PLANNING COMMISSION RECOMMENDATION RECOMMEND DENIAL. STAFF RECOMMENDATION Recommend denial for the following reasons: A. All structures to be used as dwelling units must meet the require- ments of the Virginia Uniform Statewide Building Code, Volume I, "New Construction" and/or the Virginia Uniform Statewide Building Code - "Industrial Building and Manufactured Home Safety Regu- lation." The subject recreational vehicles do not meet either of the two codes. B. The recreational vehicles are intended to house security guards for the Shoosmith Brothers Office. Appropriate structures for such should be located across Lewis Road adjacent to the Shoosmith Broth- ers Office, rather than at this distance. GENERAL INFORMATION Location: Lying approximately 500 feet off the south line of Iron Bridge Road and approximately 60 feet off the east line of Lewis Road. Tax Map 114-9 (1) Part of Parcel 4 (Sheet 31). Existing Zoning: A Size: 0.5 acres Existing Land Use: Vacant Adjacent Zoning ~ Land Use: North, South, East, and West - A; Vacant Utilities: Environmental Engineering; Fire Service; and Transportation: General Plan (Central Area Land Use and Transporta- tion Plan): DISCUSSION A 30 inch water line runs along Lewis Road, west of the site. Public water is avail- able and should be used. The site lies in the Proctors Creek sewer drainage basin. A 12 inch sewer line lies in the Ironbridge Subdivision approximately 1,000 feet northeast of the site. Public sewer should be used. This request will have minimal effect on roads, drainage, fire service, or traffic. Office The applicant is requesting Conditional Use Planned Development to allow two (2) recreational vehicles to be used as living quarters in an Ag- ricultural (A) District. The vehicles are intended to house security guards for the Shoosmith Office across Lewis Road. Staff recommends denial because the vehicles meet neither the "New Con- struction" nor the "Industrialized Buildings and Manufactured Homea" sections of the Virginia Uniform Statewide Building Code. Mr. Shoosmith and his attorney are presently in the process of working with the Depart- ment of Building Inspections to address the non-conforming code compli- ance issues. Further, living quarters for security guards should be located on the same parcel occupied by the primary land use, in this case, the Shoosmith Brothers Office, rather than at the distant location proposed. CASE HISTORY Planning Commission Meeting (1/19/88): On motion of Mr. Belcher, seconded by Mr. Warren, the Commission deferred this case for sixty (60) days to permit the applicant to research and possibly to amend the request. Planning Commission Meeting (3/15/88): At the request of the applicant, and on motion of Mr. Belcher, seconded by Mr. Kelly, the Commission deferred this case for sixty (60) days. AYES: Unanimous. Staff (4/22/88): To date, staff has received no further information from the applicant. Planning Commission Meeting (5/17/88): Mr. Thomas Cobbs, the applicant's representative, came forward and re- quested a ninety (90} day deferral. Mr. Larry Robinson, area resident, came forward in opposition to the recreational vehicles located on the subject site. He suggested the security guards which use the recreational vehicles be relocated to a more compatible area. Mr. Robinson requested the Commission recommend denial of this request. Mr. Belcher stated that he spoke with the applicant's attorney and sug- gested a deferral to allow the applicant time to move the two (2) recre- ational vehicles and amend the request for a new site. He noted that he was not in support of the request as presented. He stated that he would meet with the applicant and attempt to resolve the issues. On motion of Mr. Belcher, seconded by Mr. Perkins, the Commission re- solved to defer Case 885002 to the August 16, 1988, Planning Commission meeting. AYES: Messrs. Miller, Belcher, Kelly, Warren, and Perkins. Staff (7/29/88); To date, staff has received no further information from the applicant. Planning Commission Meeting (8/16/88): Mr. Oliver Rudy, the applicant's representative, came forward. He stated that the recreational vehicles were occupied by employees of the appli- cant and were used for security purposes. With respect to the "Request Analysis and Recommendation," he stated that one of the reasons outlined 3. 88S002/BSSEP8/SEPT28K for denial of the request was that the proposal did not conform to the BOCA Code. He stated that the issue before the Commission was a zoning, not building code, matter. He further stated that the applicant should be the one to determine the location of the vehicles necessary to provide adequate security. Mr. Rudy stated that the trailers should be allowed to remain; required to meet the BOCA Code; limit their use to employees of the applicant; and place a time limit on the approval. Further, he agreed that at such time that County water is available the vehicles would be connected to the public system. Larry Robinson came forward in opposition. He maintained that the vehi- cles were not being used for security purposes, rather are occupied by employees who are working day fobs. Mr. Belcher stated that while he was concerned that the applicant be able to provide adequate security, the two (2) vehicles were improperly locat- ed to provide security. He stated that a proper building should be constructed to use for security purposes. On motion of Mr. Belcher, seconded by Mr. Warren, the Commission resolved to recommend denial of Case 885002. AYES: Messrs. Miller, Belcher, Kelly, Warren, and Perkins.
