RECOGNIZING MR. CHARLES TUCKER UPON HIS RETIREMENT
WHEREAS, Mr. Charles Tucker retired from the Chesterfield County
Juvenile Detention Home on October 1, 2008, after providing over 35 years of
quality service to the citizens of Chesterfield County; and
WHEREAS, Mr. Tucker has faithfully served the county in the capacity of
Deputy Superintendent, Assistant Superintendent, and Superintendent of
Secure Detention; and
WHEREAS, Mr. Tucker served as Acting Director of Chesterfield Juvenile
Detention Home on two occasions and also served as Acting Co-Director of the
Crater Detention Center; and
WHEREAS, Mr. Tucker has received numerous letters of thanks and
appreciation for service rendered from the citizens of Chesterfield County;
and
WHEREAS, Mr. Tucker was very active for many years in youth sports in
Chesterfield County, and has provided the Chesterfield Juvenile Detention
Home with many years of loyal and dedicated service; and
WHEREAS, Mr. Tucker has served on numerous detention home audits
representing Chesterfield County statewide; and
WHEREAS, Mr. Tucker has represented Chesterfield County on numerous
Department of Juvenile Justice committees throughout the evolution of the
Juvenile Justice System for the State of Virginia; and
WHEREAS, Mr. Tucker has contributed to the community through his years
as a Chester Association girls softball coach, Gates Association girls
basketball coach, and AAU girls basketball coach; and
WHEREAS, Mr . Tucker has served as a member of the L . C . Bird High
School Band Boosters and the L.C. Bird High School Athletic Boosters; and
WHEREAS, Mr. Tucker served as the president of the Apamatica
Neighborhood Association; and
WHEREAS, Mr. Tucker has further served the youths of Chesterfield
County through his work as a youth mentor, scholarship foundation workshop
coordinator, and Brotherhood men's ministry; and
WHEREAS, Chesterfield County and the Board of Supervisors will miss Mr.
Tucker's diligent service and the contributions he made to the youths of
Chesterfield County.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 8th day of October 2008, publicly recognizes Mr. Charles
Tucker, and extends on behalf of its members and the citizens of
Chesterfield County, appreciation for his service to the county,
congratulations upon his retirement, and best wishes for a long and happy
retirement.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented
to Mr. Tucker, and that this resolution be permanently recorded among the
papers of this Board of Supervisors of Chesterfield County, Virginia.

Board Action Requested:
The Chesterfield County Domestic Violence Resource Center, county domestic
violence task force and service providers request the Board proclaim October
2008, as "Domestic Violence Awareness Month."
Summary of Information:
Domestic Violence Awareness Month is observed in Chesterfield County and
nationwide as a gesture to draw attention to the harsh reality of violence in
the home and the work being done to end this violence. Activities throughout
the month will remember those who have lost their lives as a result of
domestic violence, celebrate those who survive, and support those who work
all year to provide safety and support to victims and their children.
County domestic violence staff, service providers and citizens request the
attached resolution be adopted and presented to Patricia Jones-Turner,
Chesterfield Domestic and Sexual Violence Resource Center Coordinator, and
members of the Chesterfield County Domestic Violence Task Force.

"DOMESTIC VIOLENCE AWARENESS MONTH"
WHEREAS, violence in the home continues as a major social
problem affecting all members of the family and community and
dramatically reduces the quality of life for many citizens;
and
WHEREAS, we understand the problems of domestic violence
occur among people of all ages and in families of all
economic, racial, and social backgrounds; and
WHEREAS, the crime of domestic violence violates an
individual's privacy, dignity, security, and humanity, due to
systematic use of physical, emotional, sexual, psychological
and economic control and abuse; and
WHEREAS, the impact of domestic violence is wide ranging,
directly affecting women, men and their children and our
community as a whole; and
WHEREAS, Chesterfield County is committed to supporting
the well being of families by advocating for intervention and
prevention activities that decrease the incidents of domestic
violence; and
WHEREAS, only a coordinated and integrated effort, which
obtains a commitment from all elements of the community to
share responsibility in the fight against domestic violence,
will put an end to this horrific crime.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield
County Board of Supervisors, this 8th day of October 2008,
publicly recognizes October 2008, as "Domestic Violence
Awareness Month" and urges all citizens to actively support
the efforts of the Chesterfield County Domestic and Sexual
Violence Resource Center, the Chesterfield Domestic Violence
Task Force and our local domestic violence service providers
in working towards the elimination of domestic violence in our
community.

2007 GET THE FACTS:
DOMESTIC AND SEXUAL VIOLENCE IN
CHESTERFIELD COUNTY, VIRGINIA
Chesterfield County's coordinated Response to Domestic and Sexual Violence is an
interagency effort working to change the climate of tolerance toward family abuse by
integrating policies and procedures which centralize victim safety and offender
accountability in domestic assault cases. Chesterfield County recognizes the need to assess
and document the current state of domestic violence and sexual assault in the county and to
develop collaborative plans for intervening. This annual fact sheet gives the community a
glimpse of the roblem of domestic and sexual violence in our communi
A ency Services
In 2007 The Chesterfield County Police Department reported 10 homicides; three of
these were domestic violence related. There were 8,073 domestic related calls for
service. Police responded to 1,568 domestic assault calls and made 1,234 arrests for
domestic assault, stalking, and violation of protective order. Domestic violence
training was provided to 868 people, including 7231aw enforcement officers.
In 2007 the Chesterfield Commonwealth's Attorney's Office prosecuted
approximately 1,073 domestic violence related cases which included felony and
misdemeanors that involved malicious wounding, abduction, 3rd offense domestic
violence assault and battery, assault and batter, violation of protective order,
violation of probation, threatening phone calls, stalking, larceny and sexual assaults.
The Commonwealth's Attorney's Office provided 3 domestic violence trainings to
approximately 95 personnel.
In 2007 the Victim/Witness Assistance Program assisted 985 domestic violence
victims, with direct services such as crisis intervention, case status and court
information, jail notifications, employer intercession and court escorts. 251 victims
used the Pro Bono Attorney Protective Order Project, which links victims to free
legal representation for protective hearings. Cell phones were provided to 30
victims.
In 2007 Victim Witness Sexual Assault Coordinator served 344 clients, 83% of the
clients were children under 18 (284 clients) and 17% of the clients were adults (60
clients). Sexual assault victimization includes sexual battery, rape, sodomy, carnal
knowledge, indecent exposure, indecent liberties, aggravated sexual battery, object
sexual penetration and solicitation by electronic means.
In 2007 The Chesterfield County Domestic and Sexual Violence Resource Center
provided direct services to 1,253 victims, including legal advocacy crisis counseling,
safety planning, community referrals, court accompaniment and

