On motion of Mr. Britton, seconded by Lr.Apperson, it is resolved that the minutes of March 25, 1965, be and the;= same are hereby approved. On motion of Mr. Britton, seconded by Nr.Goyne, it is resolved that the Standard Water Contract A-569C for the installation of water in the Marlboro Subdivision in the amount of $7294.00, be, and the same is hereby approved. On motion of Nir. Britton, seconded by Mr. Goyne, it is resolved that the County Engineer be authorized to install a fire hydrant in the vicinity of 5111 Old Midlothian Pike, providing the applicants pay the normal installation fee of 0175.00. There arose a discussion concerning the planning of roads affected by the Swift Creek impoundment. Upon consideration whereof and on motion of NIr. Horner, seconded by NIr. Niartin, it is resolved that the plans be authorized for the raising of Rt.604 and the necessary protection of Rt. 668. On motion of Mr.Britton, seconded by Mr.l',;artin, it is resolved that Sewer Contract S-65-25D for the installation of sewers in the Larkwood Subdivision, be, and the same is hereby approved. On motion of Mr. Martin, seconded by D�Ir.Britton, it is resolved that the Contract No.S-64-19C for the installation of sewers along the Powhite Creek in Bon Air be awarded to the Roanoke Construction Company in the amount of `.113$,400.00. Hawthorne shall have executed and acknowledged for record on a form approved by the Commonwealth's Attorney an appropriate Declaration of Vacation. ?rdhen such Declaration of Vacation has been approved, and shall shall be recorded in the Clerk's Office of the Circuit Court of this County, and said Clerk shall indicate the vacation on the margin of the recorded plat of Northlake Hills, jection B, recorded in Plat Book 13, page 42, and shall enter the same on the grantor side of the General Index of Deeds in the name of Y.T%.Hawthorne. A letter was read from Mrs.Graham Bruce requesting a share of the insurance policies covering County property. Upon consideration whereof, Mr. Browning makes a motion which is seconded by Mr. Appdrson that the insurance plan be approved as presented. ',Jhereupon,Mr. Goyne makes a substitute motion: That Mrs. Bruce be added to the list of policy holders. The substitute motion failed by a vote of 4 to 1. A vote being taken on the original motion, Mr.Goyne votes Nay, the rest of the Supervisors vote Aye. -3- On motion of lvir.Appeon, seconded by Mr.Goyne, Tt is resolved that A-:rs. Bruce's name be considered in the insurance schedule for next year. It was generally agreed thnit the Executive Secretary write a letter to the highway Department concerning the prospect of purchasing a right of way for the construction of a bridge across the Atlantic Coast Line RR. in the event that traffic on the new road at the Walthall Interchange would merit such a bridge, requesting the required right of way. Mr. Goyne discussed the speed limit on Rt. 616 and Rt. 10, between R}. 616 and Rt. 1 and other locations in Chester. Upon consideration whereof, and on motion of Mr.Goyne, seconded by I�ir. Browning, it is resolved that the Highway Department be requested to reduce the speed limit from 55 to 45 MPH on Rt. 10, from Rt. 1 to Parkers Lane. On motion of 1V1r.I,.:artin, seconded by I,r.Browning, it is resolved that this Board requests the Highway Department to study the speed limit on Evansway Lane and to change the speed limit if same be feasible. On motion of Mr J,artin, seconded by I r. Apperson, it is resolved that the highway Department be and they hereby are requested to install a traffic stop light at the intersection of Buford Road and Forest hill Avenue. On motion of Mr.Goyne, seconded by Ifr. Browning, it is resolved that the County Engineer requests the contractors installing sewers in the "'hester vicinity to improve the streets as soon as possible. Mr. Apperson reports that 5 feet on the south side of Cogbill Road, from the Meadowbrook High School to Rt.10 is obtainable, with the exception of one property owner. Upon consideration whereof and on motion of Mr.Apperson, seconded by Mr.Browning, it is resolved that the Highway Department be requested to acquire the necessary right of way on the south side of Cogbill Road from Meadowbrook High School to Aoute ##10 so that a sidewalk may be constructed to facilitate the traveling public on this narrow road. There was read a letter from Iir.J.E. Harwood, Deputy Commissioner and Chief engineer, Department of Highways, denying the Board's request to make Rt. 892 a,Primary Road. The request to improve Hill Drive was discussed briefly and it was agreed that the Highway Engineer would investigate this ma tter further. IvY.Raymond Cash comes before the Board to request an appropriation toward the Manchester Athletic Association to share one-half the cost of certain proposed improvements to the Athletic Field, the total cost of which improvements are estimated at 4'p38,000.00. It was generally agreed that this Committee first