Board of Supervisors Bermuda Magisterial District Hillside Manufactured Home Subdivision RE VEST: Conditional Use Planned Development to permit exceptions to Ordinance requirements relative to setbacks for structures open on three (3) sides. PROPOSED LAND USE: A manufactured home subdivision has been developed on a portion of the request property. The remainder of the property is to be developed for manufactured home subdivision use as well. A number of existing residents have built structures which are in violation of required setbacks. PLANNING COMMISSION RECOMMENDATION RECOMMENDED APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. This proposal poses no significant detriment to the neighborhood. B. The existing structures have not adversely impacted the neighborhood. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS AND BOS NOTE. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. (P) GENERAL INFORMATION T ,n~ati nn All lots within the boundaries of the Hillside Manufactured Home Subdivision plus Tax IDs 802-628-1812 and 802-629-5207, lying east of the Seaboard Coast Line Railroad, across from Pine Forest Drive. Existing Zoning: MH-2 Size: 91.2 acres Existin Land Use: Manufactured home subdivision or vacant Adjacent Zoning and Land Use: North - A and I-3; Industrial South - A; Vacant East - A; Industrial and City of Colonial Heights West - R-7, A and C-4; Single-family residential, commercial or vacant UTILITIES; ENVIRONMENTAL; AND PUBLIC FACILITIES This request will have no impact on these facilities. Comprehensive Plan: Lies within the boundaries of the Southern Jefferson Davis Corridor Plan which suggests the property is appropriate for community commercial/mixed use corridor use. 2 08SN0269-SEP24-BOS-RPT Area Development Trends: With the exception of Hillside Subdivision, the area is characterized by industrial development and vacant property north and east of the request site as well as property located in the City of Colonial Heights southeast across Swift Creek. Property to the south is vacant and properties to the west, across the CXS Railroad right-of way, are occupied by single-family residences in the Boulevard Heights subdivision and commercial uses or remain vacant. Development Standards: The Zoning Ordinance requires structures open on at least three (3) sides to meet minimum yard standards. It does allow for some of these structures to occupy or project into the required yards in some instances. Several such structures have been erected in the Hillside Manufactured Home Subdivision and do not meet the required setbacks. This proposal is to eliminate the setback requirements for these structures in the developed and undeveloped sections of Hillside Manufactured Home Subdivision. If this proposal is approved, setback requirements will not apply to structures open on at least three (3) sides. CONCLUSION The proposed exception would pose no significant detriment to the neighborhood. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (8/19/08): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Hassen, seconded by Mr. Bass, the Commission recommended approval subj ect to the Condition on page 2. AYES: Messrs. Gulley, Bass, Brown, Hassen, and Waller.
