VIRGINIA: At an adjourned meeting; of the Board of Supervisors of Chesterfield County, held at the Courthouse on September 24, 1964, at 2:00 p.m. Present: Mr. H. T. Goyne, Chairman Y-r. Irvin G.Horner Mr. R. J. Britton Mr. H.O.Browning Mir. J.Ruffin Apperson Mr. A. R. Martin On motion of Lr. Apperson, seconded by Pir. Browning, it is resolved that %the minutes of September 1964, be and they hereby are approved. There appears a delegation of citizens requesting the Board of Supervisors to take the necessary steps to establish a library system in the County, and not to allow the matter to be voted on in the forthcoming election. Mrs. D.�,T. Murphey, Mrs. Harvey Maguigan and others speak for the group. Upon consideration whereof,1-x. Brittoh moves, that since the petition signed by 600 I;eople has been received by the Board of Supervisors and since it has been certified by the Treasurer that at least 100 taxpayers have signed said petition, that the Board has no alternative other than to ask the officials of the election to submit this question in the General election. This motion is seconded by Mir. I,lartin. Upon further consideration, Mr.Goyne makes a substitute motion, that the Board set up a library system and appropriate the necessary amount to implement the library plans, which motion was seconded by Mr. Partin. "Ihereupon P,_r. Britton withdraws the original motion. Upon further consideration, Mr.Browning makes a substitute motion, that the Board should 1we the entire feeling of the County's citizenry, which opinion could only be gained by the results of a Referendum and again moves that the question be submitted to a vote of the people. This motion was seconded by Air. Apperson. Mr. Ernest Gates, Commonwealth's Attorney, points out that should the Referendum on the question be approved that the Court would appoint the Library Board and should the Board of Supervisors establish a Library system without the demands of the Referendum, that the Board of Supervisors could appoint the Library Board. Whereupon the second substitute motion was withdrawn and a vote being taken on the first substitute motion to establish a library system, all vote Aye except P�ir.Browning who votes Nay. Pair. Laramore of the Laramore Construction Company comes before the Board seeking certain redress for claims for liquidated damages for the installation of sewers under Contract 6102-19. It was cited that Mr. Laramore was 87 days late of whic# 27 days exemption had been recommended by the consulting engineers. Upon consideration of M M Mr. Laramore's request, Mr. Browning moves that the Countycollect for the 60-day delinquency at the special rate of '$25.00 per day, plus the cost of inspectors' time on this job. This motion was seconded by Nr.Apperson. A vote being taken Mr. Browning, Mr. Apperson and Mr. horn er vote Aye. Pr. Goyne, Mr. Nartin and N;r. Britton vote Nay, and the vote is tied. Whereupon, on motion of 1,1r.Apperson, seconded by Mr.Martin, it is resolved that the former motion be and it hereby is rescinded. All vote Aye. On motion of Nir.Apperson, seconded by Ivir.1viartin, it is resolved that this Board requests the Commonwealth's Attorney to review the contract with the laramore Construction Company and advise the Board as to its rights under the contract. Ivr. W.W.Herring comes before the Board complaining of the number of lots turned down by the Health Department in :Section "B", Jessup Farm Subdivision, and asked th,,t he be permitted to build on the majority of lots in Section} "B" and that he be given the privilege of bringing water from Belmont Farms Subdivision to this Subdivision. It was cited that there was an insufficient volume of water in the Belmont Farms area and if this subdivision is to be served water should be obtained from the connection with the Trampling Farms Subdivision. On motion of Yr.Apperson, seconded by Nir. Browning, it is resolved that this Board requests 1tiir.Herring to work with the Health Department, Planning Commission and the Engineering Department in the development of the subdivision of Jessup Farms. Mr.Clifford `Vest comes before the Board again requesting some considera- tion on the deep ditches on both sides of Rt4608 and it was cited that the Board had viewed this property earlier in the day and a serious question exists as to the necessity of the dimensions of the dithces on both sides of this road. It was generally agreed that the Executive Secretary meet with the Highway Department to ascertain the reasons for such a condition. The County was notified that the following list of roads were taken into