Subject: Resolution Recognizing May 22-28, 2010, as "Safe Boating Week" in Chesterfield County County Administrator's Comments: County Administrator: Board Action Requested: Mr. Gecker requests that the attached resolution be adopted. Summary of Information: This resolution recognizes "Safe Boating Week" in Chesterfield County, urging those who boat to practice safe boating habits. Members of the United States Coast Guard Auxiliary, Flotilla 31, will be in attendance to receive the resolution. Preparers Janice BlakleY Attachments: ^ Yes ~ No ~~on~s Title: Clerk to the Board RECOGNIZING MAY 22-28, 2010, AS "SAFE BOATING WEEK" IN CHESTERFIELD COUNTY WHEREAS, Americans are increasingly heading to the water for recreation and relaxation as opportunities for on-the-water activity increase each year; and WHEREAS, with this growth comes additional responsibility; and WHEREAS, it is essential that both novice and experienced boaters alike learn and practice safe boating habits, wear a life jacket and have essential safety equipment; and WHEREAS, this year's theme of the Boating Safety Campaign, "Wear It," recognizes that boating safety begins before the boat leaves the dock; and WHEREAS, studies show that boaters who take a boating course are four to five times less likely to have a boating accident, and 80 percent of the people who have died in boating accidents were not wearing life jackets; and WHEREAS, the number of boats registered in the Commonwealth of Virginia is 251,628, and even more boats visit our area waters each summer; and WHEREAS, hundreds of lives could be saved each year by the wearing of life jackets, and the life jackets of today are more comfortable, more attractive and wearable than styles of past years; and WHEREAS, the law requires that wearable life jackets be carried for each person on board the boat, and little effort is needed to wear those life jackets; and WHEREAS, boating courses are readily available from the Coast Guard Auxiliary throughout the year. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors, this 28th day of April 2010, hereby supports the goals of the National Safe Boating Campaign by publicly recognizing May 22-28, 2010, as "Safe Boating Week" in Chesterfield County, and urges all those who boat to practice safe boating by taking a boating course, wearing their life jackets, and having their boats checked for other safety equipment by the Coast Guard Auxiliary. ~~, CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 1 of 1 Meeting Date: April 28, 2010 Item Number: 8.A.1. Subject: Nomination and Appointment to Chesterfield Community Services Board County Administrator's Comments: County Administrator: Board Action Requested: Nomination/appointment of Mr. F. Gibbons Sloan, III to the Chesterfield Community Services Board as the Bermuda District representative. The term of appointment is effective May 1, 2010 through December 31, 2012. Summary of Information: The Chesterfield Community Services Board is designated as an Administrative/ Policy Board responsible for the provision of public mental health, mental retardation and substance abuse services. Mr. Sloan resides in the Bermuda District and would serve as the Bermuda District representative on the Board. Ms. Jaeckle concurs with this appointment. Mr. Sloan's financial background and expertise would be valuable to the Board should the Board of Supervisors so choose to appoint him. Under the existing Rules of Procedure, appointments to boards and committees are nominated at one meeting and appointed at the subsequent meeting unless the Rules of Procedure are suspended by a unanimous vote of the Board members present. Subiect: Streetlight Cost Approval County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of a streetlight installation in the Bermuda District. Summary of Information: Requests for streetlights, from individual citizens or civic groups, are received in the Department of Environmental Engineering. Staff requests cost quotations from Dominion Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection or 400 VPD if the requested location is not an intersection; 3. Petitions are required and should include 75% of residents within 200 feet of the requested location and if at an intersection, a majority of those residents immediately adjacent to the intersection. Cost quotations from Dominion Virginia Power are valid for a period of 60 days. The Board, upon presentation of the cost quotation may approve, defer, or deny the expenditure of funds from available District Improvement Funds for the streetlight installation. If the expenditure is approved, staff authorizes Dominion Virginia Power to install the streetlight. A denial of a project will result in its cancellation and the District