1965-02-10 PacketTHIS DEED OF DEDICATION, made this $th day of February , 1965, by and between BROAD ROCK LAND CORPORA- TION, party of the first part, and the COUNTY OF CHESTERFIELD, VIRGINIA, party of the second part, WHEREAS, Broad Rock Land Corporation and John L. Franklin and Louise B. Franklin, husband and wife, are the owners of Lots 31 and 32, respectively, Block J, Section B, Forest Hill Farms, as shown on a map entitled "Map Showing Proposed Rearrangement of Lots 31 and 32, Block J, Sect. B, Forest Hill Farms, Chesterfield Co., Va. ", made by J. K. Timmons, Civil Engineer, dated August 15, 1962, a copy of which map is attached hereto and made a part of this deed, the dividing property line of Lots 31 and 32,being shown on said map as "Proposed Lot Line"; and WHEREAS, Broad Rock Land Corporation and John L. Franklin and Louise B. Franklin, his wife, have petitioned the Board of Supervisors of Chesterfield to vacate a sixteen foot drainage easement existing on Lots 31 and 32, Block J, Section B, Forest Hill Farms, as shown in red on the abovementioned map, a copy of which is attached to this deed, and also as shown on a plat of Forest Hill Farms, Section B, made by J. K. Timmons, Civil Engineer, dated May 12, 1959, recorded October 27, 1959, in Plat Book 11, page 73, of the Clerk's Office of the Circuit Cnurt of Chesterfield County, Virginia, and to relocate the said 16 foot drainage easement so that it lies solely within Lot 31 and along its western property line as shown in blue on the map attached hereto, which vacation and dedication was approved by the Board of Supervisors on January 28, 1965 a copy of said resolution being attached hereto; to and made a part of this deed, to the extent shown in blue thereon, to which reference is made for a more accurate description of the easement conveyed; the easement hereby conveyed being conveyed for and subject to the same terms and provisions of the easement heretofore vacated and which was dedicated by the recordation of the plat of Forest Hill Farms, Section B, made by J. K. Timmons, Civil Engineer, dated May 12, 1959, and recorded October 27, 1959, in Plat Book 11, page 73, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia. Frank Hancock come before the Board advising the Board of the serious epidemic of the Southern Pine beetle now infesting parts of the County of Chesterfield and requested that the Board whenever possible advise the timber owners of the County the necessary remedial action to be taken. Upon further consideration, and on motion of Mr.Goyne, seconded by Mr. Apperson, the following resolution is adopted: WHEREAS, the Chesterfield County Board of Supervisors is vitally interested in the forest resources of the County, and WHEREAS, the County has 225,399 forestland acres or 77% of its total land area in forest, and WHEREAS, the forest resources help to support one of the County's largest industries, and WHEREAS, the pine forests are presently being endangered by a Southern Pine Bark Beetle epidemic, and WHEREAS, this epidemic if unchecked will cause a great loss to forest landowners, the forest industry, and the economy of the County,and WHEREAS, this epidemic can be controlled by cutting and removing all infested pine .trees, NOW TH REFUtiE, BE IT RESOLVED, that the Chesterfield County Board of Supervisors assembled on this loth day of February, 1965, recognizes this serious threat to the economy of the County based on the forest resources, and urges all landowners on whose forest property the Southern Pine Beetle is present, to immediately cut and remove all 'fired -top" trees and all live trees within fifty (50) feet of "red -topped" trees, which may serve as beetle brood trees. There was d .scusscd with Mr. R.V.Lancaster, Resident Engineer, of the Highway Department, the complaint of the Wagstaff Circle Volunteer Fire Department concerning the roughness and bad alignment of Providence Road, between Reams Road and Rt. 653 and Mr. Lancaster agreed to investigate this complaint. -3- �Wv There was received official notification that the following road was accepted into the State Secondary System of roads: Dale Meadows Subdivision: Meadowway Road - from a point on Route 643, 0.24 mile east of Route 856 and running south 0.18 mile to a turn around 0.18 Mi. There was read a letter from Capt. Decatur Jones concerning the re- alignment of Old Gun Road, and it was