Bermuda Magisterial District West line of Jefferson Davis Highway Conditional Use Planned Developmem to permit a motor vehicle repair business in a Light Industrial (I-1) District. pROPOSED LAND USE: The applicant plans to locate a motor vehicle repair business within an existing building on the property, on a temporary basis. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: The proposed land use conforms with the Jefferson Davis Highway Corridor Plan which suggests the property and surrounding area are appropriate for general commercial use. Providing a FIRST CHOICE Community Through Excellence in Public Service. The proposed land use is compatible with, and representative of, existing and anticipated commercial development along this portion of the Jefferson Davis Highway Corridor. (NOTE: CONDITIONS MAY BE IMPOSED OR ~ PROPERTY OWNER MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) PROFFERED CONDITIONS (STAFF/CPC) 1. This Conditional Use Planned Development shall be granted for a period of 1 year from the date of approval. This Conditional Use Planned Development shall be limited to the use of the existing building. There shall be no expansion of the existing building to accommodate this use. GENERAL INFORMATION Lies on the west line of Jefferson Davis Highway, across from Pinehurst Street. Tax ID 795-664-1890 (Sheet 26). Size: I-1 with Conditional Use Planned Development 30.1 acres Industrial 99SN0271/WP/MAY25N Ac[iacent Zoning & Land Use: North - C-5; Commercial South - A and C-3; Commercial or vacant East - C-3 and C-5; Commercial or vacant West - A; Single family residential or vacant UTILITIES Public Water System: There is an existing eight (8) inch water line extending along Jefferson Davis Highway adjacent to the request site. It is the intent to utilize the existing building which is connected to the public water system. Use of the public water system is required by County Code. Public Wastewater System: There is an existing forty-two (42) inch wastewater trunk line extending along Proctors Creek, approximately fifty (50) feet south of the request site. It is the intent to utilize the existing building on this site, which is connected to a private wastewater septic system. Pursuant to Section 18-60 (c) of the County Code, whereby the applicant will not be applying for a building permit for a new structure, use of the public wastewater system is not required. ENVIRONMENTAL Drainage and Erosion: The requested amendment will have no additional impact on these facilities. PUBLIC FACILITIES Fire Service: The proposed motor vehicle repair business will have minimal impact on fire/rescue services. Transportation: The applicant has proffered that the requested use (motor vehicle repair) will be limited to the existing building for a period of one (1) year (Proffered Conditions 2 & 3). This 3 99SN0271/WP/MAY25N proposed use of the existing building will have a minimal impact on the existing transportation network. The property is located within the Jefferson Davis Highway Enterprise Zone. Based on the Board of Supervisors' Policy regarding development within the Enterprise Zone, no road improvements will be required by the County. Comprehensive Plan: LAND USE Lies within the boundaries of the Jefferson Davis Hiehway Corridor Plan which suggests the property is appropriate for general commercial use. Area Development Trends: Adjacent properties to the north and east and a portion of adjacent property to the south are zoned and developed for commercial uses or remain vacant. The remaining adjacent property to the south and property to the west is zoned agriculturally and is occupied by a single family residential use or is vacant. It is anticipated that general commercial uses will continue along the west line of this portion of the Jefferson Davis Highway Corridor, while a mix of uses to include commercial, office and light industrial and/or high density residential is suggested for the east line of the corridor. On May 28, 1975, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved a Conditional Use Planned Development to permit outside storage of construction equipment on the request property (Case 75S084). At one point, Owsley Equipment Company was located on the site. Site Design: Architectural Treatment: Buffers and Screening: The request property lies within the Jefferson Davis Highway Northern Area Post Development Area. The applicant has agreed to limit the proposed use to the existing structure (Proffered Condition 3). CONCLUSIONS The applicant desires to temporarily relocate this business which is currently located Perrymont Road (Proffered Conditions 1 through 3). The relocation is necessary to accommodate construction at the Perrymont Road site. In addition the proposed land use is compatible with, and representative of, existing and anticipated commercial development along this portion of the Jefferson Davis Highway Corridor. CASE HISTORY Planning Commission Meeting (5/18/99): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Cunningham, seconded by Mr. Shewmake, the Commission recommended approval of this request and acceptance of the proffered conditions on page 2. AYES: Messrs. Gulley, Cunningham, Marsh and Shewmake. D ~, 26 [ 99SN0271 In Bermuda Magisterial District, EXPRESS MUFFLER, INC. requested Conditional Use Planned Development and amendment of zoning district map to permit a motor vehicle repair facility in a Light Industrial (I 1) District. The density of such amendment will be controlled by zoning conditions or Ordinance standards. The Comprehensive Plan suggests the property is appropriate for general commercial use. This request lies on 30.1 acres fronting approximately 1,550 feet on the west line of Jefferson Davis Highway, across from Pinehurst Street. Tax ID 795 664 1890 (Sheet Mr. Jacobson presented a summary of Case 99SN0271 and stated that Planning Commission and staff recommend approval and acceptance of the proffered conditions. 5/25/99 99 496 Ms. Lisa Bailey, representing the applicant, stated that the recommendation is acceptable. There was no opposition present. On motion of Mr. McHale, seconded Board approved Case 99SN0271 and proffered conditions: 1.