the State Secondary System: Roads in Cedar Grove Farms Subdivision, Ballard Oaks, Hollyberry Hills, Section -'A", Conner Heights, Holiday Hills,Section 2; Barleth Heights, Bradley Hills, Temple Terrace, Section "A", Bruce Farms, jection 3, Falling Creek Farms, Lake Crystal Farms, Chester, Section "M", Traylor Estates, Section "F'T, Dorchester Section "F", Southam, Deerbourne, Quail Oaks, Section C", Brighton Green,Section 5, Kin Rey,Section 9,A", Northlake Hills, Cardwell Road, Searcy, Section 4, Cherry Gardens, Southam Subdivision, Section 3, Jean Court Subdivision. It was generally agreed that Mr. Goyne would seek the cooperation of the Lay Committee in investigating the needs for new schools and to keep the Board of Supervisors informed insofar as possible. -2- A letter from Mr. U.B.Ellis was read to the Board which letter proposed the acquisition of lands between Ribrerside Drive and the James River for recreational purposes. It was generally agreed that the Executive Secretary would *,rite to Px.Ellis explaining this situation. On motion of P,r.Martin, seconded by Mr.Britton, it is resolved that Contract #149=A for the installation of water in the Branch's Shopping Center in the amount of .?1012.50 be and it hereby is approved. On motion of Mr.Britton, seconded by Mr.Horner, it is resolvee that the Special Water Contract A-352 for the installation of water on Rock Crest Road in the amount of ,"951.00 be and it hereby is approved. On motion of Ivir.Apperson, seconded by Mr.Martin, it is resolved that Contract NO.AC- 315 for the installation of water and gas to the Park Lee Apartments involving a total of 9"231274.$5 be and it hereby is approved. On motion of Pir.Browning, seconded by Mr.Britton, it is resolved that Yater Contract A-1976 for the installation of water in Bruce Farms be and it hereby is approved, subj ect to the receipt of r604400. On motion of Mr.Apperson, seconded by Nir.Browning, it is resolved that the County Engineer be and he hereby is authorized to award to the lowest and best bidder on Contract AC-353 for the installation of a water line from Route #1 to the Walthall Interchange to serve the Allied Chemical Research building. On motion of I1r.Apperson, seconded by 11ir.Browning, it is resolved that this Board authorizes Shoosmith Bros. Inc. to clear the adrift Creek Reservoir to an elevation line of 176 feet. There arose a discussion on the acquisition of easements from Mr. Leo Tolker in the Forest View and Raleigh Court Subdivisions. Upon consideration whereof and on motion of Mr.Britton, seconded by Mr.Browning, it is resolved that the Right of `lay Engineer be authorized to offer $200.00 for this right of way. On motion of A-r.itiiartin, seconded by 141r.Apperson, it is resolved that application be made to the Federal Government for Federal Aid in the installation of a sewerage system in the Powhite Creek area, 4nd the Chairman and Clerk are hereby authorized to sign said application, WPC-VA-204. On motion of Nir.Britton, seconded by ihir.Browning, it is resolved that the sewer connection charge on Lot 4, Block K, in the subdivision of Marlboro be $500.00 if the sewer is connected to Lancers Boulevard or w300.00 if the sewer is connected to Wimbledon Drive and said connection be made at the owner's option. -3- swo, On motion of Nir.Niartin, seconded by I,ir.Britton, it is resolved that this Board vacate the easement signed by Mr.Perkins for the installation of seviers in the Powhite Creek area, provided he will sign a new easement and pay the cost of recording. On motion of Mr.Browning, seconded by lvir.Britton, it is resolved that Route 1144 be and it hereby is named Pine Forest Drive. On motion of Mr.Martin, seconded by Mr.Browning, it is resolved that the Police vehicle rules and regulations as set out in the memorandum of Chief Gill, be, and they hereby are approved. On motion of Mr.l artin, seconded by Mr. Browning, it is resolved that this Board will pay the cost of airline travel for Mr.James Rose to attend the International association of issessing Officers' Convention in LosAngeles. On motion of Mr.Britton, seconded by Mr.Apperson, it is resolved that the following erroneous tax claims be and they hereby are approved: Pretty H.Lybron Tax on real estate t�12.44 Warwick Road Corneal Lens Laboratory, Inc . 