t Present: VIRGINIA: At a regular meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on January 13, 1965, at 9:OOa.m. Mr. Irvin G. The Exec uti ve Secretary asked for nominations for the office of the Chairman of the Board of Supervisors. Nir.Britton states that the County faces major problems and needs an experienced leader as Chairman and nominates Mr. Irvin Horner. Mr. Martin seconds Mr. Horner's nomination. TAX. Goyne states that it is appropriate to elect a Chairman on seniority basis and nominates r..r.R Dymond Britton. Mr. Apperson seconds Mr. Britton's nomination. Mr. Britton states that he appreciates the gesture, that he could tie up the Board by voting for himself, but he wants to serve the best interest of the County at this time and states that he will continue to support Plir.Horner. Mr. Martin compliments Mr. Goyne on his good services in the past year. On motion of Mr.Browning, seconded by Mr.I�'Lartin, it is resolved that the nomination be closed. A vote taken on the applicants, shows that Mr. Goyne and Mr. Apperson vote for Mr.Britton. Mr.Britton, Mr. Martin and Mr.Browning vote for Mr. Horner. 19hereupon Mr. Horner is elected Chairman of the Board. Mr.Goyne states that he holds no animosity for any member of the Board and congratulates I`r.Horner warmly. Mr. Horner states that he accepts the gavel humbly and sincerely and promises to do the best job possible. On motion of Ar.Browning, seconded by Mr.Apperson, it is resolved that Nir.Goyne be and he hereby is appointed Vice -Chairman. On motion of Mr.Goyne, seconded by Mr. Apperson, it is resolved that the minutes of December 29, 1964 be and they hereby are approved. On motion of Mr.Goyne, seconded by Mr. Apperson, it is resolved that to light of the Attorney General's opinion concerning the rights of the County in forcing citizens to connect to the County -owned water system and upon the advice of the Commonwealth? s Attorney, that Mr. A.W. Flippo be allowed to install his own well to serve a trailer court, just north of Colony Inn, provided said well be approved by the Health Depth On motion of Nir.Goye, seconded by Mr. Appersoi it is resolved that the following standard water contracts . be and they hereby are approved: A-362 - Motor Freight express $1335.35 AR-367- Cornwallis Court 4788.00 On motion of Yx.Britton, seconded by Mr.Apperson, it is resolved that the request of Ivirs. W.L.Funai for the connection of two (2) houses on one(1) meter at 025 Hey Ropd be and it hereby is approved under the extenuating circumstances prevailing, provided that neither house can be sold and that two minimum bills will be charged each month. On motion of Mr.Britton, seconded by Iv:r. Apperson, be it Resolved, that the Board of Supervisors of the County of Chesterfield,Virginia, in regular meeting assembled that the Chairman of said Board, bef and he hereby isi authorized to enter into an agreement with the Atlantic Coast Line Railroad Company, and to sign same on behalf of said County,whereby said Railroad Company grants unto said County the right or license to install and maintain for the purpose of conducting water$ a line of 24-inch reinforced concrete pipe across the right of way and under the tracks of the Railroad Company near Richmond,Virginia, at a point 1,267.5 feet southeastwardly measured along the center line of the Railroad Companyts east track (being the former northbound main track of the Railroad Copany) from Itiiile Post 2; as more particularly described in said agreement, which agreement is dated October 30, 1964, a copy of which agreement is filed with this Board of Supervisors. On motion of Nr.Britton, seconded by Mr.Apperson, it is resolved that Contract S-65-TD for the installation of sewers in Cornwallis Court be and it hereby is approved. On motion of i,,r.Britton, seconded by Mr.Coyne, it is resolved that Sewer Contract 6102-13A in the amount of $40,195.80 be awarded to the Van Doren Construction Company who submitted the low bid on the use of concrete pipe to install sewers on Rt. 161. On motion of Ivir.Goyne, seconded by Mr.Apperson, it is resolved that the request for a reduction in connection rates for water and sewer services to the new Chester Community Center be received and the sewer connection cost be set at $200.00 and the water connection cost fee be set at the actual cost of connection. There was presented a petition from certain residents of Cooper Road requesting sewer wervice from the existing treatment plant as soon as possible. Upon consideration whereof, and on motion of Mr.Britton, seconded