Coalition of the Year Award for 2008 County Administrator's Comments: County Administrator: Board Action Requested: Mr. Holland has requested that the Board adopt the attached resolution. Summary of Information: The Community Anti-Drug Coalitions of America (CADCA) has designated SAFE as a "Got Outcomes! Coalition of the Year" for 2008. Each year CADCA selects two coalitions from across the nation to receive this award. The Got Outcomes! awards are a competition recognizing coalitions that have successfully impacted substance-abuse outcomes in a measurable way through the implementation of a sound strategic plan. The rigorous, two-phase process requires coalitions to document how they have been effective change agents in their community by demonstrating communitywide declines in their substance abuse problems. The model coalitions have undergone a comprehensive community assessment, used the data to develop a communitywide plan, implemented a truly comprehensive response to their local substance-abuse problems, and as a result, can document the community changes they have helped bring about and their contributions to population-level substance abuse outcomes. Chesterfield County's dramatic reduction in inhalant abuse was the most compelling factor in choosing SAFE for this recognition. Preparers Jana D. COALITION OF THE YEAR AWARD FOR 2008 WHEREAS, inhalant abuse is breathing the concentrated fumes of legal, common products to get high; and WHEREAS, inhalant abuse exposes the brain and body to toxic, poisonous substances, causing damage and sometimes sudden death; and WHEREAS, inhalant abuse affects the ability of children to be successful in school; and WHEREAS, inhalant abuse is most common among younger adolescents, peaking in eighth-grade; and WHEREAS, nationally, inhalant abuse has shown no decline over the past six years, with nearly one in five eighth-grade students having tried an inhalant in their lifetimes and four percent having used in the past 30 days; and WHEREAS, data from a survey of Chesterfield County Public School students in November 2005 revealed eighth-graders' past 30-day use of inhalants was higher than the national average for lifetime use and double the national average for past 30-day use; and WHEREAS, SAFE, Chesterfield County's substance-abuse prevention coalition, developed a comprehensive approach to reducing inhalant abuse in Chesterfield County; and WHEREAS, SAFE, in partnership with Chesterfield County Public Schools, the departments of youth planning and development, health, police, fire and mental health support services, and National Counseling Group Inc., implemented a variety of inhalant-abuse prevention activities; and WHEREAS, data from the November 2007 youth survey showed a 40 percent drop in lifetime use and a 44 percent drop in past 30-day use of inhalants by eighth-graders; and WHEREAS, the Community Anti-Drug Coalitions of America will be presenting SAFE its Coalitions of Excellence Got Outcomes! Milestone Award in recognition of this accomplishment at its national conference in Washington, D.C. on February 12th; and WHEREAS, this highly competitive and prestigious award recognizes coalitions that have shown they are leaders in the field of substance-abuse prevention and change agents in their community; and WHEREAS, this award exemplifies the effectiveness of community collaboration through coalitions like SAFE. MICHEL ZAJUR WHEREAS, Mr. Michel Zajur is president and chief executive officer of the Virginia Hispanic Chamber of Commerce; and WHEREAS, Mr. Zajur was born in Mexico City, Mexico and attended Virginia Commonwealth University; and WHEREAS, Mr. Zajur was the owner of his family's business, La Siesta Mexican Restaurant, for more than 30 years; and WHEREAS, beginning in 1992, Mr. Zajur and his wife, Lisa, began to offer cultural programs to the community to teach children about Hispanic culture and to motivate them to learn Spanish; and WHEREAS, this program, which began as Siesta Town and is now called the Spanish Academy and Cultural Institute, has served more than 45,000 children; and WHEREAS, after providing informal assistance to Hispanic business owners and operators for years, in 2000, Mr. Zajur established the Virginia Hispanic Chamber of Commerce; and WHEREAS, the Virginia Hispanic Chamber of Commerce helps Hispanic-owned businesses to succeed by connecting them with business opportunities in Virginia; and WHEREAS, in addition to his involvement in the Virginia Hispanic Chamber of Commerce, Mr. Zajur has served on many boards throughout Virginia, including the Richmond Chamber of Commerce, the Richmond Chamber of Commerce Foundation, the Red Cross, United Way, Catholic Charities, the Performing Arts Foundation and the Greater Richmond Retail Merchants Association; and WHEREAS, Mr. Zajur was appointed by then Governor of Virginia, Mark Warner, to the Commission on National and Community Service in October 2002, and the Governor's Latino Advisory Commission in 2004; and WHEREAS, Mr. Zajur also served on the Congressional Safety and Security Council and the Chesterfield County Blue Ribbon Committee for Economic Development; and WHEREAS, in October 2002, Mr. Zajur received the prestigious National Conference of Community Justices Humanitarian Award for the work he and his wife performed as facilitators and coordinators for world Wide Marriage Encounter in the Richmond area. Summary of Information: A work session on the proposed Capital Improvement Program (CIP) has been scheduled for this date. Staff will present amendments to last year's Adopted FY2009-2014 Capital Improvement