Stegmaier County Administrator Chesterfield County 9901 Lori Road PO Box 40 Chesterfield, Virginia 23832 Re.: Virginia Structure Number 6119 State Route 604 (Genito Road) over Swift Creek Chesterfield County, Virginia Mr. Stegmaier: As discussed last week, a recent inspection of the existing bridge over Swift Creek on Genito Road identified deficiencies such that a down posting of the structure from a 12 ton carrying capacity to a 3 ton carrying capacity was necessary. Since the down posting occurred on Januaryl4, 2010, VDOT staff has been engaged in the pursuits of identifying what short term and long term options were available to return the bridge to the pervious 12 ton carrying capacity or to replace the bridge. Short Term Options Several potential short terms options were considered as follows: • Placement of temporary structural supports (may not resolve lateral buckling issues identified during inspection). • Repair of the existing superstructure (would require further inspection and analysis prior to undertaking repairs and may not result in return to 12 ton capacity). • Replacement of the existing superstructure (replacement estimated at $1,500,000). WE KEEP VIRGINIA MOVING Due to the age and design of the structure (1939), the and the types of corrosion and deficiencies identified during the recent inspection, all of the options discussed above represent a significant investment that may or may not garner a short term return to a 12 ton carrying capacity. Due to these factors, the 3 ton posting will remain in place until a suitable long term option can be implemented. Long Term Options Two long term options were considered as follows: • Replacement of the existing structure with a current day bridge design. The bridge would be approximately 44' wide and 120' long. • Replacement of the existing structure with a series of box or pipe culverts. A replacement of the existing bridge with a bridge is a more desirable option than the culvert system from a long term maintenance approach. Pertinent details to know regazding a wholesale replacement are as follows: • Estimated cost: $3,500,000 - $4,000,000. • Project Development Time: 30 - 36 months from inception to advertisement. • Estimated Construction Time: 12 - 18 months (will require closure of Genito Road during construction). • Could be pursued as a design build project (to be determined). • The project would be developed as a federally funded project. • Will require some utility relocation. • Potential environmental hurdles will need to be addressed during project development stages due to the close proximity of the Swift Creek Reservoir and Swift Creek. Neat Steps Currently, the Richmond District staff is working to identify funding sources to replace the existing structure as described above. Finalization of funding opportunities and a formalized schedule and implementation plan is expected to be developed by Mazch 1, 2010. Subject: County Administrator's Comments County Administrator's Comments: County Administrator: Board Action Requested: Summary of Information: The Chesterfield Community Services Board has been informed by The Rehabilitation Accreditation Commission (CARF), that all mental health, mental retardation and substance abuse programs and services have been accredited for a period of three years. This accreditation outcome represents the highest level of accreditation, marking the fourth consecutive three-year accreditation awarded to the Chesterfield CSB by CARF, an international accreditation body. According to Brian J. Boon, Ph.D., President and CEO of CARF, "This achievement is an indication of your organization's dedication and commitment to improving the quality of the lives of the persons served. Subject: Appointment to Chesterfield Community Services Board County Administrator's Comments: County Administrator: Board Action Requested: Request the Board of Supervisors appoint an at-large member to the Chesterfield Community Services Board. Summary of Information: The Chesterfield Community Services Board is designated as an Administrative/Policy Board responsible for the provision of public mental health, mental retardation and substance abuse services. At the January 13, 2010 Board of Supervisors meeting, the Board nominated Mr. Vincent Burgess for appointment to the Community Services Board. Mr. Burgess is a strong advocate for those with disabilities with expertise and experience that will be beneficial to the Board. Should the Board appoint Mr. Burgess as an at-large member, his term would be effective immediately through December 31, 2012. Meeting Date: January 27, 2010 Item Number: 8.8, Subject: Streetlight Installation Cost Approvals County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of a new streetlight installation in the Dale District and additional funding for a previously approved installation in the Bermuda District. Summary of Information: Requests for streetlights, from individual citizens or civic groups, are received in the Department of Environmental Engineering. Staff