Mr, Oscar Napier, one of the developers of the Surreywood, comes before the Board seeking to reach an agreement concerning the location of easements for drainage and sewers in the Surreywood Subdivision. After much discussion of this matter, it is on motion of Mr. Horner, seconded by Mr. Myers, resolved that the County will pay for the oversize cost of the sewer line and will start condemnation proceedings so that the sewer line may go close to the creek and serve the entire area rather than putting the sewer line on Surreywood property and limiting the area of service. Ayes: Mr. Horner, Mr. Myers, Mr. Apperson and Mr. O'Neill. Mr. Krepela abstains from voting. On motion of Mr. Myers, seconded by Mr.O'Neill, it is resolved that Contract W73-74C for the installation of water in the area of Walnut Drive and Rivermont Road, be and it hereby is awarded to the 3 M Construction Company, who submitted the low bid of $14,700.00. Ayes: Mr. Horner, Mr. Myers, Mr. Apperson, Mr.Krepela and Mr. O'Neill. Mr. Painter presented a revised construction schedule pro ram which drew from Mr. Myers some complaints concerning the reatment A letter from Mr. Eugene T. Jensen concerning the status of Proctor's Creek and Falling Creek Sewage Treatment Plants was read and discussed. -2- n M On motion of Mr. Myers, seconded by Mr. O'Neill, it is resolved that this Board go into Executive session to discuss a personnel matter. Reconvening: It is on motion of Mr. Apperson,seconded by Mr. Myers, resolved that this Board contracts with the Architect, William Moseley, to draw plans and receive bids on a new building to house the Mental Health Clinic and offices with the understanding that preliminary plans will be reviewed by the Board before bids are requested. Mr. George Cosby, President of the local office of Alexander and Alexander, which Company renders a service to various employees called "Benefacts", comes before the Board and explains the service this Company renders, what it would do for the County of Chesterfield and offers to supply the employees of Chesterfield with a Benef acts quotation for the price of $4,000.00 for no more than 900 employees. Howard, Incorporated, who submitted the low bid of $1,236,886.049 which lincudes a cost for oversize pipe. Ayes: Mr.Horner, Mr. Myers, Mr.Apperson, Mr.Krepela and Mr.O'Neill. On motion of Mr. Apperson, seconded by Mr. Myers, it is resolved that fifty (50) additional sewer connections be awarded to the developer of Courthouse Green. On motion of Mr. Myers, seconded by Mr. O'Neill, it is resolved that the request of the Commodore Motel Corporation at the Walthall Interchange, which Corporation has raised the question of enforced delays to accommodate the developers of the sewer system be accommodated to the extent that if the Motel is built prior to the availability of County sewers that a $100.00 connection fee per hotel room be charged according to the code of the County, provided the package sewer plant be abandoned. On motion of Mr. Krepela, seconded by Mr. Apperson, it is resolved that the street name of State Route 728 be officially named Corner -Rock Road. There was read a letter from the Vice -President of the Payton Place Restaurant, requesting the Board to give some indication as to the possibility of changing the hours of selling or serving beer in the County and it was generally agreed that the owner of the Payton Place Restaurant would be requested to contact the Commonwealth's Pttorney to seek further relief and that at this time the Bdard did not wish to seek a change in ;the ABC hours in the County of Chesterfield. Ot motion of Mr. Horner, seconded by Mr.Krepela, it is resolved that this Board grant a Variance to allow the construction of a dwelling for Mr. T. W. Lefferts on Parcel 11-2, Section 719 provided a dedication. of 50 ft. for a roadway be accomplished before the house is occupied, and provided further that the County has no responsibility in the construction or maintenance of the road in question. C. 20006 •THE AI`1E B131 n TERMS AND CONDITIONS OF AGREEMENT BETWEEN OWNER AND ARCHITECT ARTICLE 1 ARCHITECT'S SERVICES 1.1 BASIC SERVICES The Architect's Basic Services consist of the five phases described below and include normal struc- tural, mechanical and electrical engineering services. SCHEMATIC DESIGN PHASE - 1.1.1 The Architect shall consult with the Owner to as- certain the requirements of the Project and shall confirm such requirements to the Owner. 1.1.2 The Architect shall prepare Schematic Design Studies consisting of drawings and other documents illus- trating the scale and relationship of Project components for approval by the Owner. 1.1.3 The Architect shall submit to the Owner a State- ment of Probable Construction Cost based on current area, volume or other unit costs. DESIGN DEVELOPMENT PHASE 1.1.4 The Architect shall prepare from the approved Schematic Design Studies, for approval by the Owner, the Design Development Documents consisting of drawings and other documents to fix and describe the size and character of the entire Project as to structural, mechani- cal and electrical systems, materials and such other essen- tials as may be appropriate. 