Program. The Program encompasses a six year period, FY2010-2015 and proposes funding for new facilities, renovations and expansions of existing facilities, and transportation projects. The six year plan proposes expenditures of $862.7 million. Subject: Nomination/Appointment to the Towing Advisory Board County Administrator's Comments: County Administrator: Board Action Requested. Nominate/Appoint a member to serve on the Towing Advisory Board. Summary of Information: Under state statute, the county contracts with motor vehicle towing companies to tow vehicles that are involved in accidents, are abandoned or are involved in criminal activity. The county has a Towing Advisory Board which is appointed by the Board of Supervisors pursuant to state law and advises the Police Department on the towing contract which regulates towers that are on the Police Department's list of approved towing companies. The Towing Advisory Board also discusses issues of interest to both the contract towing companies and the Police Department relating to towing. The members of the Towing Advisory Board serve at the pleasure of the Board. In accordance with the Code of Virginia §46.2-1217, the Towing Advisory Board shall include representatives of local law enforcement, towing operators, and the general public. There are three towing operators on the Advisory Board. Colonel Dupuis has recommended that the Board nominate and appoint Sgt. Brad Badgerow to replace Sgt. David Deringer on the Towing Advisory Board. The individual meets all eligibility requirements to fill the vacancy and has indicated his willingness to serve. Preparers Thierry G. Subject: Approval of the Chesterfield County Police Department Towing Contract County Administrator's Comments: County Administrator: Board Action Requested: Approval of the attached towing contract as approved by the Chesterfield County Police Department Towing Advisory Board. Summary of Information: The Police Department contracts with towing companies to tow vehicles that are inoperable due to varying circumstances such as vehicle crashes and mechanical problems. These companies are called upon when the owner of the vehicle has no preference on a wrecker. Per Virginia Code section 46.2-1217 the Towing Advisory Board, which is appointed by the Board of Supervisors, must review and agree on any changes to the contract between the Police Department and the tow company owners. The Towing Advisory Board met and agreed on the attached contract and price addendum. The County Attorney's Office has approved the contract. The Towing Advisory Board and the Police Department endorse the attached contract and price addendum and request approval by the Board of Supervisors. Preparers Thierry G. NOW ~hHER~:FORE in consideration of the placement of Contractor on the eligible list of towing operators, Contractor agrees that it will fully comply with all of the terms set out below. f. By signing this contract, Contractor certifies that its operation complies, and shall continue to comply, with all conditions, equipment specifications and requirements under this contract. Failure to comply or false statements concerning compliance shall be grounds for tc;rmination. 2. The County reserves the right to terminate this contract at anytime for any breach of the terms of tris contract. 3. If Contractor declares bankruptcy or otherwise ceases operations during the terms of this contract, the Contractor shall notify the County in writing immediately. 4. Any towing contractor submitting an application to be placed on the Chesterfield County Police towing contract list shall have conducted towing services in Chesterfield County under its current business name for a minimum of one (1) year. Prior performance and reputation in the community, as reported through the Police Department. and criminal history record information on the applicant, and input from tlic Chesterfield County Towing Advisory Board will be considered when a contractor submits his/her application. 8. Applicant must supply a copy of lus criminal history record to towing coordinator. Criminal History records will be obtained through the Virginia State Police. Contractor shall install and maintain a sign at ilie storage lot providing the company name and a telephone number where ilie owner, manager or attendant may be reached aL any time so a towed vehicle may be reclaimed by its owner during operating hours. Contractor shall insure that service is provided for its storage lot seven (7) days a week from 7:00 a.m. until 10:00 p.m. to return vehicles upon ilic payment of towing and storage charges. If a vehiicle is reclaimed from 7:00 a.m. to 5:00 p.m., response time to the storage lot by die contractor or his designee shall not exceed one (1) hour. If a vehicle is reclaimed between 5:01 p.m. and 10:00 p.m., response time by ilie contractor or his designee to die storage lot shall not exceed 2 hours. No office facilities are required to be maintained at the storage lot and die lot does not have to be constantly manned during die Lime drat service is required to be provided under dais contract. Contractor shall provide adequate security for all vehicles towed, including a fence enclosing die Low lot that meets or exceeds die standards prescribed by die BIRO public safety regulations. The Contractor shall be responsible for the vehicle towed and its contents from die time it is towed until one of die following occurs: -2- O~0(1~43 a. The velucle is delivered to a location specified by die owner or operator. If the owner, manager or agent of the specified location refuses the delivery of the velucle, the mileage charge will continue to the Contractor's tow lot. b. 1'he vehicle is released and accepted by the owner or the owner's agent; or The vehicle is otherwise disposed of according to law. 11. "Phis contract shall expire on Apri130`~ of each year, unless otherwise terminated pursuant to the teens of this contract. 