Summary of Information: Gateway Homes of Greater Richmond has been selected as an award recipient for the Heroes in the Fight program, which recognizes exemplary efforts in the fight against mental illness. Preparers Don Kappel Title: Director of Public Affairs Attachments: ^ Yes ~ No #~~~~~~ RECOGNIZING GATEWAY HOMES OF GREATER RICHMOND FOR ITS EXEMPLARY EFFORTS IN THE FIGHT AGAINST MENTAL ILLNESS WHEREAS, one in five people will experience mental illness in their lifetime, or know someone personally who has a mental illness; and WHEREAS, the number one reason for hospital admissions nationwide is a biological, psychiatric disorder; and WHEREAS, more than 54 million Americans have a mental disorder, although fewer than 8 million seek treatment; and WHEREAS, it is estimated that up to one-third of those individuals who experience homelessness have some form of mental illness; and WHEREAS, Gateway Homes of Greater Richmond is the only nonprofit organization in Virginia that provides transitional, residential treatment for adults with mental illness; and WHEREAS, Gateway Homes of Greater Richmond is located in the Matoaca District on Reedy Branch Road; and WHEREAS, Gateway Homes of Greater Richmond works to help these individuals live as independently as possible; and WHEREAS, residents of Gateway Homes participate in daily educational and therapeutic psychosocial rehabilitation; and WHEREAS, these activities foster physical, mental and emotional well being in each Gateway Homes resident; and WHEREAS, due to its many efforts to assist those with mental illnesses, Gateway Homes of Greater Richmond has been selected as an award recipient in the Heroes in the Fight program; and WHEREAS, Gateway Homes of Greater Richmond was recognized by The Voices for Virginia's Children, Mental Health America of Virginia, the National Alliance on Mental Illness of Virginia, the Psychiatric Society of Virginia and the Virginia Association of Community Services Boards for providing exemplary care and dedication to those affected by severe and persistent mental illness. NOW, THEREFORE, BE IT RESOLVED, that the Chesterfield Board of Supervisors, this 14th day of October 2009, publicly recognizes the exemplary commitment of Gateway Homes of Greater Richmond to win the fight against mental illness, and congratulates Gateway Homes of Greater Richmond on its selection as a recipient of the Heroes in the Fight program award. Summary of Information: Z & H Investments, LLC, doing business as Bon Air Animal Hospital is making this claim against the County for $3,140.00 for the amount of a sewer connection fee on property which they own and operate as a veterinary hospital at 2749 McRae Road. The property was converted from a bank to a veterinary hospital after a 2007 rezoning. Central Fidelity Bank operated a branch at the location from 1975 until 1998, when it was acquired by Wachovia Bank. Shortly thereafter, Wachovia, which already operated another branch in Bon Air, sold the branch to Crestar. Crestar and its purchaser, Sun Trust Bank, operated a branch at that location until selling the property to the Animal Hospital in 2007. Preparers Steven L. Micas Title: County Attorney 0505:82408.1 Attachments: ^ Yes ~ No # (~~4®~4 CHESTERFIELD COUNTY BOARD OF SUPERVISORS Page 2 of 2 AGENDA At the time that the Animal Hospital purchased the property, County records indicated that it was still served by a septic system which was originally installed to serve the property in the 1960s, when it was a private residence. However, an investigation determined that the property at some point had been connected to the County sewer system without paying a connection fee. Sewer service had been extended to the area in 1975, making sewer available to the branch bank when it first opened. Upon discovering that the property had been connected to the sewer system without the County's knowledge, staff contacted the two banks which had previously owned the property, Sun Trust and Wachovia (now Wells Fargo). Staff requested that Sun Trust pay back user fees from 1998 until 2007 and that Wachovia pay the connection fee and user fees from 1975 until 1998. Sun Trust paid the County for the past due user fees, but Wachovia refused to pay its user fees or the connection fee, relying on the uncertainty surrounding when the property actually connected to the sewer system and the fact that due to the long passage of time since Wachovia last owned the property, the statute of limitations for the County to sue Wachovia has now passed. Since no connection fee has ever been paid for the property, a connection fee must still be paid pursuant to County Code and to the bond covenants issued to support the Utilities Department's revenue bonds. As the owner of the property, Bon Air Animal Hospital is now the responsible party for paying the connection fee. The County has consistently required owners of property to pay connection fees when it is discovered that the property had been previously connected to the utility system without paying the connection fee, even if that occurred under a prior owner. Since 1994, 38 such situations have been discovered, and the County has required the connection fee to be paid in each of the other 37 cases. Of those 37 payments, 25 came from owners who, like the Animal Hospital, were not the owners of the property at the time that the original, improper utility connection was made. The Animal Hospital believes that the County should have discovered that this property was improperly connected to the system when the banks still owned the property and that if the County had done so, it would have received the connection fee from Wachovia. A copy of the Animal Hospital's letter explaining its position is attached. However, since the current owner is receiving the benefits of the County sewer system, the current owner must pay the connection fee, in accordance with County Code and the bond covenants. 