seek the support and approval of the School Board since the improvements would be on School Board property. Mr. Henry Blankenship explains the Centennial 4dition of the Petersburg IL41 Progress -Index and requested the County to advertise in this issue. It was generally agreed that this matter be studied further. Pinkney Sowers, representing the Toddsbury Land Corp.; speaks for the zoning request on Hopkins Road deferred from March 10, 1965 and states that his clients have just purchased 118-acres in this area and that the cost of new construction will total �22,500,000.00, that this is anoverall plan with the Medical Center possibly acting as a buffer for the proposed business area. Zane Davis, representing Shoosmith Bros. comes before the Board requesting the rezoning in Dale Magisterial District, from Agriculture to General Business (C-2) of a parcel of land of irregular shape, fronting approximately 1200 fer:t on Route 10 and extending southwestwardly 2275 feet and having a frontage of 900 feet on the west line of Lewis Road (Route 632). There appearing no one in opposition to thisrequest and the Planning Commission having recommended approval thereof, it is on motion of Yr. Apperson, seconded by Mr.Goyne, resolved that the aforedescribed parcel be and it hereby is rezoned to General Business. 65-20. Mr. Pqul A. Pedersen comes before the Board requesting the rezoning from Agticultural to Industrial in Bermuda Magisterial District, of a 182 acre parcel of land fronting 2448 feet on Route 10 and extending northwardly 2996 feet with its northern boundary being the James River property being 2900 feet west of the intersection with Hundred Road (Route 618) and Route 10. There appearing no one in opposition to this request and the Planning Commission having recommended approval, it is on motion of Nir.Goyne, seconded by Mr.Apperson, resolved that the aforedescribed parcel of land be and it hereby is rezoned for Industrial purposes. 65-21. Mr. Louis A. Lewis comes before the Board requesting the rezoning from Agricultural to iesidential-1 in Manchester Magisterial District, of a parcel of land fronting 311 feet on Ruthers Road, (Route 7331 and extending westwardly 509 feet, being 1883 feet south of Route 60. There appearing no one in opposition to this request and the Planning Commission having recommended approval, it is on motion of 11ir. Mr. A.O.Heath comes before the Board requesting the rezoning from Agricultural to Residential-2 in Manchester Magisterial District, of a 12-acre parcel of land fronting 672 feet on Dorset Road and extending 1079 feet eastwardly, with its northern boundary being Spring Branch, the property being 140 fee6 north of Pettus Road and better known as the Subdivision of Cornwallis Court. There appearing no one in opposition to thi,a. request and the Planning Commission having recommended approval, it is on motion of Ivr. Britton, seconded by I,Ir.Goyne, resolved that the aforedescribed parcel of land be and it hereby is rezoned to Residential-2 purposes. 65-24. 1.,r. Rodney F. 1,Aorris comes before the Board requesting the rezoning in Midlothian Magisterial District from :+gricultural to Residential-2 of an irregular shaped parcel of land fronting 224 feet on Old Farm Road and extending westwardly approximately 700 feet, being 860 feet south of Robious Road (Route 675). There appearing no one in opposition to this request and the Planning Commission having recommended approval, it is on motion of Mr. i artin, seconded by Mlr.Britton, resolved that the aforedescribed parcel of land be and it hereby is rezoned for Residential-2 purposes. 65-25. Mat Wiltshire, representing i,ir.W.S.Richardson, comes before the Board requesting the rezoning in Manchester Magisterial District, from Agricultural to General Business of an irregular shaped parcel of land fronting 126 feet on Lordley Lane and extending westwardly 150 feet, being 189 feet south of Belt Boulevard. The Executive Secretary pointed out that there was some question concerning the width of the public right of way of the road on which the requested property is located and the Planning Commission having recommended approval subject to the clearing up of any right of way problem, it is on motion of Pir.Britton, seconded by P,r. Goyne, resolved that the afore - described parcel of land be and it hereby is rezoned for General Business purposes, provided that no building permit be issued along this road unless and until there is dedicated free and unrestrict4d a 40-ft. right of way which right, of way is located and staked. 