by P•;r. Browning, it is resolved that the County Engineer be directed to install a sewer line on Cooper Road if same is financially feasible and acceptable to the Water Control Board. On motion of Mr.Goyne, seconded by P1r.Apperson, it is resolved that the Chairman of this Board, lair. Irvin G.Horner, be, and he hereby is authorized to sign such application and other documents on behalf of this Board, and to do any and all acts necessary and proper in connection with the application of a Federal Aid Grant to aid in the construction of the sewer system in Chesterfield County, There was read a letter from Nr. R.V.Lancaster III, Resident Engineert concerning a request for a crossover on Route k1, between Drewry s Bluff Road and Elliham which request was not allowed by the Highway Department. There was read an official notice from the Highway Department that the following roads were accepted into the State Highway Secondary Road System: Hylton Park Subdivision: Ravenscroft Drive - from the intersection of Routes 1793 and 1792 and running southwardly 0.09 miles to Littleford Lane 0.09 Mi. Haverford Lane - from Ravenscroft Drive 0.09 mile south of the intersection of Routes 1792 and 1793 and running east 0.28 mile to turn around 0.28 Mi. Reykin Drive - beginning at the end of maintenance of Route 1461,0.18 mile north of Route 647 and extending northwardly 0.14 mile to Haverford Lane, 0.06 mile west of turn around 0.14 " There was read a letter from Mr. James Sowers concerning the traffic situation on Belt Boulevard from Rt.60 to Rt.360. Upon consideration whereof, and on motion of I,1r.Apperson, seconded by Mr.Britton, it is resolved that the Eatecutive Secretary be requested to write to the Traffic and Planning Division of the Highway Department concerning the complaint of Mr. Sowers and present the suggestion that an early completion of Rt . 892 would benefit this road immeasurably. -3- On motion of 1� r.App ;on, seconded by i,,r.Brittc it is resolved th�it this Board approves the supplemental agreement th the Seaboard Airline Railroad to allow the tunneling of said Railroae at- a point 311 feet north of 1-_ile Post 7, just south of Falling creek to facilitate the installation of sewers on Coptrzct S-64-17D. On motion of 1,,r.Pviartin, seconded by Air. Apperson, it is resolved that the resident Engineer of the Highway Department, be requested to investigate the intersection of Robious Road and Rt.60 to ascertain hos this inter= section can be improved. On motion of IVr.Britton', seconded by PAr.Apperson, it is resolved that this Board request the Highway Department to put gravel on the Adler Road and charge same to the 3¢ Road Fund of the County. I�r.Goyne notes that Winfree Street, from Rt. 10 to its southern end is narrow and unkept in certain portions. On motion of PIr.Goyne, seconded by Mr.Apperson, it is resolved that the following appropriations be and the same are hereby made for the month of February, 1965, from the funds and for the functions or purposes indicated in the amount of $2 , 059, 011.00. There was received a petition signed by some 25 people requesting a wtreet light at the intersection of Hathaway and Shawnee Roads,and it was cited that the Light Committee had already viewed this location, Upon consideration whereof, and on motion of 1�11r. Britton, s:econd ed by Mr.jipperson, it is resolved that the street light be approved at the intersection of Hathaway and Shawnee Roads. There was received a notice from the Overnight Transportation Company that the 13tate 'corporation Commission would consider their request for certain franchise certificates of public convenience and necessity as a Common Carrier over certain roads in the County, which notice is received and filed with the Board's papers. On motion of Mr.Goyne, seconded by 1,r.Browning, it is resolved that this Board recommends to the Judge of Circuit Court, the Honorable William Old, the appointment of Nir.Edgar P.Gill as Chief of Police of Chesterfield County, to take effect February 1, 1965. There was presented a request by Mrs. Don Hodgins for a Variance from the County's policy of not granting building permits on unimproved roads. Upon consideration whereof, and on motion of Yr.lkiartin, seconded by Mr. Britton, it is resolved that the Building Inspector be authorized to issue a building p ermit on the northwest corner of the intersection of A Street and Willis Road, provided 1�irs. Hodgins and others build 200 feet of A Street to meet the minimum requirements of the Highway Department. There was received a