7225 Jefferson Davis Highway Wholesale merchants License $30.00 Rev.J.J.Harris TWarwick Road Real Estate tax 36.96 Rev. J.J.Harris Real Estate Tax 6.16 Eldridge E.Earks Refund Co License 3.50 On motion of Nir.Apperson, seconded by Mr.Browning, it is resolved that consideration of the Richmond Area Psychiatric Clinic be deferred to October 14, 1964, meeting. On motion of Wir.Apperson, seconded by Nir.Niartin, it is resolved that a telephone and extension be authorized for the Clerk of Circuit Court to facilitate the registration of voters. There arose a discussion as to the feasibility of inistalling facilities in the proposed County's lunch room, which facilities would perhaps offer some competition to the proposed restaurant recently planned in the Courthouse area. On motion of Mr.Apperson, seconded by I,.r. Browning, it is resolved that the plans be amended to include the necessary roughing -in of utilities so that at some time in the future light lunches could be served. Write usual resolution requesting the State Highway Department to accept Hill Road in Cavalier Court and Hill Drive in Ampthill Gardens, into the State Secondary System. -4- 0 M On motion of Mr. Apperson, seconded by Nir.Britton, it is resolved that a building permit be issued on a lot fronting on that part of Omo Road recently requested to be taken into the State jecondary System of roads as a Rural Road. On motion of Nir.Apperson, seconded by Mr.Martin, it is resolved that the highway Department be and it hereby is requested to take into the Secondary System of roads, .3 of a mile, the extension of Rt.8$2, as a Rural Road. On motion of Mr.Apperson, seconded by Mr.Tartin, it is resolved that this Board give the Chester Fire Department three pieces of steel for the construction of a new fire department, which steel is to come from the supply on hand at the Courthouse for the construction of a portion of the Stadium; provided the Commonwealth's Attorney will agree to the legality of this donation,, WHEREAS, the Laruw Brothers Tobacco Company in locating a tobacco Processing plant at the end of Rt. 1612 extended, and 'W'HEREAS, a ramp off of the Toll Road would facilitate to a great degree the flow of traffic into the plant, NOW, THEREFORE, BE IT RESOLVED, on motion of Mr.Goyne, seconded by Mr. I�,artin, that this Board of Supervisors requests the Richmond -Petersburg Toll Road Authority to allow the Larus Bros. Tobacco Company to construct an off -ramp from the TollRoad,approximately one mile south of the Falling Creek Interchange, which ramp would connect to a public right Of Way to Rt. 1. Such a road would be of great value to that traffic on the TollRoad from the north to the Bellwood Depot and other areas. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that the matter of installing a flag pole be and it hereby is referred to the Buildings & grounds Committee. On motion of Mr.Apperson, seconded by Mr.Britton, the following resolution is adopted: WHEREAS, W.S.Carnes is the owner of Lot 5 and part of Lot 6, on the Plan of Beechwood,Jection "All, dated August 14; 1961, made by J.K.Timmons, Civil Engineer and Surveyor, and recorded in the Clerk's Office, Circuit Court of Chesterfield County,Virginia, in Plat Book 12, Pages 5$ and 59; and, WHFIRS, Beechwood, Incorporated was the original subdivder of said property and dedicated certain alley easements on said subdivision plan; and 1HEREAS,Stevd Ferrence, Jr. has a contract to purchase from W.S.Carnes a portion of Lots 5 and 6, Block H, Beechwood Section TTATT, all of which is shown on a plat of survey made by J.K.Timmons, Civil Engineet and Surveyor, dated September 4, 1964, a copy of which is attached to and made a part of the Petition for Vacation, said portions of Lots 5 and 6, and the alley easement thereon being shown as shaded areas; and -5- WHEN.EAS, W.C.Carnes, Beechwood, Incorporated and Steve Ferrence, Jr., have executed a Declaration of Vacation for the purpose of vacating portions of Lots 5 and 6, Block H, Beechwood,Section "A", and abandoning the alley easement as shown thereon; and WHEREAS, W.S.Carnes, Beechwood, Incorporated and Steve Ferrence, Jr.� are -the only parties interested in the property to be vacated and abandoned and they desire to haave portions of Lots 5 and 6, Block H, Beechwood, Section "A" vacated and also desire to abandon the 8-foot alley running along; the rear of said Lots 5 and 6, Block H, Beechwood, Section "A", to the extent and according to said Declaration of Vacation; and WHEREAS, the proposed vacation and abandonment will not interfere with any rights of any party having any interest in the subdivision of Beechwood, Section "A", not consenting thereto; NOW, THERi,,r'ORE, ITNESSETH: That the Board of Supervisors do hereby approve the vacation of parts of Lots 5 and 6, Block H, and the vacation of the 8-foot alley easement running along the rear of Lots 5 and 6., Block