This year the arrangement of the sections within the Procedures has been changed to logically follow how the Board conducts it business. Two recommended changes reflect long standing Board policies: First: that citizen comments should be germane to County business and second: that real estate tax exemptions are limited to $5,000. Micas Title: County Attorney 0800:80495.1(80494.7) Attachments: ^ Yes ~ No 000002 ~A9~2009 PROCEDURES OF THE BOARD OF SUPERVISORS Chesterfield County, Virginia nth®O~~ 2A98-2009 PROCEDURES OF THE BOARD OF SUPERVISORS BE IT RESOLVED by the Board of Supervisors of the County of Chesterfield in accordance with Section 3.4 of the County Charter that the following rules of procedures shall govern the conduct of meetings and work sessions of the Board of Supervisors during the ~8 2009 calendar year. Presiding Officer Section la. The Board's parliamentary procedures shall conform with law and the historical practices of the Board of Supervisors. The County Attorney shall act as parliamentarian to the Board. To the extent necessary to address any ambiguities in procedure, the County Attorney may consider the most recent edition of Robert's Rules of Order, a Manual of General Parliamentary for guidance. Any questions involving the application of rules of procedure or the interpretation of Robert's Rules shall be decided by the County Attorney. Section lb. The chairman, or the vice chairman, or in their absence the most senior member of the Board alphabetically, shall preside at all meetings of the Board, and on the appearance of a quorum shall call the meeting to order, and the Board shall then proceed with its business. Section lc. The presiding officer shall preserve order and decorum. He may speak, make motions, and vote on all questions, and he shall decide questions of order and procedure. The Chairman may set reasonable time limits for speakers and public hearings; provided that by majority vote the Board may reject such time limits. Regular Meetings Section 2. Each year at its organizational meeting the Board shall set the regular meeting times and dates for the following year provided, however, that the Board shall meet at least once each month. Whenever the regularly scheduled meeting date shall fall on a legal holiday, the regular meeting of the Board shall be held on the following day in accordance with §15.2-1416 of the Code of Virginia, 1950, as amended. The chairman may cancel any meeting because of inclement weather and should reschedule any canceled meeting at the earliest possible date by sending written notice to each member of the Board. Special Meetings Section 3. Special meetings of the Board may be called by two members of the Board or the chairman in accordance with §§ 15.2-1417 and 15.2-1418 of the Code of Virginia, 1950, as amended. Upon making such request, the clerk shall specify the matters to be considered and shall notify in writing all members of the Board and the county attorney immediately. The nn~o~'4 0800:80494.4 meeting may be held only if waivers are signed by every member of the Board and the county attorney, or if every member and the county attorney attend the special meeting. The order of business at a special meeting shall follow that of a regular meeting to the greatest extent possible. @n} Voting Section 4. A quorum shall consist of at least three members of the Board. A majority of a quorum shall be sufficient to carry any question except tax issues, incurring of debt and appropriations in excess of $500, all of which shall require a majority of the full Board for adoption. No Board member is required to vote on any question, but an abstention, although not a vote in favor of carrying a question, shall be counted as a vote for the purpose of determining a quorum. A tie vote shall defeat the motion, resolution or issue voted on, provided that all zoning cases must be disposed of by a motion approved by a majority of those voting. An abstention is considered a vote for all purposes and defeats a motion requiring a unanimous vote. The Board shall not designate a tiebreaker pursuant to § 15.2-1421 of the Code of Virginia. Debate and Reconsideration of Vote Section Sa. Each member of the Board may participate in discussion of any issue only after being recognized by the chairman. The chairman shall not recognize a motion to "call the question" until every member desiring to speak has had a chance to speak. At the conclusion of debate, the question shall be called and no further debate shall be in order. Section Sb. Any vote by a member of the Board is final once cast. Planning Commission decisions are final once made. No ordinance, resolution or motion previously voted upon by the Board shall be brought forward for reconsideration during the same meeting of the Board and shall be final unless changed by the Board at a subsequent meeting in accordance with law. Motions Section 6. When a motion is under debate, no additional motions may be made except a motion to withdraw, defer, substitute, or to amend. If the maker of a motion and the member seconding the motion agree, a motion may be amended or withdrawn. Such motions shall take precedence in the order listed above. Only one substitute motion shall be in order for a principal motion. All motions to defer shall be to a date certain. Prior to voting on a motion to defer or remand, the Board shall hear public comments on the issue of deferral or remand if the scheduled item requires a public hearing. 