Improvement Fund will be charged the design cost shown; staff will notify the requestor of the denial. Projects cannot be deferred for more than 30 days due to quotation expiration. Quotation expiration has the same effect as a denial. "Bonnie" Bowles will retire on July 1, 2010 after providing twenty years of dedicated and faithful service to Chesterfield County; and WHEREAS, Ms. Bowles began her service on June 18, 1990 as Secretary to the Director and staff of the Internal Audit Department and took on additional responsibilities to become an Administrative Assistant during her nine years in the department; and WHEREAS, through study, dedication, and written examination, Ms. Bowles received the prestigious honor of being awarded the Certified Professional Secretary designation by Professional .Secretaries International in 1997, graduated Magna Cum Laude with an Associate of Applied Science Degree with a Specialization in Administrative Management from John Tyler in May 1999, and received the prestigious honor of being awarded the Certified Administrative Professional designation upon sitting for the first exam given in Virginia; and WHEREAS, Ms. Bowles successfully completed the TQI Advisor certification requirements and received a Certificate of Recognition in 1999; and WHEREAS, Ms. Bowles received a promotion in September 1999 to Office Administrator in the Purchasing Department, where she served for 11 years, and where her position and title changed from Administrative Officer to Administrative Supervisor then Administrative Manager; and WHEREAS, Ms. Bowles has served with honor and distinction in various capacities of the Old Dominion Chapter of the International Association of Administrative Professionals (previously Professional Secretaries International) since 1991 and in so doing, brought honor and distinction to Chesterfield County in the execution of her duties; and WHEREAS, Ms. Bowles was always willing to take on any challenge presented to her with a positive "can-do" attitude, and has always worked well and displayed a determined effort to stay with a project until it was successfully concluded; and WHEREAS, Ms. Bowles has served successfully on many teams and projects during her tenure with the county and contributed both as a team member and as an individual to the excellence which made it possible for the Purchasing Department on October 25, 1999 to be the eighth public procurement entity within the United States, Canada, Ireland, and England and the first locality or state agency in Virginia to receive national accreditation by the National Institute of Governmental Purchasing; and WHEREAS, Ms. Bowles has faithfully and effectively discharged her duties in each and every capacity with proficiency, dedication, and an unwavering commitment to provide excellent customer service to the many customers in both county and school operations served by Internal Audit and Purchasing; and ~~o~:~.~ WHEREAS, Ms. Bowles displayed a commitment to duty along with an unwavering commitment to the highest ethical and moral standards while continually seeking to obtain the best service for the taxpayers of Chesterfield County; and WHEREAS, Ms. Bowles will be tremendously missed for the quality and caliber of her commitment and performance in the Internal Audit and Purchasing Departments. Blankenship, Jr. will retire from the Fire and Emergency Medical Services Department on June 1, 2010, after providing nearly 32 years of dedicated service to Chesterfield County. Preparers Edward L. Senter, Jr. Title: Fire Chief Attachments: ^ Yes ~ No # (~~®0~.9 RECOGNIZING LIEUTENANT FRANK W. BLANKENSHIP, JR. UPON HIS RETIREMENT WHEREAS, Lieutenant Frank W. Blankenship, Jr. will retire from the Chesterfield Fire and Emergency Medical Services Department, Chesterfield County, on June 1, 2010; and WHEREAS, Lieutenant Blankenship attended recruit school #9 in 1978 and has faithfully served the county for nearly 32 years in various assignments including as a firefighter at the Chester and Manchester Fire and EMS Stations; and WHEREAS, Lieutenant Blankenship worked in the department's SCBA repair shop for over 20 years ensuring that this vital safety equipment was repaired and maintained properly; and WHEREAS, Lieutenant Blankenship was certified as an Advanced Life Support Provider in 1998, where he served as an Emergency Medical Technician - Cardiac Technician for four years; and WHEREAS, Lieutenant Blankenship was promoted to the rank of lieutenant in December 2001, and served at the Ettrick and Midlothian Fire and EMS stations; and WHEREAS, Lieutenant Blankenship received a life save award for his role during Tropical Storm Gaston in August 2004 in the rescue of numerous citizens from flood waters at the Falling