12. 'phis contract may be renewed for additional one-year terms if the Contractor submits to the County a signed, notarized form provided as Addendum C and an updated criminal history form obtained from the Virginia State Police, and an updated Virginia DMV driving record, and the Contractor has complied with all teens of this contract in the past, and the County approves such renewal. Addendum C forms must be received by the County on or before April l~ of each year to facilitate uninterrupted placement on the authorized towing list. 13. The Contractor shall meet the following minimum requirements and any other requirements of the BIRO as well as any other reasonable requirements the County may impose in its discretion from time to time: a. All wreckers must be registered as required by law under Virginia State Code (sec46.2-6491). Contractor shall display proper license plate as required by DMV. b. All wreckers roust have business name, address and phone number on bode sides of the velricle and visible to the naked eye from a distance of fifty (.50) feet. (Sec. 46.2-1076 D) The lettering will be permanently affixed to the wrecker Magnetic signs are prohibited except in the use of rental wreckers as provided in paragraph 23 of this contract. Contractor shall comply with County Code sec 19-510.(b) and 13-42 that states the following; No off-street parking area or other premises in an R, R-TH, MH and R-MI' district, except on a farm where die parking is incidental to the farming use being conducted on die property, shall be used for the parking or storage of any truck or commercial vehicle exceeding 4,000 pounds net weight and having more than two axles, except while loading or unloading on the premises. -3- No truck having wheels of the dual-tire type in excess of 6,000 pounds and no trailer, semitrailer or cab for such trailer shall be parked on any road in tlic county within any residential district as defined in the zoning ordinance. d. Contractor shall not park a wrecker in a residential area while carrying or towing vehicles. e. All wreckers must have current Virginia State Inspections. All wreckers shall be standard vehicles originally designed and built as wreckers and shall not be pick-up or similar trucks with towing slings on the body. g. All wreckers shall be provided with at least one (1) shovel, one (1) broom, one (1) container or pail for glass and debris, 5-pound serviceable/charged multi-purpose fire extinguisher and a sufficient amount of absorbent material equal to a five (5) gallon bucket and any other equipment required by die BTRO. h. In addition to the required standard lighting equipment, each wrecker will be outfitted with a flashing, blinking or alternating (rotating) amber light(s) as required by State Code, Section X6.2-1025 and X16.2-1030(0). Additions or changes in equipment or storage facilities may be made to Attaclunent A after the police have inspected and approved all equipment/facilities to be added to said attachment and after the police have been notified in writing by die Contractor of the deletions of equipment or storage facilities listed in Attachment A provided; however; that the Contractor shall at all times comply with minimum equipment and storage facility specifications of this contract or this contract shall be terrninated. 1~. The County reserves the right to contract with no more approved wrecker/towing companies at any one time than it deems to be necessary. 15. The Contractor shall be able to respond to police calls for impoundment or seizure for towing and wrecker services every day of the week on a twenty-four (2~) hour a day basis. 16. Response time for the arrival on the scene by the tow truck shall not exceed ttiirry minutes from the time the call for service is made by the County. In the event the Contractor deternunes from the circumstances of ttie call for service, that a larger than normal wrecker is required, an additional thirty minutes will be allowed. In the event the response time exceeds such time limits, the County reserves the right -4- UUUU45 to call any other available contractor. hrequent failures to respond witun the appropriate time limits shall be considered grounds for Lennination of this contract and removal from tie eligibility list. 'I'hc above time limit may be waived by the County for good cause. 17. In tic event an owner or operator of a velucle to be towed requests towing service from someone other than die County contracted towing services, such request shall be honored by die County unless circumstances prevent die request from being honored. 18. It shall be die responsibility of the Contractor to determine die appropriate wrecker to be sent on any call. The Contractor shall notify the Chesterfield County Emergency Communications Center Supervisor of a temporary change of telephone number. Any permanent change in address or phone number shall be made in writing to die Support Services Division, Chesterfield County Police Department, P.O. Box 148, Chesterfield, Virginia 23832. 20. All wrecker operators employed by tie Contractor shall be duly licensed as required by die Code of Virginia, and shall have such license in Heir possession at all times when operating wreckers or other equipment. 