RE VEST: Rezoning from Agricultural (A) to Residential (R-12).
PROPOSED LAND USE:
A single family residential subdivision with a minimum lot size of 34,425 square
feet is planned (Proffered Condition 8). A maximum of eight (8) lots are
proposed, yielding a density of approximately 0.98 dwelling units per acre.

EXHIBIT WERE SUBMITTED SINCE THE COMMISSION'S CONSIDERATION OF
THIS CASE.)
To address concerns of the Matoaca District Supervisor, on January 6, 2009, an additional
proffered condition and related exhibit were submitted to require a buffer between the planned
access road into the development and the northern property boundary. Specifically, a variable
width landscaped buffer, as generally shown on Exhibit 2, attached herewith, will be required,
except as may be modified by the Planning Commission at the time of plans review (Proffered
Condition 10 and Exhibit 2). Staff recommends that this proffer not be accepted. The proposed
buffer would be located on an individual lot rather than in recorded open space thereby making
the individual lot owner responsible for maintenance of the buffer. It has been Staff's experience
that individual homeowners clear these areas resulting in a zoning violation on that individual
lot. The maintenance of landscaping within this area will be difficult, if not impossible, for the
County to enforce.
Because numerous revisions to the proffered conditions and the exhibits have been submitted
since the Commission's consideration of this request, Staff recommends the application be
remanded. However, should the Board wish to consider this request, approval and acceptance of
Proffered Conditions 1 - 9 in the "Request Analysis" would be appropriate for the reasons

outlined in the "Request Analysis". As noted herein, Staff recommends Proffered Condition 10
not be accepted. The proposed buffer would be included within the limits of an individual lot
rather than in open space, thereby placing the responsibility for maintaining the buffer on that
individual lot owner.
(NOTE: THE ONLY CONDITION THAT MAY BE IMPOSED IS A BUFFER
CONDITION. THE PROPERTY OWNER(S) MAY PROFFER OTHER CONDITIONS.
THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH
STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE
RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE
ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.)
PROFFERED CONDITION
10. Except as may be modified by the Planning Commission at the time of plans
review, a variable width landscaped buffer shall be provided as generally shown
on Exhibit 2 prepared by Balzer and Associates Inc., dated December 30, 2008.
This buffer shall comply with Ordinance requirements for buffers less than fifty
(50) feet in width. (P)
