RECOMMENDATION Recommend approval for the following reasons: A. This request is for renewal of a previously approved manufactured home permit. B. The request is compatible with, and representative of, existing area development. (NOTE: SHOULD THE BOARD WISH TO APPROVE THIS REQUEST, CONDITIONS MAY BE IMPOSED.) (STAFF NOTE: WHILE THE ORDINANCE PERMITS A MAXIMUM PERIOD OF TIME FOR WHICH MOBILE HOME PERMITS MAY BE GRANTED OF SEVEN (7) YEARS, THIS REQUEST IS FOR APPROVAL ONLY UNTIL DECEMBER 31, 2010.) CONDITIONS 1. The applicant shall be the owner and occupant of the manufactured home. (P) 2. The manufactured home permit shall be granted for a period not to exceed December 31, 2010. (P) Providing a FIRST CHOICE community through excellence in public service 3. No additional permanent-type living space may be added onto this manufactured home. ( ) GENERAL INFORMATION T ,n~atinn~ The property fronts the south line of Velda Road, west of Jefferson Davis Highway and is commonly known as 2621 Velda Road. Tax ID 794-666-5947. Existing Zoning: R-7 Size: 0.35 acre Existing Land Use: Manufactured home Adjacent Zoning and Land Use: North and West - R-7; Residential (traditional single family dwellings and manufactured homes) South - C-3 and C-5 with CU and CUPD; Residential (manufactured home park) East - C-3 and C-5; Commercial or vacant T 1t1~1t1P,C' Public water and sewer systems T AI~TTI T TCF Comprehensive Plan: The property lies within the boundaries of the Jefferson Davis Corridor Plan which suggests the property is appropriate for community commercial use. Area Development Trends: Properties to the north and east are zoned Residential (R-7) and are occupied by a mix of traditional single family dwellings and manufactured homes or are vacant. Properties to 2 10SN0110 JAN27-BOS-RPT the west are zoned Community and General Business (C-3 and C-5) and are developed for commercial use or are vacant. In 2008, properties to the south were zoned Community and General Business (C-3 and C-5) with conditional use to permit multi- family residential use plus conditional use planned development to permit exceptions to Ordinance requirements (Case 07SN0292) subject to a condition that requires the manufactured home park existing on that property be removed within twenty (20) months from the date of zoning approval. This park, formerly known as Flippo's Mobile Home Park, is currently being demolished/vacated. Zoning and Permit History: On May 9, 1973, the Board of Supervisors approved a mobile home permit (Case 73-71) to allow Frank Mangum to park a manufactured home on the request property for two (2) years. Subsequent renewals were granted to Mr. Mangum between 1973 and 1989 to allow the manufactured home to remain on the property (Cases 75SR089, 77SR106, 79SR091, 84SR086 and 89SR0251). On May 23, 1990, the Board of Supervisors approved a mobile home permit (Case 90SN0208) to allow William and Patricia Ulrich to park a manufactured home on the request property for seven (7) years. A renewal was granted to the Ulrich's in 1997 to allow the manufactured home to remain on the property (Case 97SR0212). On April 28, 2004, the Board of Supervisors approved a manufactured home permit (Case 04SN0254) to allow Roland Sternini to park a manufactured home on the request property for seven (7) years. With this request, Bobby Powers is seeking renewal of the manufactured home permit to allow the manufactured home to remain on the request property until December 31, 2010. (Condition 2) Current Proposal: As noted above, a manufactured home has been located on the request property since 1973. The applicant is seeking renewal of this manufactured home permit until December 31, 2010 (Condition 2). This shorter approval time is requested because the request property and two (2) adjacent properties are proposed for rezoning from Residential (R-7) to Community Business (C-3) with conditional use to permit multi- family residential use (Case lOSN0252). If rezoning (Case lOSN0252) is approved, the request property and the two (2) adjacent properties noted above will be developed with properties to the south (being planned as Colony Village). Should this manufactured home permit be granted and subsequently zoning of the request property is changed from Residential (R-7), as it is currently zoned, to Community Business (C-3), as it is proposed with Case lOSN0252, then the manufactured home would become anon-conforming use. The manufactured home would be permitted to remain on the property subject to the conditions of approval, including the proposed time limit until December 31, 2010 (Condition 2). Non-conforming uses may not be enlarged, 3 10SN0110 JAN27-BOS-RPT extended, reconstructed, substituted or structurally altered except as allowed by the Zoning Ordinance. The applicant would continue to be the owner and occupant of this manufactured home (Condition 1). No additional permanent-type living space would be permitted to be may be added onto this manufactured home and the home must be skirted but would not be permitted to be placed on a permanent foundation. (Condition 3) CONCLUSIONS The temporary manufactured home continues to be in keeping with development in the surrounding area, which is a mix of traditional single family dwellings and manufactured homes. As conditioned, this use should maintain compatibility with these neighboring uses for this temporary period of time. Given these considerations, approval of this request is recommended.
