Mrs. Smith comes before the Board in behalf of a Variance granted last month to Mr. Roy Webb, and states that she cannot give 40 -feet of her land for a roadway to support this Variance and wishes to change that to 2ersonto On motion of Mr. Hornerg seconded by Mr. App , it is resolved that the Variance granted to Mr. Roy Webb be changed and that the roadway of 25 -feet from Otterdale Road to the eastern boundary of lot 16-5 be dedicated as a public road and that said Variance be granted for the construction of one dwelling. Ayes: Mr. Horner, Mr, Apperson, Mr.Krepela and Mr.O'Neill. -2- .to communicate with the Courts in some fashion, that wooded lands provide some recfeatig'n to the County, that he too is concerned with the topsy-turvy land development and the high taxes that are forcing dale of some land for development. Mr. Myers speaks of the possibility of having an environmental assessment and the impact of such an ordinance and states he will have to' -discuss this with Hiram Ziegler from the Farm Burefu before the next meeting on this matter. Upon consideration whereof, and on motion of Mr.Appersonq seconded'by Mr.Krepel a, it is resolved that this matter be deferred to.Junt.289 1974 at 7:00 P.M. Mr. Pinchbeck states that he has heard.from his Insurance 6ompany and it has started investigation and will contact Mr.Cherry, the opposition lawyer. Mr. Cherry states that the Planning Commission continued this matter for thirty days, the Board of Supervisors has oontinued the matter, that he has written to Mr. Pinchbeck inviting settle- mentp Mrs. Roetger shows water from the silt basin and from the lake shows stake from lot 16 washed down in silt..Mr. Horner reads a letter from,Xr. Pinchbeck on the insurance issue and also a letter from the Royal Globe Insurance Company indicating that it would have the matter investigated. Mrs.Roetger again cites recent rains from freshly graded.back yandd and states that this is coming over on to her property. Mr. Pinchbeck states that he is willing to withdraw the zoning and not purchase the 26 acres of the_ Rudd property. Mr. Cherry states that they will be content if the pond is cleaned and will reduce this in writing with the help of Mr.Prosise of the hydraulic department. Mr., Thomas Bryant, member of the Executive Board of the Richmond Symphony, speaks for a grant from Chesterfield County to aid in bringing music to the various Chesterfield schools and to allow On motion of Mr.O'Neill,seconded by Mr.Appersonq it is resolved that the following resolution be and it hereby is adopteds Be it Resolved by the Board of Supervisors of the County of Chesterfield, Virginia, in regular meeting assembled that the Chairman of said Board be and he hereby is authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, and to sign same on behalf of said County whereby said Railroad Company grants unto said County the right or license to install and maintain, for the purpose of a water main, a line of pipe on the right-of-way of said Railroad Company at or near Petersburg, Virginia; as more particularly described in said agreement, which agreement is dated April 29 1974, a cooy of which agreement is filed with this Board of Supervisors. Reconvening, Mr. Fred Forberg of the State Tax Mepaftment comes before the Board to speak on the Ordinance for special assessments of land, and states that it will cost something to set this ordinance in operation. Mr. Arthur Hart, from the Division of Agriculture, states that his Department is not promoting this ordinance but states that it can be beneficial. There is a lively discussion concerning the pros and cons of this ordinance. Mrs. Mary Sue Barron, League of Women Voters, speaks for the Ordinance, saying that it will sponsor open spaces and will buy time to allow the orderly development of the County. Mr. Cherry, Attorney, pact owner of Eppington, which has 1750 acres states that it appears that an ordinance may be helpful to the people who own this large parcel of land. Mr. Apperson stated that he is concerned about the legal status of the Assessing Department , since it is necessary to assess property at the fair market value and the County is now apparently not assessing at its fair market value but more or less on the use of the landq and that the County may be outside of the law in this defacto use assessment• The rollback of the taxes is up to the owner and it would be necessary for the Assessing Department _:I_ 0, the school children to come to the Mosque to hear the Richmond Symphony. He states that the Code of Virginia does not allow one locality to give a sum of money to other localities but this can be overcome by contractual agreement, and suggests that a member of the Board and perhaps a school member be designated to work out some possible details with officials of the Richmond Symphony. The Chairman appoints Mr. Krepela, with the aid of Mr. Morris Mason and possibly Mr. Clarence Curtiseor his designee to meet with the Richmond Symphony