Snyder Matoaca Magisterial District 15206 Fern Hollow Court REOUEST: Conditional Use to permit a family day care home in a Residential Townhouse (R- TH) District. PROPOSED LAND USE: A family day care home within an existing single family residence is planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Reconm~end approval for the following reasons: The family day care home, if properly conditioned, should be compatible with surrounding residential development. Family day care homes have been approved in other similar neighborhoods throughout the County and have operated without any apparent adverse impact on area residences. Through the Conditional Use process and the imposition of the recommended conditions, land use compatibility with area residential development can be further ensured. (P) GENERAL INFORMATION Location: North terminus of Fern Hollow Court and better known as 15206 Fern Hollow Court. Tax ID 718-668-4264 (Sheet 15). Existing: R-TH with Conditional Use Planned Development Size: .4 acre Single family residential 2 01SN0101/WP/OCT25K Ad)acent Zoning and Land Use: North, South, East and West - R-TH with Conditional Use Planned Development; Single family residential. UTILITIES Public Water System: There is an existing six (6) inch water line extending along the southeastern side of Fern Hollow Court, adjacent to the request site. Use of the public water system is required by County Code. The existing dwelling is connected to the public water system. Public Wastewater System: There is an existing eight (8) inch wastewater collector extending along Fern Hollow Court and continuing along the western boundary of the request site. Use of the public wastewater system is required by County Code. The existing dwelling is connected to the public wastewater system. ENVIRONMENTAL The proposed use will have no additional impact on these facilities. ~IES Fire Service and Transportation: The proposed use will have a minimal impact on the existing transportation network and fire/rescue services. LAND USE Comprehensive Plan: The request site lies within the boundaries of the Upper Swift Creek Plan which suggests the property is appropriate for residential use of 2.0 units per acre or less. Area Development Trends: The request property is located within Ashbrook Subdivision. Adjacent properties are zoned residentially and are occupied by single family residences or are vacant. 3 01SN0101/WP/OCT25K Zoning History: On December 14, 1983, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved a rezoning to allow a mixed use development consisting of residential, commercial, office and recreational uses for the Ashbrook Development (83S190). The subject site was included in that request. Site Design: A plat submitted with the application depicts an existing single family residence located on the request site with access to Fern Hollow Court via a driveway. The backyard and planned play area are shown enclosed by a four (4) foot high fence. Condition 3 would preclude any additions to the existing dwelling to accommodate the use. Condition 4 would preclude a sign to identify the use. While a family day care home, as described in the Zoning Ordinance does not limit the number of children permitted to be cared for, there have been concerns recently about what impact an unlimited number of children may have on a neighborhood. Condition 2, limiting the number of children, is recommended to address those concerns. CONCLUSIONS As noted herein, the applicants are requesting a family day care home. The Zoning Ordinance permits the keeping of a maximum of five (5) children by right in a residential district. Approval of this request would increase the number of children permitted to a maximum of twelve (12) at any one time, excluding children related to the applicants. (Condition 2) The proposed family day care home, if properly conditioned, should have no adverse impact on the surrounding neighborhood. Similar family day care homes have been approved in other neighborhoods and have operated without any apparent adverse impact on area residences. The conditions are similar to conditions imposed upon other family day care homes, and are designed to ensure land use compatibility with existing area residential development (Conditions I through 4). Therefore approval of this request, subject to the conditions, is recommended. CASE HISTORY Planning Commission Meeting (9/19/00): The applicants accepted the recommendation.