information/resources to victims of offenders supervised by Community Correction
Services. Civil court accompaniment was provided for 197 victims and 289 clients
received non-crisis counseling services.
In 2007 the Community Corrections and Pretrial Services Domestic Violence Unit
received over 450 referrals from Juvenile and Domestic Court and over 201 received
Pre trial services.
In 2007 The Chesterfield County Sheriff s Office served 437 preliminary and
permanent protective orders.
In 2007, Chesterfield County Mental Health Support Services, Prevention
Department's REACT (Referral and Education to Assist Children in Trauma)
program received 114 referrals. 109 referrals came from 561aw enforcement
officers and the rest came from other sources, including Chesterfield County Public
Schools, the Chesterfield County Police DV Coordinator, Victim/Witness Assistance
Program, YWCA, and the Domestic and Sexual Violence Resource Center. The
referrals represented 206 children who were present during violence. Of those, 131
children were reported to be between the ages of 4 and 17 years. These children
have witnessed parents or other loved ones involved in a domestic dispute.
In 2007 in Chesterfield County, the YWCA shelter provided 4,386 nights of shelter
to 107 women and 120 children seeking safety from abusive relationships. The
YWCA 24-hour hot line received over 3,100 calls for service, including crisis
intervention, counseling, information, referrals, and requests for shelter.
Trainin
In 2007, The Chesterfield County Domestic and Sexual Violence Resource Center
(DSVRC) provided 10 training sessions to 440 allied professionals and volunteers
about domestic and sexual violence. DSVRC, the Hispanic, Latino, Immigrant
Task Force, and the Chesterfield Domestic Violence Task Force, in conjunction with
New Life Outreach Christian Ministries sponsored a public awareness event for
Domestic Violence Awareness month entitled, El Dia De La Familia Hispana that
provided information to 300 people. The Domestic Violence Monologues, "The
Heart of the Matter; A Journey Towards Healing" gave 4 performances, reaching
over 160 people.
In 2007, the Chesterfield County Domestic Violence Task Force, Inc. provided three
mini-trainings: Mild Brain Trauma and Domestic Violence, Fort Lee's Victim
Advocacy Services, and Stalking. Over 160 individuals participated in these
trainings.

Awareness
In October, Domestic Violence Awareness Month activities included the El Dia De
La Familia Hispana sponsored by the Hispanic, Latino, and Immigrant Task Force
(a subcommittee of the Chesterfield County Domestic Violence Task Force), the
Board of Supervisor's proclamation declaring October as Domestic Violence
Awareness month was signed, the Chesterfield Domestic Violence Task Force
contributed to an article on Domestic Violence in Style Weekly, and The Public
Awareness Committee of the Chesterfield County Domestic Violence Task Force
distributed an informational flyer entitled "Children Who Witness Domestic
Violence to over 9,000 Chesterfield County employees. The Domestic Violence
Monologues, "The Heart of the Matter; A Journey Towards Healing" gave 4
performances, reaching over 160 people.
Domestic Violence in Vir inia
In 2005, 6,012 domestic violence programs in Virginia provided 233,159 nights of
shelter. 2,367 families asked for shelter but could not be served due to lack of space,
responded to 43,409 family violence hotline calls, provided advocacy to 3,352
children. Of these children 60% witnessed violence in their family, 26% had been
emotionally abused or neglected, 17% had been physically abused, 10% had been
sexually abused, and 10% had been physically neglected. In 2003, 57 Virginians
were killed by an intimate partner, 32 Virginians died in intimate partner related
homicides and 67 children witnessed or heard a family or intimate partner related
homicide occur or found the homicide victim. Programs provided 114,055 hours of
advocacy services to family violence victims, 27,146 hours of advocacy services to
sexual assault victims and 18,024 hours of advocacy services to stalking victims.
Advocates provided 48,481 hours of legaUcourt advocacy to 3,022 victims.

Adopt resolution recognizing October 2008, as "Cyber Security Awareness
Month."
Summary of Information:
The US Department of Homeland Security (DHS) National Cyber Security Division
(NC5D) is the head agency that leads an annual National Cyber Security
Awareness Month outreach campaign to empower all Americans and businesses to
take steps to secure their part of cyberspace. Events planned throughout the
month in states and localities across the country are intended to raise
awareness of the growing need to protect our nation's critical
infrastructures and key resources from cyber threats and vulnerabilities. The
theme for the 2008 campaign is: "National Cyber Security Awareness Month -
Protect Yourself Before You Connect Yourself."
To recognize and promote awareness of these important cyber security issues,
Chesterfield County and the Information Systems Technology Department will
present a Cyber Security Fair on October 24, 2008, and several Internet
safety seminars will be presented at the Chesterfield County Libraries during
the month of October.

