REQUEST: Amendment to Conditional Use Planned Development (Case 97SN0150) relative
to hours of operation for a police district station.
PROPOSED LAND USE:
The Chesterfield County Police Department plans to lease a structure (to be built)
for a south police district station to provide 24-hour service to the southern area of
the County.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2.
STAFF RECOMMENDATION
The conditions of zoning related to limited hours of operation were negotiated at the time of the
original zoning with area property owners. After consideration of public input, should the
Commission and Board wish to approve this amendment, imposition of the condition would be
appropriate.

UTILITIES
Public Water and Wastewater Systems:
The public water and wastewater systems are available to serve the request site. Use of
the pnblic water and wastewater systems is required by conditions of zoning approval.
Drainage and Erosion:
The proposed amendment will have no additional impact on these facilities.

Fire Service:
This property is currently served by the Dutch Gap Fire/Rescue Station, Company Number
t4 and Bensley-Bermuda Rescue Squad. When the property is developed, the number of
hydrants and quantity of water needed for fire protection will be evaluated during the plans
review process.
Transportation:
The subject property is part of a 9.9 acre parcel (Case 97SN0150) that was zoned by the
Board of Supervisors in July 1997. With that zoning approval, the Board accepted several
transportation-related proffers. One (1) of those proffered conditions (Proffered Condition
20) established a maximum density of development for the 9.9 acre project.
Since that rezoning, a 22,042 square foot post office is being developed on the property.
This request, a specific amendment to the hours of operation, will allow a police district
station to be developed on the property. The post office and the proposed police district
station densities will be applied to the maximum density allowed within the 9.9 acre
project. Based on post office trip rates and staff's estimates of trip generation for a police

station, a 3,000 square foot convenience market, or an equivalent traffic generator, could
be developed on the remaining property.
At time of site plan review, staff will cominue to evaluate the trip generation and internal
circulation for this project.
LAND USE
Comprehensive Plan:
The request property lies within the boundaries of the Chester Village Plan which suggests
the property is appropriate for neighborhood commercial use. Neighborhood conunercial
uses include office uses.
Area Development Trends:
The request property lies along a portion of West Hundred Road characterized by
commercial zoning and land uses in the vicinity of the West Hundred Road/Jefferson Davis
Highway intersection to the east. Public/semi-public uses exist to the northeast and south,
to include a small cemetery along the east line of Rock Hill Road, north of West Hundred
Road, a larger cemetery on the south, a YMCA and a Chesterfield County Fire Station.
The Chester Post Office lies to the north and corrgnercial uses are proposed to the east.
A funeral home lies to the west along West Hundred Road, transitioning to the Village of
Chester further west.
Zoning History:
On July 23, 1997, the Board of Supervisors approved rezoning with Conditional Use
Planned Development (Case 97SN0150) on the subject property and surrounding area to
permit a neighborhood shopping area with last-food restaurants and gasoline sales. With
approval of Case 97SN0150, proffered conditions that had been negotiated with area
residents were accepted to address land use compatibility, access, architectural treatment,
utilities, timbering, transportation improvements, lighting, buffers, traffic density and
hours of operation.
Current Proposal:
The police district station will provide all the necessary services for officer support, except
auto maintenance and booking. No prisoners will he housed on site. This facility will
increase police presence in the area, facilitate officers' efficiency and provide more
opportunities for the community to interact with the police. The request property is part
of a larger parcel on which a Conditional Use Planned Development was granted. As part
of that case, a proffered condition prohibiting uses on the property from being open to the

public between 12:00 midnight and 6:00 a. m. was accepted (Condition 17). The Police
Department is requested an amendment to this condition to permit 24-hour operation of
their police district station.
CONCLUSIONS
At the time of the original zoning, numerous conditions, including the condition relating
to hours of operation, were negotiated between the applicant and area property owners.
Should the Commission wish to approve this amendment to the condition relating to hours
of operation, imposition of the condition (Condition) would be appropriate. This
amendment will not aftbct the hours limitation for other uses on the request property or the
remaining part of the property which was the subject of the original zoning.
CASE HISTORY
Planning Commission Meeting (8/17/99):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Cmmingham, seconded by Mr. Marsh, the Commission recommended
approval subject to the condition on page 2.

Further, for the reasons stated herein, the Commission found this request substantially in accord
with the Comprehensive Plan. The Code of Virginia, as amended, grants the Board the authority
to "overrule the action of the Commission by a vote of the majority of the membership thereof."
The Board of Supervisors, on Wednesday, August 25, 1999, beginning at 7:00 p.m., will take
under consideration this request.

In Bermuda Magisterial District, CHESTERFIELD COUNTY POLICE
DEPARTMENT requested amendment to Conditional Use Planned
Development (Case 97SN0150} and amendment of zoning district
map relative to hours of operation for a police station.
The density of such amendment will be controlled by zoning
conditions or Ordinance standards. The Comprehensive Plan
suggests the property is appropriate for neighborhood
commercial use. This request lies in a Neighborhood
Business (C 2) District on 2.2 acres, fronting approximately
400 feet on the north line of West Hundred Road,
approximately 450 feet west of Rock Hill Road. Tax ID 797
655 Part of 3207 (Sheet 26).
Mr. Jacobson presented a summary of Case 99SN0310 and stated
that Planning Commission and staff recommend approval
subject to one condition.
Commander Louis Moore, representing the applicant, stated
that the recommendation is acceptable.
There was no opposition present.
After brief discussion, on motion of Mr. McHale, seconded by
Mr. Warren, the Board approved Case 99SN0310 subject to the
following condition:
Any police district station located on the Property may
remain open to the public twenty four (24) hours per day.