0505:82408.1 ®~®®~~ (. The property was purchased in August, 2007. According to Chesterfield County it was on a septic and not the county sewer system. On examination of the parcel it was noted that the whole lot was paved or built on. There was no place for a leach field to be located. Being on septic was highly suspicious. Prior to purchase and at my own ex- pense I had a private company "scope" the existing system. It was found to hook up to the main sewer line running along the east edge of the property. County sewer became available in 1978. The existing building was built and paved in 1979. In December of the same year I received a notification from the Health Department reminding us to pump the septic tank. I called and informed them that there was not a septic system and asked to be taken off the reminder list. They said they couldn't do this because according to Chesterfield County a septic system did exist. I was not referred to any other department. As mentioned earlier county sewer became available in 1978. The following year Crestar Bank purchased, built, and paved the lot. At that time connection to county sewer would have to been done. According to a conversation with Mr. Lance Gregory from the Health Dept on 1-22-09, a tracking program was started 10+ years ago. Every five years septic tanks were to be pumped at the owners expense. If not, Chesterfield County would do so and bill the owner. The program was never enforced although reminder letters continued to be sent and fees for the program were never approved by the then seated Board of Supervisors. According to Mr Gregory a reminder letter was sent to the previous owner on June 23rd of 2006 a year before our purchasing the building. Had this program been enforced the existing problem would have been corrected years earlier. ®~®~~~ I don't know whether the oversight was due to the County of Chesterfield or the previous owner. What I do know is that due diligence was performed by us and we shouldn't be penalized for helping Chesterfield County correct this problem. The proposed amendment is in conformity with the Building Code. The proposed amendment uses the finished area of a dwelling to establish the occupancy limitations. The proposed ordinance is similar to those already adopted in the Town of Herndon and Caroline County. It is not staff's intent to penalize or interfere with large families, so there is no limitation on the number of children who reside in the home. The proposed ordinance is attached. Since its approval by the Planning Commission, staff modified the first sentence of the proposed ordinance to clarify that group homes would not be restricted by the proposed occupancy limits. The Board of Supervisors may choose to set a public hearing on this item but is not required to do. Staff prepared this item at the request of the Planning Commission. The Planning Commission approved this request in a 3-2 vote. Subiect: Accept the Award from the FY2009 Drug Court Discretionary Grant Program, Office of Justice Programs, United States Department of Justice County Administrator's Comments: County Administrator: Acceptance of the award from the FY2009 Drug Court Discretionary Grant Program, Office of Justice Programs, US Department of Justice; and appropriation of $162,320 in federal grant funds. Summary of Information: The Chesterfield/Colonial Heights Adult Drug Court Program has been awarded a Drug Court Discretionary Grant in the amount of $162,320 from the Office of Justice Programs, US Department of Justice. The term of the grant will be September 1, 2009 through August 31, 2011. Grant funds will be used to continue access to psychiatric services for individuals enrolled in drug court that have multiple disorders, and provide continued family support services to drug court participants. (These services have previously been funded through other federal grants). Funding will also be used to provide training to the drug court team on prescription drug abuse. These grant funds will improve the operational abilities of the Adult Drug Court Program. That, in turn, will provide better service to the citizens of Chesterfield County. This grant requires a $65,304 in-kind match from the County for the entire grant period. The in-kind match consists of budgeted personnel funds currently utilized within the existing Adult Drug Court program. As a result, no additional funds are required and no new positions will be created under this grant. Summary of Information: In December 2004, the Board appropriated road cash proffers and authorized staff to proceed with the Happy Hill Road Improvement project. Preliminary engineering for Happy Hill Road between Harrowgate Road and Longmeadow Boulevard was done to determine the sections of road to improve with the available funding. The project involves two spot improvements: 1) adding shoulders to the curve south of Goodman Road and 2) improving sight distance and drainage at Tarris Lane. At the July 2009 meeting, the Board approved the early acquisition of right-of-way from one of the parcels on the project. Complete plans are available in the Transportation Department. A total of twelve parcels will be directly impacted by the project. No families will be relocated. Right-of-way and easements will need to be acquired across the frontage of the parcels in order to construct the project and adjust utilities. Staff met with ten of the twelve property owners directly impacted by the project during the plan development and explained the proposed design. The property owners were generally supportive of the project, but expressed concerns about how the project would directly impact their property. Staff has worked with the property owners to explain the project and resolve concerns. Staff was unable to contact two landowners, but has mailed the plans along with an explanation of the project and impacts to their property. A letter has been sent to each landowner advising them that Board approval of the design was being requested at this Board meeting. Staff will attempt to negotiate a settlement for all of the right-of-way acquisition. If settlements cannot be reached, staff requests authorization to advertise a public hearing for eminent domain proceedings. Staff is also requesting authorization to advertise and award a