PROPOSED LAND USE: A computer controlled variable message electronic sign incorporated into a freestanding sign is planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. AYES: MESSRS. GULLEY, BASS, BROWN, HASSEN AND WALLER. STAFF RECOMMENDATION Recommend approval for the following reason: With the recommended condition, the proposal conforms to the Electronic Message Center Po icy. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) Copy shall be limited to a maximum of two (2) lines which shall not move, but may fade; b. The message or display shall be programmed or sequenced to change no more than once every ten (10) seconds; c. The copy display color shall either be white or yellow; d. Flashing and traveling messages shall be prohibited; and e. Bijou lighting and animation effects shall be prohibited. Existin.~ Zoning: C-3 with CUPD Size: 1.8 acres Existing Land Use: Commercial Adjacent Zoning and Land Use: North, South, East and West - A with Conditional Use and C-3; Commercial Public Water and Wastewater S,, std: The existing structure is connected to the public water and wastewater systems. While installation of the proposed sign will not impact the required use of the public water and 2 09SN0128-DEC17-BOS-RPT wastewater systems, the applicant is cautioned that the proposed sign must not be placed so as to conflict with the existing public water and wastewater lines or easements. ENVIRONMENTAL This request will have no impact on these facilities. PUBLIC FACILITIES Fire Service and Transportation: This request will have no impact on these facilities. T,ANT~ TT~F, Comprehensive Plan: Lies within the boundaries of the Southern Jefferson Davis Hi h~way Corridor Plan which suggests the property is appropriate for commercial use. Area Development Trends: The area around the intersection of Jefferson Davis Highway and Weir Road is characterized by commercial zoning and land uses. Commercial uses are expected to continue in this area, as suggested by the Plan. Sign Design: The applicant plans to incorporate acomputer-controlled variable message electronic sign into an existing freestanding sign. The property was previously occupied by a theater which had a sign nineteen (19) feet in height and an area of 240 square feet. The property has been redeveloped for drug store use. In accordance with the Ordinance provisions for sign replacement, a sign of 24.5 square feet in area and seventeen (17) feet in height has been erected. The applicant plans to add a 20.25 square-foot computer-controlled variable message electronic sign bringing the total sign area to approximately 44.8 square feet. It should be noted that with this approval, however, the sign could be replaced with a sign of fifty (50) square feet in area, increasable to 62.5 square feet with the provision of changeable copy, and a height of sixteen (16) feet. The electronic message center would comply with all aspects of the adopted Electronic Message Center Policy. CASE HISTORY Planning Commission Meeting (11/18/08): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Hassen, seconded by Mr. Bass, the Commission recommended approval subj ect to the Condition on page 2. AYES: Messrs. Bass, Brown, Gulley, Hassen and Waller.