Creek Apartments; and WHEREAS, Lieutenant Blankenship was assigned to the department's planning unit in September 2004; and WHEREAS, Lieutenant Blankenship was assigned to the Fire and Life Safety Division in December 2004, where he served as an Inspector/Investigator and obtained the training to become a fully sworn law enforcement officer; and WHEREAS, Lieutenant Blankenship served on the Quality Council Committee, the Engine Design Workgroup, and the Rapid Intervention Team Workgroup sharing his knowledge and wisdom for continuous improvement; and WHEREAS, Lieutenant Blankenship was well respected by many throughout the department and recognized for his professional knowledge, work ethic, and calm demeanor. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors recognizes the contributions of Lieutenant Frank W. Keeney will retire from the Chesterfield Fire and Emergency Medical Services Department, Chesterfield County, on May 1, 2010; and WHEREAS, Lieutenant Keeney attended Recruit School #15 in 1984 and has faithfully served the county for nearly twenty-six years in various assignments, as a firefighter at the Bensley and Buford Fire and EMS Stations, and as a Lieutenant at the Ettrick, Buford, Dale and Matoaca Fire and EMS Stations; and WHEREAS, Lieutenant Keeney was recognized as an effective team member at emergency scenes, including the Virginia Power fire in June 1987, the Darryl's Restaurant fire in August 1990, the Waterford Apartments fire in December 1997, Fox and Hound Restaurant fire in June 2005, the Iron Bridge Office Park fire in December 2006, and three serious motor vehicle accidents with entrapment in front of Fire Station 11 in July 2005, February 2007 and September 2007; and WHEREAS, Lieutenant Keeney was recognized with an EMS Unit Citation for his role in saving the life of a citizen suffering from cardiac arrest on June 11, 1996 at the Sheraton Hotel on Midlothian Turnpike; and WHEREAS, Lieutenant Keeney was recognized with a Unit Citation for his role in bringing a major fire under control at Cloverleaf Mall on October 12, 1995; and WHEREAS, Lieutenant Keeney submitted a suggestion in February 1988, which led to a new procedure in which employees are properly sized to receive their safety boots. Summary of Information: The county regularly participates in an annual VDOT matching fund program (Revenue Sharing) wherein the county may provide up to $1,000,000 in anticipation of an equal match (dollar for dollar basis) by VDOT. The exact amount of funds to be matched by VDOT is determined after all statewide requests for matching funds have been received. Funding for the Chesterfield Road Fund (Revenue Sharing) projects is provided on a rotational basis among the magisterial districts. Dale and Bermuda Districts are designated to receive funding in FY2011 (see Attachment A). The Board has included $500,000 in the Capital Improvement Program for the FY2011 Chesterfield Road Fund. Staff recommends an additional $500,000 be transferred from the Industrial Access Account to maximize the $1,000,000 matching program for FY2011. District: Dale and Bermuda ~~~~~~ CHESTERFIELD COUNTY ~ BOARD OF SUPERVISORS Page 3 of 3 -- AGENDA 1748 Budget and Management Comments: This item requests that the Board of Supervisors designate the FY2011 Chesterfield Road Fund (Revenue Sharing) projects and transfer funds in the amount of $500,000 from the Industrial Access account to the Chesterfield Road Fund. The VDOT Revenue Sharing program is designed to provide matching funds to localities for general road improvements. The state has established a $1 million limitation on the annual state match. Historically, the county has appropriated $500,000 annually in the Chesterfield Road Fund when adopting the Capital Improvement Program. The state has matched those funding levels providing an annual combined total of $1 million for road improvements. From time to time, the county has been able to identify funding in excess of the annual $500,000 appropriation to maximize the amount of revenue received from the state revenue sharing program in a given year. Staff has evaluated options to leverage the state revenue sharing program up to the $1 million limitation in FY2011. Staff recommends the use of $500,000 in county Industrial Access road funding. Currently, the Industrial Access balance is sufficient enough to transfer $500,000 to the revenue sharing program. Preparers Allan M. Carmody Title: Director, Budget and Management (~:~®~~~ WHEREAS, Section 33.1-75.1 of the Code of Virginia permits the Commonwealth Transportation Board to make an equivalent matching allocation to any County for designations by the governing body of up to $1,000,000 in funds received by it during the current fiscal year