RECOMMENDATION Recommend approval for the following reasons: A. This request is for renewal of a previously approved manufactured home permit. B. This request will not have an adverse impact on the character of this residential area and the proposed uses are compatible with existing and anticipated development. CONDITIONS 1. This manufactured home permit shall be granted to and for, Virginia State University Booster Club only and shall not be transferable or run with the land. 2. This manufactured home permit shall be granted for a period not to exceed seven (7) years from date of approval (P) 3. No additional permanent-type living space may be added onto this manufactured home. This manufactured home shall be skirted but shall not be placed on a permanent foundation. (P) Providing a FIRST CHOICE community through excellence in public service 4. This manufactured home shall be used as anon-profit civic, social and fraternal club and lodge only. (P) GENERAL INFORMATION Location: East line of Third Avenue, North of Boisseau Street and is known as 20911 Third Avenue. Tax ID 796-612-8206. Existing Zoning: R-7 Size: 0.9 acre Existing Land Use: Non-profit civic or social club (Virginia State University Booster Club) Adjacent Zoning and Land Use: North - O-1 and R-7; Public/semi-public (Church and Virginia State University) South - R-7; Residential and Virginia State University East - R-7; Public/semi-public (Virginia State University) West - R-7; Residential Utilities: The request site is within the Matoaca Water Pressure Zone. There is a six (6) inch water line extending along the north side of Third Avenue adjacent to this site. The existing manufactured home is connected to the public water system. The request site is within the Appomattox River Sewer Service Area. There is an eight (8) inch wastewater collector line extending along Third Avenue adjacent to this site. The existing manufactured home is connected to the public wastewater system General Plan: (Ettrick Village Plan) Residential use (4.0 units per acre or less) 2 09SN0159-MAY27-BOS-RPT DISCUSSION The applicant is requesting renewal of Manufactured Home Permit O1 SN0124 to park a manufactured home in a Residential (R-7) District. The first permit was issued to the applicant on October 25, 2000. The manufactured home is located on 0.9 acre and is owned by the applicant. On October 6, 1999, the Board of Zoning Appeals approved a Mobile Home Permit (O1 SN0124) for seven (7) years. The applicant has indicated the manufactured home is no longer being used for residential purposes. However, in order to permit a manufactured home in a Residential (R- 7) district the applicant is required to have an approved manufactured home permit. The Board of Zoning Appeals also approved a Special Exception to permit anon-profit social club (Athletic Booster Building) for three (3) years. The property is no longer being used for residential purposes, however, the applicant wishes to continue with the non-profit social club. The Zoning Ordinance requires a Conditional Use for such use in a residential district. On April 22, 2009, the Planning Commission recommend approval of a Conditional Use (09SN0160) with conditions to permit anon-profit civic, social and fraternal clubs and lodges. This case will be heard by the Board of Supervisors on May 27, 2009. The manufactured home is located within the Ettrick Village Plan that suggests the property is appropriate for residential use of 4.0 units per acre or less. Virginia State University is adjacent to the subject property on three (3) sides. It is anticipated residential uses will continue in this area, as is suggested by the Plan. In addition, there is the possibility that the campus of Virginia State University will expand to include this property. Staff would not typically support this type of request; however, with the potential expansion of Virginia State University and the imposition of the proposed conditions, staff believes that this use would be compatible with other residential property. If the Board grants this request, it will be for a limited time period. Upon expiration of the permit, the applicant may request a renewal of the permit or may remove the manufactured home from the property.
