11� VIRGINIA: At a regular meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on January 10, 19560 at 10:00 a.m. Present: fr. Irvin G. Horner Mr. H. T.Goyne Mr. R.J. Britton Mr. Stanley R. Hague, Jr. Dr, Robt, 0. Gill Mr. Marshall F. Driskill This day Mr. Irvin Horner welcomes Mr. Marshall Driskill to the Board of Supervisors* Mr. Driskill expressed his pleasure in becoming a part of the government of Chesterfield County. Mr.Driskill introduces the Rev. Eugene Woolridge, Pastor of Stratford Hills Baptist Church, who gives the ingocation. This being the first meeting of the new term, the Executive Secretary asked for nominations for Chairman of the Board of Supervisors. On motion of Dr.Gill, seconded by Mr.Britton. it is resolved that Mro Horner be and he hereby is elected Chairman of this Board. The Chairman welcomes Mr. Ernest Gates as Commonwealth's Attorney for Chestc_f: County attending his first Board meeting in this capacity. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that this Board _authorize the Treasurer of the County to invest $5000000 from the General County Fund at the best possible rate of interest on a short term basis. This day Dr. A.G; Macklin, appeared before the Board seeking the extension of maintenance on Oakland Avenue in 11:est Chesterfield Heights* On motion of Dr.Gill, seconded by Mr.Goyne, it is resolved that this Board rescind its resolution of October 11, 1955, concerning the improvement of this street. Upon further consideration and on motion of Dr.Gill# seconded by Mr .Brit ton, it is resolved that this Board request the Highway Department to improve Oakland kvenue approximately 270 feet north of its northern end at a cost not to exceed $267.509 the cost of which is to be borne by the 3¢ Road Fund of the County. Write usual resolutions on Yeardley Road in Westover Farms, Melbourne Drive, Glyndon Lane and Woodbury Lane in Granite Hills. n —2— Mao. Coyne requested Mr. Kellam to improve a driveway helonging to Mr. X. H. Brooks, on the western end of Swineford Road. Oo Kellam informed the Board that 0120,795.00 was unprogrammed Federal Aid lklads to be available through Tune 30, 1958, Upon consideration whereof and on motion of Mr.Britton, seconded by Mr. Driskill, _t is resolved that this Board request the Highway Department to program the u:memcumbered balance of Chesterfield's Matching Fund to be spent on the improve- ment; of Cherokee Road (Rt. 704) at its intersection with Rt.679, westwardly to Bosher °s Dam and the improvement of Granite Rd. (Rt. 683) fromits intersection with Rt.679 to Rt,, 147. This day Mr. Fred Thompson came before the Board citing the fact that Manchester School and the new School on Whitehead Road would be requiring extensive sewerage systems and asking the Board of Supervisors what procedure the School Board should consider in its planning for these utilities. It was generally agreed School Board keep the Board informed as to its progress on the planning oa these utilities, but not to count on a County sewer system in the immediate suture. Whereas, a portion of Ste Rt. 10 not improved leading from Richmond to Chesterfield Courthouse carries a considerable volume of traffic, and is in need of great improvement , and Whereas;, the State Department of Highways has appropriated $55s,000.00 for the improvement of a section of this road, Now, Therefore, Be it Resolved on motion 6f Mr. Hague, seconded by Dr. Gill, that this Board request the State Highway Department to improve St. Route #10, from the southern end of recent improvement southwardly to Chesterfield Courthoilm- a distance of approximately 4-miles. Business on the following described parcel of land: In Manchester Magisterial District, a parcel of land fronting 200 feet on Blithewood Drive and extending approximately 180 feet westwardly to Hathaway Road and a parcel of land fronting Blithewood Drive 215 feet and extending eastwardly 165 feet, both of said parcels lying immediately north o" Sequoyah Road and being better known as Lots 1 and 2. B1ockA, and 1 and 2 Block F inthe Plan of Kenmore Ridge! n -3- M Mr- Schmidt states that he wishes to reduce the amount of zoning request to 65 feet north of Sequoyah Road, running fram Hathaway eastwardly 400 feet to his property line. Mr, Schmidt states there should be a ratio of 3 to 1 in the parking space in relation to actual floor space in the shopping area. Petition signed by some 15 citizens living within 500 feet of this W . Marvin Cole, Attorney for citizens opposing this request presents a notarized property, and presents another petition signed by many of the citizens in the surrounding territory, along with a delegation of some 41 persons, all opposing the requested rezoning, Mr. Robert Raab, speaking for the rezoning stated that the parking lot was most necessary. On motion of Mr. Britton, seconded by Mr.Goyne, it is resolved that action on this matter be postponed until January 24, 1956, at 8:00 peme This day Mr. John tester came before the Board requesting the rezoning from Agriculture to General Business on the following described parcel of land: In Midlothian Magisterial District, a pzrcel of land fronting 730 feet on Rte60 and extending northwardly 300 feet, said parcel bei of 1500 feet west of Buford Road, Came also