's serious transportation issues and discuss potential funding options and invited members of the legislative delegation to attend the summit. c,...... YALE MANSFIELD BRANDT FOR OUTSTANDING COMMUNITY SERVICE Ms. Ruth introduced Ms. Roslyn Blankenship who was present to receive the resolution on behalf of Mr. Yale Brandt's family. On motion of the Board, the following resolution was adopted: WHEREAS, Mr. Yale Mansfield Brandt, born September 7, 1930, was a resident of Chesterfj,eld County for nearly 35 years; and -",.' WHEREAS, Mr. Brandt attended Western Michigan University and received a Bachelor of Science degree in Pulp and Paper Chemistry; and WHEREAS, Mr. Brandt served in t.he United States Army during the Korean War and was stationed at Fort Knox; and WHEREAS, Mr. Brandt began his career at Reynolds Metals Company as a plant chemist, was promoted to plant manager positions, became the head of operations and retired as Vice Chairman of the company in 1995 after 38 years of service; and WHEREAS, Mr. Brandt was instrumental in developing the Reynolds "Brown-In-Bag"; and WHEREAS, Mr. Brandt has provided many hours of selfless volunteer service to the county as President of the Harrowgate Trust Community Association; and also served as a board member of numerous organizations including Junior Achievement, Chester Forum, Eskimo Pie, Robert Shaw Controls; and was an active member of the willow Oaks Country Club; and --" WHEREAS, Mr. Brandt was one of the founding members of the Chester Family YMCA; and was a board member of the Chester YMCA and the Metropolitan Richmond YMCA; and WHEREAS, Mr. Brandt was a member of Grace Lutheran Church since 1972; and served his church in many capacities, including several terms as Congregation President, served on a number of committees of the Southeastern District of the Lutheran Church-Missouri Synod including the Mission Board for Circuit #10 of the Southeastern District, and as a delegate to the Synodical Convention, and was a member of the church choir, and WHEREAS, Mr. Brandt was well-read and well-traveled, loved golf and tennis, enjoyed young people and mentored many people, both young and old; and WHEREAS, Mr. Brandt was a Chesterfield County resident of whom we all can be very proud; and WHEREAS, Mr. Brandt's long and successful life ended on August 17, 2006, and this is a suitable time to recognize his lifetime of commitment and contributions, particularly those to the residents of Chesterfield County, virginia. NOW, THEREFORE, BE IT RESOINED that the Chesterfield County Board of Supervisors, this 11th day of October 2006, publicly recognizes the important contributions of the late 06-936 10/11/06 Mr. Yale Mansfield Brandt for his civic-minded service, as a volunteer and citizen, and hereby extends its appreciation to his family for his many years of active and dedicated involvement in his community. AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented to Mr. Brandt's family and that this resolution be permanently recorded among the papers of this Board of Supervisors of Chesterfield County, Virginia. Mr. King presented the executed resolution to Ms. Blankenship and expressed appreciation for her father's contributions to Chesterfield County. Ms. Blankenship thanked the Board for recognizing her father's community service. Mr. Miller excused himself from the meeting. 15. PUBLIC HEARING o TO CONSIDER AMENDMENTS TO THE LAND USE TAXATION ORDINANCE RELATED TO FAMILY SUBDIVISIONS - Mr. Micas stated this date and time has been advertised for a public hearing for the Board to consider amendments to the county's land use taxation ordinance related to family subdivisions. He further stated the proposed ordinance amendments implement the change in state law adopted by the 2006 General Assembly. He stated the amendments would allow families to split off property that is subject to land use tax to family members without being subject to the rollback tax. Mr. King called for public comment. On motion of Mrs. Humphrey, seconded by Mr. King, the Board adopted the following ordinance: AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 9-22 RELATING TO ROLL-BACK TAXES IN THE COUNTY LAND USE TAXATION PROGRAM FOR FAMILY SUBDIVISONS OF REAL PROPERTY BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section Chesterfield, 1997, read as follows: 9-22 of the Code of the County of as amended, is amended and re-enacted to 06-937 10/11/06 Sec. 9-22. Roll-back tax--Imposed. The county assessor may assess roll-back taxes, penalties and interest in accordance with the Code of Virginia. However, roll-back taxes from a subdivision, separation or split of real property shall not apply to a family subdivision as defined in Chapter 17, provided that title to the parcels subdivided, separated, or split-off :is held in the name of an immediate family member for at least~ the first 60 months immediately following the subdivision, separation, or split- off. 000 (2) That this ordinance shall become effective immediately upon adoption. Ayes: Nays: Absent: King, Beirne, Humphrey and Warren. None. Miller. 16. FIFTEEN-MINUTE CITIZEN COMMENT PERIOD ON UNSCHEDULED MATTERS Mr. C. L. Morrissette, ~TL addressed the Board relative to state statutes concerning vested rights. Ms. Shelly Schuetz addressed the Board relative to the importance of an investigation of land deals to build public facilities in the county, as requested by Ms. Brenda Stewart. Mr. King stated he requested that the County Attorney review the issues raised by Ms. Stewart at the September 27, 2006 meeting. He further stated he signed a letter addressed to Ms. Stewart today after receiving approval from the other Board members, and Ms. Stewart should receive the letter soon. -~ Mr. Warren stated he briefly saw the letter prior to today's meeting and agrees that the letter should be sent, but was not in a position to endorse the details of the letter. Mrs. Humphrey stated the letter did not necessarily represent the Board's position. Mr. Warren stressed responding to citizens' the importance concerns. of Board members 17.
