August 27, 2008 BS Bermuda Magisterial District Southwest quadrant of Chester and Perrymont Roads RE VEST: Amendment to rezoning (Case 98SN0196) relative to access. PROPOSED LAND USE: A second access to Perrymont Road for proposed commercial development is planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITION ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reason: The requested second access should result in no adverse impact on existing or anticipated area development. (NOTE: THE ONLY CONDITION THAT MAY BE IMPOSED IS A BUFFER CONDITION. THE PROPERTY OWNER(S) MAY PROFFER OTHER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) Providing a FIRST CHOICE community through excellence in public service PROFFERED CONDITION (STAFF/CPC) Direct vehicular access from the property to Perrymont Road shall be limited to two (2) entrances/exits. The exact location of these accesses shall be approved by the Transportation Department. (T) (Staff Note: This Proffered Condition Supersedes Proffered Condition 4 of Case 98SN0196. All other conditions of approval for case 98SN0196 remain in effect.) GENERAL INFORMATION T ,n~ati nn Located in the southwest quadrant of the intersection of Chester and Perrymont Roads. Existing Zoning: C-5 Size: 6.6 acres Existing Land Use: Commercial or Vacant Adjacent Zoning and Land Use: North - C-3; Commercial or single-family residential South - R-7 and C-3; Public/semi-public (School Board) or single-family residential East - C-3 and C-5; Mobile home park, single-family residential, commercial or vacant West - R-7; CSX Railroad or single-family residential UTILITIES AND ENVIRONMENTAL The requested amendment will have no impact on these facilities. PUBLIC FACILITIES Fire ~PrvicP~ The requested amendment will have no impact on these facilities. 2 08SN0252-AUG27-BOS-RPT Transportation: In July 1998, the Board of Supervisors approved a rezoning request (Case 98SN0196) on these three (3) parcels, totaling 6.6 acres, which allows General Business (C-5) uses on the property. Approximately 2.5 acres of the property is within a resource protection area (RPA). In conjunction with that zoning approval, the Board accepted a proffered condition that limited direct vehicular access from the property to Perrymont Road to one (1) entrancelexit (Proffered Condition 4 of Case 98SN0196). Subsequent to that zoning approval, the existing residential structure, mostly located within the RPA, was converted into a commercial use, and the existing driveway onto Perrymont Road continued to be utilized. The applicant is requesting an amendment to that zoning case to allow an additional vehicular access to Perrymont Road (Proffered Condition). Approval of this request will allow the existing driveway onto Perrymont Road to remain, and a new vehicular access to be provided to serve future development. The Transportation Department supports this request. The Virginia Department of Transportation's (VDOT) "Chapter 527" regulations, dealing with development Traffic Impact Study requirements, have been enacted. At this time, it is uncertain what impact VDOT's regulations will have on the development process or upon zonings approved by the county. The applicant has indicated that a Chapter 527 Traffic Study is not required for this zoning request. T ,ANn T T~F, Comprehensive Plan: Lies within the boundaries of the Jefferson Davis Highway Corridor Plan which suggests the property is appropriate for general commercial use. The Plan suggests the southwest corner of the site is appropriate for residential development at a density of 2.51 to 4.0 units per acre; however, that property is physically separated from other properties along Chester Road designated for residential use by a substantial floodplain and RPA. Area Development Trends: Adjacent properties to the north, east and south which front on Perrymont Road have been zoned for commercial uses and developed for a mixture of uses, to include commercial, single family residential, a mobile home park and public/semi-public uses, or remain vacant. Adjacent properties to the north and west, fronting on Chester Road and the CSX Railway right of way, are zoned for residential and commercial uses and have been developed for single family residential uses. The Plan anticipates properties along Perrymont Road will be developed for non-residential uses and properties along Chester Road will be developed for residential uses. 3 08SN0252-AUG27-BOS-RPT Zonin H.~X: On July 29, 1998, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved C-5 zoning on the request property (Case 98SN0196). With approval of Case 98SN0196 conditions were approved which, among other requirements, limited access to Perrymont Road to one (1) entrance/exit. Development Standards: Currently, the request property lies within the Jefferson Davis Highway Corridor District. The purpose of highway corridor district standards, is to enhance patterns of development Redevelopment of the site or new construction must conform to the requirements of the Zoning Ordinance, which address access, parking, landscaping, architectural treatment, setbacks, signs, buffers, utilities, and screening of dumpsters and loading areas. CONCLUSION The requested second access should result in no adverse impact on existing or anticipated area development. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (7/15/08): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Hassen, seconded by Mr. Bass, the Commission recommended approval and acceptance of the proffered condition on page 2. AYES: Messrs. Gulley, Bass, Brown, Hassen and Waller.
