Upon consideration whereof and on motion of Mr. Gunter, seconded by Mr. Britton, it is resolved that said request to construct a house 12 a 24' be and the same is hereby denied. This day the M(ecutive Secretary presented a letter to the Board of Supervisors from 1&-, J.Spencer Gilmore concerning certain easements for the installation of water lines in Cherokee Hills Subdivision and it was g ener ally agreed that the Executive Secretary write to Xr•Gilmore advising him to appear before the Board of Supervisors to discuss this matter. On motion of Mr. Rague, seconded by Mr-Ounter, it is resolved that the Executive Secretary be and he hereby is authorized to sell the existing watef tank at the Courthouse, the same being is bad state of repair. This day the matter of furnishing a tank for the Forest View Fire Department to replace the present work out tank on the fire truck was discussed, and on motion of Mr.Britton, seconded by Mr.Goyne, it is resolved that the Executive Secretary be and he hereby is authorized to have the worn out tank replaced by a used tank if possibleo This d,iy again the matter of removing the Chester tank, which tank is in a bad state of repair, was brought to the Board's attention by Mr. ODyne. On motion of Mr.Goyne, seconded by Mr. Gunter, it is resolved that the matter of removing the Chester water tank be referred to the Commonwealth's Attorney to study the legality of such action and report back to this Board. This day the County Engineer read before the Board a proposed contract with 111r9v7,P.Leonard for the ins tal]a tion of a water line 6n Pocoshock Heights. On motion of Mr. Gunter, seconded by Mr. Goyne, it is resolved that this contract be and the same is hereby approved. SPENCER GILMORE ATTORNEY AT LAW 224 EAST BROAD STREET RECHMOND 19,VIRGINIA August 29, 1955 Chesterfield County Board of Supervisors Chesterfield, Virginia Attention: Mr. Irvin R. Horner Dear Sir: My client, Mr. Robert J. Dailey, has purchased and, with a few minor ex- ceptions, has completed construction on property located on the northern line of Cherokee Road, designated as Lots 6 thru 10, Block G, Cherokee Hills. Mr. Dailey was aware that the County of Chesterfield had an easement for water lines crossing the front of his property, but it was not until he started to grade the lots that he found the pipes were laid within the easement but approximately 9 feet above the grade line of Cherokee Road. Due to this lo- cation, it is impossible for him to construct driveways into his residences and the sale of the houses is therefore being held up. I have talked to Mr. Ernest Gates, Commonwealth Attorney, concerning this matter but we have reached no definite conclusion as to the county's responsibility. It is our feeling that the use of the easement by the county should be limited through the necessary ground which the pipes shall occupy and should not be used in such a way as to prevent owners from the adjoining land from being able to occupy the property or any part of it. It is, therefore, our request, with the hope you will give it every consideration, that the water line be lowered to the point equal to or below the grade line of Cherokee Road and that this be done at the expense of the county. Mr. Dailey has talked to Mr. George Shropshire concerning the cost of lower- ing the pipe line and it is presently estimated to be in the neighborhood of $400.00. Inasmuch as the Board of Supervisors does not meet for approxi- mately three weeks and time is of the essence, I have suggested to Mr. Dailey that he negotiate with Mr. Shropshire to change the pipes immediately and Mr. Dailey will pay the present cost. In the near future, Mr. Dailey expects to have additional pipe lines laid on property which he owns on Old Westham Road, at a cost of around $2, 000.00. This amount will, of course, be paid to the county upon completion of the service. on M Page 2 Chesterfield County Board of Supervisors August 29, 1955 I am hoping that the Board of Supervisors will allow Mr. Dailey to present his request at its next meeting, at which time it may decide that Mr. Dailey should be reimbursed for the expenditure he is now making and that this re- imbursement may be made by a reduction or credit in the amount of money Mr. Dailey will owe the county upon completion of the pipe line on Old Westham Road.