RECOGNIZING OCTOBER 2008, AS "CYBER SECURITY AWARENESS
MONTH" IN CHESTERFIELD COUNTY
WHEREAS, many citizens, schools, libraries, businesses and
other organizations use the Internet for a variety of tasks,
including keeping in contact with family and friends, managing
finances, conducting research, enhancing education and conducting
business; and
WHEREAS, critical sectors are increasingly reliant on
information systems to support financial services, energy,
telecommunications, transportation, health care, and emergency
response systems; and
WHEREAS, Internet users and our information infrastructure
face an increasing threat of malicious attack by viruses and loss
of privacy from spyware and adware; and
WHEREAS, each year there are significant financial and
personal privacy losses due to identity theft and fraud; and
WHEREAS, the Multi-State Information Sharing and Analysis
Center (MS-ISAC) was established in January 2003 to provide a
collaborative mechanism to help states and local governments
enhance cyber security, and Chesterfield County Information Systems
Technology provides a comprehensive approach to help enhance the
security of this county; and
WHEREAS, there are national organizations, such as the non-
profit National Cyber Security Alliance (NCSA), policymakers,
government agencies, private sector companies, and non-profit
entities helping consumers, businesses, educational leaders and our
youth to protect themselves online; and
WHEREAS, each one of us plays an important role in securing
our cyberspace, and awareness of computer security essentials will
improve the security of Chesterfield County information
infrastructure and economy; and
WHEREAS, the United States Department of Homeland Security,
the Multi-State Information Sharing and Analysis Center and the
National Cyber Security Alliance have declared October as National
Cyber Security Awareness Month.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Chesterfield County, this 8th day of October 2008, publicly
recognizes October 2008, as "Cyber Security Awareness Month" in
Chesterfield County, encourages its citizens to learn about cyber

Request that the Board of Supervisors nominate and appoint members to serve
on the Citizen's Budget Advisory Committee.
Summary of Information:
The Board is being asked to establish a Chesterfield County Citizen's Budget
Advisory Committee. Following establishment of the committee, the Board will
be asked to consider five nominees for appointment to the newly established
committee. The appointment terms would be for two years, effective
immediately and expiring on September 30t'', 2010.
The following individuals are recommended to serve on the newly created
Citizen's Budget Advisory Committee: Mr. Gary Armstrong, Ms. Sheryl Bailey,
Mr. Bob Bryant, Mr. Brett Sheffield and Mr. Richard Jacobs.
If the members of the Board of Supervisors desire to nominate and appoint
individuals to this committee at this meeting, they will need to unanimously
vote to suspend the Rules of Procedure. Nominees are voted on in the order in
which they are nominated.

Request that the Board of Supervisors nominate and appoint the attached list
of candidates to the Chesterfield County Multi-Cultural Advisory Commission.
Summary of Information:
At the January 23, 2008, Board of Supervisors meeting, an eleven-member at
large Multi-Cultural Advisory Commission was created.
This Commission is to advise the Board of Supervisors and the County
Administrator on issues related to the diverse cultural communities that
comprise Chesterfield County. The Commission will:
• Foster and facilitate dialog on Immigration Issues facing Chesterfield
County.
• Articulate cultural concerns, issues, and aspirations, then recommend
practical consensual policies to address them.

Summary of Information:
In 1966, a Board of Directors was formed to govern the RMA. Duties of the
Board include passing resolutions, approving the annual budget, monitoring
the organization's finances, voting upon measures related to the operations
of the RMA, approving debt issuances, setting tolls, and selecting,
appointing, supporting and reviewing the performance of the General Manager.
There are four standing committees on the Board - finance, audit, personnel,
and nominating. These committees direct and assist staff with policies
relating to external and internal auditors, decide and approve human resource
decisions affecting RMA employees, and nominate chair, vice chair and
secretary/general counsel positions on the board.
Board meetings are held every third Tuesday of the month.

Summary of Information:
GRTC is a publicly-owned corporation which was formed to provide public
transportation services in the Richmond regional area. Chesterfield County
and the City of Richmond each own 50% of GRTC as its two sole shareholders.
GRTC is governed by a six-member board of directors, three appointed by the
County and three by the City. A current membership list is attached. The
terms for David W. Mathews, Daniel K. Smith, and S. Joseph Ward, the County's
current GRTC Directors, will expire on October 15, 2008, the date of the next
GRTC annual shareholder's meeting. Under the GRTC by-laws, the Board may
reappoint the current directors to the next term or may appoint new
directors. There are no eligibility requirements to serve as a director on
the GRTC Board and the term of office is one year. The Board will be asked to
consider nominees for appointment to the GRTC Transit System Board of
Directors.

Fire and Emergency Medical Services Department, Chesterfield
County, on November 1, 2008; and
WHEREAS, Lieutenant Crosby attended Recruit School #9 and
has faithfully served the county for 30 years in various
assignments; as a firefighter at Bon Air, Dale and Dutch Gap
Fire and EMS Stations; as a sergeant and lieutenant at Dutch
Gap Fire and EMS Station; as a lieutenant at EMS Med-Flight
#1, Ettrick and Airport Fire and EMS Stations; and as the
tactical safety officer for "C" Shift; and
WHEREAS, Lieutenant Crosby was a founding member of the
Technical Rescue Team and served as a member of the Hazardous
Materials Response Team, providing outstanding leadership and
experience to enhance team knowledge and practical skills; and
WHEREAS, Lieutenant Crosby served as an advanced life
support provider from 1978 to 2003, as a medic on fire
department ambulances and as a flight medic with Med-Flight;
and
WHEREAS, Lieutenant Crosby was recognized in August 2002
with an Emergency Medical Services Unit Citation for his role
in saving the life of a worker trapped in an industrial
machinery accident; and
WHEREAS, Lieutenant Crosby has made significant and
valuable contributions to the department as an instructor in
the areas" of technical rescue, emergency patient care,
hazardous material and firefighter safety.