W- Gayle who states he does not oppose the rezoning of land for business but does not favor the monstruction of a service station on this Property, Mr, Foster states that the owner of this land had no specific•.,. Plans for its development, Upon consideration whereof and on motion of Mr.Driskill, sedonded by Mre Goyne, it is resolved that the application for rezoning the afo redeseribed property from Agriculture to General Busiress be and it hereby is denied. This day the American Telephone and Telegraph Cohpany appeared before the Board requesting a Use Permit to operate a TV Tower on the following described parcel of land: In Matoaca Magisterial District, a parcel of land containing 8—acres fronting 600 feet on the Branders Bridge Road and extending 600 feet no rthwazdl y along theSeaboard Airline RR, said parcel being west of and adjacent to the Seaboard �yirline RR. Whereas, no opposition appears to this request, upon consideration whereof and on motion of Dr,,Gill, seconded by Mr. Hague, it is resolved that the request4d for a Use Permit to operate a T2 Tower on the aforeddecribe parcel of land, be, and the same is hereby grantede This day Mr. Louis Longest appeared before the Board requesting a variance in the CountyTs building restrictions to allow him to locate a building 15 feet from his front property line on Rt. 10, said building to be located Just east of the rear of the Chester Bank, and Whereas, it appears that the Highway Department has purchased more Chad than is necessary at th-s point, and Whereas,, it appears that the strict complieice with the set beck code mould cause extreme hardship, Nowr Therefore, Be it Resolved, on motion of * .Goyne, seconded by Mr.Brit ton, that this Board giant a variance of its building restrictions to allow the co.1struction of a:� office building not less than 15 feet from the property line. This day Mr.XLbert Mumma presented a letter fm the Board of Supervisors, Proposing to give to the Bounty the Grove Place water system, presently owned and operated by Mr, Mumma, and agrees to maintain the system for any reasonable length of time to enaKe the County to construct an 8" line along Rta #]A, aad citing the fact that ;300.00 is available, and within two years, which is the estimated time necessary for completition of an 8" line along Rt. #10, $384^00 will be guaranteed inrevenuse Chereupon Mro Mumma states he is willing to pay the difference in the cost of a 611 lino from Rt. 10 and the '684.00 and will guarantee also to maintain the system until said line is installed Whereupon it was agreed that the Commonwealth's i,ttorney would prepare a contract to presence to this Board at its nsxt meeting. This dal the Count;r Eagineer presented a contract for the installation of approximatel,r 500 feet of 4" line west of Hey Road on old Broad Rock Road, stating the fact that the proposed plan calls for an 8" line on said road. Several plans were discussed for handling this project but it was generally agreed that no action be taken to approve this contract at this time. The County Engineer presented a contract for the its tallation of approximately 200 feet of 2" line in the Johnson Farms Subdivision., Upon consideration whereof and on motion of Mr.Britton, seconded by Dr., Gill, it is resolved that said contract be and the same is hereby approved. ,nd be it further resolved that the Chairman and Executive Secretary be authorized to sign said contract. On motion of Mr Goynes seconded by Mr.Britton,. it is resolved that the Chairman appoint a Committee to study the organization of the Water Department, and to recommend a plan for the setting up a Department of Public Utilities. Whereupon, Mr, Horner appoints appoints the Commonwealth's Attorney, the Chairman of the Board of Supervisors and the Emutive Secretary as this Committee. On motion of Mr. Driskill, seconded by Mr.Goyne, it is resolved that the County Engineer prepare specifications for an emergency repair truck and to obtain bids for said truck. It is here noted that DreGill vot4s "No:' It was generally agreed that no formal approval of the authorization to obtain detailed plans and specifications for the construction of water improvement until such time as the recent bond vote is certified, would Too.► made, however, the County E-ngineer is instructed to proceed as fast as possible on such work as is feasible to improve the filter pldat, to raise the dam, to locate the shop for the Water Department, and such other work as is necessary. On motion of Mr.Goyne, seconded by Mr.Brittoa, it is resolved that the insurance for the Volunteer Firemen of the County be awarded to the firm of Goddin, Goodridge and Robertson, to be p1s ced with the Firements Fund Indemnity Company*, at a price not to exceed 0585.94, which premium allows for the following coverage: Accidental Death Benefit $3000.00 Loss of two members,(hands,feet or eyes) 39000.00 Loss of hand or foot 4 500.00 L^3s of sight of one eye 4000e00 Accident medical reimbursement Benofit, Maxim= 19000,00 Weekly accident Indemnity Fayable from first day for as long as five years 25.00 On motion of DreGill, seconded by W. Driskill, it is resolved that the County Engineer be requested to contact the Consulting Engineering firm of Wiley and Wilson to get a proposal