generally agreed that the Resident Engineer of the Highway Department would make certain improvements at this location. There was read a letter from Pir.J.E.Harwood, Deputy Commissioner of the Highway Department, denying the Board's request to make Rt.653 a Primary road. Mr. Southall and Mrs. Wood come before the Board stating their objections to closing Rt. 1132 east of Route #1 and and stated that they will give the County the right of way requested for the construction of the Allied Research road, provided Rt. 1132 is not closed. Upon consideration whereof and on motion of Mr.Goyne, seconded by Mr.Apperson, it is resolved that this Board requests the Highway Depart- ment to amend its plans to the extent that Rt. 1132 is not closed, since it is apparent that this road serves properties that would be land -locked. On motion of Mr.Goyne, seconded by Mr. Britton, it is resolved that the Board receive the sketches made by the Resident Engineer of the Virginia Department of Highways, concerning the improvements on Rt. 608. On motion of Mr.Browning, seconded by Mr.Apperson, it is resolved that this Board requests the Commonwealth's Attorney to prepare deeds for the acquisition of rights of way for the improvement of Holloway Ave. On motion of Mr.Britton, seconded by Mr.Browning, it is resolved that the Executive Secretary be and he hereby is authorized to ascertain the intentions of the Atlantic CoawtLine RR. Company to enlarge the culverts underneath the ACL. RR. tracks, just northwest of Rt. 10. There arose a discussion concerning the traffic problems at DuPont and the Highway Department was ;-again requeste(dd to cooperate with this Company in an attempt to solve its problem. The County Engineer presents certain recommendations from the Water Committee. Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr. Apperson, it is resolved that the firm of R.Stuart Royer & Associates be authorized to design a five million gallon per day filtration plant on the Swift Creek Reservoir,& . that a 20" transmission main be planned on Rt.360, from Swift Creek eastwardly to Turner Road, and that the Right of Way Department be authorized to -4- offer $5,143.00 to Mir. R. H. Rose for flooding easements on his property on Swift Creek. On motion of Mr.Martin, seconded by Mr.Apperson, it is resolved that the sum of $225.00 be paid to Mr. B.W.Covington for damages to his property and for rights of way easements. On motion of Mr.Britton, seconded by Mr. Martin, it is resolved that approval be given for the plan to provide sewer service from the Kenmore Ridge Treatment plant to the. new School on Forest Hill Avenue, to exercise option agreement according to a letter from E.F.Schmidt, Jr. dated February 1, 1965, which is filed with the Board's papers, to authorize J.K.Timmons to proceed with the development of sewerage treatment facilities in the Kenmore Ridge area and to authorize R.Stuart Royer and Associates to design a sewer main from the School to the plant. On motion of Mr.Britton, seconded by Tvir.Martin, it is resolved that the Commonwealth's Attorney be and he hereby is requested to prepare an acceptance of the Schmidt proposal for sewage agreements in the Kenmore Ridge area. On motion of Nir.Britton, seconded by Mr.Goyne, it is resolved that the County Engineer be and he hereby is authorized to install sewer mains on a portion of Aberdeen Road. On motion of Pair. Goyne, seconded by N1r.Apperson, it is resolved that a contract with the Shell Oil Company for furnishing fire protection from the City of Richmond be and it hereby is approved. On motion of Mr.Martin, seconded by Mr.Browning, it is resolved that a new Pitney -Bowes meter machine be authorized for the joint use of the Treasurer and the office of the CommissL over of the Revenue. 64-913. Mr. James T.Sloan, Jr. comes before the Board requesting the rezoning from Agriculture to General Business (C-2) of a 13.41 acre parcel of land of irregular shape fronting 930 feet on Jefferson DaviatHighway (Rt. #1) and extending westwardly 950 feet, being 4 50 feet south of Rt. 892 right of way and presently zoned for C-2 for a depth of 300 feet, which case had b een d eferred fromJanuary 13, 19659 and states that he now wishes to construct apartment houses on this land. Upon consideration whereof and on motion of Mr.Britton, seconded by Mr.Apperson, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Business with a limitation that the use of the land beyond the 300-ft. presently zoned area be limited to multi -family dwellings and provided further that plans, specifications and layouts be approved by the Board of Supervisors. 