The Board is requested to adopt the attached resolution.
Summary of Information:
Chesterfield County, like other Virginia localities, pays the employee
contributions to the Virginia Retirement System. These payments are treated
as "pre-tax" payments so that no income tax is paid. The IRS recently issued
Revenue Ruling 2006-43 which provides that, for employer-paid employee
retirement contributions to continue to be treated on a pre-tax basis, the
employer must adopt a formal resolution affirming its intention to continue
the existing arrangement.. For a local government employer, this resolution
must be adopted by the locality's governing body. VRS has indicated that
Virginia localities must adopt their resolutions no later than October 30,
2008 to enable VRS to compile and submit the resolutions to the IRS before a
January 1, 2009 deadline imposed by the IRS. The attached resolution will
allow the County to continue its current contribution practice without
adverse income tax consequences.

Affirmation of Authorization to Pick-up the Employee's Contribution to VRS for CHESTERFIELD
COUNTY - 55120
Under § 414(h) of the Internal Revenue Code
WHEREAS, CHESTERFIELD COUNTY provides its employees with tax deferral pursuant to § 414(h) of the
Internal Revenue Code with respect to their member contributions to the V irginia Retirement System (referred to as
VRS) by picking up member contributions to VRS; and
WHEREAS, VRS keeps track of such picked up member contributions, and treats such contributions as employee
contributions for all purposes of VRS;
WHEREAS, the Internal Revenue Service in Notice 2006-43 has provided transition relief for existing pick-up
arrangements provided that an authorized person takes formal action to evidence the establishment of the pick-up
arrangement no later than January 1, 2009.
WHEREAS, in order to avail itself of the protection given under Notice 2006-43, CHESTERFIELD COUNTY
desires to affirm its intention to establish and maintain apick-up arrangement through formal action by its governing
body.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the existing member contribution pick-up arrangement is
hereby affirmed as it relates to salary reduction elections in effect prior to the date of this Resolution, and it is further
RESOLVED that effective the first pay day on or after October 8, 2008, CHESTERFIELD COUNTY shall pickup
member contributions of its employees to VRS, and such contributions shall be treated as employer contributions in
determining tax treatment under the Internal Revenue Code of the United States; and it is further
RESOLVED that such contributions, although designated as member contributions, are to be made by
CHESTERFIELD COUNTY in lieu of member contributions; and it is further
RESOLVED that pick-up member contributions shall be paid from the same source of funds as used in paying the
wages to affected employees; and it is further
RESOLVED that member contributions made by CHESTERFIELD COUNTY under the pick-up arrangement shall
be treated for all purposes other than income taxation, including but not limited to VRS benefits, in the same manner
and to the same extent as member contributions made prior to the pick-up arrangement; and it is further
RESOLVED that nothing herein shall be construed so as to permit or extend an option to VRS members to receive
the pick-up contributions made by CHESTERFIELD COUNTY directly instead of having them paid to VRS; and it
is further
RESOLVED that notwithstanding any contractual or other provisions, the contributions of each member of VRS
who is an employee of CHESTERFIELD COUNTY shall be picked up using the method under which the employer
will pay the employees' statutorily required contributions to VRS and the salary will not be modified.

the Chesterfield Community Services Board and the Virginia Department of
Mental Health, Mental Retardation, and Substance Abuse Services.
Summary of Information:
The State Code of Virginia requires that the governing body of each Community
Services Board (CSB) approve an annual performance contract through a formal
vote. This contract, inandateld by the State since about 1998, is required of
every CSB in the State, and is reviewed and approved annually. The contract
is between the local CSB and the Virginia Department of Mental Health, Mental
Retardation, and Substance Abuse. In essence, the State contract establishes
the primary accountability and funding mechanism between the Department and
the local CSB; and outlines reporting responsibilities, based on state code,
that are required either monthly, quarterly, semi-annually or annually. The
State uses this data to track compliance with state codes relative to
services. Some of this data is used in the Chesterfield CSB annual
performance report.
The performance contract reflects the budget approved by the Board of
Supervisors for each fiscal year. The contract describes the scope and
requirements of both the CSB and State and includes exhibits that detail:
all revenues, expenditures, number of persons projected to be served, and the

held on July 17, 2008.

Summary of Information:
Chesterfield County has developed a strategic plan that provides the basis
for allocating resources in its mission to be a FIRST CHOICE community. Each
year, the Board of Supervisors establishes priorities and assigns resources
to those priorities during the budget process. Subsequently, the results of
departmental initiatives are reviewed to measure progress towards the
strategic goals.
The formation of a Citizen's Budget Advisory Committee is proposed for the
purpose of assisting the Board of Supervisors in the evaluation and
allocation of resources in accordance with the strategic plan to ensure a
high quality of life. Earlier this year, the Board adopted the $1.28 billion
FY2009 budget that allocates resources to Public Safety, Education, Human
Services and a host of other areas such as Community Development activities
and support service functions. This committee would provide advice on
resource allocations and report on the progress being made toward strategic
goals in subsequent years.

Chesterfield Alternatives, Inc., is a non-profit organization whose mission
is to support the work of the Chesterfield Community Services Board. For
over twenty years, Chesterfield Alternatives has bought or leased houses
which the Community Services Board operates as adult group homes.