pursuant to the "State and Local Fiscal Assistance Act of 1972" for use by the Commonwealth Transportation Board to construct, maintain, or improve primary and secondary highway systems within such County; and WHEREAS, the Chesterfield County Board of Supervisors has made available $1 million for the Chesterfield Road Fund (VDOT Revenue Sharing Program) with the adoption of the FY2011 Appropriation Resolution and other Board action; and WHEREAS, the Virginia Department of Transportation has notified the county that $1 million is the maximum amount of Chesterfield County funds that will be matched by the state during FY2011. Summary of Information: Each year the Board of Supervisors is requested to adopt a priority list of projects for consideration at VDOT's financial planning and programming meeting. The last priority list of projects was adopted by the Board on April 23, 2008. The recommended priority list is the same as the previously approved list with costs updated (Attachment A). It should be noted that several projects on the priority list are shown to be fully funded over the duration of the current FY2010-FY2015 Six-Year Improvement Program. VDOT will conduct a public hearing regarding the FY2011-FY2016 Six-Year Improvement Program for the Richmond District on Wednesday, May 19, 2010, at the VDOT Central Office Auditorium located at 1221 E. Broad Street. The purpose of the hearing is to receive comments from local government officials and citizens that will assist the Commonwealth Transportation Board (CTB) in updating the VDOT Six-Year Improvement Program for primary and interstate roads, rail, transit, and other federally funded projects. The hearing to receive citizen comments will begin at 6:00 p.m. An open house for elected officials will be held prior to the hearing, at 5:00 p.m. The recommended letter to be submitted to the CTB is shown in Attachment C. The deadline for written comments is June 11, 2010. The total cost of the recommended Chesterfield priority projects is approximately $436 million. The Richmond District consists of fourteen counties and eight cities/towns. The District's total primary and interstate construction allocation for FY2010-FY2015 was approximately $199 million. A list of the Chesterfield projects included in VDOT's current FY2010-FY2015 Six-Year Improvement Program is shown on Attachment D. Projects funded only with secondary construction funds are not included in the Six-Year Improvement Program. The Board of Supervisors will be asked later this year to consider the Secondary Road Six-Year Program for improvements to the county's secondary road system. Route 10 (Route 1 to Meadowville Road) -widening to six lanes This section of Route 10 carries 50,000 vehicles per day. This volume is expected to increase to 65,000 vehicles per day by the year 2020. The county completed preliminary plans for Route 10 from Interstate 95 to Meadowville Road and the Commonwealth Transportation Board approved these plans in fall 1999. The project can be constructed in phases: Phase I - I-95 to Ware Bottom Spring Road; Phase II Ware Bottom Spring Road to Meadowville Road; Phase III -Route 1 to I- 95. The county has programmed $15 million in county bond funds in order to construct a portion of Phase I. The project involves widening Route 10 in the vicinity of the Old Stage Road intersection, including the bridges over the CSX railroad tracks. $10 million in federal stimulus funds have been secured, along with $5 million in state and other federal funds, to allow this project to be constructed. The project is anticipated to be under construction in Summer 2010 and complete by Summer 2012. Additional funding is needed to complete the widening of Route 10 between Route 1 and Meadowville Road 2. Route 60 (Courthouse Road to Old Buckingham Road) -widening to six lanes This section of Route 60 is carrying approximately 46,000 vehicles per day. This volume is expected to increase to 57,000 vehicles per day by the year 2020. This project is not in VDOT's Six-Year Improvement Program. 3. Interstate 295/Meadowville Road -interchange Construction of this interchange is needed to promote economic development and prevent unacceptable levels of service on Route 10 and other area roads. Funding for construction of a diamond interchange has been programmed. In addition to the $3.3 million shown in the current Six-Year Improvement Program, the county obtained $5 million in Transportation Partnership Opportunity Funds, $0.56 million in federal Transportation and Community and System Preservation Program funds to supplement county funds going toward the project. Additional funding will be needed to construct the full cloverleaf interchange. 