requests cost quotations from Dominion Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections; CONTINIIED NEXT PAGE Preparers Richard M. There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection or 400 VPD if the requested location is not an intersection; 3. Petitions are required and should include 75% of residents within 200 feet of the requested location and if at an intersection, a majority of those residents immediately adjacent to the intersection. Cost quotations from Dominion Virginia Power are valid for a period of 60 days. The Board, upon presentation of the cost quotation may approve, defer, or deny the expenditure of funds from available District Improvement Funds for the streetlight installation. If the expenditure is approved, staff authorizes Dominion Virginia Power to install the streetlight. A denial of a project will result in its cancellation and the District Improvement Fund will be charged the design cost shown; staff will notify the requestor of the denial. Projects cannot be deferred for more than 30 days due to quotation expiration. Quotation expiration has the same effect as a denial. BERMUDA DISTRICT: At the January 13, 2010 meeting, the Board of Supervisors approved a streetlight installation at the intersection of Indian Hill Street and Woodsedge Road in the amount of $324.12. This cost was incorrectly reported by staff. The correct cost for this project is $2,162.25. For this project to proceed it will be necessary for the Board to approve additional funding in the amount of $1,838.33. School lighting upgrades approved for funding by the grantor represent a continuation of the lighting replacement process that COPS began many years ago as a result of determining that lighting fixture replacement represents a relatively short payback (in the 6 to 7 year range). The school lighting replacement projects will begin immediately. School lighting efficiency upgrades are expected to continue as part of building renovations funded in CIP maintenance projects. Schools have identified ten sites for lighting upgrades and are ready to begin the process of replacement. The school sites chosen for the grant are: Manchester High School, James River High School, LC Bird High School, Manchester Middle, Swift Creek Middle, Providence Middle, Gates Elementary, Evergreen Elementary, Christian Elementary, and Greenfield Elementary. These improvements will provide more energy efficient lighting and assist in reducing energy costs for these selected school sites. A preliminary design was initiated for the two and three-story building for a window and curtain wall replacement project and a more comprehensive design is now in progress with an anticipated bid process to begin some time in early summer. This project has become more intensive than initially thought and requires piping replacement and asbestos removal. The grantor will disburse funds to the county on an incremental basis. Half of the funds will be provided immediately, while the second half will be provided upon two quarters of meeting the monthly reporting requirements of the Department of Energy. The cost of additional staff time for preparing reports is covered by the grant funds. S. Department of Energy, National Energy and Technology Laboratory, EECBG Program through the American Recovery and Reinvestment Act. The agency has given approval for $1.6 million in school lighting upgrades, $1.0 million for energy improvements to the two and three-story administration building, and $0.140 million for consulting and administrative services. The County is in the process of identifying all costs associated with the window and curtain wall building improvements. The final scope of the two and three-story building renovations is still being identified and a comprehensive design is under way. Summary of Information: Under state law, certain businesses in the County may only operate pursuant to a permit issued by the chief of police. Such businesses include precious metal dealers, solicitors, nightclubs, massage parlors, adult businesses, fortunetellers and massage clinics. For most of these businesses, the state enabling legislation, and the corresponding County ordinances, were enacted many decades ago. This "good character" standard has been in common usage in permitting ordinances for many decades and is still found throughout the state in local permitting ordinances. Courts (both state and federal) have increasingly been invalidating as unconstitutional permitting ordinances that allow permits to be denied or revoked, on a finding by a public official that a business owner is not of "good character". The earliest of these cases concerned door-to-door solicitor permits, but courts have since invalidated permitting ordinances for many other types of businesses on constitutional grounds since they utilize a subjective "good character" standard. The County currently incorporates a "good character" standard for the issuance of permits for the following businesses: precious metal dealers, door-to-door solicitors, nightclubs, massage parlors, adult businesses, fortunetellers and massage clinics. Staff proposes that the permitting ordinances be amended to remove the "good character" standard but to retain all of the objective standards for denial of such permits which are currently contained in these ordinances. The proposed ordinance amendments are attached. Staff recommends that the Board set a public hearing on these ordinance amendments for the Board's February 24, 2010 regular meeting. 