REQUEST: Revocation of Conditional Use Planned Development (Case 97SN0205) permitting
a 190 foot communications tower in an Agricultural (A) District (Case 97SN0205).
PLANNING COMMISSION RECOMMENDATION
RECOMMEND REVOCATION.
STAFF RECOMMENDATION
Recommend revocation for the following reason:
This site is located in a denuded area that would be highly visible to the East Hundred
Road/Route 1-295 interchange. A more suitable tower location which has received zoning
and Substantial Accord approval exists on adjacent; agricukurally zoned property that is
densely wooded with mature trees and that will be less visible from the travel lanes of East
Hundred Road and Route 1-295.

This revocation will have no impact on these facilities.
LAND USE
Comprehensive Plan:
The request property lies within the boundaries of the Meadowville Area Plan which suggests
the property is appropriate for mixed use transitional uses.
Zoning History:
On July 23, 1997, the Board of Supervisors approved a request for a Conditional Use Planned
Development to permit a 190 foot communications tower on this site (Case 97SN0205).
Staff recommended denial of this ske because of the denuded condkion of the ske and the
visibility of the tower to the East Hundred Road/Route 1-295 interchange. Subsequently, the

Board approved another site in the vicinity that is more sukable because k is densely wooded
and will be less visible from the travel lanes of East hundred Road and Route 1-295.
Subsequently, the Planning Commission voted to inkiate a zoning application to revoke the
previously granted Conditional Use Planned Development, Case 97SN0205, and a previously
granted Substantial Accord Determination, Case 97PD0257. The applicant for Case
97SN0265 has indicated that he does not object to this proposed revocation.
CONCLUSIONS
On July 23, 1997, the board approved a request for a Conditional Use Planned Development, (Case
97SN0205), for a 190 foot communications tower on this site. This site is located within the
boundaries of the Meadowville Area Plan. The tower site is located in a denuded area that would be
highly visible to the East Hundred Road/Route 1-295 interchange and staff recommended denial of
this tower request when it was originally before the Planning Commission and Board of Supervisors.
A more suitable tower location exists on adjacent agricukurally zoned property that is densely
wooded with mature trees and that will be less visible from the travel lanes of East Hundred Road
and Route 1-295. The Board approved a Conditional Use Planned Development to permit a 185 foot
communications tower at this more sukable location (Case 98SN0180). In order to eliminate the
opportunity to have two (2) tower sites wkhin such close proximky of each other, revocation of the
Condkional use Planned Development (Case 97SN0205) is necessary.
Given these conskterations, revocation of the Conditional Use Planned Development is recommended.
CASE HISTORY
Planning Commission Meeting (4/20/99):
There was no opposkion present. On motion of Mr. Cunningham, seconded by Mr. Marsh,
the Commission recommended revocation.
AYES: Unanimous.
Further, for the reasons stated herein, the Commission revoked the Substantial Accord. The
Code of Virginia grants the Board the authority to "overrule the action of the Commission
by a vote of the majority."
The Board of Supervisors, on Tuesday, May 25, 1999, beginning at 7:00 p.m., will take under
consideration this request.

In Bermuda Magisterial District, CHESTERFIELD COUNTY
PLANNING COMMISSION proposed revocation of Conditional Use
Planned Development (Case 97SN0205} and amendment of zoning
district map which permitted a 190 foot communications tower
in an Agricultural (A} District. The density of such
amendment will be controlled by zoning conditions or
Ordinance standards. The Comprehensive Plan suggests the
property is appropriate for mixed use transitional use.
This request lies on 0.4 acre fronting approximately 30 feet
on the north line of East Hundred Road, also fronting
approximately 900 feet east of Route I 295 and located in
the vicinity of the northeast quadrant of the intersection
of these roads. Tax ID 822 649 Part of 6672, 8054, 8844,
9317, 9336 and 4479 (Sheet 42).
Mr. Jacobson presented a summary of Case 99SN0246 and stated
that Planning Commission and staff recommend revocation due
to the tower site being highly visible to the East Hundred
Road/Route I 295 interchange and a more suitable tower
location which has received zoning and Substantial Accord
approval being less visible from East Hundred Road and Route
I 295.
Mr. Jacobson, representing the applicant, stated that the
recommendation for revocation is acceptable.
There was no opposition to the revocation.
On motion of Mr. McHale, seconded by Mrs. Humphrey, the
Board revoked the Conditional Use Planned Development (Case
97SN0205) permitting a 190 foot communications tower in an
Agricultural (A) District (Case 97SN0205).
Ayes: Daniel, Warren, Barber, Humphrey, and McHale.
Nays: None.