request from the School Officials for an appropriation of $718.16 for the payment of two signal lights for Manchester High School and for Falling Creek Elementary School. Upon consideration whereof, and on motion of N,rApperson seconded by Mr.Britton, it is resolved that the sum of $71K16 be alpropriated from the General Fund of the County to Item 19-403 in theSchool$udget for the gaayment of these lights. On motion of Mr.Apperson, seconded by Nir.Browning, it is resolved that the ExecutiveSecretary make the necessary arrangements so that the Board may view a data processing operation to ascertain how the 'County may handle its accounting iaork more efficiently. On motion bf Mr.Goyne, seconded by Nir.N'artin, it is resolved that the Executive Secretary contact an applicant concerning the employment as the Central Accountant. On motion of R,.r.Goyne, seconded by Mr.Browning, it is resolved that Contract No.332 for the installation of sewers in the subdivision of Falling Creek Court in the amount of 1`,7571.25 be and the same is hereby approved. 64-905. Mr. Lewis Ni. 'alker comes before the Board requesting the rezoning from Industrial (NI) to Remidential-2 of a parcel of land of irregular shape fronting 1500 feet on the South line of Dupuy Road and extending southwardly along the east line of the A.C.L.Railroad right of way 1100 feet, and extending eastwardly and southwardly approximately 700 feet, being the proposed subdivision of College Park, id Matoaca Magi sterialDistrict, and it was cited that the Planning Commission recommends that the N1 zoning be changed to R-2 for the entire tract, except the remainder of the triangular parcel owned by Mr.Walker should be rezoned for C-1. Mr. Walker states that he is in favor of the C-1 zoning on approximately 5 acres at the intersection of DuPuy Road and Davis Road. -6- Nir.`rlilliam M.Bennet asked about the jzuarantee f such rezoning to C-1 _ After considerable discussion of this proposition, it is on motion of Iv.r.Browning, seconded by Mr.Apperson, resolved that the aforedescribed parcel of land be anit it hereby is rezoned to R-2, subject to the receipt of the request for C-1 zoning with an R-2 or a conditional zoning for multiple family buffer strip, and provided further that the water and sewer system will be installed and given to the County according to the County's policy. It is here noted that the applicant agrees to the stipulation of this zoning. All vote Aye. 64-91S. This being the date and time set for the request ofir.James T. Sloan, Jr. for the rezoning from Agricultural to GeneralBusiness in I,1anchester Magisterial District of a 13.41 acre parcel of land of irregular shape fronting 930 feet on Jefferson Davis Hwy. (Rt.l) and extending westwardly 950 feet, being 450 feet south of Rt.892 right of way and presently zoned C-2 for a depth of 300 feet. There appearing no one either for or against this rezoning request, it is on motion of Lr.Britton, seconded by Nlr. Goyne, resolved that this matter be delayed to February 10, 1965. 64-923. Mr.R.H.Thurston comes before the Board requesting the rezoning in Dale Magisterial District, from Agriculture to General Business (C-2) of a parcel of land of irregular shape, fronting 125 feet on Beulah Toad (Rt. 641) and 820 feet on the south line of Kingsland Creek, its western boundary 3(,0 feet in length, said parcel being approximately 1300 feet north of the intersection of Routes 641 and 642. It was cited that the Planning Commission recommends the request be reduced to that of a Use Permit for the operation of an oil business. Upon consideration whereof, and on motion of Air.Apperson, seconded by Mr. Britton, it is resolved that the recommendations of the Planning Commission be and the same hereby are approved and the Use Permit is valid only as long as ownership of this property stays with Mr.Thurston or his heirs or assigns. It is here noted that Mr. Thurston agrees to the stipulation of this request. All vote Aye. 64-93S. Mr. P.L.Travis, J#. requests the rezoning in Manchester Magisterial District, from Residential -2 toGeneral Business (C-2) of a parcel of land fronting 70 feet on Belt Boulevard and extending 300 feet northeastwardly, being 400 feet southeast of the intersection with Brandon Road,,and there appearing no one in opposition to this request and upon the recommendation of the Planning Commission for approval, it is on motion of Mr.Britton, seconded by Mr.Browning, resolved that the aforedescribed parcel of land be and it hereby is zoned for General Business, provided proper