At its July 30 meeting, the Board received information about this project and
approved the designation of the property at 19300 Church Road (the
"Property") for this initiative. At this time, the Board is being asked to
consider the approval of a lease-purchase agreement for the Property.
Pursuant to the lease-purchase agreement, the county would lease the property
to Chesterfield Alternatives, Inc. during the period of the construction of
the house and provide Chesterfield Alternatives an opportunity to purchase
the property when the construction is completed. The execution of a lease-
purchase agreement will ensure appropriate insurance and liability coverage
is in place and will facilitate Chesterfield Alternatives in obtaining
financing for the project. Chesterfield Alternatives is willing to provide
funding for building materials, plans and services for the construction of
the house.
The lease-purchase agreement does not require payments from Chesterfield
Alternatives to the County, but instead requires Chesterfield Alternatives to
make a financial investment in the project through funding the construction
expenses. The construction expenses are estimated to be as much as $250,000.
The County entered into a similar arrangement with Chesterfield Alternatives
for the Renshaw House located on Harrowgate Road; Chesterfield Alternatives
leased and then purchased that property from the county for nominal amounts,
but invested $85,000 in house renovations and the home is leased and used by
the Community Services Board.
The deed transferring the Property from the county to Chesterfield
Alternatives will prevent Chesterfield Alternatives from reconveying the
Property without the approval of the county and will require that it be used
to provide services to consumers of the Community Services Board. The
Community Services Board intends to lease the house constructed to operate an
adult group home.
The current assessed value of the property is $50,000. It is the former
location of Union Grove Elementary School which has been demolished. The
site is currently vacant and zoned for agricultural uses which would permit
the construction and use of the proposed dwelling.
Technical Center students are available to begin construction activities as
soon as practicable.

Pursuant to Section 33.1-151 of the Code of Virginia, 1950, as amended, be it resolved that the
Chesterfield County Board of Supervisors hereby gives notice that at a regular meeting to be
held on November 12, 2008, at 6:30 p.m. it will consider a Resolution and Order to abandon a
portion of N. Enon Church Road, State Route 746, a distance of 0.13 miles, including any
remnant public road corridor extending beyond the end of State Route 746 to and including
the landing on the James River that previously served Woodson Ferry, since it serves no public
necessity and is no longer necessary as a part of the secondary system of State Highways.
Accordingly, the Clerk of the Board shall send a copy of this Resolution to the Commonwealth
Transportation Commissioner and the Department of Game and Inland Fisheries. The clerk
shall further cause to be published and posted the required notices of the Board's intention to

RESOLUTION
Resolution of Chesterfield County's intention to consider a Resolution and Order to abandon a
portion of Ridgedale Parkway, State Route 3259.
Pursuant to Section 33.1-151 of the Code of Virginia, 1950, as amended, be it resolved that the
Chesterfield County Board of Supervisors hereby gives notice that at a regular meeting to be
held on November 12, 2008, at 6:30 p.m. it will consider a Resolution and Order to abandon a
portion of Ridgedale Parkway, State Route 3259, a distance of 0.09 miles, since it serves no
public necessity and is no longer necessary as a part of the secondary system of State
Highways.
Accordingly, the Clerk of the Board shall send a copy of this Resolution to the Commonwealth
Transportation Commissioner thereof. The clerk shall further cause to be published and
posted the required notices of the Board's intention to abandon a portion of Ridgedale
Parkway, State Route 3259.

Authorize the County Administrator to execute annual requirements contracts
with Hankins and Anderson, Inc. and LandMark Design Group, Inc. for
engineering services relating to parks development and related parks
projects.
Summary of Information:
Hankins and Anderson and LandMark Design Group were recommended by the RFP
Committee out of a field of ten firms that elected to respond to the request
for proposals. The selection process followed standard purchasing procedures
for request for professional engineering services. These firms were selected
based on the specialized experience of each firm for engineering services
required in the development of new and renovated park sites and facilities as
anticipated through the County's Capital Improvement Program. Engineering
services that may be required under the resulting contract include
feasibility studies, park/structure programming, master planning, cost
estimating, preliminary design documents, prototype facility development,
permitting for environmental and land disturbance, grant applications,
illustrative drawings for presentations, public presentations, Comprehensive

RECOGNIZING MR. GEORGE E. BRP,UNSTEIN FOR HIS SERVICE TO THE CITIZENS
OF CHESTERFIELD COUNTY
WHEREAS, Mr. George E. Braunstein, Executive Director of
Chesterfield Community Services Board/Mental Health Support Services, has
served the citizens of Chesterfield County for eight years; and
WHEREAS, under the leadership of Mr. Braunstein, Chesterfield
CSB/MHSS became known nationally and statewide as a leader in using
business practices in a public sector, such as a balanced scorecard and
implementing cost management principles; and
WHEREAS, Mr. Braunstein led the way to build two state-of-the-art
rehabilitation centers - Chester House and Winchester Greens, and
expanded the number of individuals served in all service areas and ages
by over 50 percent, from 4,500 to over 8,000; and
WHEREAS, Mr. Braunstein promoted expanding the integration of
service staff into most of the Chesterfield County schools and several
county departments, including Juvenile Detention, Community Corrections,
and Social Services; and
WHEREAS, Mr. Braunstein, developed partnerships with the private
sector to create new service opportunities, including housing for the
homeless mentally ill, walk-in services for substance abuse, and
increased housing resources; and
WHEREAS, under Mr. Braunstein's leadership, Chesterfield CSB/MHSS
became known as a statewide leader in advancing quality-of-life issues
for people with disabilities, including innovative housing and job
opportunities; and
WHEREAS, Mr. Braunstein achieved Fellow status in the American
College of Healthcare Executives, their highest status; and
WHEREAS, Mr. Braunstein was appointed by Health and Human Services
Secretary Michael Leavitt to the National Advisory Council for Substance
Abuse Mental Health Services Administration (SAMHSA) for a four-year
term, 2008-2011; and
WHEREAS, Mr. Braunstein was appointed by Governor Kaine to the State
Olmstead Implementation Team, which is responsible for implementing a
plan to increase the independence of all people with disabilities; and
WHEREAS, Mr. Braunstein was appointed by the Department of Mental
Health/Mental Retardation/Substance Abuse Services Commissioner James