65-26. l,.r. Fred Gray and Mir. Garland Rowe, representing the Municipal Paving Company, come before the Board reque-.ting the rezoning from Agriculture to General Business in Manchester Magisterial District of a 3.4 acre parcel of land fronting 50 feet on Route 60 and extending southwardly 685 feet with the major portion of the property having a width of 265 feet, being 590 feet northeast of Providence Road (Rt.678), and presently zoned General Business (C-2) for a depth of 300 feet. There appearing no one in opposition to thisrequest, and the Planning Commission having recommended approval, it is on motion of Mr.Britton, seconded by I�r.Browning, resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Business with the understanding that should the parcel be subdivided in any way that a 50-ft. right of way would have to be dedicated and approved. -7- 65-8U. Mann d N:r.Drake, representing tie Mann Realty, Inc., come before the Board requesting in Midlothian Magisterial District a Use Permit to construct a Radio Tower on a three acre parcel of , land of triangular shape, fronting 770 feet on the southern right of way of the Southern Railroad and having an average depth of 190 feet, the property being 535 feet northeast of the crossing of Route 714 and the Southern Railroad. Come also, Mr. Edward Jefferson and Mr -Walter Smith and fi•v.e.:other people to oppose the erection of a Radio Tower, citing the fact that such an operation would interfere with people with electrical appliances. Upon consideration whEreof; Mr. Lartin makes the following motion, which was seconded by NIr.Britton: That the Use Permit to erect a Radio Tower on the aforedescribed parcel of land be granted, subject to the approvi:l of the Board of the exact location of the Tower. The intersection of Castlebury and Randall Drive in i;astlebury Subdivision. The intersection of Coxendale and Osborne Road in Normandale Terrace. The intersection of Allerton and Strathcona Road in Falling Creek Hills. Elliham avenue in Patterson Park On motion of Iti,r. Apperson, seconded by I�.r.Goyne, it is resolved that the Executive Secretary be requested to contact the Virginia Electric and Power Company officials to ascertain how street lights can be erected in those subdivisions with underground electrical service. The Executive ,'ecretary cited to the Board that Colonial Heights had imposed a �1.00 per load charge on the trash dumped into the Colonial Heights landfill, and it was generally agreed that this charge was in line. On motion of Nir.Goyne, seconded by P r.Apperson, it is resolved that the request of the Circuit Court for additional equipment as listed, be and it hereby is approved. On motion of Mr.Britton, seconded by 1141r.Goyne, it is resolved that the request of the County Engineer for a dictating machine and comptograph be and it hereby is approved. -8- On motion of Iv1r.Apper on, seconded by Mr.Brittonit isresolved that the following appropriations be and the same are hereby made for the month of May, 1965, from the funds and for the functions or purposes indicated in -,the amount of $1,957,659.00. On motion of 1,.r.Apperson, seconded by MrJlartin, it is resolved that the contract with the Health Department for paying a portion of the expenses of a qualified Soil Scientist to interpret the Soil Program in the County, be, and the same is hereby approved. On motion of Mr.Apperson, seconded by Mr.Goyne, it is resolved that the furniture requested by theTreasurer, Plr.George W.I,,00re, Jr., for his office in the new office building addition, e and it hereby is approved, provided the proportionate share of the cost of said furniture will be paid by the State of Virginia. On motion of 1�1r.Apperson, seconded by Mr. Goyne, it is resolved that the Y,1C.C.A. again be allowed to use the Exhibition Buildings at the Courthouse in case of rain, provided that no previous commitments for the use of these buildings have been made. On motion of Er. 1vtartin, seconded by 1.r.Goyne, and Mr. Britton, Be it Resolved: That the Vendort' Sales Tax Ordinance presented to the Board by the Executive Secretary and the Commonwealth's Attorney as heretofore requested is hereby introduced and a public hearing is ordered to be held on the 15th day of June, 1965. The Edecutive secretary is requested to cause the ordinance to be published in the News -Journal of this County in accordance with the provisions of Sect.15.1-504 of the Code of Virginia, 1950) as amended. On motion of I�X. horner, seconded by Dilr.Britton, Be it Resolved -By the Board of Supervisors of Chesterfield County, Virginia: That it determines that it is necessary and expedient fbr!:the County of Chesterfield to acquire a permanent flo6d easement over, across and upon land of Howard W. Hancock containing 89.1 acres as shown on a plat made by LaPrade Bros., Civil Engineers, dated February 91 1965, revised April 1, 1965, in connection with the construction of the Chesterfield Reservoir. The County Engineer is authorized to negotiate with the landowner for the purchase of said easement, and if he is unable to acquire the same by purdhase, then the Board is of the opinion that an emergency exists and that it is necessary to enter upon and take possession of the aforesaid land on May 20, 1965. The Executive M M MA Secretary of this Board is directed to notify the above landowner by registered mail