21. The Contractor shall be responsible for tic removal of all debris from die scene before departing. In tie event teat two or more wreckers are at a scene, Contractor agrees to cooperate wits all drivers as necessary for clean-up. If all oilier tow trucks have left die scene, die last tow will be responsible for cleaning up die debris. 22. The Contractor shall not release any vehicles "seized" or "seized for forfeiture" by tie County until the Contractor obtains permission from tie County or is ordered by die Court to release tic vehicle. 23. In performance of its duties under tiffs contract, tie Contractor shall use only dial equipment which has been inspected and approved by tie County. All approved equipment of tic Contractor shall be listed on Addendum A hereto, wluch is made -5- ~~®~~'~~ part of this contract. Use by the Contractor of equipment of any other towing facility, regardless of ownership, or of unapproved equipment, shall constitute just cause for immediate termination of this contract. If a contractor's wrecker is temporarily disabled a rental wrecker may be utilized, with the written approval of Chesterfield County Police Deparl~nent for up to 30 days. Extension of tune to the 30 day tune limit may be granted at the discretion of Chesterfield County Police Department The rental wrecker must meet all of the requirements of this contract and magnetic signs displaying the name, address and telephone number of the Contractor shall be affixed on both sides of tlic rental wrecker. (Magnetic signs are not otherwise allowed on wreckers owned and used by the Contractor.) The Contractor shall notify Chesterfield County Police Departrnent's towing coordinator for approval prior Lo putting a rental wrecker in service. This provision shall not prohibit the use of "specialty equipment" under emergency conditions. When so instructed by the police, the Contractor shall provide whatever equipment is necessary to move die motor velricle designated by die County, including, but not limited to, dollies, winches, cable extensions, and off road work. 2~. The Contractor hereby ~,nants die County permission to inspect periodically all equipment and storage facilities listed in Attaclnnents A and B at the convenience of die County. Whenever die County deterniines any storage facility or equipment to be unacceptable, die County shall eve written or verbal notification to die Contractor of its determination, and said unacceptable equipment or storage facility shall not be used by die Contractor in performance of its obligations hereunder until corrected, and, if not reasonably corrected widen 10 days, such equipment or storage facility shall be deleted from Attachment A. All findings of unacceptable equipment will be documented in tl~e tow company's file at die Police Department. 25. 'lie Contractor shall keep for two (2) years all records related to the towing of vehicles which have been towed under dais Contract 'These records will include copies of the itemized bill given to owner or operator as outlined in section 28(c) of dais contract. Contractor shall keep separate all towing charges billed under dais contract Such records shall be available at any time for inspection by the police. 26. 1'he Contractor represents that no current employee or member of die governing body of die County of Chesterfield has any interest, direct or indirect, in the Contractor's business. 27. The Contractor shall indemnify, hold and save harmless die County of Chesterfield, the Board of Supervisors of Chesterfield County, Virginia, and all County officers, agents and employees from and against any and all claims, causalities, damages, injuries, suits, actions, or causes of actions, arising or asserted by reason of any act or omission of tlic Contractor, its officers, agents or employees in the performance of this contract. -6- ~QO~J~~ 28. The Contractor may charge three basic fees for it"s services: a night tow fee to cover the period from 7:00 p.m. to 7:00 a.m., a day tow fee to cover the period from 7:01 a.m. to 6:59 p.m. and a holiday fee. The holiday fee may be charged on holidays recognized by Chesterfield County. The county holidays are listed on Addendum D of this contracC. A master copy of die towing fees will be supplied to tlic Contractor by die County. The contractor will give copies of the master copy to die owner or operator. Only the copy approved by die County will be supplied to die owner or operator. If operator or owner is noL available at die time of tow a copy maybe given when customer picks up vehicle. When requested at the scene of die tow or at die Contractor's storage lot, die Contractor shall release to die owner or his or her designee personal contents of velucle that are not pernanently attached to die vehicle. At no time can die Contractor hold personal items not permanently affixed to die vehicle in lieu of payment of die tow bill. a. Fees allowed are listed on Addendum D of tlus contract. Contractor can charge for an additional wrecker, person or equipment if utilized for die same vehicle. The fee listed in Addendum D for additional person, wrecker or equipment shall not exceed die fee for disabled passenger vehicles, pick- up, St1Vs or vans. If a wrecker responds and services are not required, no charge will be made by the Contractor if it has not hooked up to die vehicle. An example would be a parking violation where die owner arrives to claim die vehicle before die wrecker is attached to die vehicle in violation. c. 1'he Contractor shall present to the owner or operator of any motor vehicle towed or stored an itemized bill containing tlic following information: Vehicle owner's name, address and/or; -7- ii. Vehicle description including manufacturer, color, model and license plate number and vehicle identification number; iii. Date and time vehicle towed, incident number assigned by Police Communications Center, location from which the vehicle was towed and the reason for the tow, list of services provided and individual cost; iv. Location, date and the vehicle was released. It is preferred that the itemized bill has the information from both i and ii even if the information from i is unavailable the bill must contain the information required by ii. d. A separate fee may be charged for the release of a vehicle after normal business hours (5:01 p.m.