Director of Utilities Mr. W. Lynn Wingfield, Admin. Asst. to Co. Admin. The Chairmm~ called the meeting to order at the Courthouse at 9:05 a.m. (DST). Mr. Dodd gav~ the invocation. On motion of Mrs. Girone, seconded by Mr. Dodd, the minutes of September 14th and 19th were approved as amended. Ayes: Mr. O'Neill, Mrs. Girone, Mr. Bookman and Mr. Dodd. Mr. Painter introduced Mr. Robert Augustine 6f Augustine Insurance Agency, who explained the need for insurance fof the County's sewer and water systems. He presented various alternatives, their costs and the benefits the County would receive from each proposal. Mr. Meiszer stated the question before the Board was whether or not the County wants to remain self-insured as it cur- rently' does. He added the County does have a very good past record and this type of insurance would be basically for catastrophies such as earthquakes, explosions, etc. and reconmended the Board consider a very high deductible if the Board felt insurance was needed. Mr. Dodd and l~rs. Girone indicated they were not prepared at this time to make a decision. It was generally agreed, that Mr. Meiszer and the staff investigate this rotter f~rther and present a reco~umndation to the Board at the meeting on October 12th. On motion of Mr. Bookman, seconded by Mrs. Girone, the foliowing Water Contract was approved: W77-82CD Cabin Creek, Section "A" $33,069.65 Developer: Newby' s Bridge LTD. Partnership Contractor: Alpine Construction Corporation County Cost: $11,238.40 (refund through connections) Code: 366-111684-8071 Ayes: Mr. O'Neill, Mrs. Girone, ~r. Bookman and Mr. Dodd. On motion of Mr. Dodd, seconded by ~r. Bookman, the contract for the installation of three fire hydrants on Chester Road was awarded to William M. t~qrmon who submitted the low bid in the amount of $5,025 and it was further resolved that an additional $1,275 be appropriated from the Unap- propriated Surplus of the General Fund for the installation of the hydrants which bid was higher than anticipated. Ayes: ~.k. O'Neill, Mrs. Girone, Mr. Bookman and ~r. Dodd. On motion of Mr. Bookman, seconded by Mr. Dodd, Water Contract W76-36C, Replacement of Water Lines in Matoaca, was awarded to T & E Construction Company in the amount of $68,907.50 plus an encumbrance of 1~,( contingencies in the amount of $6,890.75, making a total of $75,798.25. (code: 380-61000-2340 - $65,898.25 and Code: 111-07150-2920 - $9,900.00). Ayes: Mr. O'Neill, Mrs. Girone, Mr. Bookman and ~-. Dodd. Mr. Bookman stated he was advised of a bad water problem at the Grange Hall School of which he informed the sc~hool system and added that to his knowledge the problem still exists. He asked that the Utility Department work through the Health Department to investigate and improve this sitnaation if something has not already been done. On motion of Mr. Dodd, seconded by Ik. Bookman, it was resolved that T & E Constructio~ be awarded Water Contract W77-$7C in the amount of $7,670.00 plus an encumbr&nce of 1'.%1 contingencies in the amount of $767.00, making a total of $8,437.00 for the replacement,and improvement of water lines in Percival Street between Dodomeade and Gill Street with a water line. Ayes: Mr. O'Neill, Mrs. Girone, i~r. Bookman and bk. Dodd. Mr. Painter stated he has received a request from the Meadowbrook West Civic Association for a reduced water connection fee which meter would be installed at the entrance to t~he subdivision so that they could water the shrubbery in the median n~ach easier. ~. Micas advised the Board that it could not pick and choose who pays what amount for a connection fee, that all applicants should be charged the same amount under the ordinance and recommended denial. Mr. Dodd inquired if an exception could be made for something like this which would beautify the area. Based on the County Attorney's re¢omm~dk~i~.n,~s. Girone moved that this request be denied. Mr. Bookman suggested the matter be deferred since Mr. Apperson was not present. ~rs. Girone withdrew her motion and Mr. Bookman moved that action on this request be deferred until October 26th. On motion of Mr. Dodd, seconded by Mr. Bookman, the following Sewer Contract was approved: S77-26CD Trueheart Heights, Section $36,907.35 and Off-Site Developer: J. L. Longest Contractor: Piedmont.'C~nstruction, Inc. County Cost: $13,659.25 (refund through connections) Code: 380-77000-8071 Ayes: Mr. O'Neill, Mrs. Girone, Mr. BOOkman and Mr. Dodd. · Mr. PaInter explained that the paint specified in the bid for the painting of the Chester Water Tank was not acceptable to E.P.A. and paint which is acceptable to E.PiA. is approximately $4.00 more per gallon. After consideration of this matter, it was on motion of Mr. Dodd, seconded by bR. Bookman, resolved that the Old Dominion Tank. and Iron Company's request for an additional $1,40Q be approved with funds being expended from 561-11640-2151. Ayes: MrS. Girone, Mr. Bookman and Mr. Dodd. After some discussion,of the rotter, it was on motion of Mrs. Girone, seconded by Mr. Bookman, resolved that the Comty assist the Brookwood Corporation in acquiring off-site easements to serve a proposed subdivision just north of Route 147 subject to the Board of Supervisors entering into a contract with the developer whereby the developer agrees to pay all costs in obtaining the sewer easement. It was noted that the developer had made reasonable attempts to obtain this easement. Ayes: Mrs. Girone, Mr. Bookman and Mr. Dodd. ~. Pope explained that the }Iighway Department orig%r~i!y offered $103,121 for the purchase of Rt. 288 right-of-way and now have made a counteroffer in the amount of $116,346. He stated he had met with the County Assessor and others and after careful consideration, it was felt that for the 11.72 acres, easements involved, etc. $237,920 was a more reasonable figure. After some discussion of the matter, it was· on motion of Mr. Dodd, seconded by Mr. Bookman, resolved ~t~.