officials. Mr. F. W. Be it orined by the County of Chesterfield, Virginia, that Chapter 11, Article 1, of the Code of the County of Chesterfield, Virginia, be amended by adding thereto Sections 11-11.1:1 through 11-11.1:8 to read as follows: Section 11-11.1:1 The County of Chesterfield finds that the preservation of real estate devoted to agricultural, horticultural, forest and open space uses within its boundaries is in the public interest and, having heretofore adopted a land -use plan, hereby ordains that such real estate shall be taxed in accordance with the provisions of Article 1.1 of Chapter 15 of Title 58 of the Code of Virginia and of this ordinance. Section 11-11.1:2 (a) The owner of any real estate meeting the criteria set forth in Sections 58-769.5 and 58-769.7(b) of the Code of Virginia may, on or before November one of each year, apply to the Commissioner of the Revenue for the classification, assessment and taxation of such property for the next succeeding tax year on the basis of its use, under the procedures set forth in Section 58-769.9 of the Code of Virginia. Such application shall be on forms provided by the State Department of Taxation and, supplied by the Commissioner of the Revenue and shall include such additional schedules, photographs and drawings as may be required by the Commissioner of the Revenue. An application fee of ten dollars shall accompany each application. (b) A separate application shall be filed for each parcel on the land book. Section 11-11.1:3 Promptly upon receipt of any application, the Commissioner of the Revenue shall determine whether the subject property mts the criteria for taxation hereunder. If the Commissioner of the Revenue determines that the subject property meet such criteria, he shall determine the value of such property for its qualifying use, as well as its fair market value. In determining whether the subject property meets the criteria for "agricultural use" or "horticultural use" the Commissioner of the Revenue may request an opinion from the Commissioner of Agriculture and Commerce; in determining whether the subject property meets the criteria for "forest use" he may request an opinion from the Director of the Department of Conservation and Economic Development; and in determining whether the subject property meets the criteria for "open space use" he may request an opinion from the Director of the Commission of Outdoor Recreation. Upon the refusal of the Commissioner of Agriculture and Commerce, the Director of the Department of Conservation and,Economic Develop- ment, or the Director of the Commission of Outdoor Recreation to issue an opinion, or in the event of an unfavorable opinion which does not comport with standards set forth by the respective director, the party aggrieved may seek relief from any court of record wherein the real estate in question is located. If the court finds in his favor it may issue an order which shall serve in lieu of an opinion for the purposes of this ordinance. Section 11-11.1:4 The use value and fair market value of any qualifying property shall be placed on the land book before delivery to the treasurer and the tax for the next succeeding tax year shall be extended from the use value. Section 11.1:5 There is hereby posed a roll -back tax, and interest thereon, in such amounts as may be determined under Virginia Code Section 58-769.10, upon any property as to which the use changes to a nonqualifying use. Section 11-11.1:6 (a) The owner of any real estate liable for roll -back taxes shall report to the treasurer, on forms to be prescribed, any change in the use of such property to non- qualifying use and shall pay the roll -back tax then due. On failure so to report any pay within sixty days following such change in use, such owner shall be liable for an additional penalty equal to ten per centum of the amount of the roll -back tax and interest, which penalty shall be collected as a part of the tax. In addition to such penalty, there is hereby imposed interest of one-half per centum of the amount of the roll -back tax, interest and penalty, for each month or fraction thereof during which the failure continues. (b) Any person making a material misstatement of fact in any application filed pursuant hereto shall be liable for all taxes, in such amounts and at such times as if such property had been assessed on the basis of fair market value as applied to other real estate in the taxing jurisdiction, together with interest and penalties thereon, and he shall be further assessed with an additional penalty of one hundred per centum of such unpaid taxes. Section 11-11.1:7 The provisions of Title 58 of the Code of Virginia applicable to local levels and real estate assessment and taxation shall be applicable to assessments and taxation hereunder 0 mutatis mutandis including, without limitation, provisions relating to tax liens Mid the correction of erron uus assessments, and for such purposes the roll -back taxes shall be considered to be deferred