-6:59 a.m.) Fees allowed will be listed on addendum D of this contract. 29. The Chief of Police shall designate an officer to investigate all complaints made by die owner and/or operator of vehicles which arc towed or stored pursuant to this contract. a. When deemed necessary, the Cluef of Police or his designee shall make written reconnnendations for corrective action, which shall be binding on the Contractor. b. 'hhe Chief of Police or his designee will determine whether or not die Contractor is providing satisfactory service. If service is determined to be unsatisfactory, this contract may be terminated. 30. a. The County may at any time, in its discretion, suspend or tenninatc this contract after providing the Contractor 24-hour advance written notification. Grounds for termination or suspension shall include, but not be limited to: i) Failure to respond to requests from die County within the required 30 minute time period; ii) Failure to maintain equipment in accordance with requirements as enumerated in this contract and or failure to have new equipment or facilities approved prior to their use; iii) Lack of adequate insurance as required by VA State Code Section 46.2-649.1; -8- ~4~0~9 iv) Arriving at the scene of an incident where Contractors are required without being called by the County; v) Operating in a manner which is inefficient or unsafe or allowing an inexperienced or unlicensed persons to operate any equipment which is used to t.ow a motor vehicle; vi) Storing a vehicle at a localion ocher than an approved storage lot; vii) Failure to comply with any of die terms of this contract; vii) Convictions for violating local, state, or federal laws; viii) Failure to clean roadways at the scene of an accident; ix) Use of satellite telephone numbers or business locations to increase the number of operating points for Contractors within the County; x) Substantiated complaint(s) of excessive or unnecessary fees for towing or storage charged to customers; xi) Any action or activity by tiie Contractor which, in the deternunation of the police, is not in the best interest of the police or the citizens of Chesterfield County; xii) Involvement in crinrinal olTenses or activity and/or failure to comply with all laws, ordinances, codes and regulations applicable to the operation of a motor vehicle towing and storage business; xiii) Operating a towing business without a valid Chesterfield County business license; xiv) Failure to pay county or slate taxes. xv) Violations of any towing regulations promulgated by the BIRO b. The Contractor shall receive from the Chesterfield County Police Department written police of such removal or suspension and the grounds therefore. The Chief of Police or his Designee's decision for removal or suspension shall be final and conclusive unless the Contractor appeals in writing to the Chief within ten (10) days of receipt of notice of removal or suspension. -9- 'hhe Contractor's written appeal to dhe Chief of Police shall include the basis for its appeal and die relief sought, and shall state whether the Contractor wishes to have a hearing wide respect to die appeal. d. If no hearing is requested, the Chief of Police or his designee shall render a decision to die Contractor within ten (10) days of receipt of appeal. If a hearing is requested, it shall be held within ten (10) days of receipt of die written appeal or as soon thereafter as possible, and a final decision shall be rendered by the Chief of Police or his designee within ten (10) days of the hearing. Contractor's records shall be open to inspection and subject to audit and/or reproduction by tie County to the extent necessary to adequately permit evaluation and verification of any invoices, payments or claims subnutted by Contractor of any of its payees pursuant to dus contract. Such records subject to cxahnination shall also include, but not be limited to, those records necessary to evaluate and verify direct and indirect costs (including overhead allocations) as they may apply to costs associated with this contract. For die purpose of such audits, inspections, exanunations and evaluations, die County shall have access to said records from tie effective date of this contract, for tie duration of die work, and until two (2) years after tie date of final payhnent by tie County to Contractor pursuant to this contract. The County shall have access to Contractor's facilities, shall have access to all necessary records and shall be provided adequate and appropriate work space, in order to conduct audits in compliance wide tris article. The County shall give Contractor reasonable advance notice of intended audits. Contractor shall require all subcontractors, insurance agents, and materials suppliers (payees) to comply widh the provisions of this article by insertion of tie requirements hereof in a written agreement between Contractor and payee. Failure