0825:83096.1(83097.1) O~U044 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 15-96, 15-121, 15-122.2, 15-133, 15-162 AND 15-246, OF THE COUNTY CODE RELATING TO THE "GOOD CHARACTER" STANDARD FOR CERTAIN BUSINESS PERMITS BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 15-96, 15-121, 15-122.2, 15-133, 15-162 and 15-246, of the Code o the County o Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Chapter 15 REGULATED OCCUPATIONS AND SERVICES 000 ARTICLE V. MASSAGE CLINICS 000 Sec. 15-96. Granting of permit. Within 60 days of the date of the permit application, the chief of police shall issue the permit if he shall find all the following: (a) Any massage clinic to be used or constructed meets all zoning, building, plumbing, utility, health, electric and fire prevention codes, as reported by the applicable departments. (b) The applicant complies with all requirements of this article. (c) The applicant does not pose any threat to the community's health and safety. Any past felony, or misdemeanor convictions of the applicant, materially affectin tg he applicant's ability to conduct the permitted activity including a conviction pursuant to this article and a crime of moral turpitude, shall be considered in making this determination. (d) The applicant is at least 18 years old and complies with the requirements of Code of Virginia, §§ 54.1-3000 and 54.1-3029. (e) The applicant has not made any false, misleading or fraudulent statements in the permit application nor in any other related document required by the county. 000 000045 0425:83097.1 ARTICLE VI. NIGHTCLUBS AND OTHER ADULT ENTERTAINMENT DIVISION 1. NIGHTCLUBS Sec. 15-121. Nightclub permit required from chief of police--Application; issuance. (a) Every person desiring a business license to operate a nightclub, as defined in chapter 6, shall first apply to the chief of police, or his designee, for a permit to conduct such activity. Each such application shall be accompanied by a fee in the amount of $25.00. (b) Information required on the permit application shall include, but not be limited to, the following: (1) The applicant's full name, age, sex, race, weight, height, hair and eye color, address, telephone number, date and place of birth and social security number; (2) Names and addresses of references; (3) Whether the applicant has been convicted of any felony or misdemeanor and, if so, the nature of the offense, when and where convicted, and the penalty or punishment assessed; (4) Photograph and fingerprints of applicant; and (5) Name and address of the business for which a permit is sought. (6) Written authorization to conduct a background investigation of the applicant, including a criminal records check, and to investigate whether the information provided by the applicant is true. (7) Written declaration, dated and signed by the applicant, certifying that the information contained in the application is true and correct. (c) For a corporation, partnership or other legal entity, "applicant" includes each officer, director, partner or principal of the entity and any managers of the business. (d) The applicant shall not be issued a permit if the county's investigation or the information furnished in compliance with this article shows that the applicant has been convicted of a felony or any other crime materially affectin tg he applicant's ability to conduct the permitted activity include a crime involving moral turpitude, or has been denied a permit or has had a permit revoked under any statute or ordinance similar in substance to the provisions of this article, ^- ~° ~°+ ^~ R^°a m°-^' ^''^r°^+°r. In addition, each application shall be reviewed by the county departments charged with enforcing the business license, zoning, building, plumbing, utility, health, electric and fire prevention codes, as needed, and no permit shall be issued if the applicant's business in the county does not comply with these and any other applicable county or state laws or regulations. ~~~~'~s 0425:83097.1 (e) Any changes in the ownership or principals of the business entity to which the permit is issued or in the managers of the business itself will automatically make the permit void. Such changes shall be reported to the chief of police or his designee, and a new application may be submitted for review. (f) Nightclubs shall be subject to the regulations regarding public dance establishments, set forth in chapter 3. DIVISION 2. ADULT BUSINESSES Sec.15-122.2. Same--Issuance. (a) The chief of police or his designee shall grant or deny an