Prosise, Jr. SUBJECT: Construction of County Roads and Drainage Structures On August 22, 1973 the Board passed a resolution which gave developers in the County until November 1, 1973 to bring roads in subdivisions, which have occupied homes on same, up to County specifications. Also it was stated that building permits may be issued on graveled roads with no occupied homes but no occupancy permits will be issued until the road is improved to the County's specifications. I believe the Engineering Department has a good record of trying to work with developers in getting the road and drainage structures built. Lately I am sure the developers feel we are getting stricter but that is mainly because we are doing a better job of inspection and the County is not accepting as many developer problems as once was the case. Roads are seldom ready when the developer asks the County for a final inspection. Rather than look at the approved plans and do what is required, they want us to point out each item which has not been completed. Better coordination between the developer, developer's engineer and developer's contractor would help us and the developers in expediting the completion and highway acceptance of the roads. I believe we can handle future road problems if we could control the _ issuance of building permits and occupancy permits. Occupancy permits seem'to be' the key but as long as they are controled by the Building Inspectors office they will not be an effective means of forcing compliance. I recommend that the developers who did not meet the November 1, 1973 deadline be evaluated individually and all future development come under the following policy: 1. Building permits may be issued anytime after recordation, but no occupancy permits -- shall be issued until the roads meet.the­ County's requirements. 2. The Engineering Department may at anytime hold all building and occupancy permits if, in the judgement of the County Engineer; the builder and/or developer is not maintaining the roads and drainage structures during construction. Kimberly Acres, Sec. 1 & 2 - The roads in Kimberly Acres Sec. 1 have not been taken in because the Developer has not installed the required drainage ditch (1-grouted stone or 2- paved ditch) to the rear of lots 1, 2 on Cotfield Rd. The roads in Sec. 2 have not been paved. Developer was applying stone on week of Oct. 15. It is Mr. Mason's opinion that the law apply to the County of Chesterfield which will necessitate in giving in-depth medical examinations to all Fire Department personnel. Dr. Wagner met with Morris and me and we are of the opinion that the Health Testing Center of Medical College of Virginia would be the most likely place to have the tests made. We presently have approximately 425 volunteer firefighters and 40 salaried firefighters for a total of 465.men. The projected cost of each examination is $60 to $65. The sections of the Code amended are 27-39, 27-40.1, and 27-40.2. A new section 27-40.1:1 was added. These amendments were accomplished by means of Senate Bill 864. It is important to note that if your county, city, or town does not provide death, retirement, sickness, or other benefits to any fireman, you are in no way involved in this Heart and Lun- Bill. This is entirely separate and distinct from the Line of Duty Act, which provides payments up to ten thousand dollars from the State Treasury to the beneficiary of a fireman whose death occurs in the line of duty. Fire Service Training has quoted below the sections of the Code included under the Bill as amended. Following these are extracts from a letter received from the Attorney General in response to a request for clarification of the amendments.. § 27-39. Counties, cities, and towns authorized to provide relief...,.,.. Any county, city or town which operates fire -fighting equipment may provide for the relief of (1) any children and widow of any fireman who dies (2) and for the relief of any fireman who is disabled by injury or illnass while in the service of the county, city or town or any political subdivision with which it contracts or has contracted for fire protection, whether such fireman be a member of a fire company of the county in which the injury occurred or of a political subdivision with which it contracts for fire protection. 1 27-40.1. The death of, or any condition or impairment of health of salaried or volunteer firemen caused by respiratory diseases, hypertension or heart disease resulting in total or partial disability shall be presumed to have been suffered in the line of duty unless the contrary be shown by competent evidence; provided that prior to making any claim based upon such presumption for retirement, sickness or other benefits on account of such death or total or partial disability, such salaried or volunteer firemen shall have been found free from respiratory diseases, hyper- tension or heart disease, as the case may be, by a physical examination which shall include such appropriate laboratoryand other diagnostic studies as such governing body shall prescribe and which shall have been conducted by physicians whose qualifications shall have been prescribed by such governing body; and provided, further, that any such fireman or, in the case of his death, any person entitled to make a claim for such benefits, claiming that his death or disability was suffered in the line of duty shall, if requested by such governing body or its authorized representative submit himself, in the case of a claim for disability benefits to physical examination by any physician designated by such governing body which examination may include such tests or studies as may reasonably be prescribed by the physician so designated, or in the case of a claim for death benefits, submit the body of the deceased fireman to a post-morte-m examination to be performed by the medical examiner for the county, city or town appointed under. 2 19.1-40. Such fireman or claimant shall have the right to have present at such examination, at his own expense, any qualified physician he may designate. Nothing herein shall be construed to extend or otherwise affect the provisions of Title 65.i, Code of Virginia, relating to workmen's compensation. 9 27-40.1:1. Any county, city or town providing death, retirement, sickness or other benefits pursuant to the authority granted by §27-39, or pursuant to any other provision of law or the charter of any city or town, or otherwise, shall by ordinance make provision for the employment of physicians and the performance of the physical examination required by §27-40.1 and shall cause such examination to be made within ninety days after the effective date of this act of every fireman in its service or the service of a political subdivision with which it has contracted for fire protection and of every fireman entering upon such service thereafter at the time of such entry. 