65-1. Mr. 11illiam I. Lee comes before the Board requesting the rezoning -5- from Agricultural to eneral Business (C-2) of a triangular parcel of land in Bermuda Magisterial District, fronting 685 feet on Route 620 and extending northwardly 300 feet, being 350 feet south of Route 617 and the Seaboard AirlineRailway, and it was cited that the Planning Commission recommended the denial of this request. Upon consideration of the general residential area and the lack of necessity for business expansion, it is on motion of Mr. Goyne, seconded by Mr. App erson, resolved that this request be and it hereby is denied. 65-2. Mr. R. L.Bates and Mr. J.G.Woodfin come before the Board requesting the rezoning from Agricultural to General Business (C-2) of a 10-acre parcel of land of irregular shape fronting 175 feet on the south line of Route 360, 780 feet on the east line of Turner Road and extending eastwardly approximately 1000 feet to a frontage of 309 feet on the west line of Goode's Bridge Road (Rt.1668) exclusive of Trailer Courts and Junk Yards, in Manchester Magisterial District. It was cited that the Planning Commission recommends approval, except for a buffer strip of 200 feet along the Goode's Bridge Road. The applicants cite that they will up -grade the property.&that they will not put trailer courts, junk yards or dance hall on the property. Mr. W. White raises questions concerning the intended use of the land and the possibility of an adverse effect on the property fronting on Good e t s Bridge Road. On motion of Mr.Britton, seconded by Mr.Goyne, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Business, provided the plans and layout of the improvements be approved by the Board of Supervisors. 65-3. Mr.J.K.Timmons, representing Belmont Hills, Inc. comes before the Board requesting the rezoning from Agricultural to Residential-2 of a parcel of land in Manchester Magisterial District of irregular shape fronting 1480 feet on West Avenue and extending northwardly 2250 feet to Pocoshock Creek, being 400 feet southwest of Turner Road and better known as Belmont Hills. There appearing no one opposing this request and on the recommendation of the Planning Commission that same be approved, it is on motion of Mr.Britton, seconded by Mr.Browning, resolved that the aforedescribed parcel of land be and it hereby is rezoned to Residential-2. 65-4. Mr. Palmer Condrey, representing the Daniel Wayside Furniture Company, comes before the Board requesting the reeoning from Agricultural to Residential-2 of a parcel of land of irregular shape fronting 250 feet on the north line of 11almsley Boulevard and 125 feet on the -vest line of Turner Road in Manchester Magisterial District. It was cited that the County had certain plans for the improvement of the intersection of Walmsley Blvd. and Turner Road. Upon consideration whereof and on motion of Mr. Britton, seconded by Kr.Goyne, it is resolved that a copy of the Highway Departmentts suggested plan of improvement be sent to this firm in an effort to coordinate the improvement of the road with the improvement of the adjacent property. 65-5. Mr.J.K.Timmons comes before the Board, representing Brighton Green Land Corporation requesting the rezoning from Agricultural to Residential- 1 of a parcel of land of irregular shape having anea;stern boundary line -6- 11?of 1750 feet and extending westwardly 1910 feet a western boundary of 1230 feet, beginning at a point 400 feet west of Dwayne Lane and Worsham Road. Also, from Agricultural to Residential-2 of a parcel of land of ireegular shape having an eastern boundary line of 925 feet and extending westwardly 891 feet, being south and cotiguous to the aforementioned parcel, all being a portion of -Brighton Green. There appearing no opposition to this request, and upon the consideration of the recommendation of the Planning Commission for the approval of this zoning request, it is on motion of Mr.Martin, seconded by Mr.Britton, resolved that the aforedescribed parcel of land be and it hereby iz rezoned to Residential-1. 