sewer easements are granted to the County for the installation of sewers in this area. All vote Aye. 64-945. �`ir.R.C.Dawson, et als, come before the Board requesting the rezoning in Bermuda Magisterial District, from Agricultural to Residential-2 of a 33-acre parcel of land of irregular shape fronting 1700 feet on Bermuda Hundred Road CRt. 618) and extending northeastwardly approximately 1100 feet, bein: 500rfeet northwest of the intersection of Routes 618 and 696, and there appearing no one in opposition to this request, and the Planning Commission havin. recommended its approval, -7- it is on motion of Mr.Goyne, seconded by NMr.Apperson, resolved that the aforedescribed parcel of land be and it hereby is rezoned for Residential-.2 purposes. All vote Aye. 64-95S. Mr. M.11.Hawthorne comes before the Board requesting the rezoning from Agriculture to Residential-2 in Nianchester Magisterial District, of a parcel of land of irregular shape, fronting 950 feet on Walmsley Blvd. and extending southeastwardly 960 feet, being 4240 feet southwest of the intersection of Turner Road Route 650, and -,almsley Boulevard, and the Planning Commis don recomm nds the approval of this request. Upon consideration whereof, and on motion of 1,ir.Britton, seconded by I,X.Apperson, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned for Residential-2 purposes. All vote Aye. 65-1U. Lr.William Drake and 1,4r. Plann of the Mann Realty Company come before the Board requesting a Use Permit in Midlothian Magisterial District, to construct and operate a Radio Tower on a parcel of land of irregular shape, fronting 600 feet on Route 624 and extending eastwardly 382 feet, being approximately 1020 feet south of Route 60. Mr.Drake explains that the Tower of this Radio Station will be 400 feet high, 175 feet from Rt.624. Mrs. Jones states that her husband is opposed to the Tower on this property as it will devalue their property across the road.. Upon consideration whereof, and on motion of Mr. I,lartin, seconded by Mr. Browning, it is resolved that this rm tter be delayed until January 28, 1965. 65-2U. Mr. James E.Pennington comes before the Boards requesting a Use Permit to operate a printing shop in Manchester Magisteriat District, Bn a parcel of land fronting 80 feet on Sunbury Road and extending east- wardly 125 feet, being at the intersection of Clarkson Str$et and Sunbury Road and better known as 1531 Sunbury Roads and states further that he will erect no buildin�,s nor use signs in this area. I- ra. E.C.Beasley states that she does not think that the request for a Use Permit would be granted because once business has entered the area the complexion of the entire area may be changed. Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr.Martin, it is resolved that the Use Permit on the aforedescribed parcel of land be and the same is hereby granted, provided there will be no noise, signs, nor new buildings and it be limited to the present utility room in his home. It is here noted that the applicant agrees to the stipulation of this zoning. All vote Aye. 65-3U. Mr.F.J.Wright comes before the Board requesting a Use Permit to operate a welding shop in Manchester Magisterial District, in an existing garage on a parcel of land fronting 75 feet on Southall .venue and extending westwardly 150 feet, being 90 feet south of Gregory Avenue and better known as 3306 Southall revenue, stating further that he will put blinds over his garage windows so that no one can see the lights of the weldinE machine. Mr, and Mrs. R.T.Day and Mrs. Taylor and others, come before the Board stating that T%r. Wright has not been a good neighbor, that the business that he has been conducting is very objectionable. Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr.Goyne, it is resolved that this request be and it hereby is denied. All vote Aye. so 65-4U. Mr. R.P.Sowers, representing Mr.R.J.Firestone comes before the Board requesting a Use Permit in Manchester Magisterial District$ to operate an office in an existing building on a parcel of `'land of irregular shape fronting 101 feet on Broad Rock Road (Route 10) and extending northeastwardly 650 feet, being 520 feet southwest of Ki nsley Avenue. There appearing no one to oppose this request, it is on motion of Xlr.Britton, seconded by Mr; Goyne, resolved that a Use Permit to operate an office in an existing building on the aforedescri).