RE VEST: Conditional Use to permit recreational facilities in a Residential (R-15) District.
PROPOSED LAND USE:
A playground has been constructed on the request property to serve the surrounding
residential uses without appropriate zoning. A picnic shelter is also planned.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL SUBJECT TO THE CONDITIONS ON PAGE 2.
STAFF RECOMMENDATION
Recommend approval for the following reasons:
A. The recreational facilities will provide for neighborhood amenities for area
residential development.
B. The conditions address land use compatibility between the proposed uses and area
residential development.

CONDITIONS
(STAFF/CPC) 1. Permitted recreational facilities are limited to playground equipment
(i.e. areas accommodating swings, jungle gyms or similar such
facilities) and a picnic shelter. (P)
(STAFF/CPC) 2. There shall be no outside public address systems or speakers. (P)
(STAFF/CPC) 3. Any playground equipment shall be located a minimum of forty (40)
feet from all property lines, except that such equipment shall be
located a minimum of twenty (20) feet from any public road. A
forty (40) foot buffer shall be provided along the perimeter of
playground areas except where adjacent to any public roads and
the stormwater management/BMP facility. These buffers shall
conform to the requirements of the Zoning Ordinance for buffers
less than fifty (50) feet in width and shall be inclusive of required
setbacks. (P)

Public Water System:
The request is within the Chester Water Pressure Zone. There is an existing eight (8) inch
water line extending along the east side of Glenmorgan Drive, adjacent to the request site.
Use of the public water system is required by Code should any facilities be constructed
which require water usage.
Public Wastewater S,, sue:
The request site is within the Timsbury Creek Sewer Service Area. There is an existing
eight (8) inch wastewater sub-trunk line extending within an easement across the request
site. Use of the public wastewater system is required by Code should any facilities be
constructed which require wastewater.
ENVIRONMENTAL
The subject property is adjacent to a best management facility (BMP) in Stoney Glen. The BMP
was designed and constructed with aquatic and safety benches. As an additional safety measure, a
four (4) rail wooden fence was installed around the BMP. Part of the existing playground
equipment is located within the BMP easement, but is outside of this fenced area for the BMP.
Approval of a license agreement by the Board of Supervisors is required to authorize any non-
County improvements within the BMP easement. The applicant has indicated they intend to seek a
license agreement to permit the existing playground equipment to remain.
PUBLIC FACILITIES
Fire Service:
The Chester Fire Station, Company Number 1, currently provides fire protection and
emergency medical service (EMS). This request will have a minimal impact on Fire and
EMS.
Transportation:
The use (recreational facilities) will have a minimal impact on the existing transportation
network.
Virginia Department of Transportation
The information included with this request does not provide specific information
necessary to determine the traffic volumes generated; however, it is deemed acceptable
by VDOT's considered judgment that this activity will not have any impact on existing
VDOT maintained facilities. Thus, this office has no comments regarding this request.

Comprehensive Plan:
Lies within the boundaries of the Southern and Western Plan which suggests the property
is appropriate for residential use of 2.51- 4.0 units per acre.
Area Development Trends:
The area is characterized by residential zoning and single family residential use within
Stoney Glen South and Hill Spring Subdivisions. It is anticipated that residential
development will continue in the area as suggested by the Plan.
Uses:
As previously noted, the property has been developed as a playground to serve the
surrounding residential development. The facility was built in April 2007 without approval
of a Conditional Use which is required in an R-15 District for recreational use. As
conditioned, permitted recreational facilities would be limited to playground equipment to
include areas accommodating swings, jungle gyms or similar such facilities and a picnic
shelter. (Condition 1)
Development Standards:
The recommended conditions address setbacks and buffers and prohibit public address
systems and speakers. These conditions will minimize the impact of these facilities on
area residents and are similar to conditions imposed on similar projects. (Conditions 2
and 3)
CONCLUSION
The recreational facilities provide for neighborhood amenities for the residential development.
The conditions address land use compatibility between the proposed uses and area residential
development.
Given these considerations, approval of this request is recommended.