65-6. Mr.J.W.Miller, Jr., representing the Humble Oil Company, requesting the rezoning from Residential-2 to C-2 General Business of a parcel of land fronting 125 feet on Route 10 and extending westwardly 128 feet, being 60 feet south of Horner Lane and presently zoned is-2 for a depth of approximately 80 fedt. It was cited that the Planning Commission recommended the approval of this request, and on motion of N:r.Britton, seconded by Mr.Browning, it is resolved that the aforedescrib ed parcel of land be and it hereby is rezoned for General Business purposes. 65-5U. Mr.William Martin comes before the Board requesting a Use Permit to operate a School of Ballet as an accessory use to a dwelling on a parcel of land fronting 80 feet on Pineway Drive and extending southeast- wardly 185 feed, being 650 feet northeast of Forest hillAvenue, and better known as 2327 Pineway Drive, and cites the fact that a limited program for teaching dancing would be allowed. Mrs. Helen P.Brittle and others present a petition against the requested use*of, this property, citing certain parking problems and the general devaluation of property attendant todanci.ng schools. Whereupon Mr. I'riartin states that in light of the feeling os his neighbors that he withdraws the request. On motion of Mr.Britton, seconded by Mr.Apperson, it is resolved that the withdrawal of the application be and it hereby is accepted. Mr, and Mrs. Anders come before the Board requesting a Variance to allow a dwelling on an acre of land in the rear of Lot 6 of a 5-acre tract in Villa Ridge Farms Subdivision facing Rt.604. Upon consideration of the existing circumstances, it is resolved that this Board grant a Variance from the Subdivision Ordinance to allow the construction of a dwelling on the rear of Lot 6 in Villa Ridge Farms Subdivision, with the understanding that the County assumes no responsibility for the construction of roadways. Lartin, seconded by Nr.Browning, be it resolved by the Board of Supervisors of Chesterfield County, Virginia, that: It is hereby determined that it is necessary and expedient to acquire in addition to the sixteen -foot easement that the county now has on Lots 1 through $, moth inclusive, Block E, in the Sunset Hills Subdivision, the right and privilege during the construction, reconstruction, alteration and maintenance of a sewage disposal system, that the County, its agents and employees shall at all times have full and free ingress to and egress from said easement and right of way over the lands of the owners in order to construct and efficiently maintain and operate said sewers and appurtenances, and shall have the right to inspect, rebuild, repair, improve, relocate, replace, remove, make additions or extensions thereto, and make changes, alterations and substitutions therein, including the right to install additional sewers, in the easement and right of way sought as the County may from time to time deem advisable or expedient, and shall have all the rights and privileges reasonably necessary or convenient for the full enjoyment or use, for any of the aforesaid purposes, of the easement and right of way herein requested. The County shall further have the right to trim, cut and remove all trees, limbs, undergrowth, shrubbery, landscape plantings, of any kind, fences, buildings, structures or other obstruction or facilities on or in said easement which it deems in any way to interfere with the proper and efficient construction, operation and maintenance of said sewage disposal system in said easement; provided, however, that unless hereinafter otherwise agreed, except for trees, limbs, undergrowth, shrubbery and landscape plantings of any kind, the County shall repair, restore or replace any and all facilities located on or in the said easement which may be disturbed, damaged or removed to as nearly as possible their original condition, and shall remove all trash and other debris from the easement all facilities located on or in the said ease- ment which may be disturbed, damaged or removed to as nearly as possible their original condition, and shall remove all trash and other debris from the easement and shall restore the surface thereof to as nearly s possible its original condition. ,Also, during periods of actual construction, operation or mainte- nance activities in the said easement whenever it becomes necessary to use any land of the owners immediately adjoining and abutting said easement, the County shall have the right to make reasonable use thereof. k On