H, Section "A", all in the Plan og Beechwood, Section "A"�as originally dedicated on said plat; and the Declaration of Vacation and Abandonment exhibited with the Petition herein shall be recorded in the Clerkts Office, Circuit Court of Chesterfield County, Virginia, and said Clerk shall indicate the vacation on the margin of the recorded plan of Beechwood, . ection "A", recorded in said Cl erk t s Office, in Plat Book 12, pages 58 and 59, and shall enter the same on the Grantors side of the general index of deeds in the names of the parties hereto. On motion of Mr. Apperson, seconded by Mr.Browning, it is resolved that the following street light - request be and the same are hereby referred to the Light Committee: Petersburg and Snead Streets - Chester Fieldstone & Belmar Roads On motion of Mr. fvartin, seconded by 1,1r.Horner, it is resolved that the sum of $55,200.00 be and it hereby is appropriated to the T!ater Debt Fund from the unappropriated surplus of said fund. There was read a lei' ter from Mr.S.R.Mann thanking the Board for its help in lighting the Matoaca Ball Park, which letter cites the great use of this ball park by the children of the area, and which letter is ordered received and filed with the Board's papers. A letter was read requesting that Old Centralia Road be renamed Thomas Dale Road and it was generally agreed that this matter would receive further study. -6- On motion of Mr. Martin, seconded by Nlr.Apperda�, the following resolution is adopted: `IHEREAS, a plat of Lots Nos. 3, 41 5 and 6, Block F, being a part of a plat of Huguenot Farms, Section ''F" 'Midlothian District, Chesterfield County, Virginia, dated November 1A, 1963, made by Foster and Miller, Certified Surveyors, was recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia on December 6, 1963 and appears of record in the said Clerk's bff ice in Plat Book 13, at pages 67 and 68; and WHEREAS, Louis C. Burnett, Clerk Board of Supervisors County of Chesterfield Chesterfield, Virginia Dear Mr. Burnett: w i lgs4 During the course of the audit of the Chesterfield County Court for the year ended June 30, 1963 by the State Auditor of Public Accounts, it was determined that certain prisoners had been committed to jail in violation of county ordinances but had been classified on the jail register as State cases and in other instances certain prisoners had been committed to jail in violation of State laws but had been classi- fied as local cases. We are attaching the list submitted by the State Auditor showing the names of the prisoners, the dates committed and released and the number of prisoner days involved. We have checked these prisoners with the reports submitted from your County on Form W&I-J6 and have changed the list to correspond with these reports as they were approved by this office. As you will note there was a net overcharge to the State of 372 pris- oner days. Our records show that the per diem cost for the feeding and care of prisoners confined in Chesterfield County Jail for the fiscal year ended June 30, 1963 was $1.27323, Your County, therefore, is due the State an additional payment of $473.64 to cover overpayment made for prisoners improperly classified. V We will appreciate your presenting this matter to your Board of Super- visors and ask that prompt consideration be given to our claim in the amount of $473.64. The Board of Supervisors Chesterfield County, Virginia Gentlemen: Over the Labor Day week end I had occasion to go along Riverside Drive and am again much impressed with the fact that the general public is denied all access to the use of this wonder- ful natural facility, - the James River. In fact, it is my ob- servation that the police department of Chesterfield County seems to concentrate on running people off of this property rather than certain other police measures that might be better attended, such as speeding. In short, I urge and recommend that steps be taken by Chesterfield County to acquire ownership of the property between Riverside Drive and the River so that arrangements can be made for off -the -road parking at some locations so that the general public of Chesterfield County, and particularly those people that live in the immediate vicinity can make use of the River. I also suggest that you might acquire that large tract of land under the Huguenot Bridge on the Chesterfield County side which could be a very substantial parking area and contain a boat ramp and possibly even a beach and swimming facilities or certainly fishing. There is a serious need for such and the general public should be given the benefit of a