Shoosmith Disposal LLC Bermuda Magisterial District South line of Carver Heights Drive REQUEST: Renewal of Conditional Use (Cases 89SN0132 and 90SN0122) to allow continued operation of a landfill subject to the same conditions as imposed through the original case, except the ten (10) year time limit, is requested. PROPOSED LAND USE: A construction/demolition/debris landfill currently exists on the property. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The landfill has operated for a number of years with no apparent adverse impact on the area. Providing a FIRST CHOICE Community Through Excellence in Public Service. Conditions limk disposal operations to a maximum elevation of 244 feet above sea level, at which time filling operations must cease. This requirement is designed to limit the overall height of the landfill as well as the life of the landfill. The conditions under which the landfill has existed insure proper operation and reclamation of the site. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) CONDITION (STAFF/CPC) All conditions of Cases 89SN0132 and 90SN0122 shall remain in effect except that Condition 7 of Case 89SN0132 shall be eliminated. (P) PROFFERED CONDITIONS (STAFF/CPC) 1. Within sixty days from the date of the Board of Supervisors approves the requested Conditional Use, forty five (45) feet of right-of-way on the south side of Carver Heights Drive, measured from the centerline of that part of Carver Heights Drive immediately adjacent to the property, shall be dedicated, free and unrestricted, to and for the benefit of Chesterfield County. (T) (STAFF/CPC) 2. The unenforceability, elimination, revision or amendment of any proffer set forth herein, in whole or in part, shall not affect the validity of enforceability to the other proffers or the unaffected part of any such proffer. (P) GENERAL INFORMATION Location: South line of Carver Heights Drive, west of West Booker Boulevard. Tax ID 778-650-7795 (Sheet 26). Existing Zoning: A with Conditional Use 2 000SR0112/WP/APR26G Size: 33.1 acres Existing Land Use: Landfill Adjacent Zoning & Land Use: North - R-MF and I-1; Vacant South - A; Chesterfield County Chester Landfill (inactive) East - A and A with Conditional Use; Commercial or vacant West - A; Single family residential and vacant UTILITIES Public Water System: There is an existing eight (8) inch water line extending along a portion of Carver Heights Drive and ending approximately 950 feet east of the request site. Use of the public water system for any structures receiving water is an existing requirement of zoning and would remain in effect with this approval. (Condition) Public Wastewater System: The public wastewater system is not available to serve the request site. ENVIRONMENTAL Existing conditions of the Conditional Use, coupled with the County Code, address drainage, erosion and water quality and would remain in effect with this approval. (Condition) PUBLIC FACILITIES Fire Service: This property is currently served by the Chester Fire/Rescue Station, Company Number 1 and Bensley-Bermuda Rescue Squad. Continued operation of the landfill will have no impact on these facilities. 3 000SR0112/WP/APR26G Transportation: The applicant is seeking an amendment to a previously approved Conditional Use on the property to allow continued use of the existing landfill. Traffic generation information is not available for this landfill. The majority of the traffic associated with this type of land use is generally trucks. Vehicles generated by this landfill will be distributed along Carver Heights Drive which had a 1994 traffic count of 783 vehicles per day. The traffic impact from this landfill will be the same as currently permitted. The Thoroughfare Plan identifies Carver Heights Drive as a major arterial with a recommended right of way width of ninety (90) feet. The applicant has proffered to dedicate forty-five (45) feet of right of way, measured from the centerline of Carver Heights Drive, in accordance with that Plan. (Proffered Condition 1) LAND USE Comprehensive Plan: Lies within the boundaries of the Central Area Plan and the Southern and Western Area Plan, which suggest the property is appropriate for communky mixed use and for residential use of 1 to 5 acre lots. Area Development Trends: Property to the north is zoned for muki-family residential and light industrial uses and is currently vacant. Property to the south is occupied by the Chesterfield County Chester Landfill, which is currently inactive. Property to the east and west is zoned agriculturally and is occupied by single family residences, commercial uses or is vacant. While the Plan suggests a mix of uses would be