1.1.5 The Architect shall submit to the Owner a further Statement of Probable Construction Cost. CONSTRUCTION DOCUMENTS PHASE 1.1.6 The Architect shall prepare from the approved De- sign Development Documents, for approval by the Own - Development Working Drawings and Specifications setting forth in detail the requirements for the construction of the entire Proiect including the necessary kidding information, and shall assist in the preparation of bidding forms, the Con- ditions of the Contract, and the form of Agreement be- tween the Owner and the Contractor. 1.1.7 The Architect shall advise the Owner of any ad- justments to previous Statements of Probable Construction Cost indicated by changes in requirements or general market conditions. 1.1.8 The Architect shall assist the Owner in filing the required documents for the approval of governmental authorities having jurisdiction over the Project. BIDDING OR NEGOTIATION PHASE 1.1.9 The Architect, following the Owner's approval of the Construction Documents and of the latest Statement of Probable Construction Cost, shall assist the Owner in obtaining bids or negotiated proposals, and in awarding and preparing construction contracts. CONSTRUCTION PHASE —ADMINISTRATION OF THE CONSTRUCTION CONTRACT 1.1.10 The Construction Phase will commence with the award of the Construction Contract and will terminate when the final Certificate for Payment is issued to the Owner. 1.1.11 The Architect shall provide Administration of the Construction Contract as set forth in Articles 1 through 14 inclusive of the latest edition of AIA Document A201, Gen- eral Conditions of the Contract for Construction, and the extent of his duties and responsibilities and the limitations of his authority as assigned thereunder shall not be modi- fied without his written consent. 1.1.12 The Architect, as the representative of the Owner during the Construction Phase, shall advise and consult with the Owner and all of the Owner's instructions to the Contractor shall be issued through the Architect. The Architect shall have authority to act on behalf of the Owner to the extent provided in the General Conditions unless otherwise modified in writing. 1.1.13 The Architect shall at all times have access to the Work wherever it is in preparation or progress. 1.1.14 The Architect shall make periodic visits to the site to familiarize himself generally with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Contract Doc- uments. On the, basis of his on -site observations as an architect, he shall endeavor to guard the Owner against defects and deficiencies in the Work of the Contractor. The Architect shall not be required to make exhaustive or continuous on -site inspections to check the quality or quantity of the Work. The Architect shall not be respon- sible for construction means, methods, techniques, se- quences or procedures, or for safety precautions and programs in connection with the Work, and he shall not be responsible for the Contractor's failure to carry out the Work in accordance with the Contract Documents. 1.1.15 1 Based on such observations at the site and on the Contractor's Applications for Payment, the Architect shall determine the amount owing to the Contractor and shall issue Certificates for Payment in such amounts. ARTICLE 2 THE OWNER'S RESPONSIBILITIES ascertain how or for what purposes the Contractor has used the moneys paid to him under the Construction Contract. 2.7 "the services, information, surveys and reports re- quired by Paragraphs 2.3 through 2.6 inclusive shall be furnished at the Owner's expense, and the Architect shall be entitled to rely upon the accuracy and completeness thereof. 2.8 If the Owner observes or otherwise becomes aware of any fault or defect in the Project or non-conformance with the Contract Documents, he shall give prompt writ- ten notice thereof to the Architect. 2.9 The Owner shall furnish information required of him as expeditiously as necessary for the orderly progress of the Work. 2.1 The Owner shall provide full information regarding his requirements for the Project. 2.2 The Owner shall designate, when necessary, a rep- resentative authorized to act in his behalf with respect to the Project. The Owner or his representative shall exam ine documents submitted by the Architect and shall render decisions pertaining thereto promptly, to avoid unreasonable delay in the progress of the Architect's work. 2.3 The Owner shall furnish a certified land survey of the site giving, as applicable, grades and lines of streets, alleys, pavements and adjoining property; rights -of -way, restric- tions, easements, encroachments, zoning, deed restrictions, boundaries and contours of the site; locations, dimensions and complete data pertaining to existing buildings, other improvements and trees; and full information concerning available service and utility lines hoth Puhlic and private, ahove and below grade, including inverts and depths. 2.4 The Owner shall furnish the services of a soils engi- neer or other consultant when such services are deemed necessary by the Architect, including reports, test borings, test pits, soil bearing values, percolation tests, air and water pollution tests, ground corrosion and resistivity tests and other necessary operations for determining subsoil, air and water conditions, with appropriate professional interpretations thereof. 2.5 The Owner shall furnish structural, mechanical, chemical and other lahoratory tests, inspec tions and reports as required by law or the Contract Documents. 