PROPOSED LAND USE: A single-family residential development is planned. Conditions of Case 04SN0269 currently require a minimum gross floor area of 2,000 square feet for all dwelling units. The applicant is requesting a reduction in this minimum dwelling size for amaximum ofthirty-six (36) lots. (Proffered Condition) PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITION ON PAGE 2. AYES: MESSRS. BROWN, HASSEN, BASS AND WALLER. ABSENT: MR. GULLEY. STAFF RECOMMENDATION The condition relative to house size was negotiated with area property owners. After consideration of public input, should the Commission and Board wish to approve these amendments, acceptance of the Proffered Condition would be appropriate. (NOTE: THE ONLY CONDITION THAT MAY BE IMPOSED IS A BUFFER CONDITION. THE PROPERTY OWNER(S) MAY PROFFER OTHER CONDITIONS. All other dwelling units shall have a minimum gross floor area of 2,000 square feet. Dwelling units located on lots immediately adjacent to Stanwick Subdivision shall have a minimum gross floor area of 2,000 square feet. Existing Zoning: R-12 Size: 21.7 acres Existing Land Use: Vacant Adjacent Zoning and Land Use: North, East and West - R-7, R-9 and R-12; Single family residential or vacant South - A; Single family residential UTILITIES; ENVIRONMENTAL; FIRE; AND TRANSPORTATION This request will have no impact on these facilities. Financial Impact on Capital Facilities: This case has been evaluated under the existing cash proffer policy. It has been determined that the request for amendments relative to house sizes will have no increase in the proffered maximum density. Therefore, there is no increased fiscal impact. 2 10SN0159-FEB24-BOS-RPT T , ANn 1 IMF, Comprehensive Plan: Lies within the boundaries of the Central Area Plan which suggests the property is appropriate for residential use of 1.0 - 2.5 dwelling units per acre. Area Development Trends: Surrounding properties are zoned residentially and agriculturally and are developed as part of the Colony Pointe, Evergreen Hills and Stanwick Subdivisions or as dwellings on acreage parcels. It is anticipated that area properties will continue to develop for residential uses at densities suggested by the Plan. Zonin H.~ istory: On December 15, 2004, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved Residential (R-12 and R-15) zoning on an 80.5 acre tract fronting the east line of Claypoint Road and the west line of Alberta Road. Conditions of Case 04SN0269, in part, addressed minimum dwelling sizes. Subsequent to approval of this case, the western portion of this property was recorded as the Colony Pointe Subdivision. The eastern portion remains vacant and is the subject of this current request. Huse ~i yes: Currently, conditions of Case 04SN0269 establish a minimum gross floor area of 2,000 square feet for dwelling units (Proffered Condition 5). This condition was a result of negotiations with area property owners during the zoning process. The applicant is requesting an amendment to reduce the minimum gross floor area to 1,600 square feet for a maximum of thirty-six (36) dwelling units. All other dwelling units would contain a minimum gross floor area of 2,000 square feet, to include dwellings on lots adjacent to Stanwick Subdivision located east of the subject property along Alberta Road where access to this development is also proposed. (Proffered Condition) CONCLUSION Conditions relative to dwelling sizes were negotiated with area property owners. After consideration of public input, should the Commission and Board wish to approve this amendment, acceptance of the Proffered Condition would be appropriate. 3 10SN0159-FEB24-BOS-RPT CASE HISTORY Planning Commission Meeting (1/19/10): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Waller, seconded by Mr. Hassen, the Commission recommended approval and acceptance of the proffered condition on page 2. AYES: Messrs. Brown, Hassen, Bass and Waller. ABSENT: Mr. Gulley.