construction contract, up to $700,000, to the lowest responsible bidder. Staff believes it is advantageous to the county to advertise the project as quickly as possible in the current economic climate. Upon the Board's approval, right-of-way acquisition will begin immediately followed by utility relocations in the spring. Most businesses in the County pay personal property tax to the County on their business personal property. However, under state law, localities assess a "gross proceeds" tax in lieu of business personal property tax on "short term rental businesses" (such as United Rental or Blockbuster Video) that rent items to individuals and companies. The gross proceeds tax is significantly less than the personal property tax. As a result, short term rental businesses pay significantly less in taxes than they would pay if their business personal property were taxed. Over time many businesses have transitioned from owning their heavy equipment - and, in turn, paying business personal property tax on that equipment - to renting their equipment as needed. Many of the heavy equipment rental businesses in the County could not qualify as short-term rental business under the old legislation but will now qualify under the new law for the lower "gross proceeds" tax available to short-term rental businesses. The County is required by law to adopt the new short-term rental definitions. The new legislation also permits localities to continue to tax general rental businesses (such as Blockbuster) at a rate up to 1% of gross proceeds (the current rate for short term rental businesses in the County) and up to 1.5% for heavy equipment short term rental businesses. Staff recommends that the Board adopt the attached ordinance to 1) change the definition of short term rental business to conform to the state law, and 2) set the rate for heavy equipment short term rental businesses at 1.5% of gross proceeds. And while the new definitions will allow more rental businesses to qualify as short term rental businesses and, therefore, pay lower taxes by avoiding personal property tax, the revenue reduction would be partially offset by adopting a 1.5% rate on the newly identified heavy equipment rental businesses. Even with the higher rate, these heavy equipment rental businesses will still pay lower taxes than they would if their personal property were taxed. Under a 1.5% rate scenario, it is estimated that the County will lose approximately $175,000 in revenue for the 2010 tax year. That figure is the net result of an increase in short-term rental tax (i.e. gross proceeds tax) and an even larger decrease in business personal property taxes. SHORT-TERM RENTAL TAX Sec. 9-181. Imposition; amount. A. Every person certified to engage in the short-term rental business: ~1,~ As defined in § 9-183 (A~(1), shall pay a tax of one percent on the gross proceeds of such business; or As defined in ~ 9-183 (AZ2), involving heavy equipment rental, shall pay a tax of one- and-one-half percent on the rg oss proceeds of such business. B. For purposes of this section, "gross proceeds" means the total amount charged to each person for the rental of daily rental property, excluding any state and local tax paid pursuant to the Virginia Retail Sales and Use Tax Act. C. The imposition and collection of a short-term rental property tax pursuant to this section with respect to rental property shall be in lieu of taxation of such rental property as tan i~ ble business personal property in the same tax year. D. Except for daily rental vehicles, rental property shall be classified, assessed and taxed as tangible personal property if such property- ~1,) Is owned and rented by a person not engaged in the short-term rental business, as defined in ~ 9-183; or Has acquired situs in the county and is owned and rented by a person who does not collect and remit to the commissioner of the revenue ashort-term rental property tax with respect to the rental of such property Sec. 9-182. For purposes of this article, the term "day short-term rental property" means all tangible personal property held for rental and owned by a person certified to engage in the short-term rental business. The term "-daily short-term rental property" does not include trailers or other tangible personal property required to be licensed or registered with the Department of Motor Vehicles, Department of Game and Inland Fisheries, or the Department of Aviation. A person is engaged in the short-term rental business if: (1) Not less than 80 percent of the gross rental receipts of such business i during the preceding year aye arose from transactions involving rental of short-term rental property other than heavy equipmentproperty as defined in subsection B, for periods of 92 consecutive days or less, including all extensions and renewals to the same person or a person affiliated with the lesse~ee; or (2) Not less than 60 percent of the gross rental receipts of such business during thepreceding year arose from transactions involving the rental of heav~quipment property for periods of 270 consecutive days or less, including all extensions and renewals to the same person or a person affiliated with the lessee. For the pu~pr oses of this subdivision, "heavy equipment property" means rental property of an industry that is described under code 532412 or 532490 of the 2002 North American Industry Classification System as published by the United States Census Bureau, excluding office furniture, office equipment, and programmable computer equipment and peripherals. B. ," A person is "affiliated" with the lessee of rental property if such person is an officer, director, partner, member, shareholder, parent or subsidiary of the lessee, or if such person and the lessee have any common ownership interest in excess of five percent ~e~ssee. For purposes of this section: (1) Any rental to a person affiliated with the lessor shall be included in rental receipts but shall not be included for purposes of the 80 percent requirement of subdivision 1 of subsection A, or the 60 percent requirement of subdivision 2 of subsection A; and (2) Any rental of