2.6 The Owner shall furnish such le+;al, accounting, and insurance counselling services as may he necessary for the Project, and such auditing services as he may require to ARTICLE 3 CONSTRUCTION COST 3.1 The Construction Cost to be used as the basis for determining the Architect's Basic Compensation shall he the total cost or estimated cost to the Owner of all Work designed or specified by the Architect, which shall be determined as follows, with precedence in the order listed: 3.1.1 For completed construction, the total cost of all such Work; 3.1.2 For Work not constructed, (1) the lowest bona fide bid received from a qualified bidder for any or all of such Work, or (2) if the Work is not bid, the bona fide nego- tiated proposal submitted for any or all of such Work; or 3.1.3 For Work for which no such bid or propos,11 iti received, (,I) the latest Detailed Estimate of Construction Cost if one is available, or (2) the latest Statement of Probable Construction Cost. 3.2 Construction Cost does not include the compensa- tion of the Architect and consultants, the cost of the land, rights -of -way, or other costs which are the responsibility of the Owner as provided in Paragraphs 2.3 through 2.6 inclusive. 3.3 Labor furnished by the Owner for the Project shall be included in the Construction Cost at current market rates inc luclint; a reascmable allowance for overhead and profit. Materials and equipment furnished by the Owner shall he included at current market prices, except that used materials and equipment shall be included as if pur- chased new for the Project. 3.4 Statements of Probable Construction Cost and De- tailed Cost Estimates prepared by the Architect represent his best judgment as a design professional familiar with the construction industry. (b) This document should be read in conjunction with another publication of the Virginia Chapter, The Ameri- can Institute of Architects entitled "Standards of Architectural Service", 2nd Edition. A thorough knowledge of the terms and conditions outlined in "Standards of Architectural Service" is essential to a full understanding and proper application of the recommendations set forth herein. (c) The percentages suggested herein have been shown by experience to be, and are recommended by the Virginia Chapter, The American Institute of Architects, as being the minimum that should be considered to provide a reasonable allowance of time and attention in the rendering; of basic services on projects of the type described. There are many conditions that warrant substantial increases in these minimums. (d) The importance to both owner and architect of an adequate fee should be fully recognized. The quality of architectural services depends solely on the ability of the architect and his associates and the time and attention they are able to devote to the project. Adequate fees are obviously essential for an architect to render consist- ently his fullest and best efforts. Costs of services are insignificant when compared to the over-all cost and im- portance of the completed building. The added investment in fees to get the best in architectural services will pay dividends in reducing the cost and improving the duality of the completed building. (e) It should also be recognized that, in view of the many intangibles involved, architectural services cannot be "weighed" or evaluated in the sense of a tangible product. The capabilities of any two architects for per- forming services on a particular project may vary —even though both may follow the same general rules and procedures. Therefore, in selecting an architect, a client is advised to place ability and not fee as the paramount consideration, in the same sense that a doctor or lawyer is usually chosen for his ability in handling similar cases and not because his charges are less (f) Since the selection of an architect on the basis of competition in professional charges can result in partial or inadequate services, any architect seeking to secure employment on such basis should be suspect as to his integrity and professional standing. GENERAL NOTES 1. This schedule represents a standard below which normal architectural services cannot be expected. Higher rates are proper in cases where the building problem is of greater complexity than the average of its kind, or when the long experience of the architect command a higher rate, or when services are required in addition to those included in the AIA standard form of agreement. 2. Dccoriti�c furnishings, special interiors, and alterations to existing buildings are subject to higher rates consistent with their special character. 3. A lower rate for the use of the same drawings and specifications for more than one building may be negotiated, generally at not less than one-half of the basic rate for duplicate use and at lower rates for multiple use. Duplicate or multiple use means the re -use of the complete set of drawings and specifications for a spe- cific building without change except in adjusting the foundations and utility connections to the other site or sites. When the documents are re -used, the architect's services during the construction contract administration are the same as for a new project and are repeated in full. 4. In general, the rate schedule applies to individual structurally disconnected buildings. Grouped projects shall be considered in their component parts; however, several buildings may be considered as one