00SR0285-SEP13.PDFMOBILE HOME REPORT The Board of Supervisors of the County of Chesterfield, on Wednesday, Sevtember 13. 2000, beginning at 7:00 p.m. in the Public Meeting Room at Chesterfield Comity Administration Building, Chesterfield, Virginia, will take under consideration the granting of a Mobile Home Permit on the parcel of land described herein. It shall be the policy of the Board of Supervisors that approval of a mobile home permit to park a mobile home on a parcel of land ghall be subject to compliance with the fotlowh~g Standard Conditions: 1. The applicant shall be the owner and occupant of the mobile home. No lot or parcel may be rented or leased for use as a mobile home site, nor shall any mobile home be used for rental properly. Only one (1) mobile home shall be permitted to be parked on an individual lot or parcel. The minimum lot size, yard setbacks, required front yard, and other zoning requirements of the applicable zoning district shall be complied with, except that no mobile home shall be located closer than twenty (20) feet to any existing residence. No additional permanent-type living space may be added onto a mobile home. All mobile homes shall be skirted but shall not be placed on a permanent foundation. 5. Upon being granted a Mobile Home Permit, the applicant shall then obtain the necessary permits from the office of Building Inspections. This shall be done prior to the installation or relocation of the mobile home. Any violation of the above conditions shall be grounds for revocation of the Mobile Home Permit. 2 MHR/00SR0285/SEPT13Z 00SR0285: In Bermuda Magisterial District, STEVEN C. MORGAN requests renewal of Mobile Home Permit 96SR0135 to park a mobile home in a Residential (R-7) District. The density of this proposal is approximately 2.86 units per acre. The Comprehensive Plan suggests the property is appropriate for residential use of 2.51 to 4.0 units per acre. This property is known as 10110 Brightwood Avenue. Tax ID 793-666-8706 (Sheet 18). The first permit was issued on August 24, 1983. The mobile home is located on property belonging to the applicant. The property is served by public water and sewer. Staff finds there are five (5) mobile homes located within one-quarter (1/4) mile of this property. This request, which is for seven (7) years, appears to be in character with the neighborhood at the present time. The mobile home is located in an area designated by the Jefferson Davis Corridor Plan for residential use. Adjacent property is zoned Residential (R-7). Development in this area gives the neighborhood a stable residential character. On April 29, 2000, the Planning Department received a complaint regarding the applicant's construction of an addition. A field visit revealed an addition had been added to the existing manufactured home in violation of the Mobile Home Permit and the Zoning Ordinance. This addition, as well as the existing manufactured home, were located forty-seven (47) inches from the side property line. The Building Inspections Department has indicated that there is no record of a building permit being issued for the addition. The applicant has indicated the addition which is 28' X 16' was constructed in November of 1996. On May 30, 2000, the applicant applied for a 3.6 foot Variance to the 7.5 foot side yard setback requirement for the mobile home and a 4.5 foot Variance to the ten (10) foot rear setback requirement for a shed (which was also in violation) with the Board of Zoning Appeals. On August 2, 2000, the Board of Zoning Appeals approved these two (2) Variances for the setback requirements. On June 20, 2000, the applicant applied to renew his mobile home permit and amend Condition 4 to allow for the existing addition to remain. Staff contacted the Building Inspections Department which has requested if the Board approves this request, the applicant apply for a building permit within thirty (30) days. If the Board grants this request, it will be for a limited time period. Upon expiration of the permit, the applicant may request a renewal of the permit or may remove the mobile home from the property. 3 MHR/00SR0285/SEPT13Z STAFF RECOMMENDS APPROVAL OF THIS REQUEST FOR SEVEN (7) YEARS, subject to Conditions 1 thru 3, 5 thru 7 as noted herein and Condition 4 and 8, as noted below. No additional permanent-type living space other than the existing addition may be added onto the mobile home. All mobile homes shall be skirted but shall not be placed on permanent foundation. Mr. Jacobson presented a summary of Case 00SR0285 and stated that the applicant has indicated that an addition was built on the back side of the structure in 1996 which, at that time, was a violation of County policy. He further stated that, since that time, the Board of Zoning Appeals has approved the setback variances for the addition and, therefore, staff recommends approval for seven years, subject to the standard conditions and two additional conditions one modifying Condition 4 which prohibits any additional additions to the property other than what has been constructed; and Condition 8 which will require the applicant to submit and receive necessary permits from Building Inspection within thirty days of the granting of this mobile home permit. Mr. Steven Morgan stated that the recommendation is acceptable. Mr. Jacobson presented a summary of Case 00SR0285 and stated that staff recommends approval for seven years, subject to the standard conditions, with modification to Condition 4 to recognize the existing addition that has been built and the addition of Condition 8 that requires the applicant to obtain necessary permits from Building Inspection to ensure that the addition meets the County's Building Code. Mr. George Stigall, adjacent property owner, expressed concerns relative to denial of his request for a building permit to construct an addition to his mobile home. He further expressed concerns relative to differences in the description of his property boundary lines on the deed and plat. Mr. Warren suggested that Mr. Stigall meet with County staff to determine the accuracy of his property boundaries. Mr. Miller suggested that Mr. Stigall have his property surveyed. Mr. Barber requested that Mr. Jacobson meet with Mr. Stigall to address his concerns. Mr. Steve Morgan stated that his land has been surveyed in the last three months and Mr. Stigall is aware of the location of the property line. He presented the Board with photographs of the two neighboring properties. Mr. McHale expressed concerns relative to the necessity to amend the conditions to ratify the construction that was done without a building permit. He stated that, if the applicant does not follow through with obtaining a building permit, he may be required to remove the structure. Mr. Morgan stated that he has already applied for a building permit and that the Building Inspection Office has indicated that approval is pending the Board's consideration of the request for the mobile home permit renewal. Mr. McHale made a motion, seconded by Mr. Barber, for the Board to approve Case 00SR0285 for seven (7) years, subject to conditions. 9/13/00 00 639 Mrs. Humphrey stated that, after receiving a tour of the mobile home communities along the Jefferson Davis Corridor, she appreciates the applicant's immaculate upkeep of his property.