0800:80494.47 2 ~ ~ O 0 Agenda Section 7a. The county administrator shall prepare an agenda for each regular or special meeting of the Board on which shall appear the title of each matter on which action is to be taken at that meeting. The agenda for each regular meeting shall (a) be prepared at least five days prior to the meeting, (b) be promptly mailed or delivered to each member of the Board or placed in the repository assigned to such Board member, and (c) be distributed to appropriate officers and employees of the county government and members of the public and media requesting copies. Section 7b. Upon a majority vote of the Board of Supervisors, any item may be added when the agenda is voted on, and the chairman may allow any agenda item to be called out of sequence. Section 7c. Any matter not on the scheduled agenda, may be heard after the agenda has been approved by the Board only upon the unanimous vote of the Board members present. Any such matter must be of an emergency nature, vital to the continued proper and lawful operation of the county. Section 7d. No matter on the scheduled agenda shall be considered after 11 p.m. without the unanimous consent of the Board. Any matter not heard shall be automatically continued to the next appropriate scheduled meeting of the Board. Section 7e Requests for tax exemptions shall only be considered in December of each year and real estate tax exemptions shall be limited to $5,000 per year. Order of Business Section 8. The order of business at a regular meeting of the Board shall be as follows beginning at 3 p.m. or an alternate specified meeting time: a. Call to order. b. Approval of minutes of the previous meeting. Reading of the minutes shall be automatically dispensed with. c_County administrator's comments. d_Board committee reports. e. The Board shall confine their decisions to the matters presented on the agenda. Consent Agenda and Public Hearings Section 9a. Any Board member may remove an item from the consent agenda for comment by the Board. Any person may publicly speak to an item on that meeting's "Consent Agenda" for up to three minutes, so long as the Board votes to remove a consent item from the Consent Agenda for public comment. The Board may accept written comments in lieu of oral statements. 0800: 80494.47 4 () ~) ~ (~ Q~ Section 9b. Any person may speak at a public hearing for up to three minutes. An applicant in a zoning case may give an opening presentation of the zoning case for up to 15 minutes, regardless of the number of speakers the applicant chooses to give the presentation, and may give a rebuttal after all citizens have spoken for up to 5 minutes, regardless of the number of speakers the applicant chooses to give the rebuttal. Public Comment Period Section 10. Each citizen comment period shall be limited to 15 minutes and each speaker may not exceed 3 minutes. Citizens may only speak once per meeting during the citizen comment periods. Comments must be germane to the services or policies of the Count~No citizen shall speak on any matter of business that is a subject on the Board's agenda for that day. Citizens may not yield time to other speakers. Any person desiring to speak shall sign up at the meeting prior to the afternoon or evening session. At the beginning of the citizen comment period the clerk will read the names and comments will be given in the order of the sign-up sheet. Each citizen comment period will end after 15 minutes, regardless of the number of people who have signed up to speak. Persons speaking before the Board will not be allowed to: a. Campaign for public office; b. Promote private business ventures; c. Use profanity or vulgar language; or d. Address pending litigation or matters to be addressed at that meeting Minutes of Meeting Section 11 a. The clerk of the Board shall prepare and maintain adequate minutes of the proceedings of the Board in accordance with the requirements of the Code of Virginia, 1950, as amended. Each recorded vote shall indicate how each member of the Board voted. Preparation of minutes will not include every aspect of the Board's meetings relating specifically to discussion and debate, but will include all significant events relating to official action. Minutes shall be included as part of the agenda package for the subsequent meeting of the Board. Section l lb. The Board may correct its minutes after approval of the minutes only upon a clear showing that a clerical or administrative mistake was made. l~{~~~~~ 0800:80494.47 5 Zoning Section 12a. No zoning case shall be considered by the Board of Supervisors if amendments, changes, withdrawals or proffers have been submitted by the applicant after the case