Reinhard as the co-chair of the state Pharmacy Committee; is a member of
the Clinical Faculty of VCU School of Psychiatry; and serves as Board
Member and Chair of the Virginia March of Dimes Public Affairs Committee;
and
WHEREAS, Mr. Braunstein serves as a Board member and Executive
Committee member of the Virginia Association of Community Services
Boards, as well as Chair of the Public Policy Committee; and
WHEREAS, Mr. Braunstein will be sorely missed for his professional
contributions and his commitment to the high quality of services provided
to those served by the Chesterfield Community Services Board/Department
of Mental Health Support Services.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 8th day of October 2008, publicly recognizes the
contributions of Mr. George E. Braunstein, and extends on behalf of its
members and the citizens of Chesterfield County, appreciation for his

RECOGNIZING MR. DAVID BARTH LENNON UPON ATTAINING
THE RANK OF EAGLE SCOUT
WHEREAS, the Boy Scouts of America was incorporated by Mr. William
D. Boyce on February 8, 1910, and was chartered by Congress in 1916;
and
WHEREAS, the Boy Scouts of America was founded to build character,
provide citizenship training and promote physical fitness; and
WHEREAS, after earning at least twenty-one merit badges in a wide
variety of skills including leadership, service and outdoor life,
serving in a leadership position in a troop, carrying out a service
project beneficial to his community, being active in the troop,
demonstrating Scout spirit, and living up to the Scout Oath and Law;
and
WHEREAS, Mr. David Barth Lennon, Troop 806, sponsored by Woodlake
United Methodist Church, has accomplished those high standards of
commitment and has reached the long-sought goal of Eagle Scout, which
is earned by only four percent of those individuals entering the
Scouting movement; and
WHEREAS, growing through his experiences in Scouting, learning the
lessons of responsible citizenship, and endeavoring to prepare himself
for a role as a leader in society, David has distinguished himself as a
member of a new generation of prepared young citizens of whom we can
all be very proud.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 8th day of October 2008, publicly recognizes Mr.
David Barth Lennon, extends congratulations on his attainment of Eagle

RESOLUTION RECOGNIZING THE ALPHA KAPPA ALPHA SORORITY,
INCORPORATED FOR ONE HUNDRED YEARS OF SERVICE
WHEREAS, the Alpha Kappa Alpha Sorority was established on
January 15, 1908 as America's first Greek-letter organization for
Black college women; and
WHEREAS, since its founding, Alpha Kappa Alpha has
distinguished itself as a service organization, and has grown to
more than 200,000 college-educated women from around the world; and
WHEREAS, currently, more than 950 Alpha Kappa Alpha chapters
operate in the United States, the Caribbean, Germany, Korea and
Japan; and
WHEREAS, Pi Rho Omega is Chesterfield County's local chapter,
which has 134 members who are committed to service in Chesterfield
County; and
WHEREAS, Pi Rho Omega was chartered on April 4, 1987, and
since that time, its members have worked to assist Habitat for
Humanity; voter registration drives; the YMCA; Meals-on-Wheels;
Tools for Schools; the Central Virginia Food Bank and numerous other
organizations in their efforts to improve the lives of those in
need; and
WHEREAS, in addition to these many benevolent activities, Pi
Rho Omega also has awarded two scholarships each year since 1988 to
deserving young ladies in the Richmond Metropolitan area, based on
need and academic achievements; and
WHEREAS, since 1988, the chapter has provided more than
$50,000 in college scholarships; and
WHEREAS, on October 10th and 11th, the ladies of Pi Rho Omega
will host the Northern Western Virginia Fall Cluster Conference at
the Greater Richmond Convention Center; and
WHEREAS, Chesterfield County is proud to have the Chesterfield

about Personal Property Rights and the Branner Station Case.

I believe the approval of the Branner Station zoning case has diminished the
personal property rights of members of our community. One, because those
directly impacted by the proposed roads were not personally notified before the
zoning case and two, because of our current difficulty in obtaining data of studies
and documentation on the proposed roads by a private company. When the state
or county builds a road, an individual impacted by the road has the right to view
any of the information involved on the case from the Transportation Department.
It's public information. This is different with a private company; they don't have

access to all the information on the case. The only way to dispel misinformation
and to insure personal property rights are respected is to allow transparency with
facts and data from the developer and allow those impacted the opportunity to
have input throughout the process, not just after a final plan has been submitted.
2. To remedy this current situation of lack of information, BARD is asking for the
following information be provided to the public:
- Answers to questions that Mike Uzel provided to HHHunt (a complete
list of our questions are being supplied to you tonight.)
- Data results from all studies completed by HHHunt so far and any
documentation submitted to CDOT or VDOT. (according to their
timeline all studies were to be completed by June of this year)
- A monthly update through a-mail to BARD and/or a website created
by Hunt that is updated monthly to let us know the status of the case or
set up a web site where the public can interject ideas into the plan and
where data and meeting minutes from all parties can be compiled and
shared with the public.
- A plan for how public meetings will be held. BARD has a proposal for
how the meeting should take place based on Mrs. Jaeckle's idea for the
meetings. We would like to work with her, Hunt, and Transportation to
finalize a plan for how the meetings will be implemented.
A mailing to everyone in Hunt's Study area and those property
owners directly impacted by roads once the project begins. This
mailing should describe the project and a number or website where the
homeowner can contact someone for more information.
Identify a point person for the public to gain information from. Right
now the public isn't sure who to ask questions to. The county says they are
waiting on Hunt but who is Hunt accountable to? What happens if Hunt
files for bankruptcy? How does this effect the homeowners impacted? We
need a protocol for how information is shared and dispersed.
3. Mrs. Durfee asked Mike Uzel last week if the public had any meetings with Hunt
after the BARD meeting that took place on Apri122°d of this year. I want to
clarify -Hunt did meet with two BARD members to meet on the North/South
Road in May but there have not been any public meetings on the East/West road
since before the zoning case. Mrs. Jaeckle did invite Hunt and John McCraken to
her constituents meeting on Monday to answer questions and we appreciate her
efforts, although the public only had two days notice through e-mail of our group
to attend the meeting. Even though my property has been identified as part of
Hunt's Study Area map, I have never before or after the zoning case been
personally notified of the Branner Station East/West Road. I also was not notified
of Chesterfield County's Thoroughfaze plan before I moved into my house 10
years ago and no one has asked my permission to study my property for these
roads. This needs to change...as a taxpayer and a lifelong chesterfield resident I
would like to change the policy of how residents are informed on future county
proposed roads. Development and residential housing should not be approved in
azeas that known roads are to be built without knowledge of this to the buyers. I
hope in the future the Board of Supervisors will not approve any zoning case
where right-of--way needs to be acquired unless property owners are given written
notice of the impact to their property and the opportunity to voice their concerns.

