09SN0164~~_f.. ,~__~=~; ~.r,,._.,,. ~~T STAFF' S REQUEST ANALYSIS AND RECOMMENDATION 09SN0164 May 27, 2009 B S Chesterfield County Board of Supervisors Midlothian Magisterial District North line of Midlothian Turnpike REQUEST: Conditional Use Planned Development to permit exceptions to Ordinance requirements relative to signage. PROPOSED LAND USE: Polling Precinct 513 currently operates from the Forest View Rescue Squad facility located at 8008 Midlothian Turnpike. Exceptions to the sign ordinance are requested to permit a larger offsite directional sign on Midlothian Turnpike for improved identification of this facility. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The proposed signage would permit clear identification of the facility. B. The recommended conditions would ensure compliance with Ordinance standards should this facility no longer be used as a polling precinct. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY Providing a FIRST CHOICE community through excellence in public service A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) CONDITION (STAFF/CPC) The offsite directional sign identifying the rescue squad building may be increased to a maximum of twenty (20) square feet in area provided such facility continues to be used as a polling precinct. Such sign shall incorporate the street address of the rescue squad building. At such time that the facility ceases to be used as a polling precinct, this sign shall be brought into compliance with current Ordinance limitations for offsite directional signs. (P) GENERAL INFORMATION Location: North line of Midlothian Turnpike, east of Buford Road. Tax IDs 760-706-2885 and 760- 707-23 08. Existing Zonin C-3 Size: 2.6 acres Existing Land Use: Public/Semi-public Adjacent Zoning and Land Use: North, South and West - C-3; Commercial East - C-5 and R-15; Commercial or Vacant UTILITIES: ENVIRONMENTAL: AND PUBLIC FACILITIES This request will have no impact on these facilities. 2 09SN0164-MAY27-BOS-RPT LAND USE Comprehensive Plan: Lies within the boundaries of the Eastern Midlothian Plan which suggests the property is appropriate for community mixed use. Area Development Trends: Area properties are zoned Community Business (C-3) and General Business (C-5) and are occupied by commercial uses of various intensities. Sins: As previously noted, the Forest View Volunteer Rescue Squad building currently houses a polling place for elections. The property on which this facility is located has access to, but no frontage along, Midlothian Turnpike. The Ordinance permits one (1) offsite directional sign on Midlothian Turnpike, limited to seven (7) square feet in area and seven (7) feet in height, to identify this building. The County Registrar's Office indicates that voters have experienced difficulty in locating the Precinct given the facility's distance from Midlothian Turnpike. This proposal would increase the sign area of the Squad's offsite directional sign to twenty (20) square feet with the incorporation of the street address into this sign for enhanced identification. Further, should the Squad facility cease to be used as a polling precinct, such sign would be reduced in area to comply with current Ordinance standards. (Condition) CONCLUSION The County Registrar's Office indicates that voters have experienced difficulty in locating the polling precinct given the rescue squad building's distance from Midlothian Turnpike. The proposed signage would permit clear identification of the facility. Further, the recommended conditions would ensure compliance with Ordinance standards should this facility cease to be used as a polling precinct. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (4/21/09): The applicant accepted the recommendation. There was no opposition present.