�ed parcel of land be and it hereby is approved; &r. J. B.Cephas and Mr. James Watlingtoh come before the Board representing the Virginia State College requesting the closing of certain roads that seem to interfere with the growth of the College grounds and present further plans for relocating said roads and the construction of several large buildings. After considerable discussion of this request, it is on motion of 1v':r.Browning2 seconded by Pfir.Britton, resolved that an Ordinance to vacate a portion of Fourth Avenue and Boisseau Street is hereby introduced and the Clerk of this Board is directed to cause notice of a public hearing to be held on its adoption in accordance with :section 15.1-82 of the Code of Virginia. On motionof Mr. Martin, seconded by Mr.Britton, it is resolved that an Ordinance to vacate a portion of Twin Valley Road and certain easements in the subdivision of Twin Valley Farms is hereby introduced and the Clerk of this Board is directed to cause notice of a public hearing to be held on its adoption in accordance with Section 15.1=$2 of the Code of Virginia. Mr.James Rose comes before the Board requesting additional employees to further the work of his department, citing the fact that the County is growing to the extent that additional employees seem necessary. On motion of Mr.Apperson, seconded by Mr.Browning, it is resolved that this request of the Assessor be studied further. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that the Chairman and Clerk,of this Board be and they hereby are authorized to sign the Federal Statement of Compliance with the nondiscrimination policy expressed in Title VI of the Civil Rights Act with regard to Federally Assisted Sewer Programs. On motion of Mr.Goyne, seconded by the entire Board of Supervisors, it is resolved that this Board authorizes the sum of $225,000 to be given toward the construction of a Technical College, provided the same be placed in the general vicinity of Bermauda Hundred, and to complete such application forms as are necessary to make the State aware that the need exists in this area and the people in the general locality approve of this location. Gates Commonwealth's i,ttorney for Chesterfield County a Chesterfield, Virainia�' My dear Gates: This is in reply to your letter of January 6, which reads as follows: "Chesterfield County is operating a k water supply system under the authority of:A= Chapter 175, Acts of 'ssembly, 1946, and amend- ments thereto. The net revenue derived from the operation pays for the cost of the system and its operation and is not supported by general taxes of the County. "If a landowner owns property adjacent to such water system and desires to supply his residence or business property with water from ak`we1l. approved by the State Health Department, can the County require him to connect to the County public water distribution system? The property owner is not subdividing his property under the subdivision regulations of the County." x Chapter 175 of the Acts of Assembly (1946) does not corn -in any provision conferring upon the county the power to i force abutting property owners to connect with any water system which may be established under said Chapter. Your letter states,,,t., that the county of Chesterfield is operating under thish�3 and "amendments thereto." We have been unable to find any k e 4 Honorable Ernest P. In the absence of a provision in i the Act giving the governing body of the county the power to require property owners to connect with the system, I am of the opinion that this question must be answered in the y negative.` A statute containing a provision of this nature is found in Chapter 523 of the Acts of Assembly (1948), which established the Vieber City Sanitation District in Scott County. In the case of Weber City Sanitation Commission v. Craft, �a 196 Va. 1140, this provision was considered by the Supreme u Court of Appeals of Virginia, as Craft had challenged its con- stitutionality. Goyne, Chairman of the Board of Supervisors, and Dave Welchon, field engineer for the county, in regards to a sewer hookup and water, hookup for the Community Center Building of Chester. To give you a little background about this project, the land was donated by Mr. C. J. Purdy, the building you saw this morning, which is 581 wide by 86" long, approximately 5000 sq. ft. of floor space, was recently appraised by a local bank to be worth $25,000 in its present condition, and is 95% complete, has been constructed with free labor, some free materials, others at a reduced cost and brought to its present stage for $6800.This money was contributed by local civic clubs and individuals. There is a great need for this building in Chester, and