4. What are the specific financial issues delaying the road plans and/or
the development?
5. One year after the zoning case was approved, does HH Hunt own all
the property for the development itself? If not, when will this
happen? What are the ramifications if it doesn't happen?
6. What is Hunt's revised time-line for the N-S and E-W roads?
7. Will you incorporate BARD's proposed four public meetings into
your revised time-line (see attached proposal)?
8. Where TODAY is the E-W road on your base map?
9. Are you considering changing the phasing of the roads and/or
development? If so, how?
10. Why has there been no communication from Hunt to the email list that
BARD provided to you several months ago?
11. What is the status of the Phase 1 a and 1 b Development Plans you
submitted to Planning? (No notification to BARD/email list).
12.If delays continue, where does that leave the "Stakeholding" property
owners? How tong are we to be kept in the dark on these roads
which you have committed to run through our neighborhoods?
REQUESTS:
1. Written response to the above questions, so there is no
miscommunication.
2. Notification by mail to ALL residents in your study areas for the
E-W and N-S roads that there is a road planned through the area. This
has never been done, either before the zoning case or anytime after
(over a year). We are still meeting people who know NOTHING
about these roads.
3. All data on the roads up to now, including studies submitted to
County Transportation and VDOT.
4. Your revised time-line, with BARD's proposed public meetings
incorporated in it.
5. Close communication with BARD on all future
datalstudies/reports/meetings on the roads.
6. Regular email updates to our email list (provided to you).

REMARKS TO BOARD OF SUPERVISORS DURING CITIZEN COMMENT
PERIOD
Tonight I will share the story of how billboard-sized electronic signs will be
coming to a neighborhood near you and to the highways and byways of
Chesterfield courtesy of the Chesterfield County Public Schools. The tale begins
in 2002 when Matoaca High School opened without a monument sign to identify
its building. Matoaca High is the only school that was not provided a monument
sign.
Last year, a movement began to get an electronic sign for Matoaca High. Our
reasonable requests to the school system to proceed with the sign design and
location in a manner consistent with what had been done at other county schools
and considerate of the character of the neighborhood were not honored. Our
neighborhood was publicly ridiculed and accused of wanting to deny Matoaca
High their sign. Our concerns about safety, appearance, excessive size, and
inconsistency with the character of our rural neighborhood were overwhelmingly
rejected by Mr. Cunningham, the principal, and by the PTSA. Also rejected was
our suggestion to place the sign in front of the school so all students, faculty, staff
and visitors could read it. Now more than half the students, faculty, staff and
visitors will be unable to see it, because they enter the parkway on which the
school is situated from approximately 800 feet north of the sign-too far away to
be able to read it.
Although our School Board representative, Mr. Rajah, repeatedly assured us that
we would be represented on the committee that designed the sign, we were not.
We were not allowed to participate in the design that was submitted with the
request for approval to erect the sign. Ms. Durfee decided to violate the county
policy that requires an electronic sign visible from residentially occupied
properties to be located at least 1,000 feet from such property. She moved and
voted to approve the sign, gaining support from two of you. Mr. Warren and Mr.
Gecker wisely chose to reject the approach of denying equal protection to some
of this county's citizens. I suppose the slogan "first choice community" just
applies to selected areas. Ms. Durfee would not violate county policy to put
such a sign for Cosby High at the entrance to Foxcroft, I am sure.
challenged the first design put out for bids because the sign area was almost
twice that allowed. The sign was redesigned. The sign area is now more than

two and one-half times the size allowed according to the plain English wording of
the ordinance. Word came to us that we would not like the new sign, but the
neighborhood could thank the one who challenged the first design. I also happen
to be the one who discovered and made others aware that the principal wrote the
sign designer stating he could not guarantee him the contract, but requesting that
the designer help the school write the specifications for the sign. The principal
added that the school system would get to make the selection of the winning bid,
a statement contrary to sealed bid procedure. Superintendent Newsome refused
our request to stop the second design, and the bids were opened yesterday.
Once this sign is erected, those who choose to apply for abillboard-sized
electronic sign will have a precedent to cite. That's how these signs will become
commonplace. After all, the standard for architectural compatibility of the sign
with the building is very low. As the Planning Director wrote in this case: "The
black aluminum sign structure repeats the albeit faded black aluminum
directional signs distributed around the parking and driveway areas." Now
that you understand what is at stake, I urge one or more of you to intervene in
this process and save this county from billboard-sized electronic sign blight.

