CONDITION RECOMMENDED BY STAFF WAS NOT IMPOSED.
CASE HISTORY
Staff (7/21/09):
In an addendum to the "Request Analysis" the Commission was advised that the Condition
recommended by staff could not be imposed per the Zoning Ordinance.
Planning Commission Meeting (7/21/09):
The applicant accepted the recommendation. There was no opposition present.
On motion of Dr. Brown, seconded by Mr. Hassen, the Commission recommended approval
and acceptance of the Proffered Condition in the "Request Analysis".

STAFF RECOMMENDATION
Recommend approval for the following reason:
Deletion of the proffered condition would require on-site stormwater retention and release
consistent with Ordinance requirements thereby reducing the flooding of Kingsland Road.

site, the owner/developer shall extend a wastewater line to the site and connect all existing

Public Water System:
There is an existing sixteen (16) inch water line extending along the west side of Iron
Bridge Road, approximately 215 feet west of the request site. In addition, a twelve (12)
inch water line extends across Iron Bridge Road and continues along a portion of Quaiff
Lane where an eight (8) inch water line extends onto the properties adjacent to the north

side of Quaiff Lane. Use of the public water system is required. (Case 06SN0327 -
Proffered Condition 4).
Public Wastewater S,, sue:
The public wastewater system is currently not available. The applicant initially intends to
continue use of a private septic system to serve this site. The Health Department should
be contacted concerning any expanded use of the private septic system.
The request site is within the Reedy Branch Creek drainage basin and there is an existing
fifteen (15) inch wastewater trunk line along a portion of Reedy Branch Creek that
terminates 4,300 feet east of this site. A wastewater line extension from the existing
trunk line to Iron Bridge Road has been proposed for the area and is currently under
design. While the public wastewater system is not available to serve this site at this time,
the proposed extension would make wastewater service available in the future. The
applicant has proffered to extend a wastewater line to the request site, and to connect all
existing uses to the public wastewater system at such time as the public wastewater
system has been extended to within 1,250 feet of the request site. (Proffered Condition)
ENVIRONMENTAL
Drainage and Erosion:
The property sheet flows to the north, across the adjacent property to a tributary of
Kingsland Creek. Kingsland Road floods during severe storms. To address concerns
relative to this flooding, Proffered Condition 8 of Case 06SN0327 requires retention of
water on-site, performance of off site improvements or provision of a combination of the
two (2) to compensate for the impervious area of this development and other undeveloped
properties upstream of Kingsland Road that flow to Kingsland Road.
There are no apparent water courses located on the property or adj acent to the property that
would provide a viable outfall. As such, acquisition of off site easements would be
necessary for the installation of drainage improvements required by the current condition.
The developer has worked over a period of time in an effort to minimize the easements
necessary to implement this proffered condition but has been unsuccessful in obtaining the
necessary easements. Without a natural water course, the developer has opted to store the
post development 10-year storm and release the water on a two-year pre-development storm
into the adjacent wetlands that will eventually reach Kingsland Road. This method for
addressing drainage is consistent with Ordinance requirements.
PUBLIC FACILITIES
The request will have little or no impact on these facilities.

Comprehensive Plan:
Lies within the boundaries of the Central Plan which suggests the property is appropriate
for community mixed use.
Area Development Trends:
Surrounding properties are zoned Agricultural (A) and General Business (C-5) and are
occupied by single-family dwellings, commercial and office uses or are vacant. The Plan
anticipates community-scale commercial and office uses along this portion of the Route
10 corridor.
Zonin H.~ istory:
On January 24, 2007, the Board of Supervisors approved the rezoning of this property
(Case 06SN0327). To address concerns relative to flooding along Kingsland Road,
proffered conditions require the retention of stormwater on-site, performance of off site
improvements or provision of a combination of the two.
CONCLUSION
Deletion of the proffered condition would require on-site stormwater retention and release
consistent with Ordinance requirements thereby reducing the flooding of Kingsland Road.
Given these considerations, approval of this request is recommended.

The Board of Supervisors, on Wednesday, July 22, 2009 beginning at 6:30 p.m., will take under
consideration this request.