at least thirty (30) days before said date that the County intends to enter upon and take possession of the said easement on the 20th day of T,.ay, 1965. It is the opinion of the Board that the sum of �5,453.00 is the fair valu4 of the easement taken and damages done as a result thereof. Be it Further Resolved, that the Commonwealth's Attorney of this County is authorized to institute the necessary proceedings on behalf of the County to acquire said easement by the exercise ofthe right of eminent domain and to represent the Boar( if the landowner contests the manner of said taking. It is Further Resolved, that the Clerk of this Board is authorized to deposit with the Clerk of the Circuit Court of this County the sum of 45,1_;53,00 as set forth above, being the Board's estimate of the value of the easement taken and damages done, i-�hen required to do so by the Commonwealth's Attorney. On motion of Mr.Apperson, seconded by Mr.Goyne, it is resolfed that the Commissioner of the Revenue be and he hereby is authorized, under Chapter 282 of the Acts of the Assembly of 1964 to employ the State Taxation Department to assist in the assessment of manufacturing machinery in the County of Chesterfield. WHEREAS) it is the considered opinion of the Board of Supervisors of Chesterfield County that a bridge will ultimately be needed across the Appomattox River to join the unties of Chesterfield and Dinwiddie, which bridge would connect the Primary highways 36, 460 and 85, and WhEREILS, the Appomattox Water Authority has sold bonds to finance the construction of a dam across the Appomattox River, which dam would be west of Katoaca, and WHEREAS, it is necessary to provide in the design of said dam structures that will support a bridge, NOW, ThFREFORE, BL IT RESOLVED; on motion of Mr.Apperson, seconded by Ivir.Britton, that this Board requests the Highway Department to allocate such funds as are available toward the cost of constructing a bridge and the approaches to said bridge across the Appomattox River. On motion of Mr.Goyne, seconded by Mr.Britton, it is resolved that the Executive Secretary be and he hereby is authorized to write to the Allied Chemical Company explaining the proposed closing of certain roads after tie new Rt.620 has been completed. On motion of Mr.Goyne, seconded by Mr.Apperson, it is resolved that the Board of Supervisors of Chesterflield County determines that no part of Rt. 1132, between Rt. 1 eastwardly to the proposed Rt. 620, should be closed. On motion of Mr.Britton, seconded by Mir.Goyne, it is resolved that the County Planner be and he hereby is authorized to advertise certain -10- M areas on Belt Boulevard for rezoning to General Business and certain areas in Green Acres in the same vicinity for rezoning to Residential-2. On motion of 1,1r.Apperson, seconded by Mr.Britton, it is resolved that the County Planner be and he hereby is authorized to advertise the remaining section of Rock Spring Farms for Residential-2 zoning. The County Engineer advised the Board that the proposed water line on Jubra Drive previously authorized, would cost an estimated �`4000.00 and it was generally agreed that t is matter be investigated further. On motion of 1'-1r.Britton, seconded by Nr.Apperson, it is resolved that the County Engineer be authorized to notify the Woodstock Land corporation that if the work proposed by the Atlantic Coast Line Ry. in enlarging the drainage structure underneath said Railroad is accomplished, the land in this drainage area would be released for further development. Mr.E.L.Iviumma, Building Inspector, presents 1f�r. `,arl Ittner of the Reynolds Metals Company, who presents lax. Rugg from Panel Fab Prodact�a-;-^Inc who shows plans of aluminum buildings, commercial units and schools, citing certain figures which indicate that schools of t1-is class would be somewhat cheaper than schools currently being constructed. On motion of 11r.Goyne, seconded by Vir.Apperson, it is resolved that the Building Inspector be authorized to approve one (1) dwelling of such a type for construction in the County. On motion of Nir. That $1100 be made available to match a similar amount offered by the principal of Thomas Dale High School for the development of blacktop play areas as per the copy of the communication attached hereto. b. That a sum of money sufficient to pay the cost of connecting the Bensley Elementary School to the county sewerage system be made available to the School Board by aa addition to its current budget. Mr. Schremp of the Department of Utilities has indicated to our Mr. Lux that the charge will be $500 per acre. (The site consists of twelve acres). These two requests are made because we do not have in our current budget sufficient funds to accomplish these desired projects. As Mr. Atkinson discussed with you on April 8, 1965, the FAA design criteria for general aviation airports has changed in recent weeks which may affect the initial development for the proposed