RE UEST: Amendment to Conditional Use Planned Development (Case 845060)
relative to buffers. Specifically, Condition 11 of Case 845060
required a twenty (20) foot buffer along the western boundary of a
proposed north/south road adjacent to the site on Midlothian Middle
School property. This request would substitute a ten (10) foot high
chain-link fence in place of this required buffer.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL SUBJECT TO THE CONDITIONS ON PAGES 1 AND 2.
STAFF RECOMMENDATION
Recommend approval for the following reason:
The proposed fence would serve as an effective barrier between the
proposed north/south road and an existing athletic field on the school
property. The fence would minimize the possibility of balls being hit
into the road and players entering the road.
(NOTE: THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF
AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY
STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY
THE PLANNING COMMISSION.)
CONDITIONS
(STAFF/CPC) 1. A ten (10) foot high chain link fence shall be installed
and maintained between the eastern boundary of the
Midlothian Middle School athletic field and the right of
way for the proposed north/south public road. A plan
depicting this requirement shall be submitted to the
Planning Department for approval in conjunction with the
first site plan review for any development with access to
this right of way, and the fence shall be installed prior
to any traffic utilizing this right of way. (P&CPC)
(STAFF/CPC) 2. Public water shall be used. In conjunction with the first
schematic plan review for any use, a conceptual plan of

e water distribution system for the entire property
shall b
e submitted to the Utilities Department for review
and approval. Required water demands, to include antic-
ipated flow and pressures for domestic and fire flow
needs, shall be provided for all uses. Additional con-
ditions, relative to line sizes and system connection
points, may be imposed in conjunction with schematic plan

GENERAL INFORMATION
Location: Approximately 488 feet off the south line
of Midlothian Turnpike, measured from a
point approximately 500 feet west of Mt.
Pisgah Drive. Tax Map 15-16 (1) Parcel 16
and Tax Map 16-13 (1) Parcels 2 and 5
(Sheet 7).
Existing Zoning: A, R-7, R-9, and M-1 with Conditional Use
Planned Development
Size: 33.0 acres
Existing Land Use: Vacant

Walton Park Road and within Midlothian
Office Park, approximately 250 feet north

necessary to extend public water. In
conjunction with first schematic plan
review, a conceptual layout of the water
distribution system for the entire property

proval. In addition, the required water

Additional requirements, relative to line
sizes and system connection points, may be

Lies in Falling Creek sewage drainage area.
Twelve (12) inch trunk sewer line located
along a tributary of Falling Creek, approx-
imately 1,400 feet south of site. Use of
public sewer intended (Condition 3).
Off-site easements may be necessary to
extend public sewer. In conjunction with
first schematic plan review, the anticipat-
ed sewage flows for all uses should be
provided. (Condition 3)
It should be noted that the design of the
existing twelve (12) inch trunk sewer
included the subject property at a capacity
of 1,000 gallons per day per acre. The
uses proposed for the property may require
a greater capacity, which may limit the
capacity available for future development
on adjacent properties.
Proposed amendment will have no impact upon
these facilities.
Light Industrial and
high density residential
(4.1 to 7.0 units/acre)
Transportation: The applicant has requested modification to
conditions of zoning to delete a twenty
(20) foot buffer adjacent to the proposed
north/south collector road. The applicant
intends to install a ten (10) foot high
chain-link fence along the western right of
way limits of this collector road in place
of the buffer. The proposed chain-link
fence should not be located within the
seventy (70) foot right of way of this
collector road. This is a large parcel of
land (approximately 522 acres) south of the

request site which is currently zoned
Agricultural (A), and the seventy (70) foot
right of way stubs into that parcel.
Depending upon how this property is ulti-
mately developed, the seventy (70) foot
right of way may not be capable of accommo-
dating a typical road section necessary to
facilitate anticipated traffic volumes. If
additional right of way is required in the
future, the fence may need to be relocated.
DISCUSSION
On February 27, 1985, the Board of Supervisors, upon a favorable rec-
ommendation by the Planning Commission, approved rezoning from Agricul-
tural (A) and Residential (R-7) to Residential (R-9) and Light Industrial
(M-1) with Conditional Use Planned Development to permit a rest home and
office/warehouse complex on the request property. A tweet
buffer was imposed along the western boundary of a proposed Wort /south
access road adjacent to Midlothian Middle School. The applicant requests
amendment of the original buffer condition to eliminate the twenty (20)
foot buffer and substitute a ten (10) foot high chain-link fence adjacent
to an existing athletic field at Midlothian Middle School. The proposed
fence would serve as an effective barrier between the proposed road and
athletic field and would minimize the possibility of balls being hit into
the right of way and prevent players from entering the road. Therefore,
approval of the requested amendment would be appropriate.
It should be noted that the Transportation Department recommends relo-
cation of the proposed fence approximately twenty-five (25) feet west of
the seventy (70) foot right of way. It is anticipated that, as property
to the south develops, additional right of way may be required to accom-
modate road improvements. If the fence is not located a sufficient
distance outside the right of way, it may be necessary to relocate the
fence at such time that additional right of way is required.
CASE HISTORY
Planning Commission Meeting (8/16/88):
There was no opposition present. The applicant accepted the
recommendation.
On motion of Mr. Kelly, seconded by Mr. Perkins, the Commission resolved
to recommend approval of this request, subject to the conditions on pages
1 and 2.
AYES: Unanimous.
The Board of Supervisors on Wednesday, September 28, 1988, beginning at 2:00
p.m., will take under consideration this request.