4. Route 360 (Winterpock Road to Otterdale Road) -widening to six eight lanes This section of Route 360 carries between 22,000 and 36,000 vehicles per day. This volume is expected to increase to between 38,000 and 65,000 vehicles per day by the year 2020. This project is not included in VDOT's Six-Year Improvement Program. Funds for widening Route 360 between Winterpock Road and Woodlake Village Parkway have been requested through the Richmond Area MPO. 5. Route 360 (Route 288 to Genito Road) -widening to six lanes This section of Route 360 carries approximately 41,000 vehicles per day. Centralia Road (Mott Lane to Chester Roadl -widening to three lanes Centralia Road carries between 10,000 and 13,000 vehicles per day. A high number of traffic accidents are occurring on Centralia Road between Nott Lane and Chester Road. The construction of a third lane and shoulders would help address the accident problems. This project is not included in VDOT's Six-Year Improvement Program. 7. Huguenot Road (between Route 60 and Alverser Drive) -widening to six lanes This section of Huguenot Road is carrying approximately 40,000 vehicles per day. This volume is expected to increase to 50,000 vehicles per day by the year 2020. Regional Surface Transportation Funds ($4 million) have been programmed for this project. VDOT has begun preliminary engineering. The project is expected to be advertised for construction in Fa112012. 8. Route 10 (Route 288 to Greenyard) -widening to six lanes This section of Route 10 carries between 26,000 and 40,000 vehicles per day. This volume is expected to increase to 45,000 vehicles per day by the year 2020. The county has identified $5.9 million in bond funds and cash proffers to widen Route 10 from Greenyard Road to Frith Lane. Right-of--way acquisition is underway. The project will be advertised for construction this summer, pending utility relocations. 9. Route 288/Chester Road -interchange Improvements are needed for this interchange to help improve the movement of traffic from northbound Route 288 to southbound Chester Road. This section of Chester Road carries between 12,000 and 22,000 vehicles per day. This volume is expected to increase to between 35,000 and 40,000 vehicles per day by the year 2020. Funds ($3 million) have been programmed for this project. VDOT has begun preliminary engineering. The project is expected to be advertised for construction in early 2011. 10. Route 1 at Old Bermuda Hundred Road -relocate intersection The intersection of Old Bermuda Hundred Road and Route 1 has less than desirable sight distance for motorists on Old Bermuda Hundred Road entering traffic on Route 1 and has been identified as a high accident location. Improvements to the intersection are needed to provide a better sight distance. This section of Route 1 carries approximately 23,000 vehicles per day. This volume is expected to increase to 36,000 vehicles per day by the year 2020. This project is not in VDOT's Six-Year Improvement Program. Funds for this project have been requested through the Richmond Area MPO. 11. Powhite Parkway (East of Charter Colony Parkway to Brandermill Parkway) -widening to four lanes This section of Powhite Parkway carries approximately 20,000 vehicles per day. This volume is expected to increase to 40,000 vehicles per day by the year 2020. The Route 288 project included construction of two additional lanes on Powhite Parkway from Route 288 to Charter Colony Parkway. This project will extend the four-lane road through the Charter Colony Parkway intersection to Brandermill Parkway. This project is not in VDOT's Six-Year Improvement Program. Powhite Parkway Extension; East-West Freeway; North-South Freeway Preliminary engineering and right-of--way acquisition are necessary for the county's outer beltway (Powhite Parkway Extension from Charter Colony Parkway to Route 360; East-West Freeway from Route 360 to Interstate 95; and North-South Freeway from East-West Freeway to Interstate 85). Preliminary engineering is needed to properly identify the location of the beltway. Right-of- way should be acquired where growth threatens to block the corridors. This project is not in VDOT's Six-Year Improvement Program. 13. Sisnalization (Countywide) The installation of traffic signals is needed at various intersections. Signalization requests on primary roads received through Board members include: Route 360 at Lynchester Drive; Route 360 at Lynview Drive; Route 360 at Broadstone Road; Powhite Parkway/Old Hundred Road at Brandermill Parkway; Route 10 at Ecoff Avenue; Route 10 at Parker Lane; Route 10 at West Rock Spring Drive; River Road at Pickett Avenue; Route 1 at Old Bermuda Hundred Road; Route 1 at Sand Hills Drive; and signal improvements along the Route 60 corridor. 