real estate taxes. Many of the latter are contributed by individuals and businesses in Chesterfield County. For this we are grateful. We are now in the process of conducting a campaign to raise from private sources $210,000 in annual maintenance funds. The enclosed brochure describes this effort. You will note, however, that in order to generate the $572,610 required to assure the Symphony's continuance, we need $122,100 from other sources such as grants from governments and public foundations. Toward this amount we now receive a $30,000 grant from the Council of the City of Richmond. Similar funding comes from our State and Federal governments. We feel certain that the citizens of Chesterfield County would want the official support of their county government so that this cultural part of their environment can be maintained. To this end we ask your approval of an appropriation by the County of Chesterfield of $15,000, which is small indeed when measured in terms of the benefits received by the residents and school children of the county. B an, Jr. Member of the E ecutive Committee ThuRic,hmond 5*-0myphony MEMORANDUM March 12, 1974 The residents of Chesterfield County use and enjoy the services of The Richmond Symphony - not only through our 15 subscription concerts but through the many educational programs in which they and their children participate: 11 Youth Concerts: Performed in the Mosque with approximately 30,000 school children in attendance. Of these students, 25 percent are from Chesterfield County schools. A 7S member Youth Orchestra: Provides area students with professional direction and performance exposure, with local concerts, radio and television programs. Each year approximately 25 members of the Youth Orchestra are from Chesterfield County Schools. A 48 member Youth Wind Ensemble: Formed during the current fiscal year in response to growing school and student demand for a musical group which could provide performance, instruction, and exposure for students of brass and wood wind instruments. A 50 voice Richmond Youth Chorus: Again, formed during the current fiscal year for talented vocal music students. The Youth Chorus performs with the Youth Orchestra in the same capacity as the 200 voice adult chorus serves with The Symphony. 21 Student Scholarships: Provided by The Symphony for talented students on the basis of need. Seven of the recipients are from Chesterfield county. Further, with the advent of our full-time chamber orchestra, The Richmond Sinfonia, we have been able to provide an additional twenty-five chamber music concerts for area schools. Funding by the Council of the City of Richmond for the current fiscal year was $30,000. This gift began five years ago at $15,000 when it covered more than 50 percent of the costs of all our educational programs. Throughout this time the Symphony's educational services have been shared in an approximate ratio of 50% for city children and 25% for children from Chesterfield and Henrico counties, respectively. However, the cost of our services have risen to a level where that $30,000 grant barely covers the city's share of activities. Page 3 MEMORANDUM Though the services of the Symphony have been maintained or increased in the counties in recent years, there has never been any appropriation by the counties for our supporta This year the Symphony was forced to curtail 57 teaching concerts in the county schools due to insufficient funds. In order to reinstitute this program and maintain the many others which are made available to all area students, the Symphony must have increased support from the city and initial funding from Chesterfield and Henrico counties. Without support from the counties, we are certain we will not be granted additional support from the City of Richmond. Therefore the city's grant is contigent upon that of the counties. W. Buckley, 519 N. Belmont Road, Telephone: 231-7909 requests a variance to build a dwelling on a parcel of land which has no public road frontage. Mr. Buckley is the owner of the subject parcel. This parcel can be served by public sewer- age. Records of the County Engineering Department to include the Right- of-way Engineer indicate that Cabin Creek Drive is not a dedicated road. Staff visited this site and found that Cabin Creek Drive is a very rough dirt road, and barely passable atsomepoints. Staff notes that there are three occupied dwellings that front on Cabin Creek Drive, and use this unimproved road for ingress and egress to Jessup or Turner Road. This parcel and adjacent property are occupied as shown on the attached tax map. If this variance is approved, we recommend that the applicant be required to dedicate to the County a twenty-five (25) foot wide road easement, measured from the centerline of Cabin Creek Drive, over and across the front property line of Parcel 6-1. This dedication would be with the understanding that the County will not maintain this right-of-way until it is brought to State standards by others.
