The County 7�ngineer read certain sections of a Special `dater Contract for the installation of water mains in Section A of the Subdivision of Shenandoah. Upon consideration whereof, and on motion of Ivir.Britton, seconded by 1r.Horner, it is resolved that Contract AC-349 in the, amount of ?,,9,89$.50, be, and it hereby 'is approved, with the special provisions. On motion of t,,r.Britton, seconded by fir.Horner, it is resolved that Contract A-236B for the installation of water mains in Holiday Plaza Subdivision in the amount of 4559.50, be and it hereby is approved. On motion of P-,r.Britton, seconded by hr .Appe rson, it is resolved that the combination contract AR-597C for the installation of water and gas mains in the subdivision of Deerbourne, in the amount of $20,287.45, be, and it hereby is approved. On motion of Pir.Britton, seconded by Mr.Apperson, it is resolved that the contract for the installation of water and gas mains in the Deerbourne Subdivision be and it hereby is awarded to Lyttle - and Barnes Construction Company who submitted the low bid of "v 20 , 614.45 . On motion of l,,r. Horner, seconded by Ivx.Appe rson, it is resolved that Contract 6102-30 for the installation of sewer mains in the Raleigh Court Subdivision be awarded to the Luck Construction Company, who submitted the low bid of ``:110,849.95, which bid is based on the use of concrete pipe. On motion of Pvir.Martin, seconded by I�X.Apperson, it is resolved that Contract 6102-2 for the installation of sewer mains in the Sherbourne-Bensley area be awarded to F.L.Showalter in the amount of $139,954.40, which provides for the use of cement asbestos pipe -1- On motion of Mr.Apperson, seconded by Mr.Brownin, it is resolved that Contracts S-64-22D for the installation of sewers in Business Acres and S-64-32D for the installation of sewers in Holiday Plaza be and they hereby are approved. On motion of Nir.Britton, seconded by 1,4r.Apperson, it is resolved that contract S-63-5D, providing for the installation of sewers in the Branchwood Subdivision be and it hereby is approved with the stipulation that the time limit begins January, 1964. On motion of Mr.Britton, seconded by Pir.P-iartin, it is resolved that this Board furnish a free sewer connection for the Manchester Rescue Squad. On motion of Mr.Britton, seconded by Ivir.Apperson, it is resolved that the agreement between the County of Chesterfield and the U.S. Department of the Interior for the operation of a gauging station on Falling Creek, be and it hereby is approved. On motion of Nir.Browning, seconded by fir .Appe rson, it is resolved that this Board receive the proposed contract between the County of Chester- field and the Appomattox '�T;=ter Authority and to investigate certain aspects of the contract for further discussion on August 27, 1964. On motion of Mr.Browning, seconded by Mr.Apperson, it is resolved that the entire Board meet with the Appomattox 'dater Authority to discuss the possibility of this facility. On motion of 12ir.Apperaon, seconded by Pir.Horner, it is resolved that the following appropriations be and the same are hereby made for the month of September, 1964, from the funds and for the functions or purposes indicated in the amount of o2,441,116.00. On motion of A,ir .Britton, seconded by Nir. Apperson, it is resolved that the Treasurer of the County be and he hereby is requested to transfer the sum of 20,000.00 from the General Fund of the County to the Road Fund of the County. On motion of Ivir.Browning, seconded by Mr.Horner, it is resolved that the School Board's request of July 22, 1964, for the transfer of 640.00 from Tuitions received in Summer School be approved, and the Treasurer of the County is requested to transfer �540.00 from the unappropriated surplus of the General Fund to category 17b3-399 of the School Board budget. On motion of Yx.Britton, seconded by ILir.Apperson, it is resolved that the erroneous tax claims for Ethel D. Gilliland 509 Patrick Avenue, Richmond, Virginia, refund of County license plate in the amount of : 6.50, be and it hereby is approved. -2- n n On motion of Mr. Apperson seconded by Iv'ir.Browning, it is resolved that this Board regretfully accepts the resignation of U ss Shwrrill Iiassie, ASSi stant Home Demonstration Agent, and approves the appointment of Pirs. Barbara Sue Galbreath to fill the vacancy. There was cited the fb ct that the Health Department, at the request of the Board of Supervisors, had made the necessary arrangements with the School Board and the Veterinarians in the County to hold 11 rabies clinics for the vaccination of dogs in the County at various locations on August 18 through August 29, 1964. The Chairman expressed his appreciation to the Health Department for this splendid cooperation. On motion of Mr.Britton, seconded by 1,r.Browning, it is resolved that the street lights requested in_Castlebury Hills, Oberlin Road and