14. Sight and Sound Barriers (Powhite Parkway and Route 288 -Countywide) These barriers are needed to reduce the impacts of the roadways on adjoining neighborhoods. This project is not included in VDOT's Six-Year Improvement Program. 15. Park and Ride Facilities (Countywide) Preliminary engineering is required to identify potential park and ride facility locations. These facilities will be needed in the future to help reduce countywide traffic congestion. This project is not included in VDOT's Six-Year Improvement Program. 16. Remove Tolls on the Powhite Parkway Funding is needed to retire the debt on Powhite Parkway from Chippenham Parkway to Route 288 and allow the tolls to be removed. Debt on the Powhite Parkway is a combination of the principal on bonds, Toll Facilities Revolving Account debt, VDOT Construction Fund debt and long-term notes debt. This project is not included in VDOT's Six-Year Improvement Program. 17. Hish Speed Rail Funding is necessary to develop high-speed rail service in Chesterfield County and the region. Stimulus funds ($75 M) have been programmed for high speed rail improvements between Richmond and Washington D.C. No funds have been programmed for improvements south of Richmond. Several of the county's priority projects have funding programmed for their completion: • Route 10 (I-95 to Ware Bottom Springs Road) • I-295/Meadowville Road Interchange (Interim/Diamond) • Huguenot Road (Route 60 to Alverser Drive) • Route 288/Chester Road It is imperative that any funding shown in the current Six-Year Improvement Program for these projects be maintained so that these projects can be constructed. Our top four priorities are highlighted below: Our number one priority project is Route 10 in the Enon area. Route 10 needs to be widened to six lanes from Route 1 to Meadowville Road. In addition to the $2.5 million shown in the current Six-Year Improvement Program, $15 million in county bond funds, $10 million in regional ARRA funds, $2.6 million in RSTP funds and $0.3 million in CMAQ funds are available to construct a first phase of the project. Additional funding will be needed to complete improvements to this important corridor. The county's second priority is the widening of Route 60 to six-lanes from Courthouse Road to Old Buckingham Road. This section of Route 60 is carrying approximately 46,000 vehicles per day. McCoy, Jr., president of the Chesterfield NAACP. I would first like to congratulate Assistant Superintendent Ed Pruden who has accepted a school superintendent job in another Virginia courrty. And thank you Dr. Newsome for malting progress in narrowing the achievement gaps. But while the gaps are closed in one area, others open. The Chesterfield Branch understands the African American student population is at 26% here in the county, but the gifted program has onty a 12% African American participation in this program. Of the 57 Chesterfield County students seceded for admission to Maggie Walker Governor's Sdiool for the 2009 - 2010 school year, one was African American and one student was Hispanic. The Virginia State Board of Education in the `Annual Report on the Condition and Needs of Public Schools in Virginia' states that its second objective is to elaninate the achievement gap. And tt would stand to reason that the CCPS has the same goat. Have these disproportionate numbers realty been considered? The membership of the Chesterfield NAACP really doesn't think so. After addressing the matter with the Dr. Newsome to no avail, we have filed a petition with Governor Bob McDonnell to reassess the revised gifted program recorrunended by former Govemor Tim Kaine. The membership of the Chesterfield NAACP troy believes that the CCPS has a solution to this matter, but our members have yet to see the outcome. Branch Leadership and our members are also reviewing another sensitive situation, which Indudes the dlsprvporttonate suspensions of Afrtcan Amertcan students with dtsabilRles. The current situation and tread are quite distrrrbirg. Neither I, nor anyone else could exiled this situation to be resolved overnight. Subject: Public Hearing for Zoning and Subdivision Ordinance Amendments Relating to Lot Area and Development Standards in Agricultural (A) Districts and Subdivision Requirements County Administrator's Comments: County Administrator: Board Action Requested: L Staff recommends (i) approval of the attached Ordinance Amendments and (ii) initiation by the Planning Commission of a project to obtain citizen input and prepare any desirable ordinance amendments to take effect when these amendments expire on July 31, 2011. Summary of Information: At their April 20 meeting, the Planning Commission recommended approval of the attached Ordinance Amendments and requested that the Board re-refer the ordinances to the