appropriate for the area, future development is somewhat limked due to the landfill uses that have existed in the area. Specifically, any development of the inactive Chester landfill or the subject ske is restricted due to the landfill activky on these skes. Zoning History: On July 26, 1989, the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved a Conditional Use to permk a construction/demolition/debris landfill on the request property for a period of ten (10) years. Subsequently, there was an amendment of that case to delete the time period under which the first cell would have to be closed and to modify certain requirements relative to site attendants, inspection of loads from elevated platform and paving. (Case 90SN0122) 4 000SR0112/WP/APR26G Site Design: The property is occupied by a landfill. The northern portion of the property, which is currently vacant, will be developed as a landfill which is scheduled to commence operation once the existing landfill cell is closed and an approved closure plan is implemented. Conditions of the approved Conditional Use limit the height of the landfill to 244 feet above mean sea level. CONCLUSIONS The landfill has existed for a number of years with no apparent adverse impact on the area. The existing conditions have satisfactorily regulated the land filling activity and reimposition of those conditions would be appropriate. (Condition 1, also see attached) As noted, the applicant has requested that this renewal not impose a specific time limit, but rather the life of the landfill be regulated by the maximum height permitted, which is 244 feet above mean sea level. Continued operation to achieve the design height of the landfill would be appropriate once the maximum height is achieved, the landfill would be closed and the area reclaimed in accordance with the conditions. CASE HISTORY Planning Commission Meeting (1/18/00): The applicant accepted the recommendation. There was opposition present. Concerns were expressed that the area had experienced an increase in truck traffic and that area roads had not been designed and constructed to accommodate truck traffic. Concerns were also expressed that the impact of landfills has not been fully studied. Mr. Cunningham indicated that the landfill had existed for a number of years with no apparent impact on the area. He acknowledged that the area had experience an increase in truck traffic; however, he did not feel the increase was attributable to this particular use. On motion of Mr. Cunningham, seconded by Mr. Marsh, the Commission recommended approval of this request subject to the condition and acceptance of the proffered conditions on page 2. AYES: Unanimous. 5 000SR0112/WP/APR26G Board of Supervisors' Meeting (2/23/00): On their own motion, the Board deferred this request to April 26, 2000. Mr. McHale requested that staff provide empirical data relative to the impact of the use on area properties. Staff (4/3/00): The data requested by Mr. McHale has been provided in a separate memorandum to the Board. KLUGE REF: SHOOSMITH DEBRIS LANDFILL ZONING APPLICATION Dear Mr. Bowling: Having received the comments and checklist concerning this application, the following responses to the items in question may help to clarify the issues: Item 1.ck The original Piney Branch channel and any associated wetlands within the proposed or existing boundaries, were probably altered in the past, first by land disturbing activities related to the Shoosmith farm, and second the land disturbing activities of the Shoosmith debris landfill and adjacent County landfill. The existing environment on the site in question does not appear to support vegetation characteristic of wetlands nor is there sufficient soil moisture for that type of vegetation. It is debatable as to whether the soil types on this site are characteristic of wetlands. Areas with a hi[;h probability of meeting wetland criteria have been noted as "Potential Wetlands" on the overall schematic sheet attached. Item I.e. Item 1.f. After the drainage ditch carrying a free flowing stream is relocated it will be more than 100 feet from the proposed Item 3 The original slxeam bed of Piney Branch is not to be relocated. However, the existing drainage ditches shown which were excavated in the recent past, now contain the waters of Piney Branch-These are to be relocated. Since the landfill has and will continue to be bordered on two sides by drainage ditches, the direction and flow of ground water is expected m be unchanged. The proposed ditch relative to its previous location is to be relocated with the same bottom elevation and gradient thus no significant changes in groundwater levels are expected.