~Po~p~e_, _o_n_behalf. of the County, make a counteroffer to the ~Lighway Department in the n oz ~z~/,~20 for the purchase of Rt. 288 right-of-way. Ayes: ~r. O'Neill, Mrs. Girone, Mr. Bookmmn and Mrl Dodd. Mr. Painter stated he had enclosed a copy of the list of developer water and sewer contracts which were executed by ~r. Meiszer in the Board packet. l~r. Welchons stated he had been asked to report on the sewer situation on Oakland and Dupey in Matoaca District. Mr. O'Neill stated he had received a letter stating it would cost approximately $23,400 to accommodate the 11 houses in the area some of which have failing septic systems. After further consideration of the matter, Mr. O'Neill requested the Utility Departmmnt to send out questionnaires to determine the nunber of homes which would connect to the County sewer system if it were made available and he further requested that a letter be written by the Utility Department for his signature to the City Manager of Colonial Heights inquiring if they would consider accepting the sewage from these homes. Mrs. Girone stated she felt the Board was a little late discussing the possibility of sewer and water bond issues and added further that the Falling Creek Treatment Plant should have been on the ballot for November. Mr. Dodd stated he was in favor of expanding the sewer system without raising the tax rate for at least 3-5 years. Mr. Bookman stated he did not agree with the project~ as listed. ~k. Painter stated there would be different priorities from those suggested by R. W. Beck. Mr. Painter stated there was a need to proceed with the Fallirk% Creek Plant which would oOStapproximately $4,000,000 He added further that the County has received Step II funding r the design of the plant ~ich should be completed in early spring and as soon as matching f~nds are available the CountY could apply for Step III funds. The County Attorney stated he felt if the bond referendum was approved by the citizens, tlnis would be legally sufficient to apply for federal funds even if the bonds were not sold. Mr. Craig Bryant of the Utility Depaz~nent explains where the Cotmty is in terms of capacity allowed and stated that if the County should exceed its allowed flow, the State Water Control Board stop additional connections being made to the system. Mr. Painter stated E.P.A. did not grant the requested amount of capa- city bu~ they had used projected and not actual flow figures as their basis. Mr. Meiszer stated E.P.A. was not questioning the flow but were actually saying the County could not discharge anymore into the river. Mrs. Girone inquired about what effect 208 would have on the County. - ~r. Painter stated ~the Cotmty could possibly get more allocation in the river and might cut down on the degree of trea~n~nt that is currently required which would in turn reduce the' cost of treatment. Mr. Dodd stated he would like the Utility Depar~n~t to contact E.P.A. with the actual flow figures to see if they would allow additional capacity. Mrs Girone stated she felt the citizens of the County, once they understood the bad situation that exists regarding the sewer system, they would vote in favor of expanding the Falling Creek Plant and it was on her motion, seconded by }k. Dodd, resolved that the Board hold a special election for a $5,000,000 General Obligation Bond for sewers to expand the Falling Creek ~eatment Plant in early spring. .Ayes: Mr. O'Neill, Mrs. Girone, Mr. Bookman and }~r. Dodd. Mr. Dodd and Mr. Bookman emphasized their feelings that they did not want to increase the rates for water as well as sewer. Mr. Meiszer stated the present rate structure would limit the water bonds to $9,000,000. Mrs. Girone stated the need is here but she would like to have $3-4,000,000 held hack. Mr. Meiszer stated that was the plan. After further consideration of the matter, it was on motion of 'Mrs. Girone, seconded by Mr. Dodd, resolved that the staff be authorized to proceed with the necessary legal requirements for the issuance of $9,000,000 Water Revenu~ Bonds. ~r. Micas Stated he would have the necessary resolutions as soon as possible. Mr. Dodd and Mr. O'Neill asked that Mr. Painter contact Congressman David E. Satterfield and E.P.A. to see if the capacity could possibly be increased. Mr~ Balderson introduced Mr. David Cloer, the Chief Building Inspector, to the Board. The Board welcomed Mr. Cloer to Chesterfield County. Mr. Maiszer stated the public hearing relating to the requirement for a second public road access had been deferred to this time and date. ~-~r. Bookman stated he felt the requirement for the firs~ of course, and second public road access was good but questioned the reasoning for requiring the third by wmyof ordinance. He added he would like the third public road access to remain a policy as'it has for the past few years. Mrs. ~irone stated she felt the ordinance as presented vms good because when there are a limited, number of accesses from a subdivision, etc. it puts a burden on the e~isting roads and causes traffic problems. She added f~rther this is currently the problem with Bon Air filling in as it is. Mr. O'Neill stated that the network of roads in the less developed areas of the County will not provide for this third road access until other parcels of land have been developed. He added that as a policy it would be better for the County as a whole and being applied where practical. 