Chesterfield County Airport if your project is approved. As an example, you have proposed a 3800' x 100' runway. Under the revised criteria, federal participation in the initial development for your airport may be limited to a 3600' x 75' runway. After your airport is established, and if you can show a definite need for a runway length of greater than 3600', then we can consid- er a Request for Aid for extension of the runway. Any runway length greater than 3600' would have to be justified on the basis of frequent use by the larger executive aircraft (Gulfstream, Convair, F-27 etc.) which would use the airport on a regular basis. This is our reason - in the event of an explosion of any of these objects you would have coverage under the Explosion feature of the Extended Coverage and a $ 250.00 deductible clause would apply. Our CompanyTs Engineer feels that these objects can be replaced for less than $ 250.00 and we did not want to charge a premium on something where you could not collect. We might state that if you wish these objects covered, we could quote you a premium under a separate boiler policy, which is not subject to a deductible clause. Burnett, Executive Secretary Chesterfield County Chesterfield Court House, Virginia Dear Mr. Burnett: The resolution adopted by the Board of Supervisors of Chesterfield County on March 10, requesting that Route 892 be added to the State Primary System has been very carefully reviewed by the engineering staff of the Department of Highways and has been discussed with the Commissioner. There is no doubt but what this is a much needed facility and will carry a large volume of traffic when completed, but at the present time we do not feel that it would be proper to transfer this route to the Primary System. As you know, we have worked very closely with Chesterfield County in establishing and planning this route and arranging the financing from the Secondary funds available to the county. One section is now under construction, another section is in the right-of-way stage with construction scheduled in the near future, and the remainder is about ready for right-of-way acquisition. The financing has been arranged and with the planning and construction in this advanced stage, we do not feel that it would be proper to make the transfer at this time. Of course, before this route could be added to the Primary System, a careful study would have to be made to determine whether it would meet the criteria that has been established. Unless, and until this road is in use, such a study would be rather difficult to make and I am not sure whether the results would indicate that the criteria would be met. Fortunately, this has involved little use during the past two summers. It has been a big help to us to have this area to use when rainy weather hampers the activities and program of the boys and girls of our Thunderbird Day Camp. Last year our camp averaged 120 youngsters daily for its eight —creek season, serving 432 different boys and girls. OATES COMMONWEALTH ATTORNEY The proposed vendors' tax ordinance should be published under the provisions of §15.1-504 of the 1950 Code of Virginia, as amended, which requires: (a) Any such ordinance may only be introduced at a regular meeting of the governing body and may not be adopted prior to the second regular meeting following introduction and only then if not less than sixty days have elapsed between introduction and adoption; (b) The proposed ordinance shall be published once a week for four successive weeks in a newspaper published in the county, or if there be none such, in a newspaper having general circu- lation in the coup y; and (c) The proposed ordinance shall be published at the front door of the county courthouse and at each post office in the county. Hancock.containing 89.1 acres as shown on a plat made by LaPrade Bros., Civil Enginee dated February 9, 1965, revised April 1, 1965, in connection with the construction of the Chesterfield Reservoir. The County Engineer is authorized to negotiate with the landowner for the purchase of said easement, and if he is unable to acquire the same by purchase, then the Board is of the opinion that an emergency exists and that it is necessary to enter upon and take possession of the aforesaid land on May 20, 1965. The Executive Secretary of this Board is directed to notify the above landowner by registered mail at least thirty (30) days before said date that the County intends to enter upon and take possession of the said easement on the 20th day of May, 1965. It is the opinion of the Board that the sum of $5,453.00 is the fair value of the easement taken and damages done as a result thereof. BE IT FURTHER RESOLVED, that the Commonwealth's Attorney of this County is authorized to institute the necessary proceeding on behalf of the County to acquire said easement by the exercise of the right of eminent domain and to represent the Board if the landowner contests the manner of said taking.