application within 30 days of its proper filing, unless information requested from other law enforcement agencies is not received within that 30-day period, in which case the chief of police or his designee shall have an additional 30 days to act on the application. Upon the expiration of the applicable time period, unless the applicant requests and is granted a reasonable extension of time, the applicant shall be permitted to begin operating the business for which the permit is sought, unless and until the chief of police or his designee notifies the applicant of a denial of the application and states the reasons for that denial. (b) If the application is denied, the chief of police or his designee shall notify the applicant of the denial and state the reasons for the denial. (c) The chief of police or his designee shall deny the application for any of the following reasons: (1) An applicant is under 18 years of age. (2) An applicant has failed to provide information required by this chapter or has falsely answered a question. (3) The premises to be used by the adult business have not been approved as being in compliance with health, fire and building codes. (4) The application or permit fees have not been paid. (5) The business does not have proper zoning. (6) The applicant has a permit under this division which has been suspended or revoked. (d) The applicant shall not be issued a permit if the county's investigation or the information furnished in compliance with this division shows that the applicant has been convicted of a felony or any other crime materially affectin tg he applicant's ability to conduct the permitted activity include a crime involving moral turpitude, or has been denied a permit or has had a permit revoked under any statute or ordinance similar in substance to the provisions of this division,_ . The applicant shall authorize a background investigation, including a criminal records check. Information required on the application shall include, but not be limited to, the applicant's full name, aliases, address, age, sex, race, social security number, date of birth and fingerprints; the name, address and telephone number of the applicant's employer, if any; and the location of the place of business of the dealer. The applicant shall date and sign the application and certify that the information contained in the application is true and correct. Before a permit is issued, the dealer must have all weighing devices used in his business inspected and approved by local or state weights and measures officials and present written evidence of such approval to the chief of police. (b) No license shall be valid for more than six months from the date of issuance. Any license may be renewed in the same manner as the initial license is obtained. The renewal application fee shall be $200.00. (c) If the dealer does not operate continuously at the same location after the date when he obtains the permit, he shall notify the chief of police when he ceases or renews business or upon change of his location. Failure to operate on weekends or holidays shall not be construed as ceasing or discontinuing operation. The dealer shall conduct his business only from the fixed and permanent location specified in the dealer's application for a permit. 000 ARTICLE VIII. SOLICITORS 000 Sec. 15-162. Issuance of permit; renewal. (a) No person shall enter into or upon a residential premises within the county for the purpose of soliciting, unless he has received a permit from the chief of police. ~~~Q~~ 0425:83097.1 (b) Information required on the solicitor permit application shall include, but not be limited to, the following: (1) The name, local and permanent addresses, age, date of birth, social security number, race, weight, height, hair and eye color and any other distinguishing chazacteristics of the applicant, which shall be verified by an automobile operator's license or other photo identification issued by a government agency. (2) The nature or purpose for which solicitations will be made and the nature of the goods, wazes, merchandise or services offered for sale. (3) The name and permanent street address of the employer or organization represented. (4) A photograph of the applicant and fingerprints of the applicant. (5) A statement of whether the applicant has been convicted of any felony or misdemeanor and, if so, the nature of the offense, when and where the conviction occurred and the penalty or punishment assessed therefor. (6) The make, model and license number of any vehicle to be used. (7) The specific area or azeas of the county where the solicitor will be working. (8) Written authorization to conduct a background investigation of the applicant, including a criminal records check, and to investigate whether the information provided by the applicant is true. (9) Written declazation, dated and signed by the applicant, certifying that the information contained in the application is true and correct. (c) The applicant shall not be issued a permit if a county investigation or