natural resource. Along the same line I would like to suggest that steps be taken to acquire the property along Rattlesnake Creek where it crosses Chippenham Road and is in a flood plain. This could be cleared and made into a recreation area with ball diamonds, which would not be adversely affected by the occasional springtime flood- ing. The children of the neighborhood seriously need some additional ball diamond and other playground space. Gill Chief of Police EPG/bsl Encl: Police Vehicle Rules and Regulations %W *40 POLICE VEHICLE RULES AND REGULATIONS The purpose of Police Vehicle Rules and Regulations is to formulate and maintain an effective and efficient system of control over all County owned Police Vehicles in accordance with insurance company requirements and requirements set forth by the Board of Supervisors of Chesterfield County. MAINTENANCE OF VEHICLES Each officer will be responsible for the following: 1. All maintenance of County owned vehicles will be done at the County garage unless approved by the supervisory officer. 2. Vehicle not to be washed more than once a week without approval of Duty Officer. 3. All gasoline will be purchased at the County garage unless a case of emergency. Other purchases to be approved by the Duty Officer. 4, Vehicles will be properly equipped with snow tires and chains. 5. Spare cars will not be used at any time without authority of the Duty Officer. 6. Spare car number 22 will not be used for any purpose except with permission of Duty Officer. 7. All. police vehicles will be kept at the officers home while on leave, however, vehicle will be kept where it can be picked up, at the discretion of the Duty Officer, if needed. 8. No unauthorized equipment will be installed. 9. No unauthorized persons will be transported in any County owned police vehicle. 10. Vehicles are to be kept in proper condition at all times. 11. Vehicles and equipment will. be subject to inspection at any time by the Captain of Police or a Duty Officer appointed by him and a report made to the Chief of Police in writing of such inspection. 12. All mileage reports will be turned in to the Captain of Police not later than g o'clock A. PSI, on the second day of each month. 13. All credit tickets will placed in the Captaints basket within 24 hours from time of purchase. M M Continued - Page 2 - POLICE VEHICLE RULES AND REGULATIONS ACCIDENTS 1. An accident report will be filed any time a County owned Police vehicle is involved, regardless of amount of damage or location of accident. 2. A letter will be written to the Chief of Police furnishing a full explanation and details of the accident. WHEN POLICE VEHICLE TO BE USED OFF DUTY 1. When any officer is requested to do police work in Chesterfield County when off duty, whether a County owned vehicle is used or not, he shall notify the Chief of Police or Acting Chief of Police in writing, furnishing full details of the place he is to work, hours to be worked and nature of work. The officer will mark on duty when starting and will mark off duty upon completion of his assignment. At present, the company will relocate its tobacco warehouses on the property as the present warehouse site at the north end of 7th Street in the Shockhoe Valley area has been acquired by the State to make way for Interstate Highway 64. The purchase of this industrial site through Harrison and Bates, Realtors, is a part of the company's long-range plans for the eventual construction of a multi -million dollar installation including a tobacco manufacturing plant, office building, stem wy, and other operations. Consulting engineers, Wiley & Wilson, who surveyed the area, report that the property is quite suitable for these purposes. The property is bounded on the west by the Seaboard Air Line Railroad which will facilitate Larus & Brother Company's world-wide shipping operations. Chesterfield County officials have indicated that they will cooperate to the fullest to make sure that adequate utilities are available. W. We were able to expa-�d our activities to include 110 boys between t'ae ao.e of 7-16, without any cost to them or spectators at games, with your financial help. Our league consisted of two teams for 7 and 8-,year-olds, four teams for 9-12 and one team of 13-16 year -olds, who played in the Town and Country League, in which our park was the only one with lights. On Saturday nights and other nights- the field was not in use, approximately 30 men from the Club participated in softball, an activity which was welcomed by the com,nunity as a whole since night-time activity in our community is limited.