project and the rate set accordingly if all of the following four conditions are met. (a) All of the buildings are to have the same set of specifications. (b) All of the buildings are to be Built simultaneously under one construction contract. (c) All of the buildings are to be built on the same site. (d) All of the buildings shall serve the same type of function. A grade school meeting the first three conditions is considered one project even though it may contain a cafeteria, an auditorium or a gymnasium. A church plant meeting the first three conditions is considered one project even though it contains a sanctuary. a fellowship hall, a chapel and/or religious education classrooms. All college buildings are figured as separate projects. A building remodeling project done in connection with a new building project should be figured as a separate project. Dear Sir: Due to increased requests for traffic control at the Shopping Centers and at the Funeral Homes, (copy of Funerals handled included) it is necessary that I request permission to employ two additional patrolmen and to purchase two motorcycles. The additional patrolmen will also be used for other assignments when not tied up with traffic control. Motorcycles are much eaiser to maneuver in working Funerals and con- gested traffic areas, and many times when there has been an accident in a congested area, it is impossible to get an automobile to the scene due to all lanes being blocked. I have discussed this with Colonel Hedrick, Chief of Police, Henrico County, and he advised me that he has been using two motorcycles for quite some time, and had just recently purchased three more to be delivered in December. He further stated that he had found the Harley Davidson to perform excellent and it was easy to get this make serviced. I have checked on the cost of the Harley Davidson two -wheel cycle and the necessary equipment, including radio and the total cost will be approximately $4,692.00 each. We met with Mr. C. R. Masterson of the Virginia State Department of Health on November 20, 1973 to examine the area for the proposed sludge land fill of tobacco by-products using the trench technique. Mr. Masterson suggested how this should be accomplished (sketch attached) and Would be similar to the American Tobacco sludge disposal system. I note this resolution requests that we include in our plans for Chippenham Parkway a full interchange at Dalebrook Road. In the initial planning for the four -Caning of Chippenham Parkway, and the installation of full control of access, we considered the possibilities of an interchange at this point, but rejected it because of cost and the very close spacing with other interchanges which would present serious operational difficulties on Chippenham Parkway. As you know, plans have been completed based upon the closi-ng_of- this road, and I had assumed that this was agreeable to all concerned. I recognize the fact that this might increase traffic on Hopkins Road, but when we weigh this against the installation of an interchange and the attendant problems, I think that they would be greater if an interchange were constructed. Established. There is hereby established the Chesterfield Policemen's Pension and Retirement System as provided for herein. Section 8A-2. Policemen's pension and retirement board - Established; composition; duties generally. There is hereby established the Chesterfield Policemen's Pension and Retirement Board consisting of five members, three appointed by the Board of Supervisors from the citizens of Chesterfield County for terms of two, three, and four years, respectively, one member M M shall be the chief of Police of the Chesterfield County Police Department and one member shall be an employee of the Chesterfield County Police Department elected annually by the membership of the Police Department. Such Retirement Board shall have the duty to operate and administer the retirement system and review all applications for retirement or other benefits as provided and shall have the further duty to investigate the reports that minor children of a deceased police officer are not properly cared for and if such reports prove true, shall have the authority to make payments for the said minor children as they deem in the best interest of said children. Any member on.disability retirement is subject to review by Retirement Board, and any member has the right to appeal the decision of the Retirement Board to the Board of Supervisors. Such Board shall at its first meeting, and annually thereafter, elect one of its members as president, one as secretary and may also elect a vice president, and shall elect a treasurer. Section 8A-3. Same - Powers and duties. The general powers, authority and duties of such board shall be as follows: a) To make and adopt by-laws, rules and regulations lawful to be made, which the Board may deem necessary for the proper conduct of its affairs; b) To provide for such clerical, legal, and medical and other services as the Board may deem necessary or proper, and provide for the payment of suitable compensation for such services; c) To provide for, and require, deductions from the salaries of active and paid members of such police department and cause the -2- M same to be paid into the treasury of the Board, certain percentages of salaries, as hereinafter specified, for the purpose of raising funds