MAJOR FACTORS IGNORED OR GIVEN INADEQUATE
CONSIDERATION DURING PROCESSING OF CASE TO
APPROVE ELECTRONIC SIGN FOR MATOACA HIGH
This electronic sign is located within 1000 feet of residential property
contrary to written county policy. (Decision on 3-2 vote by Board of
Supervisors) Erection of this sign effectively destroys application of
that policy to any other requests. A decision to continue to apply that
policy in the future results in unequal protection of our
neighborhood's residents under the law as compared to other county
residents.
2. No other county school has such a large, electronic (or other type)
sign to identify their school building.
3. No other county school has their sign located so far from their
building. (Planning Department has characterized sign as being
"disconnected" from the building it advertises.)
4. Sec. 19.1(3) of ordinance states purpose is "To facilitate the creation
of a convenient, attractive and harmonious community." This sign
makes a mockery of that statement.
5. Sec. 19-631(b)(1) and (2) state intention to prevent signs with
excessive height, bulk and area. This sign clearly exceeds the height,
bulk and area needed to convey the information. Other schools
convey data in much smaller space. See the Midlothian High
electronic sign.
6. Sign will be unnecessarily expensive because of added size.
7. Sign fails to meet purpose stated in application. Sign clearly does not
serve the more than one-half of students, faculty and staff who enter
Matoaca High by way of John Winston Jones Parkway approximately
800 feet to the north of proposed placement. Placement in front of
parking areas on the road in front of the school would serve the stated
purpose much more effectively.
8. Sign is incompatible with rural character of neighborhood, adjacent
church, and plantation with an official designation as historically
significant (Dellwood Plantation).
9. The taxpaying senior citizen homeowners (most are in the 60 to upper
nineties age range) who predominate in this neighborhood appear to
have been singled out for special and unusual treatment. Given the
lack of real justification for imposing this billboard-sized electronic
sign on this area and for ignoring the rules and guidelines that have
been put in place supposedly to protect our neighborhoods, we can
only guess at why this has been allowed to happen. We appear to be
the exception from Chesterfield's "first choice community" slogan.
10. The high school principal has engendered the appearance of
impropriety in the conduct of this purchase by inviting and allowing
excessive involvement of a particular potential contractor with
development of the sign specifications. (Inappropriate implications
are documented in a-mail. written by that principal to potential
contractor or subcontractor.}

In FY09, $22 million was available statewide for VDOT to carry out the
program. One project in Chesterfield was allocated funds: $200,000 towards
the Falling Creek Bridge Restoration project.
Transportation Enhancement Projects are financed with 80% VDOT funds and a
minimum 20% local match. The local match is usually provided from county
funds, from other sources, and/or by in-kind contributions. VDOT staff will
evaluate project applications and make a recommendation to the Commonwealth
Transportation Board for inclusion in the FY2010-FY2015 Virginia
Transportation Six-Year Improvement Program.
The following projects are recommended to be submitted for the FY2010
Enhancement Program (also shown in Attachment A):
• Falling Creek Bridge Restoration, continued funding ($710,000)
• Genito Road Streetlights ($62,500)
• Fordham Road Sidewalk, Phase I ($300,000)
• Springford Parkway Pedestrian Improvements($162,500)
• Walton Park Road Sidewalk, Phase II ($450,000)
This list reflects one change since the September 24, 2008 Board item. Mrs.
Jaeckle asked that continued funding of the Falling Creek Bridge Restoration
project be submitted this year for the Bermuda project.
The Board should confirm support for the priority enhancement projects by
adopting a Yesolution of support, which guarantees the county will provide
the local match. If approved and funded by VDOT, staff will prepare another
agenda item requesting appropriation of the required match. The amounts for
the local match, totaling $337,000, are as follows: Falling Creek Bridge
Restoration Project ($142,000); Genito Road Streetlights ($12,500); Fordham
Road Sidewalk, Phase I ($60,000); Springford Parkway Pedestrian Path
($32,500); and Walton Park Sidewalk, Phase II ($90,000).
Enhancement projects are required to have endorsement from area Metropolitan
Planning Organizations (MPOs). The project list, as approved by the Board,
should be forwarded to the Richmond Area MPO.
The Genito Road Streetlight project will also require the county to bear the
continuing operating expense associated with the lights (approximately
$12,000 per year).

Staff recommends the Board take the following actions:

Adopt an ordinance to vacate a portion of A Resubdivision of Open Space,
Lakepointe Subdivision.
Summary of Information:
Lakepointe Homeowners Association, Inc. has submitted an application
requesting the vacation of a portion of the open space within A Resubdivision
of Open Space, Lakepointe Subdivision. The parcels shown on the attached
plat containing 0.2 acres, more or less, and 0.8 acres, more or less, were
conveyed by the Lakepointe Homeowners Association, Inc., to Joseph E. Vaden
and Iris H. Vaden on May 11, 2006. The Planning Department is requiring
these parcels be vacated from the subdivision. Planning and Environmental
Engineering Departments have reviewed this request.
Approval is recommended.

Approve the leasing of space on the County's Lake Dale Tower to New Cingular
Wireless PCS, LLC.
Summary of Information:
Staff recommends that the Board approve the leasing of space on the County's
Lake Dale Tower. The initial lease term is for five years at $24,000 per year
with three 5-year renewal terms with 150 rent increases.
In addition to the standard terms, the lease contains a provision requested
by Mr. Gecker and the Commonwealth's Attorney's Office which states that the
cell phone company will not charge fees to the County's criminal
investigatory agencies when they are requested to produce documents pursuant
to an appropriate subpoena duces tecum in a criminal investigation or
subsequent prosecution. The County will include this language in all cell
tower leases from all vendors in order to help ease the administrative cost
and red tape sometimes encountered by the Police and Commonwealth's
Attorney's Office when they seek phone records in criminal cases.
Approval is recommended.