the information furnished in compliance with this article shows that the applicant has been convicted of a felony or any other crime materially affectin tg he applicant's ability to conduct the permitted activity include a crime involving moral turpitude, or had a prior permit revoked under any statute or ordinance similaz in substance to the provisions of this article. , ^~ ~~ ~^+ ^~'-^^a ~~^rn' ^~°~°^+°~ A permit issued under this article shall be good for 30 days from the date of issuance unless earlier revoked. Every solicitor shall carry his permit with him at all times while engaged in soliciting, and shall display such permit to any person who shall demand to see the permit while he is so engaged. (d) A solicitor's permit which has expired may be renewed for an additional 11-month period, upon the execution of a renewal application setting forth one of the following: (i) a certification that the statements made in the original application aze still true and accurate statements at the time the renewal application is filed, or (ii) all changes in the original application required by a change in facts since the date of filing the original 0425:83097.1 000049 application. Applications for renewal must be made within 15 days after the expiration of the original permit. Those applications for renewal made after this period shall be considered applications for a new permit. 000 ARTICLE XI. FORTUNE-TELLERS Sec. 15-246. Fortune-tellers. (a) Every person desiring a business license to operate as afortune-teller (as defined in chapter 6) shall first apply for and obtain a permit from the chief of police, or his designee, to conduct such activity. Nothing contained in this section shall apply to a person pretending to act as afortune-teller in aproperly-licensed theater as part of any show or exhibition presented therein or as a part of any play, exhibition, fair or show presented or offered in aid of any benevolent, charitable or educational purpose. (b) The permit application shall include, but not be limited to, the following: (1) Name, alias or nicknames, resident and business address, phone number, place and date of birth, social security number, race, sex, age, height, weight, hair color and eye color. ~) z4-se~t~re-~t ~2,)(~-) Written authorization to conduct a background investigation, including a criminal record check. ~3,)(~4-} Written declaration, dated and signed by the applicant, certifying that the information contained in the application is true and correct. (c) The chief of police, or his designee, shall conduct an independent investigation and determine whether the statements contained in the lea ^°~ implication are true. (e) The chief of police, or his designee, may revoke or suspend any permit issued pursuant to this article (i) for fraud, misrepresentation or any false statements contained in the application; (ii) upon conviction of the applicant for any felony or misdemeanor involving moral turpitude after the permit is issued; (iii) for failure to comply with the provisions of this article; or (iv) if the applicant's business fails to comply with applicable county or state laws or regulations. (f) If the chief of police, or his designee, revokes a permit, he shall notify the permittee in writing of such action, the reasons for the revocation, and the permittee's right to request a hearing. To receive a hearing, the permittee must make a written hearing request which must be received by the chief of police, or his designee, within ten days of the date of the revocation notice. If a timely hearing request is not received by the chief of police, or his designee, the decision shall be final. If a hearing is properly requested, it shall be held within ten days from receipt of the hearing request. The hearing shall be presided over by the chief of police or his designee. The permittee shall have the right to present evidence and argument or to have counsel do so. Within a reasonable time after the hearing, the chief of police, or his designee, shall render his decision which shall be final. T'he permittee must discontinue operation of its business when the decision to revoke the permit becomes final. Real estate signs. 000 (b) The following real estate/construction signs require a sign permit and are subject to the conditions specified herein: (1) One onsite real estate sign advertising a residential community, provided such sign shall be removed for single family developments, within a period of two L2~ years after the recordation of the initial subdivision plat for the subdivision or section of the subdivision and, for new multi-family developments, within a period of one (1) year after the release of occupancy permits for all buildings in the development or separate phase of the development. Sign content is limited to directing motorists to the new residential community and sign size shall not exceed four square feet and a maximum height of 18 inches. Summary of Information: In November 2004, voters overwhelmingly approved a $40 million bond referendum for