Brook Lane be referred to the Light Committee. On motion of Mr.Browning, seconded by Mr. Horner, it is resolved that the request of Major E.P.Gill in recommending the employment of P,r. John-lesley Layne, Jr. as a Police Officer for the County of Chesterfield, be, and it hereby is approved, and this Board recommends to the Judge of the Circuit Court, the Honorable William Old, the employment of Mr. John Wesley Layne as a Police Officer for the County of Chesterfield. There was read a letter from Nir. L.R.Treat, Jr., District Engineer, Virginia Department of Highways, concerning the Industrial Access Road from Rt. 1 to the T-'althall Interchange to serve the new Allied Chemical Research Center and the Executive Secretary cited the progress of the construction of said road. There was read a letter from Kr. L.R.Tr, at, District Engineer, Virginia Department of Highways, to construct a "Stop and Go" light at the intersection of Rts. 1 and 892. There was read a letter from I,x. R. U. Lancaster, III, Resident Engineer, VirginiaDepartment of Highways, which included a study from FJ .Isbell of Rt.609 as it crossed the Seaboard Airlihe RR., which report states that the exposure index at this crossing would not justify further signal equipment. On motion of Mr. Goyne, seconded by Mr. Martin, it is resolved that this Board requests the Highway Department to again review this intersection in light of the traffic generated by the new school and the use of this crossing by the additional school buses. On motion of Mr.Browning, seconded by Mr. Horner, it is resolved that a letter from Mrs. A. Yarblonsky concerning the improvement of certain roads in Rayon Park be sent to the Highway Department. It is here noted that the request w as not to improve the roads because reckless drivers will increase speed. -3- On motionof Ivir. Apperson, seconded by l-ir.Horner it is resolved that the Chairman appoint a Committee to meet with the Highway Department concerning the intersection of Cascade and Rt.892. Whereupon the Chairman appoints the entire Board to meet with the Highway Department on this matter.. On motion of Iti'r.Apperson, seconde , by Hir.Browning, it is resolved that the Highway Department be requested to improve Lake Hills Court Road., including surface treating, at a price not to exceed y 1000.00, and same to be paid from the 3¢ Road Fund. It is here noted that the Subdivider has agreed to pay the cost of this road improvement. On motion of Mr.Britton, seconded by P'ir.Niartin, it is resolved that due to the numerous complaints and requests of the citizens of Chesterfield County, the Highway Department is requested to begin construction on on 'i(.,lmsley Boulevard, which improvement is in the current year's budget, at the earliest possible day, and that consideration be given to the improvement of the crossing of the Atlantic Coast Line tracks on Walmsley Boulevard, so that in some way this dangerous crossing may be alleviated. It is generally agreed that a meeting would be sought with Mr. Lancaster concerning certain drainage conditions in Chesterfield County. On motion of I';r. Browning, seconded by Pir.Apperson, it is resolved that this Board approves the request of Mr. J. T. Rose, Countv Assessor, for permission to attend with his four Appraisers, the Virginia Awsociation of .assessing Officers' Cionference at Old Foint Comfort, on September 9-11, 1964. I,.r. Junius uormus and Lr. Garland Hening come before the Board for a Variance from the Subdivision Ordinance to allow the construction of a dwelling for Pir.Gormus on a private right of way currently known as Hening's Lane. On motion of Ivy. Apperson, seconded by 141r.Britton, it is resolved that a Variance be granted to 1,Lr.Gormus for the construction of a dwelling, provided a 50-ft. right of way is dedicated for a public roadway, and that the County in no way be held responsible for the construction or maintenance of this road. On motion of kr.Browning, seconded by Itiir.Apperson, it is resolved that the Virginia jtate College be permitted to hold a pyrotechnic displqy at Rogers Stadium on October 22 - 24, 1964, provided the usual pre- cautions are taken. There were presented plans and specifications for the County Dog Pound, which was proposed to be constructed immediately south of the sewage lagoon, which facility would adequately house 50 or more animals and could be expanded if it appeared necessary. Lrs. John G.Smith, residing on Cherokee Road, presents a petition signed by approximately 420 people calling for humane treatment to dogs in the County of Chesterfield. Pirs. Edwin King from Midlothiah requested -4- R that the Board of Supervisors check on the method by which dogs are exterminated. On motion of Mr.Piartin, seconded by Iti,r.Britton, it is resolved that bids be requested on the Dog Pound as presented. On motion of Tvir.Britton, seconded by P'r.Horner, it is resolved that