for engineering services connected with the Ettrick sewerage connection with Peterskurge This day Mr. Tordan and others appeared before the Board requesting some understanding concerning the Manchester Memorial Building which is at present being erected on Bryce's Zane, and it was generally agreed that the building should hero separate heating systems and separate electrical systems so that the Cotmty could pay its share for heating the Fire Department only. M -6- On motion of Mr. Britton, secord ed by Mr.Driskill, it is resolved that the Executive Secretary be and he hereby is authorized to purchase a siren for the Manchester Fire Department, which siren would be somewhat similar to that recently purchased for the Dale Volunteer Fire Department. On motion of Mr.Goyne, seconded b y Mr. Britton, be it resolved: that the members of the General Assembly of Virginia representing Chesterfield County are respectfully requested to introduce and work for the passage in the 1956 Session of the General Assembly the following bills in addition to other bills heretofore approved: 1. 44thority to employ a general registrar and allow the retbntion of local registrars. 2. Make water charges a lien on the real estate served. 3. Amend Section 58-266.37 of the Code, to include Chesterfield so that Chesterfield will have the same powers as Richmond and Henrico to impose certain license taxes. 4. .Authority to create Department of license inspection. 5. .Amend revenue dater Act of 1946 to allow refunding of outstanding bonded indebtedness. 6. Change the maximum and minimum limits of the salary of the Commonwealth's Attorney to $6000.00 minimum and $9500*00 maximum. This day the report from the Compensation Board as to the 3ixpenses and salaries in theSherifffs Office came before the Board; upon consideration whereof and on motion of Dr.Gill, seconded by Mr.Driskill, it is resolved that this Board doth object to the salary fixed for Gilliam H. Cogbill,Deputy Sheriff, by the Compensation Board tentatively, and request a hearing on such objections. Be it further resolved, that this Board doth designate Dr.Grll and Mr.Driskill to serve as additional members of the Compensation Board to hew this mactter. Be it further resolved, that this Board doth feel that the salary requested for Gilliam H.Cogbill, to be fair compensation to be paid said Deputy. This day the Executive Sedretary advised the Board that bids were being received for the County's fleet insurance policy and that the Nation-wide Company had given a month 's binder to allow this bid to be received. This day the Executive Secretary advised the Board that letters from the Hon. Minetree Folkes, Tr., Hon. Lloyd C.Bird and the Hon. Edward M.Hudgins, had been received, allof which letters cited and expressed cooperation with the Hoard's request for legislation. This day the reports from tye State Compensation Board on the salaftes of the Commissioner of Revenue, Sheriff, Treasurer and Commonwealth's Attorney, had been received, and it w.s ordered that these be received and fildd with the exception of the Sheriff's report. -7r The Chairman noted the fact that the Planning Commissionts . representattv9s and members should be selected at its next meeting. On motion of'Mr.Goyne, seconded by Dr.Gill, it is resolved that the minutes of October 6, 11, 13, and 27th, November 9, 22, and 29th, and December 6, 13 and. 21st, be and they hereby are approved. On motion, the meeting is adjourned until January 17, 19569 at 8:00 p.m. Virginia Otatt gCoutge 3peterdurg Virginia OFFICE OF THE DIRECTOR December 13, 1955 DIVISION OF BASIC EDUCATION The Board of Supervisors of Chesterfield County Chesterfield, Virginia Gentlemen: The resolution passed by the Board of Supervisors on October 11, 1955 re- lative to the improvement of Oakland Avenue in West Chesterfield Heights is appreciated by the property owners involved and we herewith express our appreciation for the consideration given. While the resolution did not clearly set forth this point, we recall that the improvement considered would (1) carry the improvement work up to in- cluding a point at which water would be carried through a pipe under the curve beyond the point of current State maintenance. It is our understanding that this improvement will insure maintenance by the State Department of highways from now on of the improved section and a number of us will cooperate to pay one half of the $265.00 needed. Gentlemen, time and circusmstances are of such that we take this action although we hope you will be kind enough to reconsider the payment plan when additional information is given you. Please,therefore, authorize the completion of this improvement and we respectfully request your per- mission to confer with you later about the matter. A petition to review the decision on providing additional improvement at Oakland Avenue and Plumtree Street and transfer into the State road system. 