has appeared in the newspaper pursuant to the required publication. All such cases shall be deferred to the next appropriate Board meeting for consideration or remanded to the Planning Commission after proper readvertising. Section 12b. If a majority of the Board is not reelected, no appropriation for any capital project or operational program for a magisterial district or zoning case shall be considered by the Board of Supervisors after November 8, 2011 until the organizational meeting in January 2012 unless such delay for the zoning case would exceed 12 months. Appointments Section 13. Appointments to committees of the Board and to authorities, boards and commissions shall be made only by resolution adopted by a majority of the full Board at a meeting subsequent to the meeting when the name has been offered to the Board for consideration. Prior to consideration of the nomination, the nominee shall be notified to determine his willingness to serve and to determine if he meets the minimum qualifications for such appointment. Committees Section 14. The Chairman or the Board may create committees and shall appoint members to such committees in the same fashion in which the committee was created. Committees may hold hearings and perform such other duties as may be prescribed. A committee may be instructed concerning the form of any report it shall be requested to make, and a time may be fixed for submission of any report. The Chairman may create, and appoint members to, a Budget and Audit Committee, a School Board Liaison Committee and a County Employee Benefits Committee and other committees as may be necessary. Amendment of Rules Section 15a. The rules of procedure of the governing body may be amended at any time during the year by a unanimous vote of the full Board. Section 15b. The Board of Supervisors may suspend the application of any section of these rules by a unanimous affirmative vote of all Board members present at any time during the agenda. Section 15c. Wireless Internet Access in County Facilities Q~o~~. ~ Updated 1/8/09 COUNTY ADMINISTRATOR'S REPORT TO BOARD OF SUPERVISORS JANUARY 13, 2009 Citizen's Budget Advisory Committee The Committee has met three times (monthly since November) and agreed to meet more frequently as needed. Members are provided with information in advance of their meetings so the meeting time can be used most effectively. The committee has established operating rules and procedures and began work right away to build a baseline of knowledge with the information they have reviewed, including the county's strategic plan, financial policies and the budget process. Information has also been reviewed that gives the committee a perspective on historical staffing, revenue and expenditure trends in the various county departments, as well as the general make- up of the different types of general fund revenues. In addition, the committee has reviewed the October 31 BOS work session providing insight on the revenue outlook for FY2010. They also are reviewing the inventory of programs and services that the county provides. The most recent meeting of the Committee was this past Thursday, January 8. Staff provided the committee a brief update on FY2010 budget activities including the latest information on revenue estimates, impacts of the governor's budget recommendations, staff activities related to program and service reviews and the approach being taken to identify/evaluate ways for balancing the budget. The committee is aware of the budget timeline and understands the limitations with respect to the magnitude of impact they can make on the FY2010 budget. They are prepared to make recommendations to assist in balancing the FY2010 budget and have established agendas for the next two meetings focused on doing so. In the coming meetings, the committee has asked to review more detailed information on the revenue make-up and outlook for FY2010, the direction and ideas that staff is considering with respect to balancing the budget, as well as information on the proposed Capital Improvement Program. This information will better inform members of the county's challenge, as well as the current thinking on how to move forward. Committee members are very committed to their responsibilities and are eager to help the county in this process. Understanding this challenge, the committee has increased the frequency of their meetings. I am very pleased with their enthusiasm, sincere desire to help the county in this process, and the approach they have established to help move us forward. Items on Board's Agenda Toda 1. FRANCES HAYES BROWN FOR HER SERVICE ON THE CHESTERFIELD COMMUNITY SERVICES BOARD WHEREAS, Ms. Frances Hayes Brown, representing the Matoaca Magisterial District, has served as a dedicated and faithful member of the Chesterfield Community Services Board since her appointment by the Board of Supervisors in January 2000; and WHEREAS, Ms. Hayes Brown, during her three terms as a member of the Chesterfield Community Services Board has served with distinction in the office of Chair and Vice Chair, served