PROPOSED LAND USE: An adjacent motor vehicle sales business has been expanded onto the property without the proper zoning. With approval of this request, other General Business (C- 5)uses would also be permitted. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL. AYES: MESSRS. BASS, BROWN, HASSEN AND WALLER. ABSENT: MR. GULLEY. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The proposed zoning and land uses conform to the Jefferson Davis Highway Corridor Plan which suggests the property is appropriate for general commercial use. B. The proposed zoning and land uses are representative of, and compatible with, existing and anticipated area development. Providing a FIRST CHOICE community through excellence in public service (NOTE: THE ONLY CONDITION THAT MAY BE IMPOSED IS A BUFFER CONDITION. THE PROPERTY OWNER(S) MAY PROFFER OTHER CONDITIONS.) GENERAL INFORMATION I,~cati~n: Southwest quadrant of Jefferson Davis Highway and General Boulevard. Tax IDs 794-666- 6494, 6990 and 7283. Existin.~g: C-3 Size: 0.6 acres Existing Land Use: Commercial (motor vehicle sales business) Adjacent Zoning and Land Use: North, South and East - C-5; Commercial West - R-7; Residential T ITTT ,TTTF,~ Public Water System: The request site is within the Bellwood Water Pressure Zone. The public water system is available to serve the request site. There is an existing twelve (12) inch water line extending along the west side of Jefferson Davis Highway adjacent to this site. In addition, an eight (8) inch water line extends along the south side of General Boulevard, adjacent to the request site. Use of the public water system is required by County Code for any future building. Public Wastewater System: The request site is within the Ashton Creek Sewer Service Area. The public wastewater system is available to serve the request site. There is an existing eight (8) inch wastewater collector line extending along General Boulevard that terminates adjacent to the northeast corner of this site. Use of the public wastewater system is required by County Code for any future building. 2 08SN0287-OCT22-BOS-RPT ENVIRONMENTAL This request will have minimal impact on these facilities. PUBLIC FACILITIES Fire Service: The Centralia Fire Station Company 17 currently provides fire protection and emergency medical service (EMS). This request will have a minimal impact on Fire and EMS. Transportation: The property (0.6 acre) is currently zoned Community Business (C-3) and the applicant is requesting rezoning to General Business (C-5). This request will have a minimal impact on the traffic anticipated to be generated by development of the site. The property is located within the Jefferson Davis Highway Enterprise Zone. Based on the Board of Supervisors' policy regarding development within the Enterprise Zone, road improvements will not be required by the County. Road improvements may be required by the Virginia Department of Transportation. Traffic generated by this site will initially be distributed to Jefferson Davis Highway (Route 1 /301) which had a 2006 traffic count of 22,210 vehicles per day and was functioning at Level of Service C. During site plan review, specific recommendations will be made regarding right of way dedication and access control. T,ANn 11~F, Comprehensive Plan: Lies within the boundaries of the Jefferson Davis Hi h~way Corridor Plan which suggests the property is appropriate for general commercial use. Area Development Trends: Properties to the north, south and east are zoned General Commercial (C-5) and are occupied by commercial uses or are vacant. Properties to the west are zoned Residential (R- 7) and are occupied by residential uses or are vacant. It is anticipated that commercial use will continue in the area as suggested by the Plan. 3 08SN0287-OCT22-BOS-RPT Development Standards: The request property lies within the Jefferson Davis Highway Corridor District. Development of the site must conform to the requirements of the Zoning Ordinance which address standards to encourage reinvestment and revitalization of the area. Such standards address access, parking, landscaping, architectural treatment, setbacks, buffers, signs and screening. It should be noted that the applicant has expanded the adjacent motor vehicle sales business onto the request property without the appropriate zoning and plans review. As such, it will be necessary to bring the site into compliance with Ordinance Requirements relative to site design. Subsequent to the granting of this zoning, it will be necessary for the applicant to submit site plans and perform required improvements. CONCLUSION The proposed zoning and land use comply with the Jefferson Davis Highway Corridor Plan which suggests the property is appropriate for general commercial use. In addition, the proposed zoning and land use are representative of, and compatible with, existing and anticipated area development. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (9/16/08): The applicant accepted the recommendations. There was no opposition present. On motion of Mr. Hassen, seconded by Dr. Brown, the Commission recommended approval. AYES: Messrs. Bass, Brown, Hassen and Waller. ABSENT: Mr. Gulley.