road improvements. The widening of Route 10 (I-95 to Ware Bottom Spring Road) was identified for $15 million of improvements. The total project estimate is now $30.8 million. The increase is primarily due to the construction being more complex than originally envisioned. To make up the shortfall, the county obtained approximately $10 million in American Recovery and Reinvestment Act (ARRA) funds, $2.6 million in Regional Surface Transportation Program (RSTP) Funds, and $300,000 in Congestion (Continued on next page) Preparers R.J. VDOT has allocated $2.5 million for the project. These funds total approximately $15.4 million and VDOT will use these funds to reimburse the county. The ARRA funds are required to be obligated by March 2010. The Board previously appropriated $305,000 in developer contributions and $6.3 million in county bond funds for the project. Design of the project is complete, right-of-way has been secured, and utility relocations are nearing completion. The project will be advertised in March 2010. Construction is expected to begin in June 2010 with completion by October 2012. Chairman Gecker and Members of the Board, Due to recent events in the county, my eyes have been opened to how my county government operates and how your decisions affect my family and my standard of living. I have some observations related to the School Board's CIP that you will be voting on in the upcoming months. First, I have to talk about Chester Middle School closing. Three of you sitting here tonight have stated that the closure is an operational decision by the SB. I have been told by David Myers that the closure of Chester Middle School is part of the CIP. He states that the CIP and closure of CMS were all voted on by the School Board as one item. Our committee has not received answers to questions related to this change from the School Board. Please consider asking for more information and the costs related to these changes. Also, consider the impact the closure of CMS will have on traffic along Rt 10 and concerns of families moving out of the area, which will result in decreasing home values. There were other viable options proposed in the 5 weeks that would not close a thriving, model school like Chester MS. Other issues as part of the CIP include specific line items and how the School Board plans to spend money: • -A new gym for Midlothian HS (FY2011). This school is only at 87% capacity at this time. During this financial crisis, it is not the time to build a new gym for $12M. If practice space is an issue then using existing facilities should be considered. • Renovation of Harrowgate and Enon ES with the addition of more seats being added to the school (FY2012 and FY2013)? These schools are at 84% and 83% capacity respectively. if we are expecting 15% growth in the Bermuda district by 2013 then why should the seats at Carver and Davis be at capacity? • $2M in the CIP for administration space (FY 2012 and FY2013). I consider this amount to be outrageous and poor spending of our tax dollars. • -Spending $8M on a HVAC system for the old Clover Hill HS if there is no distinct plan for this building. • -$9M fora 2155 Century Academy (FY2011). Should we be starting new programs or expanding programs during an economic crisis? I will ask that: -part of the savings that the School Board has accumulated be partially allocated back to cover the operating budget shortfall -consider increasing the percentage of funding for schools from county tax collections. -increasing the tax rate to a revenue neutral rate to accommodate for the decreased real estate assessments for 2010. The name of the group was updated as part of our desire to continue to be actively engaged in the decisions affecting our local schools and government. We have had a number of questions about the decision to close Chester Middle School (CMS) at the end of the current school year in order to make that facility available as 9a' grade academy for Thomas Dale High School (TDHS). We have not received all of the answers to these questions that we have been asking. Under the Freedom of Information Act (FOIA), we want the answer with documentation to each of the following questions. As provided by the open records law, we will expect your answer within five (5) working days. We're trying to understand why this had to happen. It would be helpful to have answers to specific questions because we are still angry and we want to get beyond angry. 1. What is the cost of implementing Option 1? 2. What is the cost of moving TDHS 9~' grade to CMS? 3. Why wasn't a cost analysis done on each option? 4. Why was the CMS Sa` grade grandfathered in at the last moment? 5. What is the cost of grandfathering the 8~' grade? 6. The Career Pathways plan being implemented at Meadowbrook HS was previously suggested as an option to relieve overcrowding at TDHS but was rejected. Why? 7. Our group was informed prior of a school board contingency to move the Cosby High School 9~' grade to what will be the old Clover Hill HS building which was later acknowledged by the Bermuda district School Board member, Marshall Trammell. However at the 01/12/10 School Board meeting, both Chairman Wyman, and the Matoaca district board member, Omarh Rajah, denied such a contingency existed. Please explain the discrepancy. 