to obtain such written contracts which include such provisions shall be reason to exclude some or all of the related payees' costs from the amount payable to Contractor pursuant to this Contract. During the performance of this contract, the Contractor agrees to: a. Provide adrug-tree workplace for the Contractor's employees. b. Post in conspicuous places, available to employees and applicants for employment, a statement notifying employees that the unlawful manufacture, sale, distribution, dispensation, possession, or use of a controlled substance or marijuana is prohibited in the Contractor's workplace and specifying the actions drat will be taken against employees for violations of such prohibition. State in all solicitations or advertisements for employees placed by or on behalf of Contractor that Contractor maintains adrug-free workplace. For the purposes of this section, "drug-free workplace" means a site for the performance of work done in connection with a specific contract awarded to a contractor in accordance with this paragraph, the employees of whom are prolubited from engaging in the unlawful manufacture, sale, distribution, dispensation, possession or use of any controlled substance or marijuana during the perfonnancc of the contract. 34. The validity and construction of this contract shall be governed by the laws of the Commonwealth of Virginia. Granger will retire on January 31, 2009 after providing over twenty-eight years of dedicated and faithful service to Chesterfield County; and WHEREAS, Ms. Granger began her career with the Chesterfield County Department of Mental Health Support Services on August 18, 1980 as an Occupational Therapy Supervisor, and on August 26, 1995 was promoted to the Manager of Infant Services and served in that capacity until her retirement; and WHEREAS, Ms. Granger served as a leader in planning and collaborating with families, dedicated staff, and partners from the public and private sectors to develop a coordinated early intervention system for infants and toddlers and their families living in Chesterfield; and WHEREAS, under the professional leadership of Ms. Granger, infants and toddlers were able to develop to their potential as a result of interactions with families and staff who share their expertise and love of children; and WHEREAS, Ms. Granger worked with community partners and early intervention personnel to provide activities such as "Meet the Expert," "Music in the Park" and "Family Fun Day" for families whose children participate in the early intervention program; and WHEREAS, Ms. Granger, through funds from an anonymous donor, established and maintained the Toy Lending Library and the Mobility Lending Program utilized by infants and toddlers in the Chesterfield Infant program; and WHEREAS, Ms. Granger, with parent liaisons produced the publication, "Toddler Times," which provides important information, calendar of events, personal stories, and many articles of interest for the families in the Infant Services, Chesterfield Mental Health Support Services and in the community; and WHEREAS, under the leadership of Ms. Granger, Chesterfield Community Services Board facilitated Medicaid Part C services for Planning District 14 (Farmville and seven counties) to bring early intervention services to families and infants and toddlers in that area, serving over one hundred children; and WHEREAS, Ms. Granger served as chair of the Council Coordinators Association of Virginia (CoCoA), a statewide organization of system managers, and through this association's collaboration with the Virginia Association of Community Services Boards and other groups, was successful in obtaining approval of an increase in state funding of $7.1 million for services for infants and children; participated on statewide stakeholder groups, and assisted in the development of position papers that resulted in policy changes that provided enhanced services for infants and toddlers; and WHEREAS, Ms. Granger believes she was fortunate to get paid to "play" all day, and she will be sorely missed for her professional contributions as a champion for the early intervention system for infants and toddlers and their families and for her commitment to the high quality of these services provided through the Infant Program of the Chesterfield Department of Mental Health Support Services. Summary of Information: The change order policy of Chesterfield County requires the Board of Supervisors to approve all change orders to a contract once the total amount of the change orders reaches 10% of the original contract amount. Ten percent of the original contract amount of $2,725,400 was exceeded by change order numbers 6 and 7, primarily due to change order number 6 at a cost of $250,723 which was a result of the project uncovering unforeseen conditions that required mold remediation and the associated removal of additional ceilings, carpeting, and ductwork. Change order number 6 was approved by the Board of Supervisors on November 19, and change order number 7 was approved by the Board of Supervisors on December 17. Part of the vision developed for the new facility was to build a pursuit driving course within a safe training environment for Police and Sheriff's officers to develop the skills necessary to control their own vehicle when involved in a pursuit. Other elements planned for the Enon Training Center included the small arms firing range, Fire Department burn buildings (both Class A and Class B) with associated support structures, an 85-foot fire training and rappelling tower and a combined support building for the three