for the necessary purposes of the Board in the administration of its affairs. d) Draw warrants on the treasury of the Board, for the payment of pensions and benefits hereunder, and costs and expenses of admin- istration, which warrants shall be signed in the name of the Board and countersigned by its president. Section 8A-4. Same — Treasurer. The treasurer of such Board shall be the custodian of all the funds and securities of the Board, and shall give bond, payable to the Board in such amounts and with such surety as may be required by the Board, conditioned for the faithful performance of his duties and the proper accounting for all funds and securities coming into his hands, the cost of the Bond to be paid out of the funds of the Board; and he shall disburse the funds of the Board on warrants drawn on him by the Board, and signed and countersigned as herein above provided for. Section 8A-5. Membership. Membership in the retirement system shall be voluntary for Police Officers presently employed at the time this ordinance becomes effective. Thereafter, all police officers employed by the County shall be required to become members of the retirement system. Each member shall contribute monthly an amount equal to three per centum (3%) of his monthly compensation. , Section 8A-6. Eligibility for retirement and pension. Any member who has attained the age of fifty-five (55) years and twenty-five (25) years creditable service with the Chesterfield - 3- M R County Police Department shall be eligible for retirement. Creditable service shall mean one year credit for each year as a member of the Police Department before chartering of the Chesterfield Police Benevolent Association and one year's service for each year as a member of the Chesterfield Police Benevolent Association and one year's service for each year after this plan is adopted. Each year a member of the Chesterfield Police Benevolent Association is in y� the Armed Forces involuntarily -shall count as one year creditable service providing the member returns to the Police Department after being Honorably Discharged from the Armed Forces. Upon retirement, a member shall receive an annual retirement allowance which shall equal one and one-half per centum (1-1/2%) of the highest five (5) years average income multiplied by the number of years of his creditable service. When any member shall have reached the age of sixty years or over and has twenty-five (25) years of creditable service, he shall be eligible for retirement and his minimum retirement payment shall be Two Hundred Dollars ($200.00) per month. If any member after retirement shall die, leaving a widow, then the widow of such member during her widowhood, shall receive an annual allowance payable monthly, equal to one-half (1/2) of the member's'retirement payment. Said widow receives this amount until she reaches eligibility age for receiving maximum Social Security Benefits. If he leaves no widow, or the widow dies or remarries, then such child or children, if any, of the deceased member, under. ,j the age of eighteen (18) years, shall be paid such allowance until such child.or children die or attain the age of eighteen (18) years, whichever shall occur first. If more than one child survives the deceased member, the allowance shall be divided among them and paid in such manner as the Retirement Board may determine. If a member hereafter dies in service at any time before retirement from a cause determined by the Retirement Board to be compensable under the Virginia Workmen's Compensation Act, there shall be paid an annual allowance payable monthly, to the widow of such member during her widowhood, if he leaves a widow, equal to one-half (1/2) of the members pension if he had retired at his earliest retirement age. (average of highest five (5) years income multiplied by the number of years of creditable service plus the number of years member would have been required to work to reach his earliest retirement age.) If he leaves a widow and child or children under the age of eighteen (18) years of age, then the widow shall receive full amount of pension until child or children reaches the age of eighteen (18) years. If he leaves no widow, or the widow, or the widow dies or remarries, then such child or children, if any, of the deceased member, under the age of eighteen (18) years shall be paid full allowance until such child or children i die or attain the age of eighteen (18) years, whichever shall occur first. If more than one child survives the deceased member, the allowance shall be divided among them in such manner as the Retirement Board may determine. Any benefits payable under the Virginia Workmen's Compensation Act shall offset against any benefits payable under the retirement system. Anc member at any time before retirement who becomes permanently disabled without misconduct from a service connected disability which prevents him from carrying out any duties as -5 a member of the Police Department shall be retired and receive an annual retirement allowance payable monthly which shall equal one and one-half per centum (1 1/2%) of the average of highest five (5) years income multiplied by the number of years of creditable service plus the number of years member would be required to work to reach his earliest retirement age. Any benefits payable under the Virginia Workmen's Compensation Act shall be offset against any benefits payable under this system.