8. Why the short time frame in implementing Option 1? 9. Will the classroom trailers at TDHS be removed upon implementation of Option 1? 10. Please provide us a copy of Marshall Trammell's communications/call log from December 3, 2009 through January 13, 2010. 11. Please provide a copy of the latest customer satisfaction survey for TDHS. 12. Please provide a copy of the most current utilization report for TDHS. 13. Please provide a copy of the functional capacity plan for TDHS. 14. I suggest that this is a good time to think soberly about our responsibilities to our descendents -those who will ring out the Fossil Fuel Age. Our greatest responsibility, asparents and as citizens, is to give America's youngsters the best possible education. We need the best teachers and enough of them to prepare our young people for a future immeasurably more complex than the present, and calling for ever larger numbers of competent and highly trained men and women. This means that we must not delay building more schools, colleges, and playgrounds. It means that we must reconcile ourselves to continuing higher taxes to build up and maintain at decent salaries a greatly enlarged corps of much better trained teachers, even at the cost of denying ourselves such momentary pleasures as buying a bigger new car, or a TV set, or household gadget. We should find - I believe -that these small self-denials would be far more than offset by the benefits they would buy for tomorrow's America."' The words I have spoken thus far have not been my own, though I do share their sentiment. Those words were in fact offered as official government testimony by Admiral Hyman George Rickover in an address to the United States Con~ress, House Committee on Appropriations in 1960. Admiral Rickover, born at the turn of the 20 Century, would have been 110 years old today, yet 50 years after he uttered those words, I find myself standing before you repeating his cautionary declaration after hearing a school budget presentation that suggests doing just the opposite as we prepare today's young people for the 21st Century. The best teachers and enough of them. Last night the Superintendent presented a school budget recommending a 3% pay cut to existing staff, a staff whose average compensation already ranks 26~` in the state of Virginia, and is almost $10,000 behind the US average. The presentation showed that Chesterfield ranks 107' of 132 Virginia localities in per pupil funding, 109 in administrative staffing; and presentations made at the Community Conversations hosted by this board in the fall showed that you are extremely fiugal and provides services to residents at the lowest cost of our peer group. But let me share another ranking, that of~per capita wealth: 18~`. The 18`t` wealthiest locality, yet 26`" in employee compensation, and 107 in per pupil spending, and last in the region in compensation to our public safety responders. The best teachers and enough of them. This is the reward that our public servants receive for the much vaunted results they've produced. r Directly stated in the COPS Core Beliefs is the idea that "our citizens, parents, students, and employees are partners in sustaining competence and investing in excellence." $25 Million of the $26 Million in cuts to the school budget (96.6%) directly involve employees. That doesn't sound like partnership or investing; it's balancing the budget on the backs of employees and the children they care for. Admiral Rickover, who lived through the worst economic depression in US history, at a time when the average home had far fewer creature comforts than today, understood the greater vision for an educated citizenry. At a rally held right outside this very building just an hour ago, a Coalition for a Quality Community engaged our citizenry on the issue of investing in quality. We had local civic leaders as well as supporters driving in from other counties and our nation's capital standing up with our community to show that we will support you if you are courageous enough to support our students and their families. So I caution you, as President Nixon remarked at Admiral Rickover's promotion ceremony, do not "become submerged by the bureaucracy, because once genius is submerged by bureaucracy, a nation [or in this case, a county] is doomed to mediocrity." 2 Please reject the notion of "Revenue Neutral," of deeper budget cuts that will hurt our employees, and the students in their charge, and instead, embrace a position of "Quality Neutral," perhaps trying some of the "outside of the box" suggestions made by citizens this past fall. They may not be perfect solutions, and you know, they may not work well for us in the long run-we don't know how we'll adapt to the change, and that makes us uncomfortable.