roads in Huguenot Farms and roads in Marlboro be added to the list of roads to be taken into the Secon&,ry System as of June 25, 1964. It was reported by the Delinquent Tax Collector that $27,387.10 in Delinquent Personal Property and Capitation Taxes for the year 1960 in past due accounts had been referred to the Delinquent Tax Collector for collection. There was received f rom Mr. Patrick Simmons a resignation from the Regional Planning Commission. On motion of T.r.Horner, seconded by 1�1r.Britton, it is resolved that this resignation be accepted and that the Executive Secretary write to Mr. Simmons expressing the County's appreciation for his valued service. On motion of Mr.Iiartin, seconded by P:r.Browning, it is resolved that the minutes of June 22 and June 25, July 8 and 23, 1964, be and they hereby are approved. 64-37. The case of Mr. Donald A. Hodgins deferred from July 8, 1964. Pir. David Meade White, representing Mr. Hodgins requested that the matter be deferred to November 10, 1964. Upon consideration whereof, and on motion of Pir.Browning, sefonded by 101r.Britton, it is resolved that Case No.64-37 be deferred to November 10, 1964. 64-23. Mr.C.Denny White, Commissioner in Chancery and Tie -Breaker for the County is presented to the Board of Supervisors, and, Whereas, The Board has submitted a tie vote on the request of Pirs. Diary Stratton for a Use Permit to mine gravel on a parcel of land in Dale Riagisterial District, and interested persons are requested to speak concerning this matter. Pir.Robert A.Cox,Attorney, representing Mrs. Stratton, presents a Soil map purportedly to show that there is gravel in the area. T,'x.Cox requested the Board of Supervisors to vote on whether Mr. Horner should have voted on the previous decision since it was apparent that 1,.r.Horner owned some of the adjacent land. Mr.Gates ruled that the Board could not decide on such a question and that the only question before the Board was the matter of a Use Permit to be decided by Mr. White the Tie -Breaker. Mrs. Stratton states that she wishes to correct certain statements made previously and a ssures everyone that she will f ollow the regulations specified in the operation of the gravel pit. Dir. George ''J. Mann, who lives in Gravelbrook states that he has no objections to the granting of this Use Permit. -5- 1,x, Fred Gray, tittorney,representing Mr. S.E.Lyttle and Iir. J.B. ``hit e, argues that the Court should decide the propriety of N,r;. Hornerr s vote, that since the question has been raised concerning this issue, for Mr. Horner's benefit it should be answered by the Court. Mr: Iv .A. Johnston, retired serviceman, gives several arguments opposing the granting of such a Use Permit. Mr. Wm. L. Hobart states that the property in Gravelbrook would be greatly affected and such a use of Mrs. Stratton's land would be detrimental to the area. io:r. Joe A. Workman states that he has in his family a serious asthmatic condition that dust will greatly aggrevate and 1 e is strongly opposed to the granting of such a Use Permit. Mr. Cox in summation reviews all of the previous arguments for the granting of this permit. 1�:r.Gray in summation presents all of the previous arguments against this request. Mr.C.Denny ",Ihite states that he has reviewed the files concerning this; matter, has visited the scene of the proposed gravel pit with clients and attorneys and has listened to attorneys from both sides previously and cast his vote to reject the application for a Use Permit. 64-50. lir.P.L.Travis comes before the Board requesting the vezoning in Manchester Magisterial District from Agricultural to General Business (C-2) on a parcel of land of tfiangular shape, fronting 15.20 feet on Turner Road and extending westwardly 23,79 feet; said parcel being 300 feet south of the intersection of Belmont Road and Turner Road, and a pa rt of a C-2 zoned parcel at the southwest intersection of the aforementioned roads. It was cited that the Planning Con nission had recommended approval of this request. Upon consideration whereof, and on motion of I,.r. Britton, seconded by Mr.hartin, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned for General BuSinEesS purposes. 