RE VEST: (Amended) Rezoning from Community Business (C-3) to Community Business
(C-3) with Conditional Use Planned Development to permit exceptions to
Ordinance requirements. Specifically, an exception to the rear yard setback is
requested.
PROPOSED LAND USE:
Except as limited herein, uses permitted in the Community Business (C-3) District
are planned. (Proffered Condition 5)
(NOTE: PROFFERED CONDITION 16 WAS SUBMITTED SINCE THE
COMMISSION'S CONSIDERATION OF THIS CASE.)
To address concerns of area citizens and the Clover Hill Supervisor, on December 2, 2008, the
applicant submitted an additional proffered condition which requires additional water quality
measures be implemented with the development. Because this additional proffer was submitted
since the Commission's consideration of this request, Staff recommends the application be
remanded. However, should the Board wish to consider this request, staff continues to
recommend denial for the reasons outlined in the "Request Analysis."
Specifically, Proffered Condition 16 addresses erosion control measures to be implemented
during construction including a double row of super silt fence and increased capacity and
improved efficiency for sediment traps. The proffer also requires landscaping within the
Resource Protection Area (RPA) between the Swift Creek Reservoir and the northwest boundary
of the request property. In addition, the proffer requires upgrades to the stormwater management
facility north of the request property and requires pre-treatment of stormwater with on-site
infiltration facilities.

PROFFERED CONDITION
16. Water Quality Measures.
a. Erosion Control (Construction Phase).
i. A double row of super silt fencing shall be installed along the
northwest Property line parallel to the Swift Creek Reservoir.
11. The capacity of any proposed sediment traps or basin/pond(s)
necessary for construction shall be enlarged by 25%.
111. During construction, the developer shall use Anionic PAM
(polyacrylamide) to improve the operating efficiency of sediment
trapping measures.
b. Resource Protection Area ("RPA") Enhancements.
i. The RPA on Tax ID 722-672-0926 located on the portion of that
parcel between the Swift Creek Reservoir and the northwest
property line of the Property shall be planted with the initial phase
of development according to the planting standards outlined in the
Chesterfield County Environmental Engineering Resource Manual
reforestation guidelines.
c. Stormwater Management/Quality.
i. Stormwater from the Property shall be discharged into the existing
Stormwater management facility located to the north in a County
easement.
11. The developer shall expand the existing Stormwater management
facility located to the north as required to meet the Stormwater
requirements generated by the Property.
111. Contemporaneously with such facility modifications, the developer
shall upgrade or replace the existing basin principal outlet structure
with a traditional riser and trash rack anti-vortex device.
d. Pre-Treatment. The developer shall construct two Infiltration BMP
Design 8 facilities on the Property to enhance water quality treatment for
the Property, such facilities to be located generally at the east and west
ends of the Property. (EE)