public safety agencies to share both classrooms and maintenance space for vehicles and equipment used in the training. The small arms range and the fire training areas have been completed and are being used today. The remaining facilities, after the Emergency Vehicle Obstacle Course is completed, include the tower for fire and rappelling training and the combined support building. Driver training has been conducted at Fort Pickett, Virginia for several years; however, those facilities are limited and inadequate for all aspects of this type of training because they were never specifically designed for this purpose. Also, due to the distance and increasing difficulty in scheduling any training at Fort Pickett due to operational needs of the Army, and the potential for serious accidents during pursuits, the priority of this emergency vehicle driver's training course has become urgent. The design team, including Police driving instructional staff, toured a number of similar local, state and federal facilities, benchmarking training needs and solutions. This formed the basis for Chesterfield County to develop the program requirements for this facility. This is a multi-year project with multiple phases. Funding was appropriated with previous capital improvement programs. Funding is appropriated and is sufficient to award this construction contract and complete the project. Of the sixteen bids received, all were below the project construction budget. Construction should take approximately one year to complete. Operating budget impacts, expected to begin in FY2011, include annual utility costs and costs to maintain the driving surface. These new costs will be evaluated along with any potential reductions resulting from changes in police's training operations to determine a net impact on the operating fund. It is estimated that over the eleven days of operation approximately 12,500 people would attend the Carnival. Food and beverages would be provided by Reithoffer Shows. Reithoffer Shows has indicated an intent to donate 5% of the proceeds to the Dominion School of Autism. They also intend to solicit local churches to sell tickets and wristbands in exchange for l00 of the proceeds of the tickets which they sell. Summary of Information: The 2008 General Assembly amended the state code to require localities to include stepchildren as persons who can benefit from family subdivisions. A family subdivision is the subdivision and transfer of property to certain family members of the property owner. Under the current subdivision ordinance, the description of the family members who can participate in a family subdivision is any person who is a natural or legally defined offspring, spouse, sibling, grandchild, grandparent or parent" of the property owner. Definitions. Subdivision, residential parcel: The division, per article II division IV, of any parcel of land for residential use, into two or more parcels all of which are more than five acres, and which: (1) Have frontage of not less than 300 feet or 250 feet if a legally established access shared by no more than two parcels is used on an existing street, and; (2) Access to the parcel is provided within the area of required frontage, and; (3) The required minimum parcel width, per (1) above, is maintained for a depth required to create a five acre parcel or in an arrangement approved by the director of planning after determining that the configuration is appropriate based upon limitations imposed by the parcel shape and environmental features on the parcel and is not for the purpose of circumventing this subsection. a. Residential parcel subdivisions shall include: Family subdivisions which shall be defined as a single division of land to create a lot or a parcel for the purpose of a sale or gift to a member of the immediate family of the property owner including a partition of property owned by immediate family members. Only one such division shall be allowed per family member and shall not be for the purpose of circumventing this chapter. For the purpose of this subsection, a member of the immediate family shall be defined as any person who is a natural or legally defined offspring, stepchild, spouse, sibling, grandchild, grandparent or parent of the owner. Family subdivisions shall comply with all applicable requirements of the zoning ordinance and the standards set forth in this chapter. Access shall be provided as required by the Code of Virginia. Family subdivisions shall comply with the following requirements: (i) The property owner requesting approval of a family subdivision shall have owned the property for a continuous period of not less than two years immediately preceding the filing of the family subdivision application. This subsection shall not apply in the case of the death of the owner, and the estate executor or administrator shall be permitted to transfer the property to any eligible family member(s) of the decedent as defined in subsection (a) for the purposes of facilitating the family subdivision. Upon application, the director of planning may 00~ ~. ~. 