personal property which also involves the provision of personal services for the operation of the personal property rental shall not be treated as gross receipts from rental. For purposes of this section, the delivery and installation of tangible personal property shall not mean operation. C. A person who has not previously been en~aaed in the short-term rental business who applies for a certificate of registration pursuant to § 9-188 shall be eligible for registration upon his certification that he anticipates meetin tg he requirements of a specific subdivision of subsection A, desis?nated by the applicant at the time of application, during the year for which registration is sought. D. In the event that the commissioner of the revenue makes a written determination that a rental business previously certified as a short-term rental business pursuant to ~ 9-188 has failed to meet either of the tests set forth in subsection A during a preceding tax year, such business shall lose its certification as a short-term rental business and shall be subject to the business personal property tax with respect to all rental property for the tax year in which such certification is lost and any subsequent tax years until such time as the rental business obtains recertification pursuant to & 9-188. In the event that a rental business loses its certification as 0425: 82266.1 (~ a short-term rental business pursuant to this subsection, such business shall not be required to refund to customers dail ry ental prope taxes previously collected in good faith, and shall not be subject to assessment for business personal propertv taxes with respect to rental propertv for tax preceding the year in which the certification is lost unless the commissioner makes a written determination that the business obtained its certification by knowingly making materially false statements in its application, in which case the commissioner may assess the taxpayer the amount of the difference between short-term rental property taxes remitted by such business durin tg he period in which the taxpayer wrongfullyheld certification and the business personal property taxes that would have been due durin sg uch period but for the certification obtained by the making of the materially false statements. Any such assessment, and any determination not to certify or to decertify a rental business as a short-term rental business as defined in this subsection, ma,~appealed pursuant to the procedures and requirements set forth in Code of Vir ig_nia § 58.1-3983.1 for appeals of local business taxes, which shall apply mutatis mutandis to such assessments and certification decisions. E. A rental business that has been decertified pursuant to the provisions of subsection D shall be eligible for recertification for a subsequent tax ~ upon a showing that it has met one of the tests provided in subsection A for at least ten months of operations during the present tax year. Sec. 9-184. Collection, return and remittance of tax. Every person certified to engage in the short-term rental business shall collect the rental tax from the lessee of the daily rental property at the time of the rental. The lessor of the daily rental property shall transmit a quarterly return to the commissioner of the revenue, indicating the gross proceeds derived from the short-term rental business, and shall also remit the payment of the tax that is due for the quarter. The quarterly returns shall be filed with the commissioner of the revenue on or before April X915, July X915, October X915, and January X915, representing, respectively, the gross proceeds and taxes collected during the preceding quarters ending March 31, June 30, September 30 and December 31. The return shall be upon such forms and shall set forth such information as the commissioner of the revenue may require, showing the amount of gross receipts and the tax required to be collected. The commissioner of the revenue shall assess the tax due, and the short-term rental business shall pay the tax so assessed to the treasurer or director of finance not later than the last day of the month following the end of the calendar quarter. The taxes required to be collected under this article shall be held in trust by the person required to collect the taxes until remitted as required in this article. No short-term rental tax shall be collected or assessed on rentals by the commonwealth, any political subdivision of the commonwealth or the United States. Additionally, all exemptions applicable in Code of Virginia, tit. 58.1, ch. 6 [§ 58.1-600 et seq.], shall apply mutatis mutandis to the short-term rental tax, except that the commissioner of revenue shall assess the tax due, and the treasurer shall collect the short-term rental propertv tax, instead of the Department of Taxatinn_ 0425:82266.1 ~ ~ ®~ Sec. 9-188. Certificate of registration. (a) Every person engaging in the short-term rental business shall annually file an application for a certificate of registration with the commissioner of the revenue. Such application shall be filed no later than January 31 of each year. The application shall be on a form prescribed by the commissioner of the revenue and shall set forth the name under which the applicant intends to operate the rental business, the location of the rental business and such other information as the commissioner of the revenue may require. (b) An application must be signed by the owner or owners of the rental business. If the rental business is owned by an association, partnership or corporation, the application must be signed by a member, partner, executive officer or other person specifically authorized by the association, partnership or corporation to sign on its behalf. (c) Upon the commissioner of the revenue's approval of the application the commissioner of the revenue shall issue a certificate of registration. The certificate shall be conspicuously displayed at all times at the place of business for which it is issued. (d) The certificate is not assignable and shall be valid only for the person in whose name it is issued and the place of business designated.