2. A petition that a clearance line be established for the rear of Lots in Block I sub -division In reference to the road improvement the correspondence here available shows that: 1. On April 26, 1949 we petitioned the Board of Supervisors for road improvements, sewer and water on the road which extends from Dupuy Road to Piedmount Avenue and water and sewage facilities on Oakland Avenue per se. 2. The estimated length of the road was 4000 feet. 3. At a meeting of the Board of Supervisors between May, 1949 and November 1949 it was determined that the cost of the road improvement would be about $1000*00 and that the County would pay half while the property owners would pay half. 4. After December 3, I discussed in a letter to Mr. Kellam, The Resident Engineer., whether or not part or all of the road was involved, and whether or not hard surface would be involved. I was advised that hard surface would be a matter of time, after the road had been taken into the State road system. 5. Gravel and drainage were provided throughout the length of the road, the cost was $900.00 and Mr. Burnett, writing for the Board of Supervisors, requested $450.00 as the property owners' part of the cost. That certain high State and County officials were kind enough to indicate that the petitioners were worthy of all consideration the County could give them. ?. The Chairman of the Improvement Committee was a member of the State Supervisory staff in the Department of Education. It was orally noted that the Chairman was a member of the Circuit Court Grand Jury, while most of the other property owners were on the staff at Virginia State College. It is worthy noting that one of the property owners not on the staff at Virginia State College is one of the most solid citizens in Chesterfield County in terms of taxes and decorum. 8. I served as a agent for the County without - collected the donations from the tax payers and submitted a check for $450.00 which check was recognized in a letter from Mr. Burnett on June 13, 1950. 9. To insure water in the area three families combined to lend the County $1000.00 in 19491 and nine property owners paid $50#00 for water connections to their land and shortly after payment of $450.00 on June 13, 1950 the entire road between North Avenue and Piedmount Avenue extension and Dupuy Road was graveled and drained by the State Highway Department and the County, with the County assuming $450.00 of the 2¢ road fund. 10. That the road was then said to meet the requirement for acceptance into the State Secondary Road System. However, in 1952 the road had not been kept up or taken into the State system, and the Board of Supervisors discovered it was a matter of over -sight and misunderstanding. When Mr. Kellam and I presented conflicting evidence, a special committee was appointed to visit the area. That committee consisted of Mr. Burnett, Dr. Gill and Mr. Kellam. They discovered that the road had been graveled and hard surfaced and that it should be kept up and recommended for inclusion into the State Road System. However, since some property owners had not built their homes in the area, this group agreed to recommend for immediate acceptance into the road system a portion of the road up to a point beyond my residence since that was the furthermost residence on the road at that time. I understood that the principle was then laid to extend the road as far as property owners built. Two members of the Armed Forces have now constructed homes slightly beyond a point of maintenance, and in pursuit of principles the fact that n n Page 3 Members of the Board of supervisors January 9, 1956 the tax payers having paid 50% of the initial cost, we petition, therefore, that: 1. The Board authorize the improvement of the additional section of the road as here discussed 2. The Board review its decision to charge the property owners another one-half cost of the road. Volunteer Firemen are those members of a Fire Company who have some regular occupation other than fighting fires. Regular members whose occupation is that of fireman and who receive a regular salary for their services are covered under the policy only while goint to, at, or return- ing from a fire. Application - Special Application to be signed by a town officer or an officer of the Fire Company or Fire District. Policy - A Master Policy is issued covering the whole Group. �W Certificates - No certificates are issued. Age Limits - Minimum 16 years. Maximum 70 years. Principal Sum Payments,- The full principal sum is payable for loss of Life to Both hands or both feet One hand and one foot Sight of both eyes. One-half the principal sum is payable for loss of either a hand or a foot. One-third the principal sum is payable for the loss of the sight of one eye. Principal Sum payments are made only provided such loss occurs within 90 days of date of accident. If a member suffers more than one loss in the same accident, only one payment, the greatest, will be made. rNI M M Indemnity for loss of life is payable to the member's Estate. All other indemnities are payable to the member. Weekly Indemnity for Total Disability - If injuries do not result in a loss for which a principal sum payment is made but ;prevent member from performing any and every duty of his usual occupation, weekly indemnity will be paid from date of accident through period of continuous total disability but in no case to exceed 104 weeks. Payable every four weeks. Weekly indemnity is payable for the period from the date of accident to the date of a principal sum loss providdd disability is total during that per- iod. Indemnity for