1~. Balderson stated that if the proposed ordinance were adopted, the Subdivision Regulations would allow for the Plaming Conmission to grant a variance to this and that by doing it in ordinance form, the ordinance would be laid out for all to see. Mrs. Girone stated that she felt this was desirable and good planning which the people want. Mr. Balderson stated the hcme builders associations are aware of this proposed ordinance and made no conment. Mr. Bookman stated he felt this could contineu as a policy as it has for the past two years, in its present form. Mr. Dodd stated he felt the need for the cou=mn sence approach to this matter was needed rather than an ordinance requiring a third public road access. There being no one present in the audience to discuss the rotter, it was on motion of Mr. Bookman, seconded by Mr.. Dodd, resolved that the following ordinance be adopted: ' "~m Ordinance to anmmd and reenact §9.2-2 of the Chesterfield County Subdivision Ordinance of the Code of the County of Chesterfield, 1975, as anmnded, relating to the requirement for a second public road access." Be it ordained by the Board of Supervisors of Chesterfield County: (1) That §9.2-2 of the Subdivision Ordinance of ~the Code of the County of Chesterfield,· 1975, as amended, is amended and reenacted as follows: §9.2-2. Arrangement Ayes: Ail streets shall be properly integrated and coordinated with existing streets, and the proPosed system of streets within and contiguous to the subdivision, and dedicated rights-of-way as established on the General Plan of the County of Chester- field, as anmnded. Ail thoroughfares shall be properly related to special traffic generators such as industries, business districts, schools, churches, and shopping centers; to popula- tiondensities; and to the pattern of existingand proposed land-uses. Local streets shall be laid out to conform as mch as possible to the topography, to discourage use by through traffic, to permit efficient drainage and utility systems and to require the mininmmnumber of streets necessary to provide convenient and safe access to property. d. The.rigid rectangular gridiron street pattern need not necessarily be adhered to and the use of cirvilinear streets, cul-de-sacs, or U-shamed streets shall be encouraged where such use will result in a more desirable layout] e. Proposed streets shall be extended to the boundary lines of the tract to be sub- divided, unless prevented by topography or other physical conditions, or unless in the opinion~of the Planning Coa,~,ission suc~h ~xtension is not necessary or desirable for the coordination of the layout of the subdivision with the existing layout or the most advantageous future developn~nt of adjacent tracts. f. In business and industrial developmants the streets and other accessways shall be planned in connection with the grouping of buildings, locations of rail facilities, and the provision of alleys, tr~ck loading and maneuvering areas, and walks and parking areas so as to minimize 'conflict of movenmnt between the various types of traffic, including pedestrian. g. Ail subdivisions shall provide for a second public road access prior to the recordatio of any subdivision plat if the cumulative total of the lots in that subdivision is in excess of 59 lots. In addition, the County shall not issue more th~n 5!3 building permits in any subdivision until the subdivider or developer completes construntion of an approved second public road access. Mr. O'I~eill, Mrs. Girone, Mr. Bookman and I~. Dodd. It was generally agreed by the Board that the third public road access would remain as a policy as it currently exists. Onmotion of Mr. Bookman, seconded by Mr. Dodd, the Chairman was authorized to sign a contract modification for the Henrico-Chesterfield-Hanover CETA Consortium which will increase Chester- filed County's reimbursement by $29,755 a copy of said modification is filed with the papers of this Board. On m0tion of Mr. Dodd, seconded by Mrs. Girone, it was resolved that the Board of Supervisors of CheSterfield County stronglyopposed the passage of Senate Bill 35 and House of Representatives Bill 4514, which would needlessly expand the exposure of local government officials, as well as local goverrm~ental units, to frivilous lawsuits arising out of Title 42 §1983 and f~rther directed the Co~mtyAdministrator to commmicate the Board's position to our Virginia Senators and Ropresentatives. Upon the recomnendation of the County Administrator, Mr. O'Neill disbanded the Financial Task Force since themajor tasks and dutieswhichwere assigned to it have been co~letedand he formally thanked the Coranittee for its tinm and effort. On motion of Mrs. Girone, seconded byMr. Dodd, a proposed ordinance to amend and reenact Sections 4-3, 4-4, 16-4, 18-3, 18-4, 19-3, 19-4,22-3 and 22-4 of the Zoning Ordinance of the Code of the County of Chesterfield, 1975, as amended, relating to uses allowed by special exceptions and conditional uses be referred to the Planning Con~ission for their review and reconnmndation.