27-40.2. Employing such presumption in determining eligibility for benefits. --Such presumption, subject to the provisions of §27-40.1, shall be employed in determining eligibility for death, retirement, sickness and other benefits provided pursuant to the authority granted by §§ 27-39, 27-40, or pursuant to any other provision of law or the charter of any city or town, or otherwise for persons who die or become totally or partially disabled. Attorney General's Informal Comments "Although I am only authorized to render official opinions to individuals who are designated in § 2.1-118 of the Code of Virginia, I shall be happy to respond to your question on an informal basis in order to assist you in carrying out your responsibilities and to eliminate the uncertainty concerning Chapter 543 of the 1973 Acts of Assembly (Senate Bill No. 864.) Section 27-40.1, as amended, creates a presumption (which may be rebutted by competent evidence) that the death of, or any condition or impairment of the health of, salaries or volunteer firemen caused by respiratory diseases, hypertension., or heart disease resulting -in total or partial disability was suffered in the line of duty. This section also provides that prior to making any claim based on the pre- sumption for retirement, sickness, or other benefits on account of death or total or partial disability, a volunteer or salaried fireman must have been found free from respiratory disease, hypertension, or heart disease, as the case may be, by a physical examination. It should also be noted that 9 27-40.1 allows the governing body of a county, city or town to require any salaried or volunteer fireman claiming that his disability was suffered in the line of duty to submit to a physical examination by a physician designated by such governing body or, in the case of a claim for death benefits, to require any person entitled to make and who makes a claim for such benefits to submit the body of the deceased fireman to a post-mortPri examination to be performed by the medical examiner of the county, city or town appointed under 5 19.1-40 of the Code. This latter part of 9 27-40.1, however, clearly applies only after a claim for death or disability benefits has been made.. Section 27-40.1:1 of the Code states as follows: 'Any county, city or town providing death, retirement, sickness or other benefits pursuant to the authority granted by 9 27-39, or pursuant to any other provision of law or the charter of any city or town, or otherwise, shall by ordinance make provision for the employment of physicians and the performance of thephysical examination required by 9 27-40.1 and shall cause 3 such examination to be made within ninety days after the effective date of this act of every fireman in its service or the service of a political subdivision with which it has contracted for fire protection and of every fireman entering; upon such service thereafter at the time of such entry.' The reference in § 27-40.1:1 to'the physical examination required by § 27-40.1'is to the physical examination required prior to making any claim based on the presumption created in § 27-40.1. Accordingly, all firemen in the service of counties, cities, and towns providing death or disability benefits as provided in § 27-40.1:1, or in the service of a political subdivision with which it has contracted for fire protection, are required to undergo a physical examination as provided in §§ 27-40.1 and 27-40.1:1 within ninety days of the effective date of Chapter 543 of the 1973 Acts of Assembly. Since that act was effective on June 1, 1973, the examinations must be performed. prior to August 31, 1973. With respect to firemen entering upon such service after that date, the examination must be performed at the time of such entry." R E P O R T TO THE HONORABLE JUDGES OF SAID COURT: Pursuant to order entered September 10, 1973, by this Court, I was directed to examine the title to: ALL that certain tract or parcel of land, lying and being in Bermuda District, Chesterfield County, Virginia, with improvements thereon and appurtenances thereunto belonging, con- taining 60.7 acres, more or less, situated on the north side of Coxendale Road and being particularly shown by metes and bounds on a plat of survey dated October 10, 1973, made by M. E. Floyd, C. L. S., Richmond, Virginia, attached hereto and made a part hereof to be recorded herewith, and to which plat reference is hereby made for a complete and accurate description of the said land. BEING the same land conveyed to Sarah Turner Sinclair by deed of partition from H. C. Turner, widower, and others, dated April 10, 1961, and recorded October 18, 1961, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Deed Book 663, page 379, and identified therein as Parcel number 4, Exhibit E-9. The said parcel of land is owned by Sarah Turner Sinclair in fee simple. In my opinion, title to this land is free and clear of all valid objections, except as follows: 1. Taxes for the second half of 1973 and subsequent years. 2. EASEMENT: From Geo. C. Hatcher and Ellen B. Hatche , his wife, by deed dated March 24, 1937, to Virginia Electric & Power Company, recorded November 24, 1937, in the Clerk's Office, Circuit Court, Chesterfield County, Virginia, in Deed Book 242, page 33. Grants easement to construct, operate, maintain, etc., a pole(s) line, etc., over, upon and across property of owner situated in Chesterfield County, with full and free ingress to and egress from and over said property and with further right to trim, cut and keep clear all trees, etc., along or near said line s) 593 Plat shows easement running in east -west direction upon subject property adjacent to and parallel with north right-of-way line of Route 615 and along eastern boundry line (not applicable) in nort - south direction adjacent to and parallel with Route 615. 3. Turner, Single, to Virginia Electric and Power Company, by deed dated July 10, 1949, and recorded September 8, 1949, in the Clerk's Office, Circuit Court, Chesterfield County, Virginia, in Deed Book 357, page 347. Grants easement to construct, operate and maintain a pole line(s)i etc., over, upon and across property of owner, at a location to be determined by company, with right of ingress and egress over said property and with further right to cut, trim and keep clear all trees, etc., along said line(s). 4. Plat shows northern boundry line is formed by cente line of Proctor's Creek; eastern boundry line follows center line of open ditch; the southern boundry line is formed by the center line of Coxendale Road 15 feet of which lies within subject property; and the northwestern portion of subject property con- sisting of approximately 18 acres is marshland and lies within an established flood plain. 5. Riparian rights of others, if any, in and to the use and flow of water in Proctor's Creek.