motion of Mr. Goyne, seconded by Mr.Apperson, it is resolved that this Board accepts a deed from Mr. and Mrs. John J. McDonald for a 20-ft. widening strip on Rt.620 in the vicinity of the Indian Hills Motor Court. On motion of Mr.Goyne, seconded by Mr.Browning, it is resolved that the request of the County School Board be and it hereby is received: 1. That the County School Board of Chesterfield County,Virginia, doth request the Board of Supervisors of Chesterfield County, Virginia, to take the necessary action for the ordering of an election upon the question of the County of Chesterfield Virginia, contracting a debt in the amount of Ten Million Dollars 4'1010001000)- and issuing general obligation bonds of Chesterfield County,Virginia, for capital school improvement purposes, acquisition of future school sites, and such other school construction as may be required by the actual educational needs in Chesterfield �ounty,Virginia, including facilities for an area technical college. On motion of Mr.Apperson, seconded by Mr.Goyne, it is resolved that the Commonwealth's Attorney be and he hereby is requested to prepare a suitable resolution requesting the Judge of Circuit Court, the Honorable '.'William Old, to set a date for a Bond Referendum, as requested by the School Board. Ox motion of Mr.Browning, seconded by Mr.Apperson, it is resolved that plans for the improvement of the freezer locker plant and conversion for use as a County Garage be generally approved and a sum not to exceed "-r20,000 be spent from the Garage Fund for the improvement of this building. On motion of Mr.Britton, seconded by Mr.Martin, it is resolved that the Commonwealth's Attorney be and he hereby is requested to prepare an amendment to the Zoning Ordinance to make Use Permits for trailers mandatory in all zoning districts of the County, except in R-1 and R-A in which trailers are not permitted. It is here noted that Mr.Goyne votes "No". BRITTON, DIRECTOR OF PROGRAMMING AND PLANNING IN REPLY PLEASE REFER TO Chesterfield County - Route 147 Request for Primary Road Extension This is in reference to resolution adopted by the Board of Supervisors of Chesterfield County on November 10, 1964, asking for the extension of Primary Route 147, southwardly across Route 60 and along Route 653, or a new right of way to Route 360. The request of the Board was forwarded to us by Mr. L. R. Treat, Jr., on November 18, and we immediately initiated a study of this request. As a result, we do not feel that this extension meets the criteria for inclusion in the Primary System at this time. As you know, the Commission evaluates requests for additions to the Primary System on a1*i.e-point criteria. In this particular case, the requested extension meets only three, or possibly four, of the nine. As you may also know, a study of the Richmond Metropolitan area, including Chesterfield County,' is now under way as a part of the continuing transportation study of the Metropolitan area. I am sure that consideration will be given to this routing during the course of the study. In fact, this was one of the locations that was considered for an outer circumferential highway by the Department a few years ago. After the results of the Consultants$ study are known, we will then be in a better position to take another look at this request, and we will be glad to do so. This entire matter was discussed with the State Highway Commission at its meeting on January 21, action was taken by the Commission at that time. Thank you for your interest in this route. We have endeavored to get the cooperation of the railroad is planning for this as shows by the attached file. Mr. Pregaall acknowledges our letters very courteously, but from where we stasd it appears that his office has more pressing matters aad is letting our problem rest. Mr. painter is a letter Nov 6 1961 stated that a culvert u&der the RR should have 50 sq ft of opening. Our engiaeerB calculate that for the acreage is this basis there should be at least 90 aq ft aad recommended a trestle which would take care of that sad more. It is the thought of the writer that it might be of help to the county is its defense of theannexation suit by the city if the county ware to get the drainage problems in the area close to Richmoad solved before the courts coasider the case.The. eousty is largely self -Buff iciest sow is the matter of water and sewers.
