Conditions of zoning approval permit one (1) drive-in restaurant within Village Marketplace Shopping Center. This request is to permit an additional drive-in restaurant at Village Marketplace. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE SCHEMATIC PLAN BEING REDESIGNED TO LOCATE THE PARKING TO THE SIDES AND REAR OF THE STRUCTURE AND THE STRUCTURE HAVING AN ARCHITECTURAL STYLE COMPATIBLE WITH THE SHOPPING CENTER AND SIMILAR TO THE BURGER KING AT COURTHOUSE COMMONS. STAFF RECOMMENDATION Recommend approval for the following reasons: A. While the proposed use does not conform to the Northern Area Land Use and Transportation Plan, which designates the property for light commercial land uses, some limited B-3 uses have previously been permitted within the shopping center along the Midlothian Turnpike frontage. Specifically, a tine store and drive-in restaurant are permitted to the west of the subject property. The proposed use is, therefore, compatible with approved land uses in the shopping center. B. The applicants have agreed that schematic plans will show parking to the rear and side of the structure consistent with that required for other sites in the shopping center and conditions of the original zoning. Further, the applicants have agreed that the architectural style of the structure will be compatible with that of the shopping center and similar to the architectural style of the Burger King located in Courthouse Commons. GENERAL INFORMATION Location: North line of Midlothian Turnpike, approxi- mately 50 feet west of Old Buckingham Road. Tax Map 16-9 (1) Parcel 53 (Sheet 7). Existing Zoning: B-2 with Conditional Use Planned Development (Village Marketplace) Size: 1 acre Existing Land Use: Vacant Adiacent Zoning & Land Use: North - B-2 with Conditional Use Planned Development; Commercial (Village Marketplace Shopping Center) South - B-2; Commercial or vacant East - B-2 with Conditional Use Planned Development; Vacant (Village Marketplace Shopping Center) West - B-2 with Conditional Use Planned Development; Vacant (Village Marketplace Shopping Center) Utilities: 6 inch water line located on-site; 12 inch water line located along Route 60. Use of public water intended and required by Ordinance. Lies in the Falling Creek sewage drainage area. 8 inch sewer line located on-site. Use of public sewer intended and required by Ordinance. Environmental Engineering: No on- or off-site drainage and/or erosion control problems anticipated. Approved conditions of zoning for Case 87S142 remain applicable for drainage and erosion control facilities. Fire Service: Midlothian Fire Station, Company ~~5. At present, fire service capability adequate. Dependent upon present locations, a fire hydrant may be required. General Plan (Northern Area Land Use and Transporta- tion Plan): Light Commercial Transportation: This proposed development could generate approximately 2,451 average daily trips. These vehicles will be initially distribut- ed along Midlothian Turnpike which had a 1987 traffic count of 32,635 vehicles per day. Conditions previously imposed (Case 835142) should mitigate concerns relative to traffic generated by this development. ,~ 2 'X~ 88SN0075/BSJUL8/JULY27X nT~~11~sTnN On April 24, 1985, the Board of Supervisors, upon a favorable recommenda- tion by the Planning Commission, approved rezoning with Conditional Use Planned Development to permit a shopping center on the request site and adjacent property to the east, west, and north (Case 83S142 Amended). This request is to amend Condition 5 (b) of Case 83S142 to permit an additional drive-in restaurant on a portion of the request site. Condi- tion 5 (b) permits only one (1) drive-in restaurant, to be located be- tween Mount Pisgah Drive and the private access into the shopping center. While the proposed use does not conform to the Northern Area Land Use and Transportation Plan which designates the request property for light commercial uses, the land use is consistent with other B-3 uses previous- ly permitted along the Midlothian Turnpike frontage. Specifically, another drive-in restaurant and a tire store are permitted by previous zoning actions. Further, the applicants have agreed that schematic plans will reflect parking to the rear and sides of the building consistent with that required on other out-parcels in the shopping center and conditions of zoning. Also, the applicants have agreed that the structure will be compatible with the architectural style of the shopping center and simi- lar to the Burger King at Courthouse Commons. Given these circumstances, approval of the request is recommended. CASE HISTORY Applicants and Staff (7/15/88): Staff met with the applicants' representative to discuss the recommendation. Originally, staff had recommended denial of the- use because the schematic plan and architectural style of the building failed to conform to conditions of zoning and to be compatible with existing and approved development in the shopping center. Staff, however, indicated that if the site were redesigned and the architectural style modified, approval of the use would be appropriate. Planning Commission Meeting (7/19/88): The schematic site design and building elevations submitted with the application failed to comply with conditions of zoning for Village Marketplace. Specifically, Condition 5 of Case 83S142 requires buildings to have a colonial architectural style and quality. In addition, parking areas are required to be located on the interior of site with buildings fronting public roads. This condition is designed to insure preservation of the village character and integrity of older Midlothian Village, discourage typical strip-type development, and is similar to conditions imposed on other commercial development within the Village. To date, all 3 88SN0075/BSJUL8/JULY27X Based on concerns expressed relative to the site design and architectural style, the Commission deferred schematic plan consideration for sixty (60) days to September 20, 1988. The applicants' representative agreed to address the Commission's con- cerns through the schematic plan review process. On motion of Mr. Kelly, seconded by Mr. Warren, the Commission resolved to recommend approval of a drive-in restaurant with the understanding that the schematic plan would be redesigned to locate parking to the sides and rear of the building; redesign the structure such that the architectural style is compatible with that of the shopping center and similar to that of the Burger King at Courthouse Commons; and other design features to insure quality development. AYES: Unanimous.
