09SN0114-Addendum December 17, 2008 BS ADDENDUM 09SN0114 2 Enon LLC Bermuda Magisterial District Southwest quadrant of Bermuda Hundred and North Enon Church Roads REQUEST:Rezoning from Agricultural(A) to Light Industrial (I-1). PROPOSED LAND USE: Light industrial uses are planned. (NOTE: REVISIONS TO PROFFERED CONDITION 2 AND PROFFERED CONDITION 4 WERE SUBMITTED SINCE THE COMMISSION’S CONSIDERATION OF THIS CASE.) (NOTE: SHOULD THE BOARD WISHTO CONSIDER THE REVISIONS TO PROFFERED CONDITION 2, THEY MUST UNANIMOUSLY AGREE TO SUSPEND THEIR PROCEDURES, AS SUCH PROFFER WAS SUBMITTED AFTER THE CASE APPEARED IN THE NEWSPAPER.) On December 10, 2008, the applicant modified Proffered Condition 2 to require recordation of permanent easement to accommodate North Enon Church Road widening in the future. Because this revised proffer and Proffered Condition 4, as stated in the “Request Analysis,” relative to access and road improvements were submitted since the Commission’s consideration of this request, Staff recommends the application be remanded. However, should the Board wish to consider this request, approval and acceptance of the profferedconditions would be appropriate for the reasons outlined in the “Request Analysis”. PROFFERED CONDITION 2.Prior to any site plan approval or within ninety (90) days of a request by the Transportation Department, whichever occurs first, forty-five (45) feet of right of way, measured from the centerline of North Enon Church Road immediately adjacent to the property, shall be dedicated, free and unrestricted, to and for the benefit of Chesterfield County.