on the Executive Committee in the office of Chair and Vice Chair, as well as Chair of the Consumer and Family Affairs Committee and the Finance Committee; and WHEREAS, for a number of years, Ms. Hayes Brown has been an active volunteer and concerned citizen of Chesterfield County, serving in numerous leadership capacities including the Chair Youth Services Citizen Board, and member of the Advisory Board for the Chesterfield Community Development Block Grant Council where she advocated for the needs of the Chesterfield Community Services Board when they applied for those funds; and WHEREAS, Ms. Hayes Brown advocated for those under-served people in the Matoaca area, including supporting the mission of the Children's Home until its recent closing; and WHEREAS, because of her professional role in the Virginia Department of Juvenile Justice, Ms. Hayes Brown worked to advocate for the needs of that population and to ensure the Chesterfield Community Services Board planned for those needs; and WHEREAS, Ms. Hayes Brown is acknowledged locally and throughout the Commonwealth for her steadfast dedication and genuine concern for all persons with disabilities. Subiect: Set a Public Hearing to Consider Amending the Public Facilities Plan County Administrator's Comments: County Administrator: Set a Public Hearing to review and consider the Public Facilities Plan Amendment for February 25, 2009. Summary of Information: On July 30, 2008, the Board of Supervisors deferred action on this request until the January 14, 2009 meeting. At a Planning Commission meeting on June 17, 2008, the Planning Commission recommended approval of the proposed Public Facilities Plan (revised 6/17/08). This document will replace the Public Facilities Plan that was adopted by the Board of Supervisors in April 2004. In addition, staff would utilize this document as a gap-filling measure until the adoption of the Countywide Comprehensive Plan, which would include a completely revised public facilities element. The Public Facilities Plan amendment, once adopted, will guide future decisions regarding the provision of identified public facilities, including: fire, police, library, parks, schools, transportation, jails, waste, airport, fleet, utilities and telecommunication facilities. This methodology can also be used should the Board of Supervisors adopt a countywide school level of service recommendation, as recommended by the Chesterfield County Planning Commission in July 2008. The Board deferred consideration of setting a public hearing for this countywide level of service recommendation until January 14, 2009. The school level of service recommendation contained in the Upper Swift Creek Plan establishes a test to determine if residential development deriving from proposed rezonings in the plan area could result in subsequent student enrollment exceeding adequate school facilities capacity standards. The full text of the Upper Swift Creek Plan school level of service recommendation is found in Attachment A. In accordance with that recommendation, staff's implementation methodology incorporates the following data for each county school: • 2008-09 functional capacities, as provided by School Board staff. • Fall 2008 membership, as provided by School Board staff. • Projections of the number of unbuilt residential dwellings contained in tentative subdivision plats and residential site plans currently on file with and approved by the Planning Department. • Projections of the potential number of students that could be generated from those potential units based on student per household yields currently used in the county's cash proffer calculations. Attachment B is a summary table of these data and projections for each school district. While this test only currently applies to the Upper Swift Creek Plan area, the methodology incorporates all of the county's elementary, middle and high schools. Because of the complexity of overlapping school boundaries, it is actually easier for staff to maintain a countywide adequate facilities test system rather than one confined to the Upper Swift Creek Plan area. Providing a FIRST CHOICE community through excellence in public service Attachment C is a map indicating areas where proposed rezonings would not meet the test for adequate school facilities at 120 percent of functional capacity, as recommended by the Upper Swift Creek Plan. This map is based on an overlapping of all elementary, middle and high school districts whose projected test membership is 120 percent or greater of 2008-09 functional capacity. Attachment D is a map indicating areas where proposed rezonings would not meet the test for adequate school facilities at 110 percent of functional capacity. In evaluating this information, the following should also be considered: As shown in Attachment B, in some instances for elementary schools School Board staff's projected fa112009 membership is greater than the projected membership based on the Adequate Public Facilities Test. This is because the test only projects membership increases from potential new dwellings