2723:79574.1 grant relief to this two-year retention period in cases of severe hardship including foreclosure, judicial sale, condemnation, bankruptcy or permanent relocation by the owner out-of-state. This subsection shall apply only to property acquired by the owner subsequent to January 1, 2005. (ii) Lots or parcels created through a family subdivision shall be titled in the name of the original recipient for whom the subdivision is made for a period of not less than five years. Upon application, the director of planning may grant relief to this five-year retention period in cases of severe hardship including foreclosure, death, judicial sale, condemnation, bankruptcy or permanent relocation by the owner out- of-state. Additionally, the director of planning may approve the transfer of property between eligible family members as defined in subsection (a) within the five-year retention period. Any such relief granted by the director shall be in the form of an instrument that the applicant shall record against the parcel in the land records of the circuit court. (iii) Family subdivisions that do not comply with these requirements shall be presumed to have intended at the time of approval to circumvent this chapter and shall be deemed to be in violation of section 17-6. Any such lots or parcels shall be denied a building permit and, if a building permit has already been issued, shall upon discovery be subject to provisions of section 17-12 and 17-13. Further, the director of planning may take any reasonable actions necessary to ameliorate the effect of such circumvention including, without limitation, requesting the board of supervisors to adopt an ordinance pursuant to state law that vacates the subdivision in whole or in part. (iv) All proposed plats for family subdivisions shall include on the plat an affidavit under oath and penalty of perjury from the proposed grantor that identifies the subdivision as being for the purposes of conveyance to a qualifying family member and identifies the receiving family members and their relationship to the grantor. (v) All family subdivision plats must contain a conspicuous note containing the following language: "The Chesterfield County Subdivision Ordinance requires the original recipient of a parcel or lot created by a family subdivision to retain ownership of the property for not less than five years unless granted relief by the director of planning. Any violation of this requirement shall be presumed to constitute a circumvention of the subdivision ordinance and may result in corrective action taken by the county including, without limitation, imposition of applicable penalties, denial of building permits, and/or vacation of the subdivision." b. Summary of Information: The Capital Region Taxicab Advisory Board ("CRTAB"), of which Mr. Holland is a member, met on September 17, 2008 to review the existing uniform ordinances in effect in Chesterfield, Henrico, Richmond and Hanover. After holding a public hearing, CRTAB recommended that each locality amend their ordinance (1) to raise taxicab rates by 10~, from 40~ every 1/5 mile, to 50~ every 1/5 mile and (2) to increase rates for waiting time, from 30~ for each one minute of waiting time to 50~ for each 80 seconds of waiting time. CRTAB recommends the change to help the taxicab industry offset the rising cost of fuel and insurance. The taxicab industry has not had a rate increase since 2005. This item was deferred from the December 17, 2008 meeting because there were questions regarding the history of taxicab regulation in the Richmond region. History of Taxicab Ordinances The County first adopted a limited taxicab ordinance in 1965. At that time, all the other localities in the region had similar limited ordinance provisions, except Hanover County, which had no ordinance. In 1991, the Preparers Steven L. The region had suffered for many years from a number of taxicab problems including poor customer service and safety issues. For example, the Taxicab Advisory Board found that out of 41 taxicab operators listed in the local telephone directory at the time, only 5 operators actually answered their phone when called for service. The Board also found that a number of taxicabs had no vehicle communication or any service support system. Those deficiencies created a major safety concern not only for the public, but also for the taxi driver. There were also anecdotal stories of unsuspecting visitors, such as new soldiers going to Fort Lee, being charged inflated trip fares. As the Taxicab Advisory Board considered amending the local ordinances, it found that approximately 880 of all communities in the United States controlled market entry to the taxicab industry in some fashion. Of the remaining 12%, half had never controlled market entry and had 10 or fewer cabs operating in their respective cities. The Board considered three basic approaches to controlling the industry: (1) unrestricted "open entry," (2) the more restrictive medallion system (as is used in New York City), and (3) a certification process. At the time, all localities in the Richmond region used a modified "open entry" method which allowed anyone to operate a taxicab service with little regulatory oversight. The Board ultimately recommended keeping the existing modified "open entry" system but with additional provisions to tighten customer service, safety, and rates. In 1994, all localities in the central region adopted the model ordinance, which remains in effect substantially in its original form. Henrico, Hanover and Richmond City have all approved the proposed rate increase. Staff recommends adopting the recommended ordinance amendments. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 15-196 RELATING TO RATES FOR TAXI SERVICES BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 15-196 of the Code of the County of Chester geld 1997, as amended, is amended and re-enacted to read as follows: Sec. 15-195. Except as otherwise provided in this article, it shall be unlawful for the owner or driver of any taxicab to charge a rate above or below the rates established by the board of supervisors.