` Any member at any time before retirement who has ten or more years of creditable service, who becomes permanently disabled without misconduct from a disability which pre eats--- him from carrying out any duties em eb r of the Police Department shall be retired and receive an annual retirement allowance payable monthly which shall equal one and one-half per centum (1 1/2%) of average of highest five year (5) income multiplied by the number of years of creditable service I- plus the number of years member would have been required to work to reach his earliest retirement age. Section 8A-7. Death or separation from service prior to eligibility for retirement. In the event a member of the Chesterfield County Police Department who participates in the retirement system shall die before retirement from a cause determined by the Retirement Board not to be compensabl,e under the Virginia Workmen's Compensation Act, his estate shall receive the amount he has contributed to the Retirement Fund. If a member resigns or is i' separated from the Police Department, he shall, on application, be paid the amount of his contributions paid into said Retirement Fund and into the Chesterfield Police Benevolent Associated, -6- Incorporated, or if he had at least fifteenl5) years creditable service, he may elect to leave the amount contributed in said fund and he shall be paid annually one and one half per centum (1 1/2%) of his highest five (5) years annual average for creditable service multiplied by the number of years of creditable service in monthly installments when such member reaches the eligibility age for receiving maximum Social Security Benefits. In the event of his death prior to reaching eligibility age for receiving Social Security Benefits, then the amount contributed shall be paid his estate., Section 8A-7.1. Cost of living increase in benefits. In addition to all of the benefits provided herein, there shall be made on an annual basis a cost of living adjustment in the retirement, disability, and death benefits provided for in this Chapter. The basis for these adjustments shall be the Consumer Price Index as reflected by the year 1973. Beginning with the Consumer Price Index as determined six months after the passage of this ordinance, all persons receiving retirement, disability, or death benefits as of the effective date of this ordinance shall receive a cost of living increase in said benefits which shall be measured by the percentage of increase or decrease in the Consumer Price Index from 1973 to 1974. In each succeeding year, the amount of benefits being received by those persons at the time of the determination of the Consumer Price Index shall be increased or decreased acc a increase or decrease in the Consumer Price Index for the past year. All persons who become eligible for benefits subsegent to the effective date of this ordinance shall be entitled to receive -7- those benefits earned under the system together with the cost of living increases to place those newly eligible members in the same position as those similarly situated prior to the effective.date of this ordinance. After their benefits'have been equalized initially, their annual increases or decreases for all subsequent years shall be as determined for eligible members who were receiving benefits prior ,to the effective date of this ordinance. In no event, however, shall any decrease adjustment be made on account of a decrease in the cost of living, to reduce the base retirement, disability, or death benefits earned by an eligible member under the provisions hereinabove establ Section 8A-8. Contribution of--f-u­n`ds by Board of Supervisors. The Board of Supervisors shall contribute annually sufficient funds to assure the proper operation of the system and the payment of benefits falling due hereunder. Each annual contribution shall be actuarially determined percentage of payroll such that the aggregate present value of future contributions at such percentage rate, to- gether with the current assets of the fund and the aggregate present value of future member's contributions shall equal the present value of all benefits under the system. Section 8A-9. Deductions from salaries of policemen. There shall be deducted from the salaries of such policemen who are members of the retirement system such -amounts as provided for herein which shall be paid into the treasury of the Chesterfield Policemen's Pension and REtirement Board. i' SECTION 8A-10. Transfer of assets. Any and all assets and funds derived or obtained from or trans- ferred to the County of Chesterfield, Virginia, by,the-Chesterfield -8- Benevolent Association, Inc. shall be transferred to the Chesterfield Policemen'.s Pension and Retirement Board, Section 8A-11. Investment of funds. All cash assets and funds not necessary for immediate payments of pensions or benefits as provided hereunder, shall be invested in securities that are legal investments under the laws of this Common .wealth. Section 8A-12. Same -Appeal from decision. An appeal of right shall lie from the action of such Board on, any matter in which the Board is given discretionary power, to the Board of Supervisors and, if an adverse decision is rendered, an appeal of right shall be allowed to the Circuit Court of Chesterfield County, Virginia. Section 8A-13. Effective date.
