The water to be furnished by the City under this contract shall be used oa#y in the area served by the system shows on the sketch hereto at- tached and marked "A", which sketeh shows the present lines of the water system serving that lttrick Sanitary District contiguous torritory, together with the lines proposed to be installed imadiately by the County in the It - trick Sanitary District and in the territory adjacent and contiguous to the The City of Petersburg shall not be bald to guarantee either the quantity or quality of water to be supplied, but the City shall be obligated to furnish only such quantity or quantty of water as may be available in its water supply system for use in such territory at any given ties* and this agreement is not to be construed as as agreement on the part of the City that it will furnish any particular quantity ,or quality of water for any purpose or purposes of the said Sanitary district or of the territory referred to above outside of said district, or to the users of water within such district or territory, and the City is not to be held liable for its failure so to do. And if at any time the requirements of the City of Petersburg or of the resi- dents or other users of water within the.said City shad be such that, in the judgsent of the City, the City can no longer supply water to the said district or to the users of water therein, then the City of Petersburg may terminate this agreement with respect to the sale or use of water to be supplied by the City upon six months notice of its intention so to do. It is understooe am agreed that this contract for the supply of water shall be in effect for tan (10) years from the date of the execution of this contract, The City further agrees: (1) That upon: the execution of this contract by the City and the Co ty, the County shall have the right to dispose of sewage originating within the area of the attrick Sanitary District as now defined shown on the plat here attached and marked "'", which area may be expanded or contracted at say ti and from time to tine by mutual agreement of the City and the County, throupb the City$$ sewerage system when the present Sewage Treatment Plant now under construction is completed and the Cou n,t'y has constructed connecting lines and equipment hereinafter mentioned to the sewerage system of the City. The County agrees that it will pay the City for such service at the rats of Sixty-five Dollars ($63.00) per million gallons, which anount shall be paid by the County to the City in monthly payments as billed by the City. In the.event the City, during the term hereof, for any reason, treats its sewage in ,any Sreoterdegree, new rates will be negotiated based epos a determination by the City of the increased cost resulting for said increased treatment. Likewise, if the Cost of such treatment shall decrease,then _to that event, new rates will be nege- tiated based upon the actual cost of such service. The County agrees that it will same all connections to the sewerage lines of the City and provide a metering station, at its expense, at the aoa- neating point, the metering station to be constructed in accordance with'the` requirements of Wiley 6 Wilson, Consulting Insincere for the said City of Petersburg. The County will owes in fee simple free of all liens the sewerage lines and metering station constructed by the County. it is understood and agreed that the portion of this contract provid- ing for the treatment of sewage shall continue is dfiii::foree and offset for a period of twenty years and that, at the end of such twenty-year period, this contract shall be automatically Continued for a five-year period unless sith party has given to the other,at least two years prior to such expiration dot written notice that it does not desire to renew �he said contract. Upon considers tion whereof and on motion of Mr.Gunter, seconded by DreGill, it is reaDlved that the bid be awarded to the Humphries Electric Company, of Ettrick, * ich Company submitted the low bid of 0439e40• This day the Executive Secretary r5ported he had sent out bids as per instructions of the Board for the purchase of eight (8) new oar se six for the Police Department and one for the Executive Secretary, one for the Water Super inte ndent * and Me real, many of the companies advised the Board to send new bids in approximately thirty days so that the 1956 models may be obtained. Upon consideration whereof and on motion of Mr.Gunter, seconded by Mr. Hague, it is resolved that all bids be requested as soon as new prices are available to various car dealers. On motion of Mr.Goyne, seconded by Dr.Gill, it is resolved that the Bellwood Drive -In -Theater be permitted to have an aerial pyrotechnic dispely on Moniay, September 5, 1955, with the understanding that adequate care be taken in all phases of this operation. On motion of Mr.Gunter, seconded by Mr.Aague, it is resolved that'the Chairman be authorized to sign a contract with the Department U.S.Inter ior, Geological Survey, which contract calls for the instal]a tL on of a gauging station on Falling Creek west of Rt. 10, to be paid for one-half by the Federal Government and one-half by the County of Chesterfield , fit an expense not to exceed $900v00• This day Mr. Darouse came before the Board seeking a variapae con Lot 13, —2� in Ampthill Heights, on which he proposed to construct a used gov ernmenj prefabricated building& Whereupon Mr. Gunter made the following motion: That this Board grant the requested variance for constructing a used pre -fabricated house on a lot having approximately 8935 square feet, provided the ownsss of the adjoining land will give their consent in writing. I am glad to learn that the Board of Supervisors approved the proposal for a gaging station on the Falling Creek. We will be very pleased to work with you in obtain- ing data which I think will be of real value to the County. The second paragraph of your letter requests that construction be held in abeyance for a few weeks. This will be entirely satisfactory with me because we have been so busy with hurricanes and other matters that I do not think we could proceed with the construction of a gaging station until sometime in September. I am enclosing with this letter a cooperative agreement,in triplicate, which is the standard agreement for work of this kind between a county or municipality and the Survey. This agreement has been made out in the amount of $900 contribution by each party, this sum being available for the fiscal year ending June 30, 1956, and this sum will cover the proposed construction of the gage and operation for this fiscal year. It would be appreciated if you could obtain signature to this agreement under the line showing "County of Chesterfield" by you, as Executive Secretary, unless the signature is to be made by the chairman of the board of supervisors. CHESTERFIELD COUNTY. It appearing to the Court, that due to the continuing illness of Marcus A. Cogbill, the Commonwealth Attorney for Chesterfield County, it would be desirable to continue to have an Acting Commonwealth Attorney available at all times to advise the Trial Justice Court, the Board of Supervisors, the School Board, and other officers of the County, the Court did on July 1511 1954, appoint Ernest P. Gates as Acting Commonwealth Attorney for Chesterfield County to be effective as of August 1, 1954, and did by said order fix the compensation of said Acting Commonwealth Attorney at $300.00 per month, one-half to be paid by the County and one-half to be paid by the State of Virginia. It now appearing to the Court in consideration of a resolution passed by the Chesterfield County Board of Supervisors that the time required of the said Acting Commonwealth Attorney in performing his official duties justifies an increase in his compensation, in accordance with Section 19-5 of the Code of Virginia of 1950, the Court doth order that the pay of Ernest P. Gates, acting Commonwealth Attorney be $500.00 per month, effective as of July 1, 1955, one-half to be paid by the County of Chester- field and one-half by the State of Virginia.
