REQUEST: Conditional Use to permit a family day care home in a Residential (R-15) District.
PROPOSED LAND USE:
The applicant is currently operating a family day care home within an existing single
family residence without the requiske Condkional Use. A Condkional Use is
requested to bring the use into compliance wkh the Ordinance.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON

STAFF RECOMMENDATION
Recommend approval for the following reasons:
A. The family day care home, wkh the acceptance of the proffered condkions, should
be compatible with surrounding residential development. Family day care homes
have been approved in other similar neighborhoods throughout the County and have
operated without any apparent adverse impact on area residences.

B. Through the Condkional Use process and the imposkion of the recommended
condkions, the residential integrky of the area can be further ensured.

exclusively, and shall not be transferable nor run with the land. (P)

GENERAL INFORMATION
Location:
Eastern terminus of Arbor View Terrace and better known as 6001 Arbor View Terrace. Tax
ID 779-656-5151 (Sheet 26).

UTILITIES
Public Water System:
There is an existing sixteen (16) inch water line extending along Arbor View Terrace,
adjacent to the request site. Use of the public water system is required by County Code. The
existing dwelling is connected to the public water system.
Public Wastewater System:
There is an existing eight (8) inch wastewater collector extending along Arbor View Terrace,
adjacent to the request site. Use of the public wastewater system is required by County Code.
The existing dwelling is connected to the public wastewater system.
ENVIRONMENTAL
The proposed use will have no addkional impact on these facilkies.
PUBLIC FACILITIES
Fire Service and Transportation:
The proposed use will have a minimal impact on the existing transportation network and
fire/rescue services.
LAND USE
Comprehensive Plan:
The request site lies within the boundaries of the Central Area Plan, which suggests the
property is appropriate for residential use of 1.0 to 2.5 dwelling units per acre.
Area Development Trends:
The request property is located within Arbor Landing Subdivision. Adjacent properties to
the north, south and west are zoned Residential (R-15) and occupied by single family
residences. The adjacent properties to the east are zoned Agricultural (A) and are occupied
by single family residences on acreage parcels which front Chalkley Road.

Zoning History:
On April 11, 1979, the Board of Supervisors, upon a favorable recommendation from the
Planning Commission, approved rezoning to allow a mixed use development consisting of
residential, commercial, office and recreational uses for the Ironbridge Development (Case
78S105). The subject site was included in that request.
Site Design and Use:
A family day care home is currently being operated within a single family dwelling on the
subject property. Proffered Condition 2 precludes any addition to the existing dwelling to
accommodate the use. Proffered Condition 3 precludes a sign to identify the use. A fenced
play area exists to the rear of the existing dwelling. Some limited on-site parking is
available.
The use is licensed by the State Department of Social Services and permit a maximum of
twelve (12) children on the site any one time. The applicant has indicated that there is one
full and one part-time employee and that hours of operation am generally between 7:00 a.m.
and 6:00 p.m.
CONCLUSIONS
As noted herein, the applicant is currently operating a family day care home from the location and
has filed this Conditional Use request to come into compliance with the Ordinance. The Zoning
Ordinance permits the keeping of a maximum of five (5) children by right in a residential district.
Approval of this request would allow for the keeping of more than five (5) children.
The proposed family day care home, with the acceptance of the proffered condkions, should have
no adverse impact on the surrounding neighborhood. Similar family day care homes have been
approved in other neighborhoods and have operated without any apparent adverse impact on area
residences. The proffered conditions are similar to condkions required for other family day care
homes and are designed to ensure that the residential integrky of the area is maintained (Proffered
Conditions 1 through 3). Therefore, approval of this request and acceptance of the proffered
condkions is recommended.

CASE HISTORY
Planning Commission Meeting (4/24/00):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Cunningham, seconded by Mr. Marsh, the Commission recommended
approval of this request and acceptance of the proffered conditions on page 2.
AYES: Unanimous.
The Board of Supervisors, on Wednesday, May 24, 2000, beginning at 7:00 p.m., will take under
consideration this request.