contained in approved tentative subdivision plats and site plans. The test does not account for other enrollment increases that could be expected from resident children entering the school system for the first time, immigration, etc. The Adequate Public Facilities Test only accounts for unbuilt residential dwellings contained in approved tentative subdivision plats and residential site plans, and not all potential dwellings that could be built within each school district. For example, Planning Department staff estimates countywide there are currently 19,000 unbuilt dwelling units in approved tentative subdivision plats and residential site plans, but there are an additiona130,600 potential units that could be built on land zoned for residential development but not yet incorporated into approved tentative subdivision plats and residential site plans. In effect, the test only accounts for 38 percent of all potential new dwelling units. We hope you will find this information of value. Schools shall be responsible for determining 1) the current enrollment for each school; 2) the capacity of each school; and 3) the anticipated impact of the proposed development based on the maximum number and type of residential dwelling units or lots, including proffers for limited or delayed development. b. If any of the applicable public schools which would serve the future residential development on the subject property exceed 120% of capacity at the time of the review of the subject rezoning request, the proposed rezoning does not pass the test for Adequate School Facilities. In addition, the proposed rezoning will not pass the test for Adequate School Facilities if the anticipated enrollment at any school to serve the subject rezoning will exceed 120% of capacity upon the development of 1) the property proposed for rezoning; and 2) all unimproved residential lots in the service area shown on approved preliminary site plans, preliminary subdivision plans and construction plans. c. When the capacity of any public school in the service area is determined to exceed 120% under the conditions described above, and where such school is expected to be improved to less than 120% of capacity within one year of the date that the Board of Supervisors is scheduled to consider the subject rezoning request, the residential rezoning will pass the test for Adequate School Facilities. Summary of Information: This project consists of the construction of nutrient compliance equipment and systems including a fine screens building and methanol facilities along with associated civil, structural, piping, and electrical work at the Falling Creek Wastewater Treatment Plant. The project is one of five nutrient reduction projects required in response to Chesapeake Bay Water Quality regulations. Staff received nine (9) bids ranging from $20,349,608.56 to $25,289,000.00. The lowest bid, in the amount of $20,349,608.56, was submitted by Southwood Builders, Inc. The County's engineering consultant, Malcolm Pirnie, has evaluated the bids and recommends award of the contract to the low bidder. Addison, Jr. began his public service with the Chesterfield County Utilities Department's water treatment plants on September 19, 1973, and has faithfully served Chesterfield County for 35 years; and WHEREAS, Mr. Addison demonstrated an impressive scope of talents as the only water plant employee ever to work in the operations, laboratory and maintenance sections, and throughout his career always responding in an admirable manner during crisis situations; and WHEREAS, Mr. Addison advanced in his career to become the Chief Operator of the Addison/Evans Water Treatment Plant, where he set a high standard for supervising water plant operations as evidenced by the facility being awarded the Environmental Protection Agency's Ten Year Director's Award for superior water treatment; and WHEREAS, Mr. Addison was recognized by his peers in the water treatment industry for being a highly competent professional as evidenced by him being named Water Plant Operator of the Year for the State of Virginia in 2000 and serving on the Board of Trustees of the Virginia Section of the American waterworks Association; and WHEREAS, Mr. Addison will forever have the admiration of those he worked with as a strong and capable leader and colleague whose support, companionship and ever-ready assistance brought unity and pride to the workplace. Senior activities at The Episcopal Church of Our Saviour have been operating since July 2008. It is anticipated that the program at the Huguenot Road Baptist Church would begin on February 1. The proposed lease agreements will serve to document the ongoing activities. Summary of Information: The Chesterfield County Parks and Recreation Department is sponsoring older adult activities at satellite locations in order to better serve the recreation needs of senior citizens. In July, funds were allocated by the Board of Supervisors to operate programs at The Episcopal Church of Our Saviour four days per week and at Huguenot Road Baptist Church one day per week. Activities