Commission to determine whether any further modifications are desirable. A recent Virginia Supreme Court ruling has voided the portion of the County's subdivision ordinance which required a five (5) acre minimum parcel size for any division of land in Agricultural (A) Districts. The Court ruled that the County cannot require the five (5) acre minimum in the subdivision ordinance because the zoning ordinance identifies a one (1) acre minimum in the Agricultural (A) Districts. The Court's ruling has impacted approximately 7,500 parcels, 139,000 acres, and 6,027 land owners. Due to State Law requirements, all affected land owners have been notified of the pending public hearings. The subdivision standards which require the five (5) acre lot size were adopted in 1988 subsequent to the adoption of the 1987 Western Area Plan, a component of the Comprehensive Plan, and were adopted to address growth in areas where adequate public facilities were not available. The current Southern and Western Area Plan also incorporates these goals and policies. The Supreme Court sent the case back to the Chesterfield Circuit Court for entry of a final order that will resolve the case. In the meantime, the Planning Department has been accepting, for filing purposes, subdivision applications that attempt to take advantage of the loophole created by the Court's ruling. If the Board amends the ordinances, vesting claims by such applicants will be reviewed on a case-by-case basis in accordance with state vesting law. To date, nineteen (19) tentative plats, consisting of a total of 1794 lots, have been submitted seeking to create Agricultural subdivisions without the benefit of public input or the opportunity to address development impacts which normally occur through the rezoning process. The Board of Supervisors referred the proposed amendments to the Planning Commission in March. Since then, staff has made some corrections which are reflected through double underlines and double overstrikes in the attached ordinances. The corrections were made to ensure that the Board's intent to maintain prior practice and requirements is accomplished and to address concerns from the Agricultural Committee and others. The proposed amendments will bring the County's zoning and subdivision ordinances into compliance with the Court's ruling and reinstate the regulations and practices that have been applied for the past twenty-two (22) years. ~~~n~~ 2723(28).83650.1 SYNOPSIS OF PROPOSED AMENDMENTS ZONING ORDINANCE (CHAPTER 19) • Preserves past practice since 1988 by changing the minimum size of newly created lots for residential purposes in Agricultural (A) Districts from one (1) acre to five (5) acres (excluding family subdivisions). Lots of one (1) acre are permitted for non- residential uses such as churches and barns; • Continues to allow family subdivisions in Agricultural (A) Districts with a minimum lot area of one (1) acre, a minimum lot width of 150 feet and 15 feet of road frontage; • Requires road frontage in Agricultural (A) Districts of 300 feet, unless there are lots with shared access, and requires that the road frontage width be maintained for a minimum distance; • Prohibits the creation or extension of a street in Agricultural (A) Districts which would result in development of an Agricultural (A) subdivision and; • Prohibits lots having less than five (5) acres from fronting on major roadways in residential zones unless approved through a subdivision process or development standard modification. SUBDIVISION ORDINANCE (CHAPTER 17) • Clarifies existing practice that the creation or extension of a street requires subdivision approval. BOTH ORDINANCES (SUNSET CLAUSE) • Establishes a "sunset" clause tied to the anticipated adoption of the new Comprehensive Plan. The new ordinance amendments would expire July 31, 2011 unless readopted prior to that date. As a part of the Comprehensive Plan amendment process, there will be discussions as to appropriate residential development in agricultural areas. In an Agricultural (A) District, the creation or the extension of a street shall be prohibited unless such street or extension is for the sole purpose of providing access to non-residential development, as allowed by Section 19-124 (a). Summary of Information: The county is negotiating to acquire right of way for construction of the Interstate 295/Meadowville Road Interchange Project from Merit Medical Systems, Inc., 12701 Kingston Avenue, PIN: 819655585400000, and Meadowville Associates II, LLC, 621 Meadowville Road, PIN: 819655015800000. Authorization at this public hearing will allow the county to take immediate title to the right of way and once a certificate is filed, the county will be obligated to purchase the right of way sought.