we are very anxious to complete it as soon as possible. Therefore, we are making formal application to you for the sewer hookup and water connections. As we explained to you and Mr. Goyne,this morning, we are out of funds at the present time, and while we have the building this near complete and with the sewer line being installed in Chester now, we would like to go ahead and complete the project. Roanoke Construction Company, who is installing the sewer line in Chester, has agreed to open the ditch for us for both lines, and we fedl.we can purchase the pipe rather reasonable. Roanoke's men will install for us as a contribution. Since this is a community project, being done as economically as possible and built for the taxpayers of Chester and Chesterfield County, we are requesting, if at all possible, the fee for hookup charges to the sewer and water lines be waived. If this can't be done, we would appreciate as much time as possible allowed to pay this after installed, but we would like permission to install immediately, since Roanoke Construction is working right in front of the building. That W.S. Carnes be granted a building permit to construct a house on a parcel of land containing .6958 acres at the intersection of Edgemere Boulevard and Monza Drive. The background information con- cerning this request is as follows: Several years ago, Meadowbrook Country Club requested the Meadowbrook Estates Corporation to exchange certain land along their common boundary. When the Meadowbrook Golf Course was constructed, No. 7 green was located almost on the property line of the Country Club. In order for this hole to continue to be used, it was necessary that the Club acquire a 70-foot strip of land parallel to No. 7 fairway and green. The Meadowbrook Estates Corporation was happy to cooperate with the Club and several months ago the :exchange of property between the two corporations took place. The Club was deeded the 70-foot strip and, in turn, two parcels of land were deeded to the Meadowbrook Corporation by the Club. When the exchange took place it was in accordance with the tentative plan of subdivision approved by Chesterfield County Planning Commission for the Meadowbrook Estates property. An 80-foot strip was allowed for the future extension of Edgemere Boulevard. At the time the Club conveyed the two parcels, no one interpreted this transaction as a violation of the subdivision ordinance. However, by a strict interpretation of the subdivision ordinance, County officials now feel that this transfer probably violated it. n M Mr. Melvin Burnett 2 - January 8, 1965 Since this property was conveyed to Meadowbrook Estates in two parcels, Meadowbrook Estates then offered Parcel A for sale to Mr. Leo Porisbky, who is Plant Manager at Allied Chemical Corporation. Mr. Porisbky chose this parcel and contracted with Mr. Carnes to build a home costing $45,000.00. I believe everyone would agree that the house will be a valuable addition to Chesterfield County, the Meadowbrook Country Club, and the entire community. Mr. Porisbky is anxious to complete the house and neither he nor Mr. Carnes had any idea that the parcel could not be built on. Meadowbrook Estates is now preparing Section D for recordation. They would be happy to covenant with the County that Section D will be recorded as soon as is practical and that when the section is recorded, both parcels of land deeded from the Club will be shown on the subdivision plat. Furthermore, the street in front of the lot Mr. Porisbky has contracted to buy will be widened to 50 feet. I can assure the Board that granting this request will in no way adversely affect the orderly development of the community and that the situation arose because of a genuine misunderstanding of the full scope of the subdivision ordinance. We had been instructed by the architects to begin work on January 13, 1965. We have made the necessary arrangements to do so, but recently have been advised that there may be a delay due to certain procedures necessary to the closing of the road running through the proposed building site. We have made considerable rearrangements in our personnel to be prepared to start this project on the date indicated. Any significant delay will bring on some difficult problems with supervisory personnel we have hired to properly man this project, in that we have no other specific work awaiting them at this time. We would greatly appreciate any efforts that might be exercised to expedite the early approval of the road closing so that the work may proceed.