64-51. heir. Tower, representing the Atlas Fence Company comes before the Board requesting the rezoning in Manchester I�iagisterial District, from Agricultural to General Busines (C-2) on a .7 acre parcel of land of irregular shape being 670 feet east of Elkhardt Road and 203 feet north ofRt.360; said parcel extending northwardly 209 feet and east- wardly 158 feet. It was cited that the Planning Commission recommends approval of this request. i;omes also hr. Bbnjamin Lyne, representing the Estate of Nor. Clodfelter and his mother-in-law, and tells briefly the history of the development of the area and states that several widows live in this area and should be protected from this proposed general business zoning. Pictures were presented to show the area. Upon consider tion whereof, and on motion of Ir. Britton, seconded by Mr.Goyne, it is resolved that the requested be reduced to a Use Permit for the purpose of storing fence materials and such a Use Permit be and it hereby is granted. Farley, representing Ivir.Fred Lord, comes before the Board requesting the rezoning in Manchester Magisterial District, from Residential-2 to General Business (C-2) of a parcel of land fronting 350 feet on Belt Boulevard (Rt. 161) and extending northwardly 300 feet, being north and east of the intersection of Berkley Road and Rt. 161, and it was cited that the Planning Commission recommended the approval of this request, provided any utility easements necessary were granted. On motion of tilr. Britton, seconded by Mr. Browning, it is resolved that the aforedescribed property be and it hereby is rezoned for General Business purposes, provided the proper easements are granted. 64-53. Mr. E.P.Garrigan, representing Dir. R. Leighton, hXs. M.Gormours, Itiir. J. H1. Turner and Iir.V.A. Ihlenfeld, come before the Board requesting the rezoning in Manchester Pflagisterial District, from Residential-2 to General Business (C-2) on a parcel of land fronting 255 feet on Belt Boulevard (Rt. 161) and extending southwardly 300 feet, being 325 feet west of Berkley Road. There appearing no one in opposition to this request, and it was cited that the Planning Commission recommends -the approval, provided the necessary utility easements are granted, it is on motion of Mr Britton, seconded by Ii.r.Browning, resolved that the aforedescribed parcel of land be and it hereby is rezoned for General Business purposes, provided the proper utility easements are granted. 64-54. Mrs. Marie TI, Porter comes b efore the Board, requesting the rezoning in Manchester Magisterial District) from Residential-2 to General Business (C-2) of a parcel of land of irregular shape) fronting 75 feet on Belt Boulevard (Rt. 161) and extending southwardly 140 feet, being 280 feet east of Brandon Road and better known as 114 E.Belt Boulevard. There appearing no one in opposition to this request, it is resolved on motion of Mr.Britton, seconded by I'Jr.Browning, that the aforedesfribed parcel of land be and it here'Uy is rezoned for General Business purposes, provided the proper utility easements are granted. 64-55. Mr. R. P. Sowers, representing Ix. Lewis Gergoudis, comes before the Board requesting the rezoning in L-anchester Piagisterial District, from Residential-2 to General Business (C-2) of a parcel of .land fronting 61 feet on the south line of Belt Boulevard and extending southwardly 150 feet along the east line of Berkley Road. There appearing no one in opposition to this request, and the Planning Commission recommends that the request be approved, provided water and sewer easements are granted, it is on motion of Lr.Britton, seconded by Lr.;kpperson, resolved that the aforedescribed parcel of land be and it hereby is zoned for General Business purposes, provided adequate easements for utilities are provided. 64-56. I�ir. R. P.Sowers, Atty. representing the Tower Construction Co., comes before the Board requesting the rezoning in I�ianchester Magisterial District, from agricultural to General Business (C-2) of a 17acre parcel of land of irregular shape, fronting 1000 feet on the north line of Rt.60 and 650 feet on the northeast line of Warwick Road and extending northwardly from Rt.60 to a depth of 500 feet, being presently zoned C-2 for a depth of 300 feet. And there appears no one in opposition to this request and the Planning Commission recommends that the approval of this request be limited to -7- zoning for a shopping center, business offices, and similar establish- ments and that a 200 foot triangular parcel in the northeastern section of this land be zoned for Residential-2 as a buffer to Beaufont Hills' Upon consideration whereof, and on motion of Mr. Britton, seconded by Nir.Apperson, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned for General Business purposes with the stipulations as recommended by the Planning Commission. 64-57. Mr. L. Kimbrough, oecretary of the Capital, Inc.,comes before the Board requesting the resoning from Agricultural to Residential-2 in Dale MRgisterial District, of an 84-acre parcel of land fronting 895 feet on Salem Church Road (Rt. 642) and extending northeastwardly approximately 2500 feet; its southern boundary line being ReedyCreek and better known as the Ellis Tract. 1,ir. A.L.Taylor comes also to object to the rezoning of the l.and:in' that area for Residential purposes and states that too much of the farm land in Chesterfield County is being rezoned for building development and it was pointed out that the Planning Commission recommends approval of this request. On motion of Mr. Apperson, seconded by !�,r, martin, it is resolved that this matter be deferred to the next meting of this Board, the 27th day of August, 1964. Nir:George Gratton,tittorney, representing; Mr. J.B.Colef comes before the Board again requesting the approval of the County of Chesterfield for houses manufactured in Avis, Penna. and shipped to the County on trucks. Mr. E.L.Lumma, Building Inspector, states that it is impossible to inspect all of the wiring and plumbing in '.he building. I.r. Buford Butts, comes also representing the Old Dominion Homes, manufactured in Roanoke, Virginia. Also requesting the Board of Supervisors to approve the construction of their homes in the County. Upon consideration whereof, and on motion of liir. Britton, seconded by lir.Nlartin, it is resolved that this matter be continued until Ivir. Burma can present his recommendations and the Board of Supervisors to make further study of these two model homes. On motion of Nir.1,iartin, seconded by Pir.Browning, it is resolved that the request of i:r. H.P. 11icCann for a Variance from the Subdivision ®rdinance on property bordering on Rt.360, be, and it hereby is referred to the Planning Commmission for consideration. It was generally agreed that the reque >t of l r. George T. Shepard, who recently purchased the livent tract on Point O'Rocks Road, be referred to the Planning Commission. On motion of I,.r.Appdrson, seconded by Ir.Eorner, it is resolved that Air. Sullivan builder of a house in Jessup raruls, to which section County water is supposed to be run, be allowed to put in a temporary well until the developer completes the installation of water rains to this subdivision. The County Engineer presented the fact that the bid for the construction of the Chester lagoon is `8 ,650.00, and the bid for installing -8- M M all of the sewer lines prot.;rammed was $149,039.00, and further that only 55 applications had been received as of this date and recommended that the construction of the lagoon be awarded and that the installation of sewer lines be deferred until further applications are received. Upon consideration whereof, �-,nd on motion of Mr.Goyne, seconded by N1r.Britton, it is resolved that this Board award the contract for the construction of a lagoon to the Roanoke Construction Company in the amount of 048,650.60 as recommended by the County Engineer: Upon further consideration and on motion of hr. Goyne, seconded by B`ir.Browning, it is resolved that consideration of the installation of the sewer lines in Chester be deferred until additional connections are promised. On motion of Lr.Britton, seconded by I�r.Horner, it is resolved that the Executive Secretary purchase and install a flag pole for the Fair Grounds. On motion of N1r.Browning, seconded by Mr.14artin, it is resolved that a walkway bg placed on the Fair Grounds and a light close to the Exhibition Building. On motion of Pir.1vlartin, seconded by Air.Browning, it is resolved that a pressbox be authorized for immediate construction. Burnett Chesterfield County Court House Chesterfield, Virginia Dear Mr. Burnett: We understand that it is not necessary for rescue squads and volunteer fire departments to pay the sewerage fee required for connection. This was called to our attention by one of the Chesterfield County Supervisors. Our rescue squad had already paid this sewerage fee before we heard this. Burnett Executive Secretary County of Chesterfield Chesterfield, Virginia Dear Mr. Burnett: July 27, 1964 Herewith is a tabulation of daily and monthly discharges for the gaging station on Falling Creek near Chesterfield for the water year ending September 30, 1963. You will recall that at a meeting held in the County offices in late September of last year, it was agreed that representatives of your office, Belwood Depot, and this office would meet annually to review what was needed in the way of stream gaging on Falling Creek. Before a meeting was arranged this year, I was advised by Mr. Barton of the Depot that they wanted us to discontinue the Drewrys Bluff gaging station on June 30. He stated that your engineering depart- ment had been advised of this decision. In view of the use your consulting engineers are making of the Falling Creek near Chesterfield record and the interest that Mr. Schremp of your engineering department has expressed in it, I assume that you will want to continue the operation of the Falling Creek station. Herewith is a cooperative agreement which calls for a con- tribution of $450 by each the County of Chesterfield and the U. S. Geological Survey during the 1965 fiscal year. If this is satisfac- tory, please have both copies executed and return them to me. After signature by our Director, a fully executed copy will be sent you for your files. FOOTING 1a All footings for foundation walls shall be excavated to a width of 16" and a depth of not less than 24" below finish grade. 2. Concrete footings shall be 3,000 lb. mix. B. Cinder Block 1.
