REQUEST: Rezoning from Light Industrial (I-1) to General Business (C-5).
PROPOSED LAND USE:
Continued operation of an existing contractor's office is planned; however, with approval
of this request other C-5 uses, except as restricted by Proffered Condition 3, would be
permitted.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON

STAFF RECOMMENDATION
Recommend approval for the following reasons:
A. The proposed zoning and land uses conform with the Jefferson Davis Corridor Plan which
suggests the property is appropriate for general commercial use.
B. The proposed zoning and land uses are compatible with, and representative of, existing and
anticipated non-residential development along this portion of the Jefferson Davis Highway
Corridor.
(NOTE: THE ONLY CONDITION THAT MY BE IMPOSED IS A BUFFER CONDITION. THE
PROPERTY OWNER MAY PROFFER OTHER CONDITIONS. THE CONDITIONS NOTED
WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION.

PUBLIC FACILITIES
Public Water and Wastewater Systems:
Use of the public water and wastewater systems are required by County Code. The existing
building on the request site is connected to the public water and wastewater systems.
Fire Service:
The Public Facilkies Plan indicates that Emergency Services calls are expected to increase forty-
five (45) percent by the year 2015. Eight (8) new fire/rescue stations are recommended for
construction by the year 2015 in the Public Facilities Plan.
This property is currently served by the Bensley Fire/Rescue Station, Company Number 3 and
Bensley-Bermuda Rescue Squad.

Transportation:
This request will not limit development to a specific land use; therefore, k is difficult to anticipate
traffic generation. Based on retail trip rates, development could generate approximately 750
average daily trips. These vehicles will be distributed via Metro Court and Norcliff Road to
Jefferson Davis Highway (Route 1/301) which had a 1997 traffic count of 17,896 vehiclesper day.
The Thoroughfare Plan identifies Route 1/301 as a major arterial with a recommended right of way
width of 120 to 200 feet. The applicant has proffered to dedicate sixty (60) feet of right of way
measured from the centerline of Route 1/301, in accordance with that Plan. (Proffered Condition
1)
Development must adhere to the Zoning Ordinance relative to access and internal circulation
(Division 5). Access to major arterials, such as Route 1/301, should be controlled. The applicant
has proffered that no direct access will be provided from the property to Route 1/301. (Proffered
Condkion 2)
The property is located within the Jefferson Davis Enterprise Zone. Based on the Board of
Supervisors' Policy regarding development within the Enterprise Zone, no road improvements will
be required by the County. At time of site plan review, specific recommendations will be provided
regarding internal circulation.
LAND USE
Comprehensive Plan:
Lies wkhin the boundaries of the Jefferson Davis Corridor Plan which suggests the property is
appropriate for general commercial use.
Area Development Trends:
Area properties have been zoned and developed for commercial and industrial uses or remain
vacant. It is anticipated that these type of uses will continue along this portion of the corridor.
Ske Design:
The request property lies within the Jefferson Davis Highway Corridor District and a Post
Development Ama. Redevelopment of the ske must conform to the requirements of the Zoning
Ordinance for these areas which address access, parking, landscaping, archkectural treaunent,
setbacks, signs, buffers, utilkies, and screening of dumpsters and loading areas.

CONCLUSIONS
The proposed zoning and land uses conform with the Jefferson Davis Corridor Plan which suggests the
property is appropriate for general commercial use. In addition, the proposed zoning and land uses am
compatible with, and representative of, existing and anticipated development along this portion of the
Jefferson Davis Highway Corridor.
Given these considerations, approval of this request is recommended.
CASE HISTORY
Planning Commission Meeting (8/17/99):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Cunningham, seconded by Mr. Shewmake, the Commission recommended
approval of this request and acceptance of the proffered conditions on page 2.
AYES: Unanimous.
The Board of Supervisors, on Wednesday, September 8, 1999, beginning at 7:00 p.m., will take under
consideration this request.

In Bermuda Magisterial District, MICHAEL WIRT requested
rezoning and amendment of zoning district map from Light
Industrial (I 1} to General Business (C 5}. A contractor's
shop is planned. However, with approval of this request,
other C 5 uses would be permitted. The density of such
amendment will be controlled by zoning conditions or
Ordinance standards. The Comprehensive Plan suggests the
property is appropriate for general commercial use. This
request lles on .5 acre known as 8807 Metro Court. Tax ID
792 672 6569 (Sheet 18).
Mr. Jacobson presented a summary of Case 99SN0303 and stated
that Planning Commission and staff recommend approval and
acceptance of the proffered conditions. He noted that the
proposed development conforms to the Jefferson Davis
Corridor Plan.
Mr. Mike Wirt stated that the recommendation is acceptable.
There was no opposition present.
On motion of Mr. McHale, seconded by Mr. Barber, the Board
approved Case 99SN0303 and accepted the following proffered
conditions:
