09SN0160 STAFF' S REQUEST ANALYSIS AND RECOMMENDATION 09SN0160 VA State University Booster Club Matoaca Magisterial District 20911 Third Avenue May 27, 2009 B S REQUEST: Conditional Use to permit non-profit civic, social and fraternal clubs and lodges. PROPOSED LAND USE: The applicant has previously received approval through a Special Exception to hold meetings and conduct other functions on the property for the Virginia State University Booster Club. The use was approved for a limited period of time. That time period has expired and the applicant wishes to continue the use. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. Although the Ettrick Village Plan suggests the property is appropriate for residential use of 4.0 or less units per acre, the proposed uses are compatible with existing and anticipated area development. B. The proposed uses are no more intense than the existing church use on adjacent property to the north. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A Providing a FIRST CHOICE community through excellence in public service "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) CONDITIONS (STAFF/CPC) 1. This Conditional Use shall be granted to and for the VA State University Booster Club only and shall not be transferable or run with the land. (P) (STAFF/CPC) 2. Any development for non-profit civic, social and fraternal clubs and lodges shall conform to the requirements of the Zoning Ordinance for office uses in the Ettrick Village Core. (P) GENERAL INFORMATION Location: East line of Third Avenue, north of Boisseau Street and better known as 20911 Third Avenue. Tax ID 796-612-8206. Existing Zonin R-7 Size: 0.9 acre Existing Land Use: Non-profit civic or social club (VSU Booster Club) Adjacent Zoning and Land Use: North - O-1; Public/semi-public (church) South, East and West - R-7; Single-family residential, public/semi-public (university) or vacant 2 09SN0160-MAY27-BOS-RPT UTILITIES Public Water System: The request site is within the Matoaca Water Pressure Zone. There is a six (6) inch water line extending along the north side of Third Avenue adjacent to this site. The existing structure is connected to the public water system. The proposed Conditional Use will not impact the public water system. Public Wastewater S.. sue: The request site is within the Appomattox River Sewer Service Area. There is an eight (8) inch wastewater collector line extending along Third Avenue adjacent to this site. The existing structure is connected to the public wastewater system. The proposed Conditional Use will not impact the public wastewater system. ENVIRONMENTAL Drainage and Erosion: The subject property drains in several directions through storm sewers to the Appomattox River. There are no existing or anticipated on- or off-site drainage problems. PUBLIC FACILITIES Fire Service: The Ettrick Fire Station, Company Number 12, and the Ettrick-Matoaca Volunteer Rescue Squad currently provide fire protection and emergency medical service (EMS). This request will have a minimal impact on Fire and EMS. Transportation: The proposed development will have a minimal impact on the transportation network. T ANTI T TCF Comprehensive Plan: Lies within the boundaries of the Ettrick Village Plan which suggests the property is appropriate for residential use of 4.0 or less units per acre. Area Development Trends: The area is characterized by a church use on office zoned property to the north and by single-family residential uses in Boisseau subdivision and by Virginia State University to 3 09SN0160-MAY27-BOS-RPT the south, east and west. It is anticipated residential uses will continue in this area, as is suggested by the Plan. In addition, there is the possibility that the campus of Virginia State University will expand to include this property. Zoning HistorX: On October 6, 1999, the Board of Zoning Appeals approved a Special Exception to permit anon-profit social club (VSU Booster Club) incidental to a dwelling unit on the property (Case OOANOll7) for three (3) years. The property is no longer being used for residential purposes, however, the applicant wishes to continue with the non-profit social club. The Zoning Ordinance requires a Conditional Use for such use in a residential district. Development Standards: The property is currently located within the Ettrick Village Core. However, because the property is zoned Residential (R-7) the requirements of the Ettrick Village Core do not apply to this request unless they are imposed through conditions of zoning. The purpose of the Ettrick Village Core District Standards is to promote high quality, well-designed projects within the Village that maintain and reinforce the village's character, identity, and pedestrian scale by continuing and enhancing existing patterns of development. Within the Ettrick Village Core District, the Zoning Ordinance specifically addresses access, landscaping, setbacks, parking signs, buffers, lighting and screening of outside storage areas. Condition 3 would require that development be subj ect to these Ordinance standards. CONCLUSION Although the Ettrick Villa eg Plan suggests the property is appropriate for residential use of 4.0 or less units per acre, the proposed uses are compatible with existing and anticipated area development. In addition, the proposed uses are no more intense than the existing church use on adj acent property to the north. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (4/21/09): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Bass, seconded by Mr. Waller, the Commission recommended approval subj ect to the conditions on page 2. AYES: Messrs.