Medical Treatment of Non disabling Injuries - If the injuries do not result in a principal sum loss, or total disability for which weekly indemnity is paid, but do require medical or surgical attention, the Com- pany will pay the cost thereof to an amount not exceeding weekly indemnity for one week. Premiums are payalle annually in advance. If the binder premium accompany- ing a new application is less than the annual premium, the balance must be to collected before the policy may be delivered . Medical Reimbursement Benefit - For a basic annual extra premium of $40.00 the policy may provide reimbursement of the member for actual expenses incurred by him for medical or surgical treatment, hospital confinement or the employment of a trained nurse due to an injury covered by the policy provided such expense is incurred within twenty-six weeks of the injury. I attended the Welfare Board's meeting November 17th, at which time we discussed several proposed changes. Ernest Gates is preparing these bills, some of which are covered by the resolutions of the Board. It was suggested that a change in Section 63-73.1 regarding accounting procedures for handling special funds be approved by 1,1r. Moore, our treasurer. Ernest is no doubt seeing about these. It was also thought advisable to discuss some of these with Colonel Cope- land before the session meets. Some of the lawyers in the area seem to think we should try for the Chesterfield Circuit again and others say wait. We will have to decide what is best at this time. I am not definitely opposed to trying again, but feel certain we can arrive at the right decision. Meetings regarding the referendum are picking up as well as the interest. Dear Mr, Burnett: COMMITTEE ASSIGNMENTS: COUNTIES, CITIES AMC) TOWNS FEDERAL RELATIONS GENERAL LAWS OFFICERS AND OFFICES AT THE CAPITOL I have your letter of December 21, enclosing therewith a number of resolutions and requests of the Board of Supervisors. I will comment on each resolution by separate paragraph. I am doing all within my power to secure favorable vote for the Referendum on January 9, in order to pave the way for amending Section 141 of the Constitution of Virginia. A Bill for an additional courtfbr Chesterfield County was, as you know, presented to the Legislature by me last year. We were able to get the Bill out of the House Judiciary Committee, and as a matter of fact it was passed by the House. When it reached the Senate it was referred to the Senate Judiciary Committee. That Committee had Bills for the creation of three or four other Judgeships, and instead of passing any of these Bills creating new Judgeships, they referred the entire matter to a Legislative Advisory Committee for study and approval. The Advisory Committee has con- sidered the matter very carefully, and in recent report recommended the creation of several new Judgeships at various point throughout the State, but did not recommend the creation of a new Judgeship for Chesterfield County. It did recommend the elimination of Powhatan County from this Circuit, which the Committee reported would lighten the load somewhat. While it is my in- tention to introduce a Bill to create a new circuit for Chesterfield County, in view of the report of the Advisory Committee I do not believe that such a Bill would pass either the House or the Senate. My present inclination is not to request that Powhatan be detached from our present circuit, as to do so would detract from our chances of obtaining a separate circuit for Chester- field later on. I think it is just a question of time before we will be able to obtain a separate circuit for Chesterfield, but I am very doubtful that it can be done at this session of the Legislature. With reference to the request that the section on "Hospitalization and Treatment of ImUg" Persons" be amended, I beg to advise that this mat- ter was taken up with me by the Welfare Board in a recent meeting which I attended at their request. I told the Board at that time that I did not know exactly what connection Senator Bird had had with this particular leg- islation, but that he was much more conversant and famiba.r with laws relating to our State hospitals than I was, especially in view of the fact that he has been and possibly still is on the Board of Visitors of the Medical College of Virginia. I further advised the Welfare Board that I felt that h h 1` suc and "Jg CM `4"O° — 2 — as might be indicate in connection with this Section should be with Senator Bird, and that, of course, I would be glad to assist in any way that I could. I believe Mrs. Lucy Corr has taken the matter up with Senator Bird already. The Boardts approval of the Welfare Department's request to eliminate the "Submission of Biannual Welfare Budget" has been and is being handled by me. Any time one proposes to change an accounting practice a great many clearances are necessary. I have already taken the matter up with the Budgeting Bureau, Mr. J. Gordon Bennett, State Auditor, and I will this week handle the matter with Colonel Copeland, Superintendent of Welfare and Institutions. If all necessary clearances can be obtained, I will have the proper Bill prepared and introduced. I believe that this covers all of the matters concerning which you have written me.