include classes in aerobics and arts and crafts as well as special events, including brown bag education series and potluck luncheons. The program at The Episcopal Church of Our Saviour is cosponsored by the nonprofit group, Chesterfield Senior Center. Summary of Information: The Planning Commission held their public hearing on the attached church steeple height exemption ordinance amendment on November 18, 2008. The Planning Commission recommended denial of the ordinance amendment based upon a concern that allowing church steeples to increase in height through an administrative approval process would eliminate the opportunity for concerned residents to participate in a public hearing process. Snead Attachments: ^ Yes Title: Director, Social Services No # 0007.06 RECOGNIZING THE COMMUNITY RESPONSE TO AMERICANA MOBILE HOME PARK CLOSURE WHEREAS, in September 2007 approximately 275 households in the Americana Mobile Home Park were notified of the sale and impending closure of the park by a developer; and WHEREAS, many trailers were too old to be moved to other parks and many residents were elderly or disabled or had limited financial resources making relocation challenging; and WHEREAS, concerned citizens and agencies partnered with the Jefferson Davis Association (JDA) forming the Americana Coalition, including the Better Housing Coalition, Chesterfield-Colonial Heights Alliance for Social Ministry (CCHASM), Commonwealth Catholic Charities, Elder Homes; Middle District Baptist Association, United Methodist Urban Ministries of Richmond, United Way of Greater Richmond and Petersburg, Chesterfield County Community Development and Chesterfield-Colonial Heights Department of Social Services; and WHEREAS, Bon Secours Memorial School of Nursing voluntarily assessed disabled or elderly residents; the Middle District Baptist Association and area churches, including Chester Baptist, Chester and Ampthill Presbyterian, and Sherbourne and Trinity United Methodist and others, identified housing resources, moved households, demolished decks, porches and fences and removed debris to ensure residents could receive the park's relocation reimbursement payment; Senior Connections assisted elderly residents, CCHASM and United Way made referrals and participated in arranging financial assistance; and various community helpers located property, new mobile homes, apartments or houses, cleared lots after moves, secured deposits, down payments or temporary lodging; and representatives of the JDA worked with others to help the many abandoned animals and the feral cat population; and WHEREAS, Chesterfield Community Development Division led coordination of resources; County school administration helped assist students affected by relocation; Chesterfield Mental Health Support Services worked intensively with persons they serve to transition them to new housing; and the Department of Social Services operated a hotline for residents to ensure locally relevant referrals and follow-up; and WHEREAS, the JDA and the Americana Coalition held a public meeting in March 2008 to provide a forum for community organizations and businesses to offer resources and provide assistance to the residents; and WHEREAS, the JDA maintained a regular presence in the park, assessing resident needs, providing information, direction and encouragement to take advantage of available resources, as a result of which all lots were successfully vacated by early November 2008; and ~~~~_®~ WHEREAS, the assistance made available by the JDA and the Americana Coalition, comprised of county representatives, area churches and myriad community organizations and individuals, provided moral support, physical labor, financial aid, and a guiding hand. Summary of Information: As shown in Attachment A, the fee for all Conditional Use applications (with the exception of family day care homes) was increased in July, 2008 to make it match the fees charged for rezoning, Conditional Use Planned Development and Substantial Accord applications. Members of the Board of Supervisors have recently expressed concern about the Conditional Use fee charged for the following types of applications: • Conditional Use For Any Use Incidental To A Principal Dwelling Unit Except Family Day Care Homes The current fee schedule adopted in July 2008 increased application fees for conditional uses in residential districts from $2,200 plus $95 per acre to $5,300 plus $90 per acre. The fee for family day care homes would remain at $300. • Conditional Use For Recreational Facilities And Grounds Primarily Serving The Surrounding Residential Community This proposed revision addresses concern about fees currently charged for Conditional Use applications for playgrounds and other recreational facilities proposed to serve adjacent residential communities. In July 2008 these fees were also increased to $5,300 plus $90 per acre. Staff proposes going back to the pre July 2008 Conditional Use fee of $2,200 plus $95 per acre for